Recent EEG studies on the early postmortem interval that suggest the persistence of electrophysiological coherence and connectivity in the brain of animals and humans reinforce the need for further investigation of the relationship between the brain’s activity and the dying process. Neuroscience is now in a position to empirically evaluate the extended process of dying and, more specifically, to investigate the possibility of brain activity following the cessation of cardiac and respiratory function. Under the direction of the Center for Healthy (...) Minds at the University of Wisconsin-Madison, research was conducted in India on a postmortem meditative state cultivated by some Tibetan Buddhist practitioners in which decomposition is putatively delayed. For all healthy baseline and postmortem subjects presented here, we collected resting state electroencephalographic data, mismatch negativity, and auditory brainstem response. In this study, we present HB data to demonstrate the feasibility of a sparse electrode EEG configuration to capture well-defined ERP waveforms from living subjects under very challenging field conditions. While living subjects displayed well-defined MMN and ABR responses, no recognizable EEG waveforms were discernable in any of the tukdam cases. (shrink)

Conçue par l’éditeur Charles-Joseph Panckoucke, elle s’échelonne sur cinquante ans (1782- 1832). Elle remanie et reprend les volumes de l’Encyclopédie de Diderot et d’Alembert, en substituant à l’ordre alphabétique un ordre des matières. Elle oriente les Lumières vers l’épistémologie positiviste. C’est pourquoi cette encyclopédie, qui demeure pourtant souvent méconnue, revêt aujourd’hui un intérêt considérable, notamment parce qu’elle montre un moment particulier des savoirs qui relient (...) les mots et les choses. Les trois volumes du Dictionnaire d’Architecture, dus à la plume de Quatremère de Quincy, s’inscrivent dans ce cadre éditorial et culturel, et en même temps dans l’histoire longue des théories de l’architecture : ils achèvent une tradition qui remonte à Vitruve. Quatremère de Quincy reprend et corrige Vitruve quand la théorie de ce dernier est démentie par la raison ou par l’histoire. Mais derrière cette critique, Quatremère se bat aussi avec son siècle. In this article, I show how resources for an education for non-dichotomous thinking can be drawn from the two Daoist texts, the Daodejing and the Zhuangzi. Dichotomous thinking can be defined as thinking that considers things in terms of strict and even irreconcilable dichotomous oppositions. The authors of the Daodejing and the Zhuangzi are known for their criticism of such dichotomous thinking. At the same time however, these authors seem to fall into this very kind of thinking which they criticize. (...) That is to say, the Daodejing and the Zhuangzi often promote adherence to conventionally ‘lower’ values over ‘higher’ ones. I believe though that this tension can be resolved if viewed through a pedagogical framework. Specifically, the adherence to ‘lower values’ can be seen as the initial step in the process of Daoist self-cultivation where one reduces the artificial distinctions one adheres to in order to prepare one’s disposition for union with Dao, which in turn entails non-dichotomous thinking. I aim to show how Confucian philosophy can contribute to the contemporary resurgence of virtue ethics education by arguing that it has the resource to address a lacuna in Aristotelian ethics. Aristotelian ethics, which is arguably the main resource of contemporary virtue ethics, lacks a virtue that corresponds to the notion of loving each person as one’s self or the Golden Rule. To be more precise, Aristotelian ethics has no virtue about loving all people as one’s self, although philia comes (...) close but is precisely limited because it lacks universality. However, I believe that Dai Zhen’s interpretation of the Confucian virtues of shu and zhong does have this universal scope which philia lacks. For Dai, the ground for loving another is not any characteristic that a particular group of people have in common, such as, in the case of philia, being virtuous. The predominance of the bioethical paradigm (principalism) is measured by a comparative analysis of regional moral opinion reflected in nation-state health laws. By looking at the way the ethico-legal concept figures into various national ordinances, we attempt to ascertain the extent and nature of variation (if any) between localities by exploring the understanding and application of principalism’s (...) keystone: patient autonomy. This paper presents a version of neurophenomenology based on generative modelling techniques developed in computational neuroscience and biology. Our approach can be described as _computational phenomenology_ because it applies methods originally developed in computational modelling to provide a formal model of the descriptions of lived experience in the phenomenological tradition of philosophy (e.g., the work of Edmund Husserl, Maurice Merleau-Ponty, etc.). The first section presents a brief review of the overall project to naturalize phenomenology. The second section presents and evaluates (...) philosophical objections to that project and situates our version of computational phenomenology with respect to these projects. The third section reviews the generative modelling framework. The final section presents our approach in detail. We conclude by discussing how our approach differs from previous attempts to use generative modelling to help understand consciousness. In summary, we describe a version of computational phenomenology which uses generative modelling to construct a computational model of the inferential or interpretive processes that best explain this or that kind of lived experience. Is the tick a machine or a machine operator? Is it a mere object or a subject? With these questions, the pioneering biophilosopher Jakob von Uexküll embarks on a remarkable exploration of the unique social and physical environments that individual animal species, as well as individuals within species, build and inhabit. This concept of the umwelt has become enormously important within posthumanist philosophy, influencing such figures as Heidegger, Merleau-Ponty, Deleuze and Guattari, and, most recently, Giorgio Agamben, who has called Uexküll (...) "a high point of modern antihumanism." A key document in the genealogy of posthumanist thought, _A Foray into the Worlds of Animals and Humans_ advances Uexküll's revolutionary belief that nonhuman perceptions must be accounted for in any biology worth its name; it also contains his arguments against natural selection as an adequate explanation for the present orientation of a species' morphology and behavior. _A Theory of Meaning_ extends his thinking on the _umwelt_, while also identifying an overarching and perceptible unity in nature. Those coming to Uexküll's work for the first time will find that his concept of the _umwelt_ holds out new possibilities for the terms of animality, life, and the whole framework of biopolitics itself. : This paper presents a method of moral problem solving in clinical practice that is inspired by the philosophy of John Dewey. This method, called "clinical pragmatism," integrates clinical and ethical decision making. Clinical pragmatism focuses on the interpersonal processes of assessment and consensus formation as well as the ethical analysis of relevant moral considerations. The steps in this method are delineated and then illustrated through a detailed case study. The overall goal of this essay is to explore the initial findings of neuroscientific research on meditation; in doing so, the essay also suggests potential avenues of further inquiry. The essay consists of three sections that, while integral to the essay as a whole, may also be read independently. The first section, “Defining Meditation,” notes the need for a more precise understanding of meditation as a scientific explanandum. This is the first article in a two-part series describing subject and family perspectives from the central thalamic deep brain stimulation for the treatment of traumatic brain injury using the Medtronic PC + S first-in-human invasive neurological device trial to achieve cognitive restoration in moderate to severe traumatic brain injury, with subjects who were deemed capable of providing voluntary informed consent. In this article, we report on interviews conducted prior to surgery wherein we asked participants about their experiences recovering from (...) brain injury and their perspectives on study enrollment and participation. We asked how risks and benefits were weighed, what their expectations and fears were, and how decisions were reached about trial participation. We found that informed consent and enrollment decisions are fraught. Subjects and families were often split, with subjects more focused on putative benefits and families concerned about incremental risk. Both subjects and families viewed brain injury as disruptive to personal identity and relationships. As decisions were made about study enrollment, families struggled with recognizing the re-emergent agency of subjects and ceding decision-making authority to subjects who had previously been dependent upon them for protection and guidance. Subjects and family members reported a hope for the relief of cognitive disabilities, improved quality of life, normalization of interpersonal interactions, and a return to work or school as reasons for study participation, along with altruism and a desire to advance science. Despite these aspirations, both subjects and families appreciated the risks of the intervention and did not suffer from a therapeutic misconception. A second essay to be published in the next issue of Cambridge Quarterly of Healthcare Ethics—Clinical Neuroethics will describe interviews conducted after surgery, the effects of cognitive restoration for subjects, families, and challenges presented to the social structures they will call upon to support them through recovery. Background: Even in countries with an opt-out or presumed consent system, relatives have a considerable influence on the post-mortem organ harvesting decision. However, their reflection capacity may be compromised by grief, and they are, therefore, often prone to choose refusal as default option. Quite often, it results in late remorse and dissatisfaction. So, a high-quality reflection support seems critical to enable them to gain a stable position and a long-term peace of mind, and also avoid undue loss of potential grafts. (...) In practice, recent studies have shown that the ethical aspects of reflection are rarely and often poorly discussed with relatives and that no or incomplete guidance is offered. No review of the literature is available to date, although it could be of value to improve the quality of the daily practice. Objectives: The objective was to review and synthesize the main concepts and approaches, theories and practices of ethical reflection support of the relatives or surrogates of potential post-mortem organ donors. Research design: A narrative review was performed in the medical, psychological and ethical fields using PubMed, PsycArticles and Web of Science databases (1980–2020). Results: Out of 150 papers, 25 were finally retained. Four themes were drawn: the moral status of the potential post-mortem organ donor, the principlistic approach with its limits and critics, the narrative approach and the transcendental approach. Discussion: This review suggests an extension of psychological support towards ethical reflection support. The process of helping relatives in their ethical exploration of post-mortem organ donation is psychologically and morally characterized. The need for specialized professionals educated and experienced both in clinical psychology and in health ethics to carry out this task is discussed. Practical impact: This review could contribute to optimize the quality of the ethical reflection support by initiating an evolution from an empirical, partial and individual-dependent support to a more systematized, professionalized and exhaustive support. In this article we will draw on experiences from our own research on deep brain stimulation of the central thalamus in the minimally conscious state. We describe ethical challenges faced in clinical research involving medical devices and offer several cautionary notes about its funding and the interplay of market forces and scientific inquiry and suggest some reforms.

As in other societies, medical professionalism in the Peoples’ Republic of China has been rapidly evolving. One of the major events in this process was the endorsement in 2005 of the document, “Medical Professionalism in the New Millennium: A Physician Charter,” by the Chinese Medical Doctor Association (hereafter, the Charter). More recently, a national survey, the first on such a large scale, was conducted on Chinese physicians’ attitudes toward the fundamental principles and core commitments put forward in the Charter. Based (...) on empirical findings from that study and comparing them to the published results of a similar American survey, the authors offer an in-depth interpretation of significant cross-cultural differences and important transcultural commonalities. The broader historical, socio-economic, and ethical issues relating to salient Chinese cultural practices such as family consent, familism (the custom of deferring decisions to family members), and the withholding of medical information, as well as controversial topics such as not respecting patients’ autonomy, are examined. The Chinese Survey found that Chinese physicians supported the principles of the Charter in general. Here we argue that Chinese culture and traditional medical ethics are broadly compatible with the moral commitments demanded by modern medical professionalism. Methodologically and theoretically—recognizing the problems inherent in the hoary but still popular habit of dichotomizing cultures and in relativism—a transcultural approach is adopted that gives greater (due) weight to the internal moral diversity present within every culture, the common ground shared by different cultures, and the primacy of morality. Genuine crosscultural dialogue, including a constructive Chinese-American dialogue in the area of medical professionalism, is not only possible, but necessary. (shrink)

Solid state physics, the study of the physical properties of solid matter, was the most populous subfield of Cold War American physics. Despite prolific contributions to consumer and medical technology, such as the transistor and magnetic resonance imaging, it garnered less professional prestige and public attention than nuclear and particle physics. Solid State Insurrection argues that solid state physics was essential to securing the vast social, political, and financial capital Cold War physics enjoyed in the twentieth century. Solid state’s technological (...) bent, and its challenge to the “pure science” ideal many physicists cherished, helped physics as a whole respond more readily to Cold War social, political, and economic pressures. Its research kept physics economically and technologically relevant, sustaining its cultural standing and policy influence long after the sheen of the Manhattan Project had faded. (shrink)

Recent research in moral psychology highlights the role of emotion and intuition in moral judgment. In the wake of these findings, the role and significance of moral reasoning remain uncertain. In this article, we distinguish among different kinds of moral reasoning and review evidence suggesting that at least some kinds of moral reasoning play significant roles in moral judgment, including roles in abandoning moral intuitions in the absence of justifying reasons, applying both deontological and utilitarian moral principles, and counteracting automatic (...) tendencies toward bias that would otherwise dominate behavior. We argue that little is known about the psychology of moral reasoning and that it may yet prove to be a potent social force. (shrink)

It is argued that John Rawls’ theory of social justice as well as the contract argument for it are misleading, if not actually mistaken, in that they appear to take institutional features of societies as fundamental objects of moral evaluation. An alternative view: is expounded. Principles involving institutional features are only contingently related to principles involving the distribution of things people care about. These distributions are taken as the fundamental objects of moral evaluation. Social, political and economic institutions are means (...) to achieve more desirable distributions. It is argued that the alternative provides a more accurate reconstruction of the moral foundations of social-democratic liberalism than does Rawls’ theory. (shrink)

In this response to Paul Gaffney’s “The Nature and Meaning of Teamwork,” I draw on recent work in analytic social philosophy to provide a more robust vocabulary for understanding teamwork as a distinctly social fact. I argue that teamwork entails complex reflexive social cooperation aimed at achieving shared excellence within constraints of various kinds.

ReedAs aeneas ranges the battlefield in search of Turnus and the Aeneid storms toward its close, an odd note sounds. A Trojan named Thymbraeus slays a Rutulian named Osiris. Neither is mentioned before or again. Even when one considers the diversity in this poem of names of Italian warriors, which Virgil takes not just from Italian traditions but from all over (...) the Mediterranean world,1 Osiris is surprising. Why does the name of an Egyptian god intrude into a primeval scene of Roman origins? The reader cannot ignore this provocation, especially on recollecting the rich patterns of meaning that such a contemporary of Virgil as Tibullus works into his elegy on Messalla’s birthday through an invocation of Osiris.2 So unexpected is the name that Bergk emended Osirim to Osinim, recalling the Italian king Osinius mentioned at 10.655.3 But emendation is misguided: as this paper will argue, the suggestiveness of the name is satisfied on the levels of history, ideology, religion, and literary influence, all major domains of Virgil’s epic. And the slaying of Osiris by Thymbraeus can be shown to emblematize both the whole mission of Aeneas and the achievement of Augustus.Aeneas, cured of the wound on his thigh, arms himself and, with some final words of instruction to his son, goes into battle seeking Turnus. In a memorable simile, he is compared to a storm that brings horror to farmers and ruin to their crops. His example rouses his fellow Trojans against the Italians: ferit ense gravem Thymbraeus Osirim, Arcetium Mnestheus, Epulonem obtruncat Achates Ufentemque Gyas; cadit ipse Tolumnius augur, primus in adversos telum qui torserat hostis.(12.458–61)[End Page 399]With his sword Thymbraeus smites the gravem Osiris. The adjective is equivalent to fortis, according to Servius Auctus; Forbiger prefers a denotation of towering size, comparing gravis as epithet of the boxer Entellus at 5.437 and 447.4 “Massive” might capture the sense in English. The effect here is to highlight Thymbraeus’ prowess. Like Osiris, two of the other Italian victims, Arcetius and Epulo, are unknown except for this passage. (The important Ufens received six lines at 7.744–49, in the catalogue of Latin allies,5 and Tolumnius, as line 461 reminds us, began this phase of the battle at 12.257–67.)6 But both their names etiologize some ancestral Italic or Roman institution: Epulo suggests a prototype of the college of epulones, priests of Jupiter Epulo;7 Arcetius invites a connection with the Italian gens Arquitia.8 In this they are like their enemy Mnestheus, supposed eponym of the gens Memmia (5.117). Osiris stands alone among his compatriots in his nomenclatural irrelevance to anything Roman. The catalogue here is introduced by a pair of unknown warriors.The two belong together and give each other meaning. If the name of Osiris applied to a follower of Turnus reduces the critic to perplexity and silence, we can approach its significance through that of the name of Thymbraeus, which has obvious relevance to the whole drift of the epic. Thymbraeus reprises a Thymbraeus killed by Diomedes in Iliad 11.320–21, also mentioned only once. Virgil has revived the obscure Trojan, as it were, to permit him the victory at last; the fact that each Thymbraeus is hapax legomenos in his epic reinforces the reference, especially for such learned readers as Virgil himself was and expected in [End Page 400] his audience.9 The name itself, “the Thymbraean man,” comes from the town Thymbra near Troy (first attested in Il. 10.430),10 and so unmistakably marks the first warrior in Virgil’s catalogue as a representative survivor of the fallen city. This article examines the interpretive dimensions of human action. Although it takes the reflexive sociology of Pierre Bourdieu as its starting point, the article attempts to develop a more robust hermeneutical account of the reflexivity of social actors and those who study them than Bourdieu himself has considered. It is argued that interpretation is best understood not as the homologous expression of inculcated structures but rather as context-sensitive and reflexively context-transforming action—or what the author wishes to characterize, respectively, as first- (...) and second-order thematizations of embeddedness. BackgroundThe Freedom of Information Act (FOIA) provides access to unreleased government records that can be used to enhance the transparency and integrity of biomedical research. We characterized FOIA requests to Department of Health and Human Services (HHS) agencies, including request outcomes, processing times, backlogs, and costs.MethodsUsing HHS FOIA annual reports, we extracted data on the number of FOIA requests received and processed by HHS agencies between 2008 and 2017, as well as request outcomes. Processing times were reported in three time (...) increments, < 1–20, 21–60, or 61+ days, and trends in backlog status were also described. Information about costs and fees collected were aggregated.ResultsBetween 2008 and 2017, 69.6% of 530,094 HHS FOIA requests were received by the Centers for Medicare and Medicaid Services (CMS), 18.9% by the Food and Drug Administration (FDA), and 11.6% by all other HHS agencies. During this period, CMS processed 374,728 requests, FDA 114,938, and other HHS agencies 61,890. CMS and FDA reduced backlogged requests by 9396 (89.7%) and 4289 (65.3%), respectively, leaving backlogs of 1081 and 2279 requests at the end of 2017. CMS fully or partially granted 60.3% of requests whereas FDA fully or partially granted 72.4%. Of all requests to CMS, 82.0% were considered simple and 18.0% complex; 82.2% of simple requests and 54.9% of complex requests were processed in 20 days, and 5.6% and 29.9% were processed in 61+ days. In contrast, 60.2% of requests to FDA were considered simple and 39.8% complex; 28.8% of simple requests and 9.0% of complex requests were processed in 20 days, and 58.3% and 81.5% were processed in 61+ days. The costs to HHS associated with FOIA requests totaled $446.4 million ($809 per processed request), increasing from $28.1 million ($423 per request) in 2008 to $53.3 million ($1544 per request) in 2017. In total, HHS collected $8.5 million in fees (1.9% of total costs).ConclusionsFOIA is frequently used to obtain information about HHS and its agencies. With growing costs, minimal fees collected, and lengthy processing times, HHS agencies’ FOIA programs might be made more efficient through greater proactive record disclosure. (shrink)

Much of the recent discussion of problematic aspects of quantum-mechanical measurement centers around that feature of quantum theory which is called "the projection postulate." This is roughly the claim that a change of a certain sort occurs in the state of a physical system when a measurement is made on the system. In this paper an argument for the projection postulate due to von Neumann is considered. Attention is focused on trying to provide an understanding of the notion of "the (...) state of a physical system" which is compatible with the argument von Neumann offers. An attempt is made to formulate the argument in terms of an objectivistic interpretation of probability concepts. It is seen that such an interpretation does not provide a suitable way of understanding the argument. An attempt is made to illustrate the source of this failure in terms of a non-quantum-mechanical example. (shrink)
