This article draws on key models of monitoring and blockholding articulated in the incomplete contracts theory of the firm. Under incomplete contracts theory, different governance systems have incentive structures that entail different tradeoffs—tradeoffs between ownership concentration and liquidity, between monitoring and management initiative, and between private rent-seeking and activity benefiting shareholders as a group. The tradeoffs delimit opportunities for productive cross-reference. More specifically, blockholder systems, such as those in Europe, subsidize monitoring by permitting blockholders to reap private benefits of control (...) through self-dealing and insider trading. Market systems, such as those in the United States and Britain, regulate such private rent-seeking toward the end of maintaining an institutional framework that supports diffuse share ownership and liquid trading markets. It follows that a legal framework conducive to blockholding may be ill-equipped to foster dispersed equity ownership and thick trading markets and that a legal framework conducive to liquid trading markets may have properties that discourage blockholding. This gives rise to questions for law reform agendas on both sides of the Atlantic. In the United States, proponents ask for deregulation of controls on institutional investors, looking to encourage blockholding and more effective monitoring. In Europe, proponents ask for stronger securities regulation, looking to encourage deeper trading markets. This article suggests that each reform program may lead to disappointing results because neither assures conforming adjustments to the pertinent actors’ incentives. Alternatively, strict reforms that materially change prevailing incentive patterns could perversely destabilize workable arrangements without assuring the appearance of more effective alternatives. Naturalism in the philosophy of science has proceeded differently than the familiar forms of meta-philosophical naturalism in other sub-fields, taking its cues from “science as we know it” (Cartwright in The Dappled World, Oxford University Press, Oxford, 1999, p. 1) rather than from a philosophical conception of “the Scientific Image.” Its primary focus is scientific practice, and its philosophical analyses are complementary and accountable to empirical studies of scientific work. I argue that naturalistic philosophy of science is nevertheless criterial for (...) other versions of meta-philosophical naturalism; relying on a conflicting conception of scientific understanding would constitute a “first philosophy” imposed on the sciences. Moreover, naturalistic philosophy of science provides the basis for a “radically” naturalistic alternative to the familiar forms of orthodox or liberal naturalism. Goodman, Sellars and Hempel had previously challenged empiricist scruples against causal connections or nomological necessity by arguing that scientific concepts already had modal import. The radical naturalism I defend similarly challenges meta-philosophical naturalists’ conception of the Scientific Image as anormative, and instead shows how the normativity of scientific understanding in practice is a scientifically intelligible natural phenomenon. This account then provides a basis for naturalistic reflection on how other practices and normative concerns fit together with the best scientific understanding of human ways of life. (shrink)

The inclusion of morally binding values such as religious—or in a broader sense, spiritual—values fundamentally alter organizational decision-making and ethical behavior. Family firms, being a particularly value-driven type of organization, provide ample room for religious beliefs to affect family, business, and individual decisions. The influence that the owning family is able to exert on value formation and preservation in the family business makes religious family firms an incubator for value-driven and faith-led decision-making and behavior. They represent a particularly rich and (...) relevant context to re-assess the relationship between ethical beliefs, decision-making processes and behaviors in business organizations at the interface between family and professional logics. This Special Issue is dedicated to deepening our understanding of the role religious values and spirituality play in the formation of organizational ethical practices in faith-led family firms and resulting organizational and family-related outcomes. In this editorial, we introduce the 10 papers included in this Special Issue, which investigate the relationship between religion or spirituality and family firm ethical behavior in various geographical, cultural and religious contexts, using a multitude of qualitative and quantitative methodologies. By focusing on the effects of religious or spiritual orientations on both the business and the family, as well as on the values, norms and goals present in the family business system, further research can gain a more nuanced understanding of the relationship between religious and spiritual believes, and sustainable ethical behavior in family firms. Abstract:The titular question, of what makes a disorder 'mental,' has an obvious answer: mental disorders are disorders of the mind. I argue that this is not so, before proposing a positive theory of what makes a disorder 'mental,' that what makes a disorder 'mental' is its relationship to psychiatry. The overall thrust of my argument is that mental disorder is mental in name only—to have a mental disorder is not to have a disorder of the mind. Instead, mental disorder is (...) psychiatric disorder, a class of conditions grouped together not because of anything to do with the mind, but because of their relationship to psychiatry, a concrete group of methods, practices, and institutions. Generalization is a fundamental problem solved by every cognitive system in essentially every domain. Although it is known that how people generalize varies in complex ways depending on the context or domain, it is an open question how people learn the appropriate way to generalize for a new context. To understand this capability, we cast the problem of learning how to generalize as a problem of learning the appropriate hypothesis space for generalization. We propose a normative mathematical framework for learning (...) how to generalize by learning inductive biases for which properties are relevant for generalization in a domain from the statistical structure of features and concepts observed in that domain. More formally, the framework predicts that an ideal learner should learn to generalize by either taking the weighted average of the results of generalizing according to each hypothesis space, with weights given by how well each hypothesis space fits the previously observed concepts, or by using the most likely hypothesis space. We compare the predictions of this framework to human generalization behavior with three experiments in one perceptual (rectangles) and two conceptual (animals and numbers) domains. Across all three studies we find support for the framework's predictions, including individual‐level support for averaging in the third study. (shrink)

Analytic debates about truth are wide-ranging, but certain key themes tend to crop up time and again. The three themes that we will examine in this paper are (i) the nature and behaviour of the ordinary concept of truth, (ii) the meaning of discourse about truth, and (iii) the nature of the property truth. We will start by offering a brief overview of the debates centring on these themes. We will then argue that cross-linguistic experimental philosophy has an indispensable yet (...) underappreciated role to play in all of these debates. Recognising the indispensability of cross-linguistic experimental philosophy should compel philosophers to significantly revise the ways in which they inquire about truth. It should also prompt analytic philosophers more generally to consider whether similar revisions might be necessary elsewhere in the field. (shrink)

A defining characteristic of Alzheimer’s disease is difficulty in retrieving semantic memories, or memories encoding facts and knowledge. While it has been suggested that this impairment is caused by a degradation of the semantic store, the precise ways in which the semantic store is degraded are not well understood. Using a longitudinal corpus of semantic fluency data, we derive semantic network representations of patients with Alzheimer’s disease and of healthy controls. We contrast our network-based approach with analyzing fluency data with (...) the standard method of counting the total number of items and perseverations in fluency data. We find that the networks of Alzheimer’s patients are more connected and that those connections are more randomly distributed than the connections in networks of healthy individuals. These results suggest that the semantic memory impairment of Alzheimer’s patients can be modeled through the inclusion of spurious associations between unrelated concepts in the semantic store. We also find that information from our network analysis of fluency data improves prediction of patient diagnosis compared to traditional measures of the semantic fluency task. (shrink)

In early 2017, Nevada amended its Uniform Determination of Death Act, in order to clarify the neurologic criteria for the determination of death. The amendments stipulate that a determination of death is a clinical decision that does not require familial consent and that the appropriate standard for determining neurologic death is the American Academy of Neurology’s guidelines. Once a physician makes such a determination of death, the Nevada amendments require the withdrawal of life-sustaining treatment within twenty-four hours with limited exceptions. (...) Neurologists have generally supported Nevada’s amendments for clarifying the diagnostic standard and limiting the ability of family members to challenge it. However, it is more appropriate to view the Nevada amendments with concern. Even though the primary purpose of the UDDA is to ensure that all functions of a person’s entire brain have ceased, the AAN guidelines do not accurately assess this. In addition, by characterizing the determination of death as solely a clinical decision, the Nevada legislature has improperly ignored the doctrine of informed consent, as well as the beliefs of particular faiths and cultures that reject brain death. Rather than resolving controversies regarding brain death determinations, the Nevada amendments may instead instigate numerous constitutional challenges. (shrink)

Since the introduction of the concept of brain death by the Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death in 1968, the validity of this concept has been challenged by medical scientists, as well as by legal, philosophical, and religious scholars. In light of increased criticism of the concept of brain death, Stephen Napier, a staff ethicist at the National Catholic Bioethics Center, set out to prove that the whole-brain death criterion serves as (...) good evidence for death in the Catholic bioethical framework, on the grounds that when whole-brain death has occurred the soul has already departed from the body. Opponents have argued that (1) brain death does not disrupt the somatic integrative unity and coordinated biological functioning of a living organism and (2) clinical tests outlined in the practice guidelines for determining brain death lack sufficient power to exclude persisting function and fail to detect elements of the brain that, although currently functionless, may retain potential for recovery under conditions of optimal medical care. It is therefore possible that heart-beating organ procurement from patients with impaired consciousness is de facto a concealed practice of active euthanasia and physician-assisted death, both of which, either concealed or overt, the Catholic Church opposes. Stanislas Breton's _A Radical Philosophy of Saint Paul_, which focuses on the political implications of the apostle's writings, was an instrumental text in Continental philosophy's contemporary "turn to religion." Reading Paul's work against modern thought and history, Breton helped launch a reassessment of Marxism, introduce secular interpretations of biblical and theological traditions, develop "radical negativity" as a critical category, and rework modern political ideas through a theoretical lens. Newly translated and critically situated, this edition takes a fresh approach to Breton's (...) classic work, reacquainting readers with the remarkable ways in which an ancient apostle can reset our understanding of the political. Breton begins with Paul's biography and the texts of his conversion, which challenge common conceptions of identity. He broaches the question of allegory and divine predestination, introduces the idea of subjectivity as an effect of power, and confronts Paul's critique of Law, which leads to an exploration of the logics and limits of agency and power. [Peter Simons] Commonsense ontology contains both continuants and occurrents, but are continuants necessary? I argue that they are neither occurrents nor easily replaceable by them. The worst problem for continuants is the question in virtue of what a given continuant exists at a given time. For such truthmakers we must have recourse to occurrents, those vital to the continuant at that time. Continuants are, like abstract objects, invariants under equivalences over occurrents. But they are not abstract, and their being invariants (...) enables us to infer both their lack of temporal parts and that non-invariant predications about them must be relativized to times. \\\ [Joseph Melia] In this paper I try to eliminate occurrents from our ontology. I argue against Simons' position that occurrents are needed to supply truthmakers for existential claims about continuants. Nevertheless, those who would eliminate occurrents still need some account of our willingness to assert sentences that logically entail their existence. Though it turns out to be impossible to paraphrase away our reference to occurrents, I show that the truthmakers for such sentences are facts that involve only continuants. This is enough to allow us to regard our ordinary talk about occurrents as fictional. Finally, I argue that a proper conception of the underlying temporal facts about continuants can both avoid the problematic tensed theory of time and the problem of temporary intrinsics. (shrink)

Two recent practice-based conceptions of linguistic communication challenge the dominant “content-delivery” models. Beaver and Stanley’s The Politics of Language (2023) and Rouse’s Social Practices as Biological Niche Construction (2023) have different aims. Beaver and Stanley develop an account of linguistic meaning as affective and politically engaged. Rouse starts from evolutionary accounts of human ways of life to situate language within a more general, naturalistic account of social practices as forms of biological niche construction. Despite their different orientations, the two books (...) can work together as a more compelling challenge to standard accounts of linguistic meaning and communication. (shrink)

The starting point of Joseph Margolis' last philosophical effort is represented by the problem of the human "gap" in animal continuity: "There appear to be no comparable variants of animal evolution [...] effected by anything like the culturally enabled creation". While we share with other animals more or less refined forms of societal life, acquiring a natural language remains a distinctively human character: although it is grounded in the completely natural favourable changes in the human vocal apparatus and brain, (...) the merely causal emergence of language in humans reacts back into human primates by transforming them into persons or selves. The artifactuality of persons appears to be at the same time a natural and emergent phenomenon, constituting the other side of the process of language acquisition both by early hominids and by human infants. In this perspective the largely informal, mongrel and approximate functionality of ordinary language is interpreted as a good tool for the cultural animal to cope with the world, while the collective dimension of human forms of life appears as the shared context of external and internal constitution of the human selves. IN A RECENT ARTICLE, the late Isaac Franck presented both Maimonides and Aquinas as prominent proponents of negative theology; he went on to defend negative theology against a number of contemporary criticisms. More specifically, Franck set out to defend what he called "a radical negative theology." By this he meant.

This book explores the metaphysical underpinnings of theories of human nature, personhood, and the self. Fogelin posits, and Flew with reservations acknowledges, a "traditional interpretation" consisting (...) oftwo theses: TI.1 Hume did not put forward ana priori argument intended to show that miracles are not possible. TI.2 Hume did put forward an a priori argument intended to show that testimony, however strong, could never make it reasonable to believe that a miracle had occurred. (Fogelin 1990, 81) The disagreement between Fogelin and Flew could not be more complete: FogeUn thinks TLl is false and TI.2 true; Flew thinks TI.l is true and TI.2 false. Nonetheless, I disagree with both of them: I defend both theses of TI, and shall give a different (better) reason for each. FogeUn argues against TI.l by citing "clear texts... that go dead against it" (1990, 81). These are three sentences from the last but one paragraph of part 1: Amiracle is a violation ofthe laws ofnature; and as a firm and unalterable experience has established these laws, the proof against a miracle, from the very nature ofthe fact, is as entire as any argument from experience can possibly be imagined.... There must... be a uniform experience against every miraculous event, otherwise the event would not merit that appellation. And as a uniform experience amounts to a proof, there ishere a directand fullproof, from the nature ofthe fact, against the existence of any miracle; nor can such a proofbe destroyed, or the miracle rendered credible, butbyan opposite proof, which is superior.1 From these passages Fogelin constructs an argument, which I shall reconstruct as follows: Volume XLX Number 1 203 JOSEPH ELLIN 1.The proof against any miracle is direct and full unless destroyed by an opposite, superior, proof. 2.Since the proof against any miracle is as entire as any argument from experience can be imagined, there can be no opposite superior proof. Therefore: 3.The proofagainst any miracle is direct and full. FogeUn comments: "the strong claim in the second premise that the proof against a miracle is as entire as any argument from experience can possibly be imagined cancels the possibility left open in the first premise that there might be an opposite proof, which is superior. The conclusion then follows at once" (1990, 83). This argument is certainly sound; is it Hume's? Is it a priori? Does it show that miracles are not possible? Flew argues that it is not Hume's: "Proofs against proofs are no proofs" (1990, 142). Because a "proof" is a conclusive argument, there cannotbe proofs which are opposite but superior to other proofs; hence Hume's term "proof" needs some qualification: Hume means "what would in ordinary circumstances be accounted a proof, yet in the present case may conceivably not be" (Flew 1990, 144). One support for Flew is that when Hume in the previous paragraph supposes "that the testimony [for the miracle] considered apart and in itself, amounts to an entire proof " (E 114), he invokes a double standard, distinguishing the kind of evidence which, in the ordinary case, would be taken as proof, from what shouldbe so regarded in the case ofan alleged miracle (if one hundred witnesses testify that Lazarus got up from his bed and danced, this would ordinarily be taken to be proof; but not if he had died first). But though Flew has the better ofit with regard to the word "proof," 2 he hasn't made out his case against Fogelin, for it is not the word "proof" but the terms "direct and full" and "entire" that seem to carry the burden of Fogelin's reconstructed argument. Hume's distinction is between proof tout court, which means roughly a good enough case, and proof "full" or "entire," which perhaps does mean conclusive demonstration. ABSTRACT The Pātañjalayogaśāstra (PYŚ) is typically understood to define yoga as thought-suppression. In several publications, Ian Whicher has sought to avoid the conclusion that the PYŚ endorses thought-suppression by proposing that the PYŚ’s definition of yoga refers not to thought-suppression but to liberation from the puruṣa’s misidentification with the mind. I argue that Whicher’s proposal is unsuccessful because the PYŚ portrays thought-suppression as necessary for this liberation.
