In this paper, we try to expose the fundamental ideas at the basis of Jorge Millas’ axiology. First, we will expose synoptically the core of the legal philosophy that the Chilean thinker develops on his works on the subject, including his conception about philosophy in general , and about legal science in particular . Secondly, we will expose the epistemological suppositions of his legal philosophy , and his consequent conception of law’s essence , the legal rule and its foundation, and (...) the axiological theory that Millas develops on the basis of the distinction and relationship between “is” and “ought” . We conclude with a critical analysis that pretends to expose the strengths and weaknesses of the legal theory of this Chilean author. (shrink)

The relationship between ethics and performance has previously been addressed in the literature, although there are still some gaps, for example, the relationship of ethical ideologies to student performance. This work aims to contribute to the literature with a statistical evaluation using partial least squares path modelling (PLS-PM) regarding whether university students’ ethical ideologies and moral meaningfulness influence their level of student performance and academic achievement. Results indicate that the ideologies of justice and deontology increase moral meaningfulness, moral meaningfulness in (...) turn increase student’s citizenship behaviours and student’s in-role performance, and finally, student’s in-role performance positively influences academic achievement. This research provides resources applicable to the fields of pedagogy and ethics to encourage performance during the study and highlight the value of the ideologies of justice and deontology. They assume they have to do research as mandatory. Research becomes a means and not an end. This paper is an overview of social psychology in Mexico. It shows three aspects of how social psychology is addressed and some critical reflections that could be useful for those engaged in research in social psychology. The configuration of a psychology of complexity is related with the application of this principles for the analysis of the social reality in several addresses: a) to win complexity in the explanatory and descriptive environments, opening diverse ways of thinking and novel investigation lines, accepting that the theories of the complexity have been related inevitably with the sciences of the behavior; b) to understand that the daily life can be studied from four optics that deserve recognition in the epistemological level of the social psychology: fuzzyness, catastrophic, fractal and chaotic; c) to recognize that reality demands scientific explanations complex and leave the simplicity; d) to renovate the psychology from their base and not from the obedience and the academic subjection. Resumen: Este artículo tiene como foco de estudio la fonología segmental del mapudungun, en general, y el estatus de los fonos interdentales /en el chedungun hablado en Alto Biobío, en particular. Se elicitó una lista léxica adaptada de Croese, 30 colaboradores adultos, bilingües de chedungun y español, pertenecientes a 10 localidades pehuenches de esta comuna. Mediante evidencia cuantitativa, visual, palatográfica y de contraste en ambiente análogo, se concluye que dichos fonos tienen estatus fonémico en la zona señalada.: This article focuses (...) on the Mapudungún segmental phonology in general, and the status of the interdental phones / from the Chedungun spoken in Alto Biobío in particular. An adapted lexicon list by Croese was elicited from 30 adult bilingual assistants, belonging to 10 towns of this community. AI research is being challenged with ensuring that autonomous agents learn to behave ethically, namely in alignment with moral values. Here, we propose a novel way of tackling the value alignment problem as a two-step process. The first step consists on formalising moral values and value aligned behaviour based on philosophical foundations. Our formalisation is compatible with the framework of (Multi-Objective) Reinforcement Learning, to ease the handling of an agent’s individual and ethical objectives. The second step consists in designing an (...) environment wherein an agent learns to behave ethically while pursuing its individual objective. We leverage on our theoretical results to introduce an algorithm that automates our two-step approach. In the cases where value-aligned behaviour is possible, our algorithm produces a learning environment for the agent wherein it will learn a value-aligned behaviour. (shrink)

Norms have been widely enacted in human and agent societies to regulate individuals’ actions. However, although legislators may have ethics in mind when establishing norms, moral values are only sometimes explicitly considered. This paper advances the state of the art by providing a method for selecting the norms to enact within a society that best aligns with the moral values of such a society. Our approach to aligning norms and values is grounded in the ethics literature. Specifically, from the literature’s (...) study of the relations between norms, actions, and values, we formally define how actions and values relate through the so-called value judgment function and how norms and values relate through the so-called norm promotion function. We show that both functions provide the means to compute value alignment for a set of norms. Moreover, we detail how to cast our decision-making problem as an optimisation problem: finding the norms that maximise value alignment. We also show how to solve our problem using off-the-shelf optimisation tools. Finally, we illustrate our approach with a specific case study on the European Value Study. (shrink)

The purpose of the article was to determine the relationship between the organizational culture and the institutional management of the "Enrique López Albújar" Educational Institution, Piura. Work is worked under a quantitative approach, descriptive and correlational scope, 40 teachers participated as a sample. Among the results, it was found that there is no significant relationship between organizational culture and institutional management, which did not allow validating the research hypothesis; However, a significant relationship between norms and customs with institutional management was (...) found; which concludes in compliance with the norms and good customs based on values. As opposed to Descartes, and in accordance with authors such as Nietzsche, Darwin or Chomsky, Pinker sustains that language is just another instinct of human nature. But he differs himself from Chomsky by affirming that language is also the result of the mechanism of natural selection. Recent discoveries seem to strengthen Pinker’s thesis, in as far as it has been possible to establish a link between the FOXP2 gene and language. Philosophy should take good note of these results, as they (...) fully affect the status of lógos: from now on, it is possible, without needing to resort to any type of transcendence, to consider language as constitutive of human singularity regarding other species and, at the same times, as just another avatar in the evolution of the natural world. Presento argumentos en contra de: a) que sea necesario distinguir entre representaciones epistemológicamente “peligrosas”e “inofensivas”; b) que el empirismo mínimo sea un tipo de realismo directo; c) que mi uso de la expresión “evidencia distal” y el interés por la teoría de la correspondencia sean asuntos ajenos a Davidson. I argue against: a) the need to distinguish between epistemologically “dangerous” and “harmless” representations; b) the idea that minimal empiricism is a kind of direct realism; and c) the claim that my usage of the expression “distal evidence” and interest in the theory of correspondence are issues that do not pertain to Davidson. Finally, I claim that triangulation is a key element in Davidsonian epistemology since it allows us to deal with the realist anxiety while maintaining a non-representationalist viewpoint. (shrink)

El artículo presenta una síntesis comparativa de las aportaciones de dos autores hispanos sobre la Eucaristía: Domingo de Soto, perteneciente a la Escuela de Salamanca, y Juan de la Anunciación, teó- logo relevante de los Salmanticenses. Los dos autores representan la neoescolástica que predomina en Salamanca y, si bien los dos autores comentan a Santo Tomás, manifiestan también unas diferencias de interpretación y un progreso teoló- gico complementario, como puede apreciarse en sus tratados correspondientes sobre la Eucaristía.

Among the manuscripts containing works by the dominican Domingo de Soto we find the acephalous and mutilated fragment Relectio an liceat civetate infidelium seu gentium expugnare ob idolatriam, titled by a later hand. Soto’s argument belongs to the context of the juridical, political and religious polemic on alleged rights to subdue unbelievers, staged by the junta gathered in Valladolid, in August and September 1550, to hear the arguments in favour, by Juan Ginés de Sepúlveda, and arguments against, (...) by Bartolomé de las Casas, whose meeting Summary was written by Domingo de Soto himself. In the fragment An liceat, Soto unwaveringly takes upon himself the refutation of each argument deployed by proponents of the right to subdue and punish natives in the New World, asserting their state of non subjection to Christian norms before their convert. Bearing in mind its structure and arguments, it is conjectured that the text may have been written for the De iustitia et iure, published in 1554, and again in 1556, though, for unknown reasons, was not included in that work. Who owns the girl’s body, the parents, or the daughter herself? In Catholic casuistry, this issue has not only been occasionally touched upon, it has been topical among the commentators on Aquinas (STh II-II, q. 154, a. 6) from the 16th up to the 18th centuries. Nevertheless, modern scholarship ignores this big dispute. The distortion of early modern history in consequence thereof precludes a fair appraisal of the achievements of the Christian schools within the Habsburgian commonwealth. Whereas the Iberian Peninsula (...) was the theatre of the endeavour here described (Domingo de Soto OP, Luis de Molina SJ, Gabriel Vázquez SJ, Juan de Lugo SJ, the Salmantine Carmelites), Jansenist France was forward in defeating it. The quarrel about this issue gains an additional interest by the observation that it represents the rare case where the schoolmen themselves had the keen feeling that the stand they took represented a divide between two ages, medieval and modern, viz. Pre-Tridentine and Post-Tridentine. The main purpose of the present paper, then, is to render a necessary piece of apologetics. Endocrinologists apply the idea of feedback loops to explain how hormones regulate certain bodily functions such as glucose metabolism. In particular, feedback loops focus on the maintenance of the plasma concentrations of glucose within a narrow range. Here, we put forward a different, organicist perspective on the endocrine regulation of glycaemia, by relying on the pivotal concept of closure of constraints. From this perspective, biological systems are understood as organized ones, which means that they are constituted of a set of (...) mutually dependent functional structures acting as constraints, whose maintenance depends on their reciprocal interactions. Closure refers specifically to the mutual dependence among functional constraints in an organism. We show that, when compared to feedback loops, organizational closure can generate much richer descriptions of the processes and constraints at play in the metabolism and regulation of glycaemia, by making explicit the different hierarchical orders involved. We expect that the proposed theoretical framework will open the way to the construction of original mathematical models, which would provide a better understanding of endocrine regulation from an organicist perspective. There are associations with Teresa of (...) Avila, who spent the night there just after her reform was approved by Rome, with the young Cervantes, with Luis de Leon and Ignatius Loyola, and with John of the Cross, who was a student there. A bridge from the time of Trajan spans the river Tormes, and the Romanesque cathedral still reserves a chapel for the Mozarabic rite. The University of Salamanca The city brings to mind sixteenth century Dominicans like Francisco de Vitoria, often called the founder of international law, and Domingo Bafiez, confessor to Teresa of Avila. The Order of Friars Preachers, however, came to Salamanca in 1222 at the same time that Dominic's missions were taking root in·Paris and Bologna; the friars founded a priory and soon a school under the patronage of St. Stephen (San Esteban). The " Dominican School of Salamanca " means formally the line of great theologians reaching from Diego de Deza at the end of the fifteenth century to Tomas de Lemos, a main protagonist in Rome in 1607 in the controversy over grace entitled De Auxiliis. Today, after seven and a half centuries of existence, the Salamancan SSS 556 THOMAS F. o'MEARA, O.P. Dominicans remain a vital community, active m teaching, research and publishing. My attention was directed to the Dominicans at Salamanca by two volumes of essays reporting on congresses concerning the "Dominicans and the Discovery of the New World." My interest was not church history but the history of theologies of how grace might exist outside of explicit faith and sacramental baptism. The following report is a bibliographical survey of recent research on a theological era and school. Focusing on the thought of the theologians stimulated by the experiences of the missionaries in the Indies, it treats the Dominicans during the first decades after the voyages of Columbus. In the 1480s, as it entered its golden age, the University of Salamanca had a hundred professors and almost 7000 students. University records begin late, but they show that in 1546/47, one hundred thirty-four Dominicans were studying at the university, and in 1598/99, eighty. J. L. Espinel has written. a historical guide to the Dominican buildings and institutions.1 The great period of the Dominican school at the University began with Diego de Deza ( 1480-1486), professor and archbishop of Seville, and Matias de Paz (1518-1519), a professor of Scripture. In lieu of an abstract, here is a brief excerpt of the content:Conquest and English Legal Identity in Renaissance IrelandBrian LockeyLike the Spanish administrators of the American territories, English administrators of Ireland attempted to impose their own native legal system on the Irish inhabitants. Nonetheless, important differences existed between the two kingdoms' legal approaches to their respective colonial contexts. Because Spanish jurisprudence was allied with universalist Catholic doctrine and was officially based on Justinian's Corpus Iuris Civilis (the ancient Roman legal (...) code which had close affinities to natural law discourse), Spanish administrators expected New World inhabitants to accept what they considered to be the "universal values" that were inherent in Spanish law.1 In contrast English common law had its roots not in natural law but in the peculiar customs of the English people. Thus, while the Spanish were able to claim that they were replacing unnatural Indian customs with a legal system rooted in universal natural law, the English were attempting to reform what they considered to be the unnatural practices of the Irish by imposing a legal system defined by its insularity and its peculiar affinity with English institutions.2 In this essay I show that Renaissance ethnographies on Ireland by such English administrators of Ireland as Edmund Spenser, Sir John Davies, and Fynes Moryson are fractured by a conflict between a commitment to natural-law theory, which had its origin in continental writings, and a corresponding commitment to the native English tradition of common law. I examine how works by Spenser, Davies, and Moryson dealt with this conflict within their collective project of articulating a legal justification and strategy for the pacification of Ireland. [End Page 543]Despite reports throughout Europe of Spanish-perpetrated cruelty throughout the Americas, the idea that war or conquest could be just or even charitable when prosecuted against oppression originated within the Catholic tradition of scholastic just-war theory.3 Many of the sixteenth-century writers who were writing about war and conquest in legal or ethical terms were Spanish or continental theologians who had attempted to evaluate Spanish imperial policy in the New World. On the one side were such figures as the Scottish theologian John Major and Spanish historian Juan Ginés de Sepúlveda, both of whom had justified Spanish conquest and treatment of the Indians using arguments based on the foundation of natural law.4 On the other side were those who had, on similar terms, voiced criticisms of the cruelties which Spanish forces were inflicting on the Indians. Francisco de Vitoria and Bartolomé de las Casas were certainly the most notable Spanish writers who favored more ethical treatment of New World inhabitants.5 Other prominent defenders of Indian rights were Domingo de Soto and Melchor Cano.6 Whether directly or through intermediaries, the ideas of many of these writers permeated the ideological fabric of England.Sir Fulke Greville's famous statement about Sir Philip Sidney's goal of fostering alliances with New World inhabitants in order to overthrow the Spanish authorities included an awareness of the "inhuman cruelties" of the Spanish forces, an awareness that probably originated in the English translation of Las Casas's Brevissima relación de la destrucyión de las Indias (1552).7 Beyond [End Page 544] this significant text, however, there were others. One important book that captured the ideas of the early Spanish debates on the ethics and justice of the New World conquests was Antonio de Guevara's Relox de príncipes (1529), a work twice translated into English during the sixteenth century.8 The third book of the Relox de príncipes, which treats the princely virtues of justice, peace, and magnificence, contains several sections that together constitute a polemic against violent imperialism and unjust conquest. In one notable episode Guevara employs the example of ancient Roman imperialism to produce a veiled critique of the injustices which Spain had committed against New World polities. A "villain of Danuby" from a German province newly conquered by Rome makes a speech to the Roman senate in which he criticizes the injustice of his Roman oppressors. Many years before Adam Smith, numerous theologians associated with the School of Salamanca, such as Domingo de Soto, Juan de Lugo, Juan de Mariana, Luís Saravia de la Calle, Martin de Azpilcueta, Luis de Molina, Leonard Lessius, Thomas Cajetan, and Francisco Garcia had made great strides in the development of economics. Specifically, these theologians, otherwise known as the “Scholastics,” analyzed and argued against price and wage controls by explaining that the only “just” prices and wages are those (...) that are set by the market, examined and pushed back against prohibitions on usury, understood the concept of time preference, and helped develop monetary theory in multiple ways. They also demonstrated that all of this was consistent with the Catholic religion. This paper analyzes the ways in which these early theologians contributed to the development of economics and reconciled it with their Catholicism. (shrink)

In the debate over Spanish treatment of the natives of the New World, both sides regularly invoked Aristotle on natural slaves. This paper argues that the interpretation of the Spanish Dominican Domingo de Soto displays a greater understanding of Aristotle and the Aristotelian tradition of justice than that of Juan Gines de Sepúlveda, the Spanish Humanist. The paper goes on to argue that it is the humanist tradition itself that disposes Sepúlveda to misconstrue Aristotle and the tradition of (...) political justice. (shrink)

This unusual book takes the form of a dialogue between a linguist and another scientist. This unusual book takes the form of a dialogue between a linguist and another scientist. The dialogue takes place over six days, with each day devoted to a particular topic--and the ensuing digressions. The role of the linguist is to present the fundamentals of the minimalist program of contemporary generative grammar. Although the linguist serves essentially as a voice for Noam Chomsky's ideas, he is not (...) intended to be a portrait of Chomsky himself. The other scientist functions as a kind of devil's advocate, making the arguments that linguists tend to face from those in the "harder" sciences. The author does far more than simply present the minimalist program. He conducts a running argument over the status of theoretical linguistics as a natural science. He raises the general issues of how we conceive words, phrases, and transformations, and what these processes tell us about the human mind.
