One of the principles of health care ethics is the principle of justice. An important expression of justice is equity. The provision of basic primary health care services to all people is the key to eliminating the gross inequities in health status existing in many countries. For many years nurses in developing countries have ‘led the way’ in bringing these essential services to poor rural communities, including the diagnosis and treatment of illnesses, and the prescribing and dispensing of medications. Nurses (...) are the most appropriate health workers for this role, but most have not been prepared adequately for it. This is unsafe for patients and puts nurses at legal risk. Justice requires that patients should obtain access to safe health care and that nurses should receive appropriate education. Nurse practitioner programmes are being established to prepare nurses for this advanced practice role, but here again ethical considerations apply. Justice will be served only if nurse practitioner programmes are accessible to the nurses who are most likely to work in medically underserved communities where the need is greatest. (shrink)

Ferebee (bio)On August 28, 2021, former Royal Marine and charity worker Pen Farthing was evacuated from Afghanistan with almost two hundred dogs and cats that his Kabul animal charity, Nowzad Dogs, had rescued. The role of the British government in this evacuation remains hotly contested: At the time, the British Ministry (...) of Defence tweeted (Fig. 1) that Farthing's escape had been assisted by the British military, but Farthing later disputed this claim and argued that his rescue was not the result of high-level intervention in the British government. In January 2022 controversy erupted around the emergence of documents suggesting that Prime Minister Boris Johnson had lied to Parliament about the personal role that he played in just such an intervention. Notably, Nowzad's Afghan staff members were not evacuated alongside Farthing and the animals, though they would eventually escape to Pakistan. Following Farthing's escape, the British government failed to evacuate hundreds of British citizens and residents (Merriman and Ghouri), as well as many more Afghans who had worked on behalf of British forces. The Nowzad Dogs evacuation became a site of symbolic struggle over Britain's respect (or lack thereof) for human rights. "What a story to tell the world: Britain values dogs more than Afghan people," the headline of an opinion piece in the Guardian (Hinsliff) read.The story of Nowzad Dogs is interesting to me not only as a tale of human-nonhuman relations, but also because I was, at the time it occurred, volunteering within the Afghan aid community to assist relatives of a friend, British Afghans who had been visiting Kabul when the government [End Page 52] collapsed. The family repeatedly asked for assistance from the British Foreign, Commonwealth and Development Office—assistance that never appeared. Ultimately, due to the generosity of donors and the coordination of a volunteer team, the family was able to flee to Pakistan, where they boarded a commercial flight to London. This case was a particularly stark and powerful illustration of the negotiations of rights and value that took place during and following the evacuation. It seemed nonsensical, in August 2021, to suppose that British citizens, including British children (the family I worked with included a six- and an eleven-year-old who were British citizens), would be abandoned while Afghan dogs had their rights prioritized. As I hope to demonstrate here, however, such an incident becomes comprehensible and even logical when it is understood as part of a specifically Anthropocene manifestation of subjectivity.Upendra Baxi suggests that 1948's Universal Declaration of Human Rights (UDHR) marks a broad shift from the era of "modern" (42) human rights (which began with the American and French Revolutions) to the era of "contemporary" (42) human rights. His periodization links these eras in human rights to shifts in the ideology of capitalism and empire. The "modern" era of human rights, he writes, "signals a whole variety of ideological 'justifications' for colonization and world domination" and "provides a register of major development in industrial capitalism" (42), while the "contemporary" era of human rights "is based on the premise of radical self-determination" (46). Such a periodization also brings human rights into close alignment with the Anthropocene, which is rooted in the capitalist-colonial Enlightenment and Industrial Revolution, yet often dated most concretely to the circa-1950 shift that some (such as J. R. McNeill and Peter Engelke) label the "Great Acceleration." Indeed, one could reasonably appropriate Baxi's terms and speak of "modern" and "contemporary" Anthropocenes mapped identically onto the global timeline.I propose to use the 2021 Afghan evacuation as a site from which to explore how human rights and the Anthropocene have together coproduced certain forms of subjectivity that are essential for the continued smooth functioning of world-ecological capitalism. Such special issues are able to cover an author, work, or subject with more range and depth than one individual paper can, and they often contain layers of complexity and interdisciplinary insights that a single author would find it difficult to contribute.This special issue had its origins in the conference "Performing Aristophanes," held at Case Western Reserve University on February 24, 2001. Designed by the University's Theater Arts Department to complement the production of Mary-Kay Gamel's version of Aristophanes' Thesmophoriazousai, The Julie Thesmo Show, the conference was generously supported by the Baker-Nord Center and by the Susan and Ronald Heller Conferences for the Arts Fund. Oocyte donation raises conflicts of interest and commitment for physicians but little attention has been paid to how to reduce these conflicts in practice. Yet the growing popularity of assisted reproduction has increased the stakes of maintaining an adequate oocyte supply and minimizing conflicts. A growing body of professional guidelines, legal challenges to professional self-regulation, and empirical research on the practice of oocyte donation all call for renewed attention to the issue. As empirical findings better inform existing conflicts and their (...) potential harms, we can better attempt to reduce these conflicts. To that end, the article first describes the nature of conflicts in oocyte donation and relevant regulations and professional guidelines. We then describe studies on conflicts at four phases of oocyte donation: recruitment, screening, stimulation, and post-stimulation monitoring. Next we consider three models for conflict reduction in medicine generally: improved professional self-regulation, outright restriction like Stark anti-referral laws, or the use of conflict mediators, like in living organ donation. We ultimately conclude that improved professional self-regulation is a reasonable starting place for oocyte donation. (shrink)

Rising rates of female incarceration within the United States are incompatible with the lack of federal standards outlining the rights of incarcerated mothers and their children. A robust body of evidence demonstrates that prison nurseries, programmes designed for mothers to keep their infants under their care during detainment or incarceration, provide essential and beneficial care that could not otherwise be achieved within the current carceral infrastructure. These benefits include facilitation of breastfeeding, bonding during a critical period of child development, and (...) decreased recidivism rates for participants. Legal precedent exists to support the rights of the mother to continue to parent their child but remains in stark opposition to current prison infrastructure that could allow them to do so. Existing state policies also have inconsistent mechanisms for determining child eligibility and should move to centre decision-making on a case-by-case basis. This work will demonstrate that a just society, supported by law and ensuring maternal–child welfare supports the establishment of prison nursery programmes as a part of the existing right to healthcare for incarcerated individuals. Phillips published an article describing what he observed to be the inverse relationship between inflation and unemployment; subsequently, the "Phillips curve" became a central concept in macroeconomic analysis and policymaking. But today's Phillips curve is not the same as the original one from fifty years ago; the economy, our understanding of price setting behavior, the determinants of inflation, and the role of monetary policy have evolved significantly since then. Auf diese Weise wird erneut das Scheitern einer deduktiven Begründung für die Falsifikationsmethodologie und damit die Gültigkeit der Symmetriethese erwiesen.

The works of Paul K. Feyerabend, Norwood Russell Hanson and Thomas S. Kuhn have come to occupy a central place in the annals of contemporary philosophy of science. Some of their contemporaries,, tend to regard them as the vanguard of a new “revolutionary” intellectual movement. Reacting against the views of their positivist predecessors, they embrace and propagate the idea that “pervasive presuppositions” are fundamental to scientific investigations. Thus, Feyerabend thinks that, “... scientific theories are ways of looking at the world; (...) and their adoption affects our general beliefs and expectations, and thereby also our experiences and our conception of reality”. This is in stark contrast to the positivist view that the aim of science is the systematization of experience that exists independently of any scientific theories. This new view of scientific theories also involves a “radical” conception of the nature of theoretical change. Rejecting the positivist notion of any constant element through such change, Kuhn regards a basic theoretical change as a conceptual revolution and “wants to say that after a revolution scientists are responding to a different world”. Hanson uses the phrase ‘theory-loaded’ to give expression to a view of the semantic content of observation statements that follows from this general position. (shrink)

Die ethische Bewertung des Freiwilligen Verzichts auf Essen und Trinken stellt Patienten und Angehörige, aber auch begleitende Ärzte und Pflegende vor erhebliche Schwierigkeiten. Basierend auf Ergebnissen eigener qualitativer Interviews mit Personen nach dem FVET ihrer Angehörigen legt dieser Artikel die bestehende Unklarheit und inhärente ethische Ambivalenz des Begriffs FVET frei, stellt aber in der Unterscheidung von FVET-Fällen – mit bzw. ohne terminale Erkrankung – (...) einen Weg zur Lösung der Frage nach der ethischen Bewertung des „Sterbefastens“ und seiner medizinischen Begleitung vor: Ethisch wird der Freiwillige Verzicht auf Essen und Trinken und seine medizinische Begleitung erst in der Analyse von Situation und Intention der Handelnden beurteilbar. The aim of the study is to encourage a critical debate on the use of normality in the medical literature on DSD or intersex. For this purpose, a scoping review was conducted to identify and map the various ways in which “normal” is used in the medical literature on DSD between 2016 and 2020. We identified 75 studies, many of which were case studies highlighting rare cases of DSD, others, mainly retrospective observational studies, focused on improving diagnosis or treatment. The (...) most common use of the adjective normal was in association with phenotypic sex. Overall, appearance was the most commonly cited criteria to evaluate the normality of sex organs. More than 1/3 of the studies included also medical photographs of sex organs. This persistent use of normality in reference to phenotypic sex is worrisome given the long-term medicalization of intersex bodies in the name of a “normal” appearance or leading a “normal” life. Healthcare professionals should be more careful about the ethical implications of using photographs in publications given that many intersex persons describe their experience with medical photography as dehumanizing. Let me begin by thanking David for his always generous and intelligent reflection on not only my new monograph [End Page 181] but also on Henry Rosemont's (...) and my best efforts to expand upon the idea of "role ethics" as a productive way to read Confucian ethics.David asks: Is relationality truly a part of original Confucian thought? Does relationality rule out any notion of essential human nature, and does it necessarily imply or entail role ethics? Is relationality true or merely a useful way of thinking (if these can be distinguished)? Do we know that it's useful?I think the answer to these questions turns on two very different ways of understanding relationality, namely the doctrines of first and second order relationality. The term 'ontology' as "the science of being per se or in itself" gives us a doctrine of external, second order relations. Ontology was introduced into our philosophical vocabulary as a new term for an old way of thinking at the beginning of the seventeenth century by two German philosophers.1 For the classical Greeks, "the science of being per se" (to on he on) was posited as their "first philosophy" with all of its implications for metaphysics, epistemology, logic, ethics, philosophy of religion, and so on. Ontology is that branch of metaphysics that seeks to classify and explain the things that exist, with its underlying assumption that there are unchanging substances or essences internal to things that are available to us to classify them as this and not that. Ontology privileges "being per se" with its categorical language and its "substance" and "attribute" dualism, giving us a grammar of substances as property-bearers and properties that are borne, respectively.Such ontological thinking animates Plato's pursuit of formal, "real" definitions in his quest for certainty (that is, definitions not of words but of what really is), and underlies Aristotle's taxonomical science of knowing "what is what." For these classical Greek philosophers, only what is real and is thus true can be the proper object of knowledge, giving us a logic of the changeless. Corollary to ontology is causal thinking, formal definitions, and, important for David's question, a doctrine of external, second order relationality in which relations conjoin discrete and self-sufficient things, such as human "beings." As the contemporary philosopher Zhao Tingyang 趙汀陽 avers, this kind of substance ontology defining the real things that constitute the content of an orderly and structured cosmosprovides a "dictionary" kind of explanation of the world, seeking to set up an accurate understanding of the limits of all things. In simple terms, it determines "what is what," and all concepts are footnotes to "being" or "is."2In the Book of Changes, we find a vocabulary making explicit cosmological assumptions that stand in stark contrast to this substance ontology and that brings with it a doctrine of first order, constitutive relations. This alternative "first philosophy" has prompted me to create the neologism "zoetology," with the Greek zoe- "life" and -logia "discourse," as my own new term for an old way of thinking that we might translate into modern Chinese as shengshenglun 生生論: "the art of living." The starting point in this zoetological cosmology, then, is that nothing does anything by [End Page 182] itself; association is a fact. Since the very nature of life is associative and transactional, the vocabulary appealed to in defining Confucian cosmology is irreducibly dyadic and collateral: always multiple, never one.And further, it is the nature of life itself that it seeks to optimize the available conditions for its continuing growth, where such growth has a persistent existential and thus intentional aspect. The miniseries Frank Herbert’s Dune (2000) and Frank Herbert’s Children of Dune (2003) offer a stark warning that people must think for themselves rather than relying on authority. In particular, they warn against overreliance on leaders and on religious authorities. The series tell the story of how, in the far future, Paul Atreides becomes dictator and religious leader over the human race, bringing slaughter and oppression in his wake. The chapter will consider the views of philosophers like Plato, who believed (...) that power should be concentrated in the hands of leaders with absolute authority, along with the views of philosophers who advocated democracy, like John Locke, John Stuart Mill, and John Dewey. The chapter will also examine the views of philosophers on religion, especially philosophers critical of religion, such as Locke, Thomas Paine, and Bertrand Russell. It is argued that the series present a strong case against allowing others to think for us, because the story they tell matches the historical record of the real world. When leaders have been given the power to be arbiters of truth, they have too often exploited those beneath them, using their positions to accumulate wealth, power, and glory. When too much trust has been placed in religious authority, it has likewise too often led to exploitation and repression. What is worse, the power of religion is uncontrollable, easily leading to violence and destruction. Having said that, the series fail to reflect that religion does good in the world. This chapter argues that, as maintained by W. K. Clifford, whether people should accept religious views depends on whether they have good grounds to believe that these views are true. This implies that people must not accept religious views without thinking the views through for themselves. (shrink)

We show that for any, the structure of sets that are hereditarily of size at most k is decidable. We provide a transparent complete axiomatization of its theory, a quantifier elimination result, and tight bounds on its computational complexity. This stands in stark contrast to the structure of hereditarily finite sets, which is well known to be bi‐interpretable with the standard model of arithmetic.

Auch bewirken gnostische Ideen durch die Aufstellung von Mittlerwesen eine Entfernung der Gottheit von der Welt: er nimmt nicht mehr unmittelbar an ihr teil. Gottes Macht wird beschränkt durch die Hypostasierung seiner Eigenschaften. Der Anthropomorphismus, von einem Teil der Schriftgelehrten zu beheben oder zu mildern versucht, wird bei anderen umso stärker, und sie drücken darin ihren Hader mit Gott aus: er ist trotzig gegen die Bitten der Gemeinde, er verwechselt Namen und ist vergeßlich, ja er entzieht sich seinem eignen Gesetz oder den ethischen Verpflichtungen, die er selbst geboten hat. Aber wiederum, von der anderen Seite gesehen: Gott leidet mit seinem Volk, er ist ohnmächtig, demütig, weint und klagt, trauert um Stadt und Tempel, ist erlösungsbedürftig und ringt mit sich selbst um sein Erbarmen. Man könnte dies die positive Seite der rabbinischen Kritik an Gott nennen. Auf zwei große Motive läßt sich diese Kritik zurückführen : auf eine Fortführung des alttestamentlichen Dispute zwischen Gott und Menschen, wobei gleichzeitig eine Veränderung der biblischen Gottesvorstellung nach der spekulativen Seite hin erfolgt - und auf das Interesse a n der Entlastung der bedrängten Gemeinde. Es sind Motive, die in der Weiterentwicklung des Judentums unvermeidlich waren. Auch andere große Religionen haben unter dem Druck solcher Anfechtungen gestanden. Auch dem Islam und dem Christentum ist solche Kritik nicht fremd geblieben. Was den Islam betrifft, so ist Verfasser durch einen Vortrag von Hellmut Ritter im Orient-Institut Frankfurt/Main über "die Kritik an Gott bei den persischen Mystikem"33) zu vorliegender Untersuchung angeregt wor den. Wenn auch die Erscheinungswelt der islamischen, zumal der persischen Mystik von derjenigen der Rabbinen so verschieden ist wie nur möglich, da es sich dort meist um Extravaganzen des Typus des "närrischen Heiligen" handelt, der die Freiheit hat, auch die radikalsten Gedanken über die Gottheit zu äußern, ohne daß er sein praktisches Verhalten der Ergebung in Gott ändert, so haben doch b e i d e Welten das eine gemeinsam, daß es die Not ist, die hier ein entscheidendes Wort mitspricht. Im Christentum ist die Kritik an Gott lediglich verhüllter dank der Idee der Menschwerdung Gottes und der ins Dogma eingebauten Theorie vom Mittler; aber sie ist nichtsdestoweniger vorhanden und bricht in Zeiten der Krisis hervor. Schon die Theodizee, die positive Seite der Kritik an Gott, setzt voraus, daß der Mensch nicht um eine Recht-fertigung Gottes herumkommt; das aber hat wieder zur Voraussetzung, daß der Mensch Gott Vorwürfe macht. So tut es z. B. LUTHER, der "in seinen seelischen Kämpfen Gott besonders Härte und Ungerechtigkeit vorgeworfen hat"34). Diese Kritik ist zuletzt notwendige Begleiterscheinung jedes ernsthaften, sich um sich selber mühenden, nicht scholastisch erstickten Glaubens. Auch über die Kritik der Rabbinen an Gott kann schließlich kein anderes Urteil gefällt werden, als daß sie die dialektische Überwindung der Negation mittels ihrer ehrlichen Durchschreitung darstellt. For example, at the conclusion of his Histoire de la folie (Madness and Civilization, 1961)—a book which brought him extensive intellectual recognition in France—Foucault (...) drew his readers' attention to José de Goya y Lucientes's (1746-1828) well-known etching, El Sueño de la Razón Produce Monstruos (The Sleep of Reason Brings Forth Monsters, Plate 43 of Los Caprichos, 1797). In Foucault's estimation, by revealing a "night which is doubtless that of classical unreason," Goya's work represented a socially removed condition within which people encounter "what is most solitary" and experience what is "deepest" within themselves. With his reference to Goya's imagery, Foucault illustrated a major theme of his history of madness, namely, how people referred to as "mentally ill" experienced a gradual, physical exclusion from participation in public society, and how they were eventually isolated in a more frightening way: within their physical confinement, they were subject to techniques of psychological and spiritual alienation that reduced them to a condition of utter solitude.In a comparable, if not more central manner, Foucault used as thematic motifs for the preface, first and second chapters of a book for which he is widely known, Les Mots et les choses (The Order of Things, 1966), the work of three major writers and artists from the Spanish-speaking world: Jorges Luis Borges (1899-1986), Diego Velázquez (1599-1660), and Miguel de Cervantes (1547-1616). Among these references, the most popular is probably Foucault's discussion of [End Page 80] Velázquez's Las Meninas—a painting which captured Foucault's interest as a perfect exemplar of its time period—and which inspired him to devote the entire first chapter of his book to decoding the mechanics of its perspectival arrangement. And within the community of those who read, write and discuss the interrelationship between Foucault's thought, literary theory and the contemporary emphasis upon the multivocal quality of textual meaning, Foucault's citation of an excerpt from a short story by Borges—the subject of this essay—is also familiar. We show that any (atomic) excellent class K can be expanded with hyperimaginaries to form an (atomic) excellent class Keq which has canonical bases. When K is, in addition, of finite U-rank, then Keq is also simple and has a full canonical bases theorem. This positive situation contrasts starkly with homogeneous model theory for example, where the eq-expansion may fail to be homogeneous.
