My aim in this paper is to determine how Locke understands suspension and the role it plays in his view of human liberty. To this end I, 1) discuss the deficiencies of the first edition version of ‘Of Power’ and why Locke needed to include the ability to suspend in the second edition, then 2) analyze Locke’s definitions of the power to suspend with a focus on his use of the terms ‘source’, ‘hinge’, and ‘inlet’ to describe the power. I (...) determine from these descriptions that the ability to suspend is a passive power and is a necessary condition for the rational deliberation that Locke takes to be necessary for acting as a free agent. In 3) I connect Locke’s view of the power to suspend to his discussion in the sections that precede ‘Of Power.’ I argue that the kind of judgment that Locke endorses in his discussion of the Molyneux problem is also at work in acts of suspension. In 4) I apply my interpretation to Locke’s description of the connection between the power to suspend and liberty. In 5) I conclude with a discussion of a passage from the fifth edition of the Essay. Locke adds this passage to address worries raised by Limborch over the course of their correspondence. This article pursues the hypothesis that there is a structural affinity between the case study as a genre of writing and the question of gendered subjectivity. With John Forrester’s chapter ‘Inventing Gender Identity: The Case of Agnes’ as my starting point, I ask how the case of ‘Agnes’ continues to inform our understanding of different disciplinary approaches (sociological and psychoanalytic) to theorizing gender. I establish a conversation between distinct, psychoanalytically informed feminisms (Simone de Beauvoir, Juliet Mitchell, Judith Butler, and Denise (...) This paper treats a heretofore-unnoticed concept in the history of the philosophical discussion of human freedom, a kind of freedom that is not defined solely in terms of the causal power of the agent. Instead, the exercise of freedom essentially involves the non-occurrence of something. That being free involves the non-occurrence, that is, the absence, of an act may seem counterintuitive. With the exception of those specifically treated in this paper, philosophers tend to think of freedom as intimately involved with (...) volition, the judging or deciding activity of the will that votes in favor of or against a proposed action. However, there are two thinkers who endorse a view where not willing constitutes human freedom. Our analysis focuses on the views of Malebranche and Locke. Both invoke a notion dubbed here as ‘absential suspension.’ On this view, freedom is associated not with the power of volition, but rather with this kind of suspension. (shrink)

A central project of Enlightenment thought is to ground claims to natural freedom and equality. This project is the foundation of Suchon’s view of freedom. But it is not the whole story. For, Suchon’s focus is not just natural freedom, but also the necessary and sufficient conditions for oppressed members of society, women, to avail themselves of this freedom. In this paper I, first, treat Suchon’s normative argument for women’s right to develop their rational minds. In Section 2, I consider (...) Suchon’s three necessary and sufficient conditions for freedom, and the manners in which women are blocked from meeting them. The normative argument together with the obstacles to women meeting the conditions for freedom raises the question of how to get women into a position where they can enjoy the freedom to which they are entitled. In Section 3, I outline Suchon’s answer: women must live a life without attachment. I argue this answer situates Suchon both chronologically and theoretically between the Béguines, a medieval women’s spiritual movement, and 20th century feminist separatism. I conclude that Suchon’s view of freedom is radical, both for its time and ours, and deserves greater attention from historians of philosophy and of feminist thought. (shrink)

JohnLocke’s 1700–1702 correspondencewith Dutch Arminian Philippus van Limborch has been taken by commentators as the motivation for modifications to the fifth edition of “Of Power,” the chapter in An Essay Concerning Human Understanding that treats freedom. In this paper, I offer the first systematic and chronological study of their correspondence. I argue that the heart of their disagreement is over how they define “freedom of indifference.” Once the importance of the disagreement over indifference is established, it is clear that when (...) Locke altered parts of “Of Power” as a reaction to Limborch’s questioning, he did so in the interest of further clarifying and solidifying his view, not changing it. Seeing how they disagree over indifference also allows us to see the correspondence as showcasing the conflict between intellectualism, the view that cognitive states determine the will, and voluntarism, the view that the will alone determines action. Although Bossuet and Fénelon are the names most famously associated with the debate over the Quietist conception of pure love, Malebranche and his erstwhile disciple Lamy were the ones who debated the deep philosophical issues involved. In the wake of the collapse of the Soviet bloc, it is timely to ask what continuing role, if any, the concept of sovereignty can and should play in the emerging "new world order." The aim of _Law, Power, and the Sovereign State_ is both to counter the argument that the end of the sovereign state is close at hand and to bring scholarship on sovereignty into the post-Cold War era. The study assesses sovereignty as status and as power and (...) examines the issue of what precisely constitutes a sovereign state. In determining how a political entity gains sovereignty, the authors introduce the requirements of de facto independence and de jure independence and explore the ambiguities inherent in each. They also examine the political process by which the international community formally confers sovereign status. Fowler and Bunck trace the continuing tension of the "chunk and basket" theories of sovereignty through the history of international sovereignty disputes and conclude by considering the usefulness of sovereignty as a concept in the future study and conduct of international affairs. They find that, despite frequent predictions of its imminent demise, the concept of sovereignty is alive and well as the twentieth century draws to a close. (shrink)

This article critically examines the relationship between shared residence and contact after the breakdown of the parents’ relationship. It examines the background to the government’s main emphasis on methods of monitoring, facilitating and enforcing contact as the most efficacious method of proceeding in respect of the law reform agenda, focussing particularly on the potential impact of punitive enforcement measures on primary carers, usually mothers. The article sets the discussion within its wider cultural context in respect of fathers’ rights claims that (...) family law currently favours mothers, and shows how recent legal developments constitute part of a package to manage post-separation relationships between parent and children. It also examines some of the emerging case law to show how the judiciary is using shared residence orders and transfer of residence to deal with protracted and very difficult contact disputes, and in ways which were not anticipated when shared residence orders were first introduced. Drawing on feminist legal commentaries the argument will be made that the use of transfer of residence and shared residence orders in these disputes is extremely worrying, especially in light of the growing body of empirical research which heralds caution. The article will conclude by suggesting that far from favouring mothers, both the law reforms and the case law effectively construct mothers as integral to the problem of contact. They are treated as the site of and solution to the ‚problem’ of contact, and the means of dealing with the problem is by increasingly punitive measures which are inappropriate in a family law context. At the same time non-residential fathers who do not uphold contact escape legal sanctions. (shrink)

ABSTRACT:In 1740, Joanna Stephens (fl. 1720–1741) produced a recipe for a tonic that she claimed cured bladder stones. Although she had the support of some notable and powerful men in the medical community and empirical evidence that her tonic worked, it took two years of petitioning, discussing, and even (unsuccessfully) crowd-sourcing before Parliament relented and awarded her the sum she requested to take her tonic public. Stephens’s interaction with the scientific community serves as a case study for how epistemic credibility (...) shapes how communities hear, interpret, and react to testimonies of knowledge claims from marginalized community members. Stephens’s position as an outsider, both qua woman and qua experimentalist, meant that she was effectively and almost immediately written out of her own story by learned and powerful men with who had both vested interests in the cure for the stone and epistemic prejudices that made it impossible for them to hear Stephens’s claim that she had made a discovery. The Supreme Court’s Dobbs v. Jackson Women’s Health Organization decision, first leaked to the public on 2 May 2022 and officially released on 24 June 2022, overturned Roe v. Wade and thereby determined that abortion is no longer a federally protected right under the Constitution. Instead, the decision gives individual states the right to regulate abortion. Since the Dobbs decision first leaked, our institution has received numerous requests for permanent contraception from individuals stating that their motivation to pursue permanent contraception (...) was influenced by the Dobbs decision and concerns about their reproductive autonomy. Discussions with patients seeking permanent contraception since the Supreme Court’s leaked decision have led us to ask ourselves, is legislative anxiety an indication for surgery? This article presents a case series consisting of a convenience sample of 17 young, nulliparous individuals who sought out permanent contraception in the six months following the leak of the Dobbs decision. Healthcare professionals often feel discomfort in offering permanent contraception to young and nulliparous individuals. Accordingly, we discuss pertinent legal issues, review relevant ethical considerations, and offer a framework for these discussions intended to empower the consulting healthcare professional to center the bodily autonomy of every patient regardless of age, parity, or indication for permanent contraception. One of the longest and most acrimonious polemics in the history of philosophy is between Antoine Arnauld and Nicolas Malebranche. Their central disagreements are over the nature of ideas, theodicy, and, the topic of this paper, grace. We offer the most in-depth English language treatment of their discussion of grace to date. Our focus is one particular aspect of the polemic: the power of finite agents to assent to grace. We defend two theses. First, we show that as the debate (...) progresses, the differences between Arnauld and Malebranche become, surprisingly, less pronounced—despite mutual accusations of Pelagianism and Calvinism. Our second thesis is developed to explain the outcome of the first. We argue that the employment of different methodologies to interrogate the relationship between efficacious grace and human power prohibits any possibility of reconciliation between Arnauld and Malebranche. Philosophical writing is challenging for students new to philosophy. Many philosophy classes are populated, for the most part, by students who have never taken philosophy before. While many institutions offer general writing support services, these services tend to be most beneficial for helping to identify problems with style and grammar. They are not equipped to help students with the particular challenges that come with writing philosophy for the first time. We implemented the “Home Base” Mentoring Program in two introductory level (...) philosophy courses to target the specific challenges that novice learners have when learning how to write philosophy. Through the program, students had access to writing mentors who were undergraduate senior philosophy majors. Based on surveys given to the students who have participated in this program, we found that the program boosted student confidence in writing and also worked to develop a welcoming, judgment-free, and encouraging environment in the philosophy department more generally. Richard Watson’s Descartes’s Ballet engages three main questions uncommon to traditional Cartesian scholarship: Did Descartes script La Naissance de la Paix, the ballet performed in honor of Queen Christina’s twenty-third birthday in December 1649? Did Descartes have a political philosophy? Did Descartes read the French dramatist Pierre Corneille? Watson answers no, yes, and yes.By emphasizing the complete lack of evidence that Descartes wrote La Naissance de la Paix, Watson disarms the suggestion made by Adrien Baillet, Descartes’s seventeenth-century biographer, that Descartes (...) authored the ballet. Watson further suggests that only someone who was immersed in the subtleties of political culture in the Swedish court and was in Christina’s confidence could have written it. And Descartes, he argues, could not have met this description. Had it been written by Descartes, the ballet could have provided a foundation on which to build an interpretation of Cartesian political philosophy. Without it, explicit textual support for the construction of Descartes’s political philosophy is nonexistent. Undaunted by the lack of texts, Watson nevertheless constructs one based largely on the. In this paper I argue that according to Malebranche mental attention is the corrective to epistemic error and moral lapse and constitutes the essence of human freedom. Moreover, I show how this conception of human freedom is both morally significant and compatible with occasionalism. By attending to four distinctions made by Malebranche throughout his writings we can begin to understand first, what it means for human beings to exercise their freedom in a way that has some meaningful consequence, and second, (...) how this meaningful consequence does not conflict with occasionalism. The distinctions are: mind/matter, nothing/real, moral/physical, union of the human mind with God/union of the human mind with the human body. By getting clear about how Malebranche sees the overlap between and interconnection among these distinctions we can get a better handle on the metaphysical nature of human freedom, what kind of power it confers on us, and what it entails. I will discuss each distinction is turn starting in 1) with the mind/matter distinction. This first pair will be analyzed by way of a comparison between extended things and thinking things introduced by Malebranche early in *The Search After Truth.* Taking note of where the comparison breaks down, and why, leads directly into 2) where I discuss the nothing/real distinction. This pair is discussed at length in the first Elucidation to *The Search*, the stated objective of which is to clarify what was written in the course of the comparison between mind and matter at the outset of *The Search.* In 3) I analyze the moral/physical distinction, developed in Malebranche’s final work *Réflexions sur la prémotion physique*, and suggest that this pair exactly parallels the nothing/real distinction. In 4) I suggest that the only way to fully understand what is a stake with these distinctions and what Malebranche is trying to do with them is by looking at them in relation to the most important distinction of them all –between the union of the mind and God/union of the mind and body. I conclude in 5) by suggesting a way to understand our power to unite our minds to God. This power does not conflict with occasionalism because it is neither an efficient cause nor does it produce any real effects. It does, nevertheless, have a meaningful role in our moral lives. This article discusses section 156 of the Criminal Justice and Public Order Act 1994 which prohibits the use of eggs from aborted female foetuses for the purposes of reproduction. I argue that the pre-legislative debates focus only on the biological relationship between the aborted foetus and any ensuing child and foreclose the possibility of useful discussion about the potential merits of such technology. Kristeva's theory of abjection has been used in order to elucidate the strength of feeling about the use (...) of eggs from the expelled foetus. I suggest that the ‘yuk’ factor stems from the potential for the blurring of the boundaries between life and death. In addition, I suggest that the stress placed on the biological link means that the foetus is ascribed special properties not given to live donors. Woman's very crucial role in reproductive technologies is therefore erased. The article argues that there are very good reasons why the debate on the subject should remain open. At present women donors have to undergo highly intrusive procedures in order to give eggs and the process is not without its health risks. The use of eggs from aborted foetuses certainly raises important consent issues but these could be addressed by placing women at the centre of the decision making process, starting with the recognition that it is women and not foetuses who have the remit and responsibility for giving consent for the use of their genetic material. Moreover, there should be an acknowledgement that women are perfectly capable of making informed decisions about donation and of considering the potential implications of participating in egg donation. Both the medical model and the social model of disability have substantial drawbacks for the project of creating better lives for people with disabilities; the first denies the value of difference and the effects of discrimination, and the second denies any place for prevention and cure. Using fictional and non-fictional parental narratives of Fetal Alcohol Syndrome, this article argues that a third model–a morphological model of disability–can best help us think about respectfully and effectively intervening in disability.

Different forms of mindfulness meditation are increasingly integrated in the clinical practice in the last three decades. Previous studies have identified changes in the neurophysiology and neurochemistry of the brain resulting from different mindfulness meditation practices in the general population. However, research on neural correlates of different types of meditation, particularly on the clinical outcomes, is still very sparse. Therefore, the aim of this article is to review the neural impact of mindfulness meditation interventions on different mental disorders via the (...) classification of main components of mindfulness meditation. In this paper, I examine a heretofore ignored critic of Descartes on the heterogeneity problem: Anton Wilhelm Amo. Looking at Amo’s critique of Descartes reveals a very clear case of a thinker who attempts to offer a causal system that is not a solution to the mind-body problem, but rather that transcends it. The focus of my discussion is Amo’s 1734 dissertation: The Apathy [ἀπάθεια] of the Human Mind or The Absence of Sensation and the Faculty of Sense in the (...) Human Mind and their Presence in our Organic and Living Body. Amo’s discussion of the interaction, or lack thereof, of the mind and body hinges on the essential feature he identifies for the human mind—apathy, that is, impassivity. In this work, Amo engages explicitly with Descartes’s writing, which allows us to more precisely see the nature of his agreement and disagreement with the Cartesian metaphysics of mind. I proceed by treating Amo’s five stated criteria for spirit-hood which, in turn, reveal the kinds of causal connections that are possible for embodied spirits on his view. My aim is threefold: To lay out what I take to be Amo’s view of and arguments for the five criteria he takes to be required for a substance to be spirit. To locate Amo’s agreement and disagreement with Descartes. To suggest that Amo’s view on mind-body interaction involves a kind of occasional causation. (shrink)

Historically the terms “final,” “unconditional,” and “intrinsic” have played a foundational role in ethical theory. I argue that final/instrumental distinction is best understood in terms of the for-sake-of relation and involves a tri-part division of goods. I show that this first way of categorizing goods is more closely aligned with a second way of categorizing goods in terms of intrinsic/extrinsic goods than has thus far been acknowledged. Lastly, I distinguish yet a third way of categorizing goods: unconditional/conditional goods. While the (...) final/instrumental and intrinsic/extrinsic distinctions have received the lion’s share of philosophical attention, the unconditional/conditional distinction is no less important.
