Friedrich Wilhelm Joseph Von Schelling (1775-1854) was a colleague of Hegel, Holderlin, Fichte, Goethe, Schlegel, and Schiller. Always a champion of Romanticism, Schelling advocated a philosophy which emphasized intuition over reason, which maintained aesthetics and the creative imagination to be of the highest value. At the same time, Schelling's concerns for the self and the rational make him a major precursor to existentialism and phenomenology. Schelling has exercised a subterranean influence on modern thought. His diverse writings have not given rise (...) to a system or school of thought; rather, individual philosophers have been influenced by the resonance of his ideas and their influence on contemporary ideas and movements. The New Schelling brings together a wide-ranging set of essays which elaborate the connections between Schelling and other thinkers - such as Marx, Nietzsche, Freud, Sartre, Deleuze, and Lacan - and argue for the unexpected modernity of Schelling's work. Since 9/11, citizens of all nations have been searching for a democratic public philosophy that provides practical and inspiring answers to the problems of the twenty-first century. Drawing on the wisdom of past and present pragmatist thinkers, Judith M. Philosophical treatments of natural kinds are embedded in two distinct projects. I call these the philosophy of science approach and the philosophy of language approach. Each is characterized by its own set of philosophical questions, concerns, and assumptions. The kinds studied in the philosophy of science approach are projectible categories that can ground inductive inferences and scientific explanation. The kinds studied in the philosophy of language approach are the referential objects of a special linguistic category—natural kind terms—thought to refer directly. (...) Philosophers may hope for a unified account addresses both sets of concerns. This paper argues that this cannot be done successfully. No single account can satisfy both the semantic objectives of the philosophy of language approach and the explanatory projects of the philosophy of science approach. After analyzing where the tensions arise, I make recommendations about assumptions and projects that are best abandoned, those that should be retained, and those that should go their separate ways. I also recommend adopting the disambiguating terminology of “scientific kinds” and “natural kinds” for the different notions of kinds developed in these different approaches. (shrink)

Two decades of research on euthanasia in the Netherlands have resulted into clear insights in the frequency and characteristics of euthanasia and other medical end-of-life decisions in the Netherlands. These empirical studies have contributed to the quality of the public debate, and to the regulating and public control of euthanasia and physician-assisted suicide. No slippery slope seems to have occurred. Physicians seem to adhere to the criteria for due care in the large majority of cases. Further, it has been shown (...) that the majority of physicians think that the euthanasia Act has improved their legal certainty and contributes to the carefulness of life-terminating acts. In 2005, eighty percent of the euthanasia cases were reported to the review committees. Thus, the transparency envisaged by the Act still does not extend to all cases. Unreported cases almost all involve the use of opioids, and are not considered to be euthanasia by physicians. More education and debate is needed to disentangle in these situations which acts should be regarded as euthanasia and which should not. Medical end-of-life decision-making is a crucial part of end-of-life care. It should therefore be given continuous attention in health care policy and medical training. Systematic periodic research is crucial for enhancing our understanding of end-of-life care in modern medicine, in which the pursuit of a good quality of dying is nowadays widely recognized as an important goal, in addition to the traditional goals such as curing diseases and prolonging life. Foucault proposes at the end of the first volume of The History of Sexuality to shift the focus of sexual studies from sex-desire to bodies and pleasures. This article seeks to establish what he means by this shift, how he proposes it be made, and what the consequences are for thinking about sexuality together with `sex'. Foucault's shift involves a historiographical claim about the superability of the recent past, and can be read as an effort to relegate the concerns about (...) sexual difference and kinship to the past, and to establish a contemporary field for sexuality that involves bodies without history, pleasures without sex. The article suggests a way around this questionable historiographical assumption and marks a different departure for a Foucauldian study of sexuality. It also seeks to highlight some of the contemporary tensions between feminist and lesbian and gay studies, especially queer studies, in light of this reading of Foucault. (shrink)

On April 2, 1987, Professor of Philosophy, Judith Jarvis Thomson of Massachusetts Institute of Technology, delivered the Georgetown Law Center’s seventh Annual Philip A. Hart Memorial Lecture: "The Decline of Cause." Judith Jarvis Thomson works in ethics and metaphysics. Her book, The Realm of Rights (Harvard University Press, 1990) is a study of the questions what it is to have a right, and which ones we have. An article entitled "Self-Defense" appeared in Philosophy and Public Affairs (Fall 1991); (...) another entitled "On some ways in which a thing can be good" appeared in Social Philosophy and Policy (Spring 1992). Her work in metaphysics has largely been on the ontology of events, and the identity across time of people and other physical objects. An article entitled "People and their bodies," which takes issue with views expressed by Derek Parfit in Part III of his Reasons and Persons, has recently appeared in a collection of essays (edited by Jonathan Dancy) written on topics dealt with in that book. The recent arrest of Roman Polanski, the film director who fled to France from the United States in 1978 on the eve of sentencing for having unlawful sex with a 13-year-old girl, has caused an international ruckus. The French culture minister, Frédéric Mitterrand, and the French foreign minister, Bernard Kouchner, both issued statements of support for Mr. Polanski. But many others in France have expressed outrage at that support and said he should face justice for the crime.

In contrast to Christopher Kelty’s case for the “careful cultural analysis of the domesticated forms that open source is taking” – which we agree to be a very useful endeavor – we would like to stick with the original call for papers for this special issue, that explicitly addresses the critical power of free software and a necessary shift to epistemologies. In our contribution we are responding to the aims of this special issue and to some of the contributions from (...) the perspective of feminist epistemology. There are several reasons for this decision. First of all, feminist scholars have been amongst the rst and most explicit to stress the linkages between knowledge and power. Apart from this generic focus, speci c feminist approaches, namely the approaches proposed by Helen Longino, Karen Barad and Lucy Suchman, o er invaluable insights for understanding the critical power of free software as a practice, which enables the materialization of principles into objects, as Kelty rightly emphasizes. Furthermore, feminist approaches suggest looking at epistemological politics and the situatedness of knowledge practices including e ects of perspectivism and marginalization. We adopt a performative understanding of epistemic practices, an understanding that take the interrelations between epistemology, ontology and ethics seriously. Thus, we start our inquiry from Kelty’s observation that free software “promises a sequence of [...] values: experimentalism and creativity, provisionality and modi ability, recti cation and refraction, dissent and critique, participation and obligation“ and that it „allows values and principles to be turned into material objects“. These and other values have already been inscribed in the launch of the GNU project in the beginning 1980s, the creation of the GPL, and they are continuously realized in the Free Software movement. Hence the interesting question is how they are realized and how are they shaped vice-versa by practices. (shrink)

Although the number of women in middle management has grown quite rapidly in the last two decades, the number of female CEOs in large corporations remains extremely low. This article examines many explanations for why women have not risen to the top, including lack of line experience, inadequate career opportunities, gender differences in linguistic styles and socialization, gender-based stereotypes, the old boy network at the top, and tokenism. Alternative explanations are also presented and analyzed, such as differences between female leadership (...) styles and the type of leadership style expected at the top of organizations, feminist explanations for the underrepresentation of women in top management positions, and the possibility that the most talented women in business often avoid corporate life in favor of entrepreneurial careers. Bringing a postcolonial perspective to UK constitutional debates and including a detailed and comparative engagement with the constitutions of Britain’s ex-colonies, this book is an original reflection upon the relationship between the written and the unwritten constitution. Can a nation have an unwritten constitution? While written constitutions both found and define modern nations, Britain is commonly regarded as one of the very few exceptions to this rule. Drawing on a range of theories concerning writing, law and violence, _Constitutions _makes a (...) theoretical intervention into conventional constitutional analyses by problematizing the notion of a ‘written constitution’ on which they are based. Situated within the frame of the former British empire, this book deconstructs the conventional opposition between the ‘margins’ and the ‘centre’, as well as between the ‘written’ and ‘unwritten’, by paying very close, detailed attention to the constitutional texts under consideration. Pryor argues that Britain’s ‘unwritten’ constitution and ‘immemorial’ common law only take on meaning in a relation of difference with the written constitutions of its former colonies. These texts, in turn, draw on this pre-literate origin in order to legitimize themselves. The ‘unwritten’ constitution of Britain can therefore be located and dislocated in postcolonial written constitutions. _Constitutions _is an excellent addition to the bookshelves of all students of the philosophy of law, political theory, constitutional and administrative law and jurisprudence. When two agents of unequal strength compete, the stronger one is expected to always win the competition. This expectation is based on the assumption that evaluation of performance is complete, hence flawless. If, however, the agents are evaluated on the basis of only a small sample of their performance, the weaker agent still stands a chance of winning occasionally. A theoretical analysis indicates that, to increase the chance of this happening the weaker agent ought to give up on enough occasions (...) so that he or she can match the stronger agent on the remaining ones. We model such a competition in a game, present its game‐theoretic solution, and report an experiment, involving 144 individuals, in which we tested whether players (both weak and strong) are actually sensitive to their relative strengths and know how to allocate their resources accordingly. During the past few years, feminist critics have approached writing by women with an "abiding commitment to discover what, if anything, makes women's writing different from men's" and a tendency to feel that some significant differences do exist.4 The most common answer is that women's experiences differ from men's in profound and regular ways. Critics using this approach find recurrent imagery and distinctive content in writing by women, for example, imagery of confinement and unsentimental descriptions of child care. The other (...) main explanation of female difference posits a "female consciousness" that produces styles and structures innately different from those of the "masculine mind." The argument from experience is plausible but limited in its applications: the argument from a separate consciousness is subject to mystification and circular evidence. In both cases, scholars tend to list a few characteristics of writing by women without connecting or explaining them.· 4. This work considers current models for understanding tactical interaction among social movement actors and finds them insufficient for making sense of the tactical work required of the Irish women's movement. Analysis of Irish feminist efforts to expand reproductive freedom calls into question the idea that tactical innovations are solely responses to countermovements or state repression. In this case, feminist activists spent considerable energy avoiding co-optation by sympathetic men and class-based movements and competing with economic and nationalist dilemmas that capture the (...) lion's share of public attention. “Friendly fire” refers to the process by which nonoppositional groups within and around, but not of, a movement threaten movement aims. Observational work focused on feminist campaign meetings and political theater yields significant insights concerning the effects of friendly fire and, specifically, the role of men in women's movements.
