North American psychiatric literature describes the current method of psychiatric diagnostic assessment as "phenomenological"; however, it is unclear what phenomenology 1 means in this context. This paper investigates the meaning and impact of some of the major philosophical and psychiatric definitions of phenomenology on contemporary psychiatric assessment. Employing a comparative analysis of selected definitions of phenomenology, this paper argues that North American psychiatric assessment does not reflect any of these definitions of phenomenology. Instead, within the context of psychiatric assessment, phenomenology (...) has taken on an idiosyncratic, clinical meaning of signs and symptoms. However, this does not mean that phenomenology has had no impact on North American psychiatry. This paper contends that phenomenology has made contributions to psychiatry, particularly in the area of psychotherapy and especially in self-psychological psychotherapy. The importance of the concept of empathy within psychotherapy is evidence of the continuing influence of philosophical phenomenology on psychiatry. The COVID-19 pandemic will likely recede only through development and distribution of an effective vaccine. Although there are many unknowns surrounding COVID-19 vaccine development, vaccine demand will likely outstrip early supply, making prospective planning for vaccine allocation critical for ensuring the ethical distribution of COVID-19 vaccines. Here, we propose three central goals for COVID-19 vaccination campaigns: to reduce morbidity and mortality, to minimise additional economic and societal burdens related to the pandemic and to narrow unjust health inequalities. We evaluate five (...) prioritisation approaches, assess their likely impact on advancing the three goals of vaccine allocation and identify open scientific questions that may alter their outcomes. We argue that no single prioritisation approach will advance all three goals. Instead, we propose a multipronged approach that considers the risk of serious COVID-19 illness, instrumental value and the risk of transmission, and is guided by future research on COVID-19-specific clinical and vaccine characteristics. While we focus this assessment on the USA, our analysis can inform allocation in other contexts. (shrink)

This article uses critical discourse analysis to examine how the higher COVID-19 infection rates among South Asians in general, and Punjabis more specifically, have been represented by conservative politicians and their representatives as a consequence of cultural and religious practices. Two counter-narratives are discussed. The first substitutes the negative image of the Sikh Punjabi Canadian community with a celebratory and positive view of Sikh humanitarianism and community service. The second attributes the high numbers to class attributes such as precarious jobs, (...) poverty-level wages, employment insecurity, lack of sick days, over-crowded housing, racism and lack of access to healthcare. We argue that the conservative explanation as well as the first counter-narrative reveal continuities in culturalist understandings of South Asian immigrants, albeit in slightly different ways. The second counter-narrative represents a discursive resistance by advancing a structural analysis of health and disease in immigrant communities. (shrink)

Creative Writing programmes in universities now offer both an education for and employment to literary writers. This papers asks how literary writers apprehend their relatively recently institutionalised position, as university staff and students. The concept of ‘patronage’, it is argued, offers a useful way into reflecting upon such academic institutionalisation. The argument is presented in three parts. The first outlines some of the conceptual nuances of patronage. The second examines the oft made claim that universities extend patronage to literary writers (...) by enabling employment as Creative Writing staff. The third part engages with a question: what precisely does a student expect to gain from a Creative Writing programme and what does the degree validate? It is suggested that Creative Writing programmes are designed principally to offer supportive patronage, with a promise – but without guarantees – of entry into a financial patronage system. This paper seeks to show that human cognition cannot be characterised purely in mentalistic term. It has a bodily basis and cognition is thus the product of the interplay between mind, body, and brain. This is how the idea of embodiment and its importance is realised and gets its foothold in both philosophy and cognitive science. This brings a radical change introducing a new framework for philosophy and cognitive science. In this new change philosophy and cognitive science have a special (...) role to play which this paper seeks to explore. Philosophy in its capacity as a conceptual inquiry provides justification for human embodiment on a conceptual ground whereas cognitive science provides the same on an empirical and experimental ground. This brings the two disciplines closer resulting into a new field of inquiry which can be best described as the interface between philosophy and cognitive science. An important consequence that follows from this alignment is that the traditional epistemological distinction between the a priori and the empirical can no longer be rigidly maintained. (shrink)

The concept of truth serves in logic not only as an instrument but also as an object of study. Eubulides of Miletus (fl. fourth century BCE), a Megarian logician, discovered the paradox known as ‘the Liar,’ and, ever since his discovery, logicians down the ages ‐ Aristotle and Chrysippus, John Buridan and William Heytesbury, and Alfred Tarski and Saul Kripke, to mention just a few ‐ have tried to understand the puzzling behavior of the concept of truth.

Economic migration is a significant and growing development around the world but has produced unequal outcomes and experiences for marginalized groups. To theoretically explain such inequalities, we argue that integration experiences of immigrants in the host country differ based on the privilege that their demographic category bestows on them (or not). We elucidate our arguments by unpacking the concept of ‘privilege’ to theorize two key sources of privilege—_locational_ and _historical_—and explain them using the global economic divide (Global North vs. Global (...) South) and local social divides (race and caste). We propose that locational and historical privilege manifest as various types of capital that immigrants carry into their host countries. We juxtapose these two sources of privilege and its levels (low vs. high) to develop a typology of immigrants—_Marginalized, Peripheral, Assimilated,_ and _Wanted—_that captures differences in migrants’ integration experiences. By shining a light on the systematic differences between immigrants based on privilege, our research brings additional nuance to the scholarship on immigrant workers and inclusive organizations; and broadens avenues to make human resource practices more ethical by taking these differences into account. We examine whether social capital mitigates managerial opportunism around share repurchase announcements. We find that firms headquartered in high social capital states are associated with: (i) higher repurchase completion rates, and more so in environments where governance is weak and the potential for misleading investors is high, (ii) a smaller likelihood of information manipulation such as revealing bad news before repurchases, and (iii) lower completion rates when shares are less undervalued. By documenting that firms’ external social environments help curb managerial (...) opportunism, our study suggests that the location of headquarters facilitates trustworthiness and affects ethical considerations in corporate announcements. Some criticisms are offered of Barwise and Etchemendy's theory of truth, the principal one being that it violates a feature of truth called “supervenience”.

‘Corporate Social Responsibility’ (‘CSR’) has gained popularity in corporate as well as academic debates, especially since the 2008 financial crisis (Okpara & Idowu, 2013). Although CSR as an idea has not failed, concerning gaps remain in the theory and practice of CSR. More particularly, in India, the legislature has adopted a ‘one size fits all’ approach which permits businesses to interpret and implement CSR based on their unique circumstances. This leads to persistent and escalating concerns regarding its implementation and limits. (...) The most basic of such concerns is the fact that CSR conceptually lacks a consistent understanding as scholars all around the world have defined it differently (Votaw & Sethi, 1973), which has an effect of conflating CSR with legal obligations or pre-existing moral obligations of the company. This work, limiting the study to Indian context, argues that the effectiveness of any policy or regulation is a direct result of express intention behind it and Indian law lacks such expression. It specifically argues that the framework in India is based on the misconceived idea of CSR resting on ‘neo-liberal’ principles meaning that a corporation’s primary responsibility is maximization of the profits of the shareholders and hence CSR is perceived merely as an add-on. There needs to be a change in this narrative to a ‘socio-economic’ one which could bring CSR within the core functions of corporations and which largely depends on the Corporate Governance ecosystem so in place. India although claims to have adopted the Stakeholder Model of Corporate Governance, in practice it still aligns with the Shareholder Model. It is only when the former is adopted in practice, can CSR be effectively implemented which can be further facilitated through a clear expression of legislative intent behind the provisions and regulations concerning CSR. In order to substantiate these arguments, this work adopts a doctrinal method of research which undergoes a thematic discourse analysis of the issue and its theoretical underpinnings, and also provides certain recommendations in this respect. In this paper, I draw attention to various doctrines common to different Vedāntic traditions. In particular, I pay close attention to the doctrine of beginningless _karman_. I also note that this doctrine seems to stand in tension with Leibnizian Cosmological Arguments (LCAs) and Kalām Cosmological Arguments (KCAs). This tension arises because defenders of these arguments argue that an infinite causal regress or an actual infinite cannot be physically instantiated and because the doctrine of beginningless _karman_ seems to imply that such (...) a regress or actual infinite can be physically instantiated. I address this tension by showing that not all interpretations of beginningless _karman_ involve an infinite causal regress or an actual infinite. I close this paper by highlighting a few features that Vedāntic traditions have that make them more resistant to some objections to LCAs and KCAs. (shrink)

Consumers of software often face an acquisition-mode decision, namely whether to purchase or pirate that software. In terms of consumer welfare, consumers who pirate software may stand in opposition to those who purchase it. Marketers also face a decision whether to attempt to thwart that piracy or to ignore, if not encourage it as an aid to their software's diffusion, and policymakers face the decision whether to adopt interventionist policies, which are government-centric, or laissez faire policies, which are marketer-centric. Here (...) in order to assess the decision-making of all three of these stakeholders, we focus on the consumer's point-of-view as central and examine it by considering on a comparative basis the ethical dimension versus other dimensions, including economic, legal, and other salient consumer behavior considerations. Based on a survey of 689 software consumers conducted over the Internet, the results indicate that ethics as a factor is embedded in a multidimensional set of determinant factors influencing software piracy, including attitudes, legal aspects, social support, perceptions of economic loss and age. Today’s economy has transitioned from the traditional brick and mortar structure of doing business to that of digitalized economy. The latter functions with the aid of technological tools with ‘data’ being the most significant tool in today’s context. The issue has become even more critical with the advent of ‘big data’. It is argued that accumulation, analysis and usage of ‘big data’ enable creation of varied forms of entry barriers for new entrants and information asymmetries for customers which in turn (...) affect ‘market competition’ adversely (Santesteban & Longpre The Antitrust Bulletin,65(3), 459-485, 2020; Fast et al., 2021). Consequently, it is pertinent to revisit the traditional understanding of ‘market competition’ as stipulated in the antitrust laws across jurisdictions and specifically the Indian Competition Act, 2002. The existing regime being centred around neo-classical price theory is not equipped to comprehend the various dimensions of the digitalised world where ‘data’ is the new form of currency having effects on market power and, consequently, on market competition. Digital markets are multi-sided and non-linear in nature where ‘big data’ acts as a lubricant for their smooth functioning. Whether access to data provides any form of competitive advantage is the central question. A resource to provide any form of competitive advantage must be distinct, rare, inimitable, non-substitutable and valuable (Barney, 1991). If data carries such characteristics, the continuous percolation and usage of technology powered by ‘big data’ into the markets will affect the understanding of the basic competitive wrongs. Potential interdependencies between technology, data and market power also affect the understanding of ‘dominance’ as stipulated under the existing law. The unique challenges which ‘big data’ poses are not only restricted to competition policy but also extended to enforcement as they trigger overlapping constitutional concerns in relation to privacy. This demands for looking at the existing gap between competition law/policy and the ‘data’-driven challenges being faced in this ever-evolving digital economy. (shrink)

WE ARE GRATEFUL to the journal for prviding the opportunity for exchange and discussion of some of the themes raised in our paper, "The impact of phenomenology on North American psychiatric assessment" and we are (...) pleased to be able to reply to the two excellent commentaries by McMillan and Morley. Both McMillan and Morley question the prospect of employing phenomenology and its methods in psychiatric assessment, and in psychiatric practice more generally. McMillan questions the utility of such a step, and Morley is pessimistic about its feasibility. We shall address each author's concerns in turn.Initially, let us restate the aims of our paper to contextualize our arguments and those made in the commentaries. First, we sought an understanding of what is meant by North American psychiatrists, working within the DSM framework, when they refer to the phenomenological approach to psychiatric assessment. To elucidate this meaning, we compared the contemporary North American usage to a small number of definitions of phenomenology, particularly those definitions that were, and are now, applied to clinical psychiatric work. Contrary to McMillan's suggestion, we did not intend to state definitively what should or should not count as phenomenological, but rather to compare North American psychiatric assessment to what typically has counted as phenomenological. Second, we sought to examine phenomenology's influence on North American psychiatric practice, particularly psychotherapy.Morley argues that such influences usually exemplify the inappropriate appending of phenomenology to psychiatric practice rather than true integration of different paradigms. Although we do not disagree with this general contention, we will argue that the deployment of phenomenological methods in psychiatric assessment is a necessary first step toward the kind of integration he proposes.McMillan makes two related but unintegrated points. First, he argues that objective, behavioral data are phenomenological, according to his broad definition of the term. Second, he proposes that, if the behavioral and the phenomenological are different, we are better off staying with the behavioral when it comes to psychiatric nosology. Let us consider these two points in succession.McMillan seeks to broaden Jasper's definition of phenomenology to include objective observations [End Page 93] as phenomenological. To this end, he distinguishes methods from aims. He summarizes Jasper's definition of phenomenology as "an empirical method for investigating 'individual psychic experience (p 55)" and claims that this is a statement of aim or objectives. He then urges us to "consider the merits of different phenomenological methodologies in terms of their success in achieving this objective" whether or not they utilize "all the methods" of phenomenology. This is much like saying that if we treat waving one's hand as a method for greeting someone, we are then free to treat the objective of the wave as one of greeting someone, and then say that anything that serves as a greeting is, by definition, a "wave." Whatever else McMillan's objective observations are, he has not convinced us that they are phenomenological, anymore than we are likely to convince you that a kiss on the lips is really just a wave.Nonetheless, it is worthwhile seeing what McMillan does with this argument. He tells us that we can "read the first-person experience from behavior in a fairly accurate and informative way." He uses the example of a father gazing at his young child and notes that it is not unreasonable to infer that he is experiencing loving and nurturing feelings. It is, indeed, not unreasonable to draw such an inference. But it is far more reasonable to infer that the father is experiencing a cacophony of feelings, including, but not limited to, love, concern, anxiety, pride, envy, hope, and sadness (Stern 1995, 18-58). Private tutoring is a globally pervasive phenomenon. While scholars have explored the demand for and supply of private tutoring, how tutoring centres organise their services, and the role of temporality in this, remains underexplored. To address this gap in the scholarship, this article draws on ethnographic data, produced during 2014–15 in Dehradun (India), to discuss four aspects of a ‘shadow education’ timescape: how tutoring services are mapped onto the formal schooling structure (Mapping); how tutorial centres benefit from having more time (...) to allocate to educational services over formal schools (Advantage); how tutorial centres diversify the nature of academic support they offer throughout an academic year (Diversity); and, how tutoring services accommodate changing schooling practices over time (Adaptability). This discussion unveils the specific ways in which the temporal facets of private tutoring help tutoring businesses circumvent the schooling system to secure their space alongside – rather than by attempting to replace – the formal institutions of education within the Indian educational landscape. Although this article is empirically grounded in India, the conceptualisation of temporalities of private tutoring it generates will be valuable to the investigations of organisational framings, structural arrangements and practices of tutoring provisions in other contexts. Popular imaginations and receptions of Hinduism often neglect to consider its theological dimensions that conceive of the divine reality along conceptual pathways analogous to those of the major Judeo-Christian religious traditions. Thus, within Western scholarship, there have been no systematic attempts to delineate central doxastic elements within the Caitanya Vaiṣṇava tradition by suggesting correlations with distinctive Christian concepts, and this scholarly lacuna within Caitanya Vaiṣṇavism restricts comparative theological dialogue between Caitanya Vaiṣṇavism and Christianity. In order to address this lacuna, I (...) demonstrate that aspects of Caitanya Vaiṣṇavism’s theological framework can be conceptualized in conversation with their Christian counterparts. -/- By illustrating certain parities between the theological frameworks of Caitanya Vaiṣṇavism and Christianity, I also aim to pave the way for further comparative theological dialogue between these two religious traditions. In particular, I propose that Caitanya Vaiṣṇavism’s theological framework enables the tradition to become a suitable dialogical partner to Christianity in comparative theodicy. I also suggest and put into practice a criterion that can be helpful for refining the comparative theodical exchanges between Caitanya Vaiṣṇavism and Christianity. (shrink)

Since the late 1900s the business world has been under increasing pressure to demonstrate responsible social behaviour and the pressure continues to grow. Today, the role of business in society is on the Boardroom agenda and at stake are corporate reputation, innovation, competitiveness and growth. It is a clarion call, that either, the CEO and the Board manage it or someone else will manage it for them. As we know that we cannot solve our problems with the same level of (...) thinking that created them; therefore it is imperative that we look beyond the 20th century’s scientism and materialism dominated worldly ways for solutions. In view of the above, I believe that the ‘Indian Philosophy of Consciousness’ which focuses on practicing “better-worldliness” rather than “worldliness” and has developed over the past 4000 years has the potential to help business. Better worldliness is ‘a disposition towards life that is based on a Dharmic (righteous) way of conduct; a conduct with compassion and forbearance for fellow man, no matter what the nationality, or the colour of the skin, religion or caste.’ Society expects similar compassion and forbearance from business. We took as our starting point ‘Becoming visible: Black lesbian discussions’ (Carmen et al, 1984), featured in the 1984 special issue of Feminist Review on black feminism. Here, we reflect on the political, cultural and technological transformations of queer life since the publication of ‘Becoming visible’. The original discussion focused on questions of identity, safety, the public and the private, and the tensions between race (...) and sexuality. The discussants took personal and political risks to be active organisers. As the beneficiaries of that activism, we interrogate not only the broader ideas of race, sexuality and feminism, but critique some of the discussions circulating within our own ranks. We also consider our responsibility to follow our predecessors and to learn from their mistakes. We are more visible than ever, but at what price? What has been gained and lost? The Yogārṇava is a Sanskrit compendium on yoga that has not been published, translated or even mentioned in secondary literature on yoga. Citations attributed to it occur in several premodern commentaries and compendiums on yoga, and a few published library catalogues report manuscripts of a work on yoga called the Yogārṇava. This article presents the results of the first academic study of the text. It has attempted to answer basic questions, such as the work’s provenance and textual sources.
