Informed consent is a perennial topic in bioethics. It has given the field a place in clinical practice and the law and is often the starting point for introductory instruction in medical ethics. One would think that nearly everything has been said and done on this well-worn topic.

Background The globalization of medical science carries for doctors worldwide a correlative duty to deepen their understanding of patients' cultural contexts and religious backgrounds, in order to satisfy each as a unique individual. To become better informed, practitioners may turn to MedLine, but it is unclear whether the information found there is an accurate representation of culture and religion. To test MedLine's representation of this field, we chose the topic of death and dying in the three major monotheistic religions. Methods (...) We searched MedLine using PubMed in order to retrieve and thematically analyze full-length scholarly journal papers or case reports dealing with religious traditions and end-of-life care. Our search consisted of a string of words that included the most common denominations of the three religions, the standard heading terms used by the National Reference Center for Bioethics Literature (NRCBL), and the Medical Subject Headings (MeSH) used by the National Library of Medicine. Eligible articles were limited to English-language papers with an abstract. Results We found that while a bibliographic search in MedLine on this topic produced instant results and some valuable literature, the aggregate reflected a selection bias. American writers were over-represented given the global prevalence of these religious traditions. Denominationally affiliated authors predominated in representing the Christian traditions. The Islamic tradition was under-represented. Conclusion MedLine's capability to identify the most current, reliable and accurate information about purely scientific topics should not be assumed to be the same case when considering the interface of religion, culture and end-of-life care. Neuropsychiatric disorders introduce distinct challenges to clinical decision-making. Affected patients often experience impairments or absences in rationality, lucidity and cogni-emotional capacities, rendering it difficult for them to engage in the decision-making process. In turn, dynamics of the patient-physician relationship become strained, including when physicians employ bioethical principlism or moral case deliberation to arrive at ethically justified courses of action–both of which require sufficient communication and rationality that may be impaired or altogether absent in the presence of psychopathology. The complexity of (...) neuropsychiatric conditions therefore compels interrogation towards how ethics consultations are currently constructed and conducted when full communication or rational decision-making cannot be assumed. Delany et al, for example, present a robust, methodical framework for ethical deliberation.1 Such methodologies for facilitating ethical decision-making, although valuable in predominant contexts, assume full participant engagement and decision-making capacities (eg, independent moral agency). Neuropsychiatric disorders complicate this assumption, making it difficult for patients with limited decision-making capacity to engage meaningfully in proposed ethics consultations.2 This paper will explore how neuropsychiatric disorders complicate the assumptions of full participant engagement underlying ethical frameworks. It will argue that, by adapting ethics consultations to function as a ‘mental prosthesis’, clinicians can better navigate the ethical challenges posed by neuropsychiatric disorders, helping to ensure that patient autonomy is upheld even in cases of impaired cognitive …. Diseases causing inherited retinal degeneration in humans, such as retinitis pigmentosa and macular dystrophy, are genetically heterogeneous and clinically diverse. More than 40 genes causing retinal degeneration have been mapped to specific chromosomal sites; of these, at least 10 have been cloned and characterized. Mutations in two proteins, rhodopsin and peripherin/RDS, account for approximately 35% of all cases of autosomal dominant retinitis pigmentosa and a lesser fraction of other retinal conditions. This target article reviews the genes and mutations causing retinal (...) degeneration and proposes mechanisms whereby specific mutations lead to particular clinical consequences, that is, the relationship between genotype and phenotype. Retinitis pigmentosa and macular dystrophy are genetically heterogeneous diseases that cause retinal degeneration in humans and often result in severe visual impairment or blindness. Although many of the genes causing these diseases have not been identified, three photoreceptor-specific proteins have been implicated: rhodopsin, peripherin/RDS, and the P-subunit of rod phosphodiesterase. Mutations in the genes for these three proteins can cause either dominant retinitis pigmentosa, recessive retinitis pigmentosa, dominant congenital stationary night blindness, or dominant macular degeneration. Why this multiplicity of clinical phenotypes? Our target article summarizes the genetic and biochemical background to this question and proposes a number of possible explanations. Discussion focuses mainly on 73 distinct disease-causing mutations of rhodopsin. We feel that rhodopsin and other photoreceptor proteins can serve as model systems for unraveling the connection between genotype and phenotype, not only for inherited retinal diseases but for other degenerative disorders as well. Recent findings emphasize the complexity, both genetic and functional, of the manifold genes and mutations causing inherited retinal degeneration in humans. Knowledge of the genetic bases of these diseases can contribute to design of rational therapy, as well as elucidating the function of each gene product in normal visual processes.

This paper analyses and criticizes Joseph Raz's attacks on coherentist theories. It is argued that Raz's characterisation of epistemic coherence theories is too narrow and that his criticism of constitutive coherence theories is based on a conceptual mistake in his own description. The study is an indirect argument to rethink coherence theories of law and adjudication within a more powerful framework than that propounded by Raz.

This article contends that Dworkin's notion of ‘genuine’ theoretical disagreements, which is a fundamental pillar in his criticism of legal positivism and semantic disagreements, requires a realist reinterpretation. This view is defended according to two core arguments. First, a realist reinterpretation of ‘genuine’ theoretical disagreements enables Dworkin to avoid semantic criticisms such as the one advanced by Joseph Raz, who propounds a sophisticated model of criterial semantics to explain theoretical disagreements. Second, to make intelligible the distinction between theoretical and (...) semantic disagreements in law, we need to resort to realist elements. The conclusion is striking and in clear contradiction with Dworkin's ametaphysical and epistemic abstinence. The article shows that there is a problematic tension within Dworkin's constructivist project and that he should revise either its ametaphysical view and epistemic abstinence, or notions such as ‘genuine’ theoretical disagreements. Investigaciones previas muestran que existe una importante relación entre la capacidad de los estudiantes para realizar una descomposición morfológica de las palabras y sus habilidades para adquirir vocabulario. El objetivo de esta investigación fue evaluar la reproducibilidad de un proyecto didáctico en torno a la descomposición de palabras como estrategia para adquirir vocabulario en estudiantes de tercer grado de secundaria. Participó un grupo experimental cuyas habilidades de descomposición morfológica se compararon en un pre y post-test con las de un grupo (...) control. Los resultados mostraron en el grupo experimental un incremento en las habilidades para segmentar las palabras, aunque no hubo diferencias significativas entre grupos en la obtención del significado de palabras. Un análisis cualitativo de las emisiones del docente y de los estudiantes señaló factores importantes a tomar en cuenta para la reproducibilidad de un proyecto didáctico de esta índole en la escuela secundaria. This paper uses social capital theory to explain contemporary slavery in the context of American professional sports leagues. While traditional slavery was legallyabolished in the United States (US) during the nineteenth century, using the label slavery to describe professional athletes is often dismissed because these athletes are wellcompensated performers with access to incremental compensation through commercial endorsements. As active players, athletes have opportunities to build and leverage social capital, yet, after they retire from competition, these opportunities frequently diminish. We contend (...) contemporary slavery exists for professional athletes and during their careers they are bound to their owners via “gilded cage” slavery, which is attractive to enter yet difficult to exit. We also contend that during this “bondage,” athletes build and maintain social capital; yet upon retirement, athletes are limited in opportunities to leverage socialcapital to improve their own situations or those of their communities. The thesis that in social sciences causal explanations are possible only in terms o mechanisms due to the lack of genuine laws has been increasingly popular among social scientist and philosophers. In this article it is examined whether the explanation by mechanism is necessarily an explanation without laws or, on the contrary, it can involve some kind o laws. To this end it is argued, firstly, that mechanisms are not always the antonym of law insofar as they express propensities and (...) so tendencies; secondly, that these tendencies ar causal and entail capacities and dispositions; thirdly, that capacities and dispositions involve in human behaviour have to face the problem of free will; and finally, reasons are offered i favor of considering causal tendencies as authentic laws. The ultimate aim of this article is to demonstrate that explanation of social facts can involve well-established laws in its explanans although they are not universal laws. (shrink)

Although Shanker & King disregard the behavioral paradigm, their arguments are reminiscent of those in Skinner 's Verbal Behavior. Like S&K, Skinner maintained that communication is not appropriately characterized as the transmission of information between individuals. In contrast to the paradigm advocated by S&K, however, the behavioral paradigm emphasizes prediction and control as important scientific goals.

Psychobiography has been a topical area and an applied research specialty in psychology since Freud’s (1910/1989) influential psychoanalytic psychobiography of Leonardo da Vinci. Throughout the last century, psychobiographers have emphasized the importance of anchoring interpretations of life histories in established psychological theories and rigorous historiographic research methods. One topical area receiving less attention in psychobiography is the critical relationship between the psychobiographer and her or his subject as it relates to the process of psychobiographical writing. The present article explores the (...) phenomenology and challenges of this relationship in order to ultimately propose practical strategies for navigating countertransference issues throughout the subject selection, research and publication phases of psychobiography. Freud’s psychobiography of Leonardo da Vinci is used as a model of the stages of psychobiography, the evolution of the psychobiographer-subject relationship, and the challenges of countertransference. P. Goold, Catullus: Edited with Introduction, Translation, and Notes, 2d ed. (London 1989; 1st (...) ed., 1983), and Guy Lee, Catullus: Edited with a Translation and Brief Notes (Oxford 1990). The proportion of commentary varies considerably among the three editions. Goold's notes are very brief, occupying less than one-sixth the number of the pages of the text plus translation; they identify references mostly, or sketch a background, either historical or personal. Lee's notes, somewhat more devoted to language and interpretation, amount to one-fourth. In Godwin's book the commentary equals the text and translation. This, clearly, is intended to be the author's chief contribution, and indeed it is easily the most valuable part. (In the same format he dealt with the longer poems, 61-68, in a volume published in 1995.) Rather than an editor or translator, Godwin is an interpreter of literature.Most parts of the introduction are reliable. "Catullus' Life and Times" balances familiar scholarly positions with criticism. Against Ross's view (originating with Reitzenstein, actually) that the poet applied the language of politics to love, he cites Lyne's, that poet and politician alike used the language of the governing class. He is skeptical of identifying Lesbia with Clodia Metelli. The next section describes the performance of poetry, an important subject, if less obvious. The discussion of poets' financial rewards here would be less neat had the instructive researches of Peter White been taken into account (JRS 64 [1974]: 40-61; HSCP 79 [1975]: 265-300; JRS 68 [1978]: 74-92). Godwin afterward sets forth well first the poetic standards and strivings of Catullus and his fellow-neoterics, then the major interpretative strategies practiced by literary critics: biography, New Criticism, New Historicism, and attention to intertextuality, to the arrangement of poems, to their closure (but not structuralism or deconstruction). His own stance is characterized by a keen awareness of the literary artifact, and this will make for some fine, persuasive interpretations.The section on meter, however, is seriously defective. Addressed to the rank beginner, who is taught when syllables are long, when short, what elision is, and which patterns of longs and shorts constitute the various meters, it is bound to mislead in important ways. It ignores prodelision (which Goold, for the sake of correct reading, represents in his text: gratumst, for example). Nowhere does it say that the fifth foot of a hexameter is regularly a dactyl, much less that the substitution of a spondee there is a neoteric affectation (see Cic. Att. 7.2.1). It claims that "the second half of the pentameter is in the overwhelming majority of cases dactylic" (17, my emphasis). For iambic senarii and choliambics it fails to mention the caesura. Lack of attention to meter probably explains why Godwin prints vehemens (rather than vemens) at 50.21 and vastasque paludesque at 115.5 (no other verse among the elegiacs is hypermetric, though 64.298 is), and also why in the commentary on poem 4 he does not draw attention to Catullus' tour [End Page 283] de force in writing pure iambics; this would have strengthened his point that the verse gives "the movement of the poem a swift impetus appropriate to the movement of the yacht" (117). The last part of the introduction is a concise statement of how the text has been transmitted.The text here printed is Godwin's own. Let it be compared with Goold's, which is, in my opinion, the truest ever produced--comprehensive in understanding the sources, fearless in replacing manuscript nonsensicalities with Catullan sense and elegance, from start to finish marked by sound judgment.
