This paper argues that a minimal notion of function and a notion of normal-proper function are used in explaining how bodies and brains operate. Neither is Cummins’ notion, as originally defined, and yet his is often taken to be the clearly relevant notion for such an explanatory context. This paper also explains how adverting to normal-proper functions, even if these are selected functions, can play a significant scientific role in the operational explanations of complex systems that physiologists and neurophysiologists provide, (...) despite a lack of relevant causal efficacy on the part of such functions. I argue for the claim in the title. Along the way, I also address an independently interesting question: what is metaphysics, anyway? I think that the typical characterizations of metaphysics are inadequate, that a better one is available, and that the better one helps explain why metaphysics is no more problematic than the rest of philosophy.

Setting goals in the workplace can motivate improved performance but it might also compromise ethical behavior. In this paper, we propose that individual differences in the dispositional tendency to morally justify behavior moderate the effects of specific performance goals on unethical behavior. We conducted an experimental study in which working participants, who were randomly assigned to a specific goal condition or to a condition with a vague goal that lacked a specific target, completed two tasks in which they had the (...) opportunity to act unethically. In an ethical dilemma task, participants in the specific goal condition were more likely to advocate using unethical methods. However, in an anagram task, only those with high moral justification overstated their performance to a greater degree in the specific goal condition. As such, individuals may not be equally susceptible to the ‘dark side’ of goal-setting. (shrink)

To date, research into socially responsible investment (SRI), and in particular the socially responsible investment funds industry, has focused on whether investing in SRI assets has any differential impact on investor returns. Prior findings generally suggest that, on a risk-adjusted basis, there is no difference in performance between SRI and conventional funds. This result has led to questions about whether SRI funds are really any different from conventional funds. This paper examines whether the portfolio allocation across industry sectors and the (...) stock-picking ability of SRI managers are different when compared to conventional fund managers. The study finds that SRI funds exhibit different industry betas consistent with different portfolio positions, but that these differences vary from year to year. It is also found that there is little difference in stock-picking ability between the two groups of fund managers. (shrink)

To deal with potential conflicts between the triple-bottom-line expectations of investors and the performance of executives, firms can use incentives by integrating corporate social performance targets into executive compensation. No evidence yet exists that CSP targets in executive compensation actually lead to an improvement of CSP results. Using a panel data set of 400 firms for the years 2008–2012 leading to 1846 firm-year observations, the relationships between CSP targets and CSP results and CSP improvements are analyzed. The results show that (...) the level of CSP has no effect on the use of CSP targets, the use of CSP targets in general does not automatically lead to better CSP results, and the use of quantitative, hard CSP targets is an effective way to improve CSP results, especially to lower CSP weaknesses. Actualists routinely characterize their view by means of the slogan, “Everything is actual.” They say that there aren’t any things that exist but do not actually exist—there aren’t any “mere possibilia.” If there are any things that deserve the label ‘possible world’, they are just actually existing entities of some kind—maximally consistent sets of sentences, or maximal uninstantiated properties, or maximal possible states of affairs, or something along those lines. Possibilists, in contrast, do think that there are mere possibilia, that (...) there are things that are not actual. They think that more exists than what actually exists. All I have done so far, though, is rephrase the slogan in various ways. To say that everything is actual is precisely to say that there are no things that do not actually exist, which is precisely to say that there are no mere possibilia, and which is also precisely to say that we cannot sep- arately quantify over what exists and what is actual. These claims all amount to the same thing. But what is that, exactly? What on earth does it mean to say that everything is actual, that there are no mere possibilia, and so on? What does the actualist slogan really come to? I think the literature is far from clear on this point, and that people work themselves into unnecessary muddles because of it. Indeed, certain confusions that I shall discuss in the first half of this article seem to be on the rise. It is high time to lay out the issues and the choice points as clearly as possible. There are two primary choices to be made; there are two axes along which versions of actualism can vary. One choice has to do with how to treat claims about things that merely could exist. The other choice has to do with the modal status of the view and of how we should think about the “actual” in actualism. I make no claim that the positions I will eventually endorse are star- tlingly new. I think that most people will agree with the decisions I make at both choice points and will in fact find some bits of this essay obvious. But not everyone agrees with my decisions, and it has been my experience that people differ remarkably about which bits they find obvious—a fact I find rather telling. This innovative critical study reinterprets Ludwig Wittgenstein's philosophy for the study of modernist and contemporary literature and brings Wittgenstein into literary conversations around problems of difficulty, ethical instruction, and the yearning for transformation. Central to Karen Zumhagen-Yekple͹'s book are her critical readings of key modernist texts by Franz Kafka, Virginia Woolf, and James Joyce. Throughout, Zumhagen-Yekplé brings to bear an interpretive framework that she derives from Wittgenstein's gnomic "Tractatus Logico-Philosophicus" (first published in English in 1922, the "annus mirabilis" of (...) modernism), which she treats not as a theory of logic or metaphysics but as a complex mock-theoretical puzzle. The book's final chapter turns to recent fiction by J. M. Coetzee, a living author conscious of his debts both to Wittgenstein and his modernist literary precursors. In this research, we examine the effects that customer perceptions of employee deception have on the customers’ attitudes toward an organization. Based on interview, archival, and observational data within the international airline industry, we develop a model to explain the complex effects of perceived dishonesty on observer’s attitudes and intentions toward the airline. The data revealed three types of perceived deceit (about beliefs, intentions, and emotions) and three additional factors that influence customer intentions and attitudes: the players involved, the beneficiaries (...) of the deceit, and the harm done by the perceived lie. We develop a model with specific propositions to guide organizations with respect to apparently deceitful behavior of their employees. Implications and directions for future research are provided, focusing on the question of whether organizations should consistently encourage honesty or train their employees to be effective liars. Experimental radiobiology represented a long-standing priority for the U.S. Atomic Energy Commission, but organizational issues initially impeded the laboratory progress of this government-funded work: who would direct such interdisciplinary investigations and how? And should the AEC support basic research or only mission-oriented projects? Alexander Hollaender's vision for biology in the post-war world guided AEC initiatives at Oak Ridge, where he created and presided over the Division of Biology for nearly two decades. Hollaender's scheme, at once entrepreneurial and system-oriented, made good (...) use of the unique resources provided by the AEC and by Oak Ridge's national laboratory setting, while at the same time it restructured wartime research practices to better reflect biologists' own priorities. Because Hollaender offered many academic experimental biologists a way of envisioning military-related patronage as integral - rather than antithetical - to their professional identities, his work provides an important lens through which to examine the early post-war intellectual and institutional development of radiobiology. It is argued that it is not enough for feminist standpoint theory to argue that a feminine standpoint is better than a masculine one because of its genesis in female psycho-sexuality, it needs to show that its content is actually objectively more accurate. It then argues that historical feminists, such as Mary Wollstonecraft, have in fact tended to adopt a justice perspective, grounded in reason, which is objectively of greater value than that developed by many male authors, because these historical (...) writers have failed to think that justice is incompatible with feeling and emotion and have attempted to combine the importance of sympathy, empathy, and feeling with the need for equality, liberty, and fairness. This article discusses the development and application of various types of corporate social monitoring systems. Boycotts are a relatively simple form of social monitoring system which aim to produce changes in corporate social behavior. Boycotts may be organized by a single group, or by a number of groups simultaneously. Rating systems may be organized around a single issue, such as the Sullivan Principles rating scheme, or may include multiple companies and multiple issues, such as shopping guides or ethical investment systems.Monitoring (...) systems may be unidimensional or multidimensional, qualitative or quantitative, and absolute or relative. Consumers and investors appear to be the groups most likely to be targeted in these schemes. The importance of these monitoring systems appears to be increasing as both consumers and investors become more interested in using social criteria in decision-making. (shrink)

We commonly think of presumptions as second-best inferential tools allowing us to reach conclusions, if we must, under conditions of limited information. Scholarship on the topic across the disciplines has espoused a common conception of presumptions that defines them according to their function within the decisionmaking process. This focus on the “private” face of presumptions has generated a predominantly critical and grudging view of them, perpetuated certain conceptual ambiguities, and, most important, neglected the fact that what we refer to as (...) “presumptions” have distinguishing features other than the defeasibility and burden-shifting effects associated with their use as inferential tools. When a decisionmaker gives reasons for a conclusion, the decisionmaker often cites a presumption among the reasons for that conclusion; in this guise – their “public” face – presumptions display different, and uniquely valuable, features that remain hidden if we understand them only as aids to inference. This essay both surveys recent approaches to the critical analysis of presumptions in law, philosophy, and discourse studies, and offers an account of how we might begin to think about this other, public face of presumptions. Summary The enthusiasm of Renaissance humanists for classical learning greatly influenced the development of botany in the late fifteenth and sixteenth centuries. Humanist scholars restored the treatises of Theophrastus, Pliny, Galen and Dioscorides on botany and materia medica to general circulation and argued for their use as textbooks in Renaissance universities. Renaissance botanists' respect for classical precepts and models of the proper methods for studying plants temporarily discouraged the use of naturalistic botanical illustration, but encouraged other techniques for collecting and (...) communicating new observations: herbaria, botanical gardens and field trips. This paper explores and reflects upon the literature and several mini case studies to recommend a change of focus for the linking management and development of community participants and community organisations. This change of focus looks at complexity and patterns that arise from the multitude of social interactions; the support and development of individuals and the effect this can have on an organisation’s wellbeing; and the effect a community organisation can have on that of the individual. To gain insight into (...) wellbeing, people need to be aware of their mind, body and energy and how they affect others. There is evidence that terminally ill people who have found new beliefs have experienced a spontaneous remission of disease. Humanity evolves in the same way as we control our destiny. We can learn to love, respect, trust, and commit to each other and work in harmony, or we can foster disharmony resulting in failure and negative feelings. As the economy changes, community organisations are under threat of extinction. Just as species and humanity evolve, we suggest that community organisations need to evolve to ensure wellbeing. A striking and unexplained feature of granulomatous inflammation is its anatomical association with the lymphatic system. Accumulating evidence suggests that lymphatic tracks and granulomas may alter the function of each other. The formation of new lymphatics, or lymphangiogenesis, is an adaptive response to tumor formation, infection, and wound healing. Granulomas also may induce lymphangiogenesis which, through a variety of mechanisms, could contribute to disease outcomes in tuberculosis and sarcoidosis. On the other hand, alterations in lymph node function and lymphatic draining (...) may be primary events which attenuate the risk and severity of granulomatous inflammation. This review begins with an introduction of granulomatous inflammation and the lymphatic system. A role of the lymphatic system in tuberculosis and sarcoidosis is then hypothesized. With a focus on lymphangiogenesis in these diseases, and on the potential for this process to promote dissemination, parallels are established with the well‐established role of lymphangiogenesis in tumor biology. I examine recent arguments to the effect that there are significant logical, conceptual, historical, or psychosexual connections between the subordination of women and the subordination of nature and argue that they are all problematic. Although there are important connections between women’s emancipation and the achievement of important environmental goals, they are practical connections rather than conceptual ones.

Ludwig Wittgenstein famously declared that philosophy “ought really to be written only as a form of poetry,” and he even described the Tractatus as “philosophical and, at the same time, literary.” But few books have really followed up on these claims, and fewer still have focused on their relation to the special literary and artistic period in which Wittgenstein worked. This book offers the first collection to address the rich, vexed, and often contradictory relationship between modernism—the twentieth century’s predominant cultural (...) and artistic movement—and Wittgenstein, one of its preeminent and most enduring philosophers. In doing so it offers rich new understandings of both. Michael LeMahieu Karen Zumhagen-Yekplé bring together scholars in both twentieth-century philosophy and modern literary studies to put Wittgenstein into dialogue with some of modernism’s most iconic figures, including Samuel Beckett, Saul Bellow, Walter Benjamin, Henry James, James Joyce, Franz Kafka, Adolf Loos, Robert Musil, Wallace Stevens, and Virginia Woolf. The contributors touch on two important aspects of Wittgenstein’s work and modernism itself: form and medium. Despite the growing literature on childhood obesity and lifestyle intervention programmes focusing on weight loss, few studies have examined young persons’ experiences of being identified as candidates for such programmes and of participating in them. This paper does so. Juxtaposing insights from phenomenology with an approach inspired by Foucault, the paper shows how teenage girls’ bodily self-perception and bodily self-awareness are shaped in intercorporeal assemblages comprising other people and specific features or elements of the lifestyle programme.Inspired by van Manen’s hermeneutic-phenomenological (...) approach, with its point of departure in lived experience, this paper draws on interviews with Norwegian teenage girls participating in the same lifestyle programme and identifies three core thematic aspects of the girls’ experiences: being identified as a candidate for a lifestyle programme and not wanting this; negotiating the lack of weight loss and the scales; and bodily situated agency – feeling good and being able. Permeating all three themes are two central, interrelated phenomena: agency and resistance. Furthermore, the paper shows how a combination of Foucauldian insights and a phenomenological understanding of intercorporeality can help to shed light on the power, affective, material and temporal dimensions of dys-appearance (i.e., when one’s body appears as bad or wrong), as well as those of eu-appearance (i.e., when one’s body appears as healthy or strong), and thus contribute to the understanding of the girls’ narrated lived experiences.On the basis of these findings, we argue that weight-related treatment goals are not necessarily compatible with the strengthening of adolescents’ body images and self-esteem. However, whilst being obliged to attend to their bodies while in the programme, the girls also encountered unexpected, positive bodily feelings and experiences. Such events, we suggest, offer a means of resisting the more troubling dys-appearing bodily situations our participants described so powerfully. (shrink)

On the eve of the presidential inauguration, the U.S. health system faces rising costs of care, growing numbers of uninsured, wide variations in quality of care, and mounting public dissatisfaction. Despite spending more on health care than any other country, a recent Commonwealth Fund Commission on a High Performance Health Care System National Scorecard reports that the United States is lagging far behind other major industrialized countries — all of which provide universal health insurance — in five key domains: healthy (...) lives, access, quality, equity, and efficiency. U.S. national performance is well below benchmarks of top performance set by other countries or high performing states, hospitals, or health plans within the United States, with broad disparities in experience depending on geographic location, income, race/ethnicity, and insurance coverage. Media critics invariably disparage the quality of programming produced by the U.S. television industry. But why the industry produces what it does is a question largely unasked. It is this question, at the crux of American popular culture, that Switching Channels explores.

In recent years, public health law has seen some important court decisions. Those are presented below.In Pelman v. McDonaldS Corporation, the court dismissed a complaint filed by three children who claimed that McDonald’s practices in making and selling its products were deceptive. This deception, the children alleged, caused them to consume McDonald’s products with great frequency and become obese, thereby injuring their health. The plaintiffs pled five causes of action against McDonald’s, alleging that McDonald’s: 1) failed to adequately disclose the (...) ingredients and health effects of its products and described their food as nutritious without disclosing detrimental health effects; 2) engaged in marketing techniques geared toward inducing children to consume their products; 3) acted negligently in selling foods high in fat, cholesterol, salt, and sugar when studies show that foods containing these ingredients cause obesity and detrimental health effects; 4) failed to warn consumers of the quantity and qualities of levels of fat, cholesterol, salt, and sugar in its products or of the detrimental health effects of such foods; and 5) acted negligently in marketing foods that were physically and psychologically addictive. As an effect of the recent economic and financial crisis in the USA, a vast number of people have suddenly lost their jobs and income and often also their home. Many of them still live in their cars or even just in the streets. In spring 2007, the young.

Considerable efforts have been made in recent years to improve the safety of human subjects who participate in research. However, there are no data to demonstrate that we have made human research safer. There is a critical need to determine whether we have achieved our goal of better protecting research subjects. We have developed 16 quality indicators for assessing the quality of human research protection programs at the Department of Veterans Affairs. Our experience implementing these quality indicators at the VA (...) may help other institutions to develop appropriate quality indicators for assessing their own human research protection programs. This essay reflects on the role academic journals like the JRE can play in facilitating and addressing tainted legacies. As an institution in religious ethics, the journal not only determines whose work is important, but it also replicates such judgments, passing certain sets of issues, concerns, and methods down from the past to the present, shaping future work. Journals highlight the systemic, structural elements of legacies that we often neglect in heated debate over how to respond to them. Consequently, they (...) illuminate the complexity of the problems tainted legacies present. I first discuss three ways a journal like the JRE facilitates the structural features of tainted legacies in religious ethics. I then suggest how the JRE might implement a position I call the “reformer” in response to such legacies. This position emphasizes practices of moral repair designed to challenge the systemic injustices that underlay tainted legacies. (shrink)

Contributing to the debate between referentialist and predicativist accounts of the semantics of proper names, this paper partly endorses a recent trend to reject unitary accounts of their semantics. It does so by restoring a Fregean version of the variety of use account. It criticizes alternative variety of use accounts for not clearly distinguishing pragmatic, syntactic, and semantic issues and argues that, once these are distinguished, the necessity of accepting that names have a variety of uses, and are sometimes logical (...) singular terms and at others logical predicates shows that Frege’s claim, that we should recognize that names have both reference and sense, is vindicated. Scholars celebrate Dietrich Bonhoeffer as a "prophet of justice for the oppressed" who identified the need "to see the great events of world history from below." But few address the thorniest aspect of Bonhoeffer's ethics for the marginalized: the mandates or divine commissions in church, marriage, work, and government made concrete within certain orders of relationship and authority. Bonhoeffer's marriage mandate poses particular problems as it reinforces unjust social structures. Fortunately, striking similarities between Bonhoeffer's ethics and feminist thought—attention to concrete (...) contexts, the role of emotion in moral reasoning, opposition to harmful dualisms, and emphasis on relationality—suggest that feminists are well-placed to critique and reconstruct Bonhoeffer's account. Construing the mandates as contexts for "genuine communities of argument" repurposes them to combat rather than condone injustice. (shrink)
