Decision-making capacity in children and adolescents in healthcare requires thorough assessment: the minor's maturity, understanding of the decision, risk of the situation and contextual factors needs to be explored. The intention was to design and validate a test—the Maturtest—to assess the maturity of minors in decision-making processes in healthcare. A reasoning test on moral conflicts for adolescents was designed to infer the degree of maturity of minors applied to decision-making regarding their own health. The test was completed by a sample (...) of 441 adolescents aged from twelve to sixteen, with a corresponding analysis of their psychometric skills to measure feasibility, viability, reliability, validity, and sensitivity to change. Psychometric test results showed viability, reliability, validity, and sensitivity to change. High correlation between the test score and the reference method were notable. A high stability was obtained with an intraclass correlation coefficient. The average response time of the test was twenty-three minutes. This test measures the moral maturity of adolescents. It is presented as an objective, useful, valid, reliable tool, easy to fill out, edit and apply in a healthcare context. It helps to assess the maturity of minors faced with a decision. (shrink)

This essay begins with a look at the contribution made by Business Ethics and by Corporate Social Responsibility (CSR) to Business Education, and how the first two have moved to the last over time. Yet their contributions also reveal limitations that need to be taken into account in the debate on the training provided by Business Schools. This debate cannot be confined to speaking of disciplines and their cross-cutting natures but rather needs to focus directly on the kind of personal (...) profile fostered among business students. In the context of this debate on the future of Business Schools, the essay stresses the relevance of Peter-Hans Kolvenbach’s framework. He proposed an educational ideal based upon educating competent, conscious, compassionate, and committed people. This ideal took shape in the form of an educational paradigm integrating four dimensions: professional (_utilitas_), ethical-social (_iustitia_), humanist (_humanitas_) and spiritual (_fides_). The essay not only shows how each of these dimensions is in tune with some of the present proposals for renewing Business Education but also how Kolvenbach's more holistic approach can help to further integrate and spotlight the blind spots of each of them. Presuppositions are well known phenomena. One way of treating them is as partial 'meaning-functions '. There is an attractive argument that holds that in order to explain the contrast between such sentences as "John came into the room" and "That bastard John came into the room" it is required to make our semantic theory essentially more complex. This argument appeals to the fact that contrasts such as the ones just mentioned play a role in the validity of logical inferences. In (...) this paper I argue that these contrasts can be accounted for by appealing to presuppositions. In order to defend this view we will have to offer a characterization of logical consequence that applies to sentences that involve presuppositions. (shrink)

The last years of the 20th Century have been somewhat contradictory with respect to values like loyalty, trust or truthfulness. On the one hand, (often implicitly, but sometimes very explicitly), self-interest narrowly defined seems to be the dominant force in the business world, both in theory and in practice. On the other hand, alliances, networks and other forms of cooperation have shown that self-interest has to be at least "enlightened".The academic literature has reflected both points of view, but frequently in (...) an ambiguous way, since the concepts of loyalty and trust are somewhat elusive and equivocal. This paper attempts to analyze the concept of loyalty in depth, examining the different conceptions about the word that can be found in the literature. We begin by going to the management classics (specifically, Follett, Barnard and Simon), and we then turn to the anthropological approach of Pérez López (1993), with its built-in ethical analysis, and show how trust and loyalty are crucial to the development of organizations. We end by suggesting in what ways loyalty and trust can be created and fostered in organizations. (shrink)

In this paper two deductive systems associated with relevance logic are studied from an algebraic point of view. One is defined by the familiar, Hilbert-style, formalization of R; the other one is a weak version of it, called WR, which appears as the semantic entailment of the Meyer-Routley-Fine semantics, and which has already been suggested by Wójcicki for other reasons. This weaker consequence is first defined indirectly, using R, but we prove that the first one turns out to be an (...) axiomatic extension of WR. Moreover we provide WR with a natural Gentzen calculus. It is proved that both deductive systems have the same associated class of algebras but different classes of models on these algebras. The notion of model used here is an abstract logic, that is, a closure operator on an abstract algebra; the abstract logics obtained in the case of WR are also the models, in a natural sense, of the given Gentzen calculus. The eleven contributions are organized into three main subjects: on Wittgenstein's method, on knowledge and meaning, on language and use. In this paper, we review the conventional analyses of management control systems, to conclude, first, that the illusion of control can mislead managers into believing that everything can be controlled and monitored, and, second, that no incentive system based only on extrinsic rewards can motivate individuals properly. Then, we investigate the philosophical foundations of the basic assumptions that, implicitly or explicitly, are made about the nature of the acting person. Based on personalist phenomenology, we show how the development of technical (...) and moral values is crucial to the long-run survival of organizations. We end by offering some guidelines as to what control systems should be like in order to be compatible with the nature of human persons. (shrink)

There are many theories about organizations that are mutually inconsistent with each other, which explain phenomena to very similar extents. Most of them ignore the ethical dimension completely. In this paper I put forth the basic principles for a theory of decision-making in organizations, which integrates ethics in the core of the theory. It is based on the work of Juan Antonio Pérez López [1991, Teoría de la Acción humana en las organizaciones (Ediciones Rialp, Madrid), 1993, Fundamentos de la Dirección (...) de Empresas (Ediciones Rialp, Madrid)] and is essentially a humanistic view of the interrelationships between people and its implications for organizational decision-making. I will first show that in any relationship between two people, the learning of the two is crucial for such a relationship to last; and then I will expand on the different aspects of that learning. This analysis will then be applied to the organizational context as a basis for organizational decision-making, Second, it applies the previous analysis to the organizational context as a basis for organizational decision making, showing how any decision in an organization needs to be analyzed on the basis of three criteria (short-run effectiveness, development of distinctive competence, and unity and identification with the organization) and how ethics is included in the last two. This paper reviews the development of socially responsible investment (SRI) in the Spanish financial market. The year, 1997 saw the appearance in Spain of the first SRI mutual fund, but it was not until late 1999, that major Spanish fund managers offered SRI mutual funds on the retail market. The development of SRI in the Spanish financial market has not experienced the high levels of development seen in other European countries, such as France or Italy, where interest in SRI began (...) during the same period. This paper presents an analysis of the impact of SRI mutual funds managed by Spanish fund managers comparing the evolution of managed assets and number of investors. We also analyse the investment strategies adopted by these funds, which mainly use negative screening criteria and the participation of non-governmental organisations as institutional investors. An analysis of the take up of socially responsible investment in the Spanish financial market shows majors deficits in this process. This is due to Spanish investors having limited sensitivity to social issues and knowledge of SRI, and a lack of development of SRI investment strategies, such as engagement or shareholder activism by fund managers. Furthermore, the take-up of SRI mutual funds in the Spanish financial market coincided with a fall in the stock market at the beginning of the 21st Century. We conclude with an analysis of the relationship between SRI and Corporate Social Responsibility (CSR). (shrink)

Great importance has recently been given in studies on management to subjects such as values or organizational cultures. The fact that on dealing with these questions there are many terminological coincidences with ethics has meant that the discourse on values or organizational culture has often automatically been identified with organizational ethics. This paper questions this identification, proposing an approach to what should be understood by organizational ethics . Three ideas support this approach: an understanding of OE from a process and (...) learning approach, a presentation of 10 components that make up a reflective OE, and an understanding of how values are understood in OE, underlining four dimensions: dynamic, practical, dialogical, and committed. The paper concludes by proposing that the development of OE should be linked to the development of an organizational citizenship. (shrink)

This article examines the relevance of a theory of the multinational state for the evaluation of claims for self-determination and secession. Considerations of ?ethnocultural justice? imply that the recognition of the multinational character of a state ? or the granting of some of the minority nations' demands ? is a matter of justice. If these requirements are not met, secession could be justified. Indeed, if secession needs a just cause (as it has been argued), a failure to build a truly (...) multinational arrangement can be a valid reason for a minority nation to secede. An approach like the one proposed would also contribute to the resolution of some of the key problems of the three main theories of secession and their appeals to nationalism, choice and remedial rights. Natural languages come in two different modalities. The impact of modality on the grammatical structure and linguistic theory has been discussed at great length in the last 20 years. By contrast, the impact of modality on linguistic data elicitation and collection, corpus studies and experimental (psycholinguistic) studies is still underinvestigated (van Herreweghe/Vermeerbergen 2012; Orfanidou et al. 2015). In this paper, we address specific challenges that arise in judgement data elicitation and experimental studies of sign languages. These challenges are related to (...) the socio-linguistic status of the Deaf community and the larger variability across signers within the same community, to the social status of sign languages, to properties of ;he visual-gestural modality and its interface with gesture, to methodological aspects of handling sign language data, and to specific linguistic features of sign languages. While some of these challenges also pertain to (some varieties of) spoken languages, other challenges are more modality-specific. In addition, the special combination of the challenges discussed in this paper seems to be a specific facet empirical research on sign languages is faced with. In addition, we discuss the complementarity of theoretical approaches and experimental studies and show how the interaction of both approaches contributes to a better understanding of sign languages in particular and linguistic structures in general. Despite traditionally having been studied within the field of Musicology, the analysis of music in film should be approached as an aesthetic study of the relationship between «image» and «music» which is central to the cinematographic framework. From this interdisciplinary perspective numerous theoretical and methodological issues emerge. The aim of this article is to investigate, using both a synchronic and diachronic focus, some of the key issues arising from this joint music-image approach, in an attempt to develop a theoretical framework (...) for a joint aesthetic of music and image: a study of «cinematographic expression» that brings together the visual and the sound dimensions and which we call the «musicalised image», a neologism of our own creation. Es posible que así sea si sólo tenemos en cuenta el aspecto crematístico y prescindimos de otros aspectos, como las condiciones de trabajo, las instalaciones, el reconocimiento social, etc. Si comparamos lo que ganan los docentes con lo que ganan los futbolistas podemos incluso suponer que el sueldo de un maestro es miserable. Y lo que es peor, su prestigio, comparado con el de los futbolistas, es ínfimo. (...) Nuestra época premia el espectáculo y desvaloriza la cultura, pero hubo un tiempo en que los docentes ganaban mucho más que cualquier as de la pelota. En el texto que presentamos se hace un cálculo aproximado del valor que los griegos llegaron a dar a la cultura, los medios de transmitirla y a los factores de esa transmisión, los docentes. The concept of convention has been used in different fields and from different perspectives to account for important social phenomena, and the legal sphere is no exception. Rather, reflection on whether the legal phenomenon is based on a convention and, if so, what kind of convention is involved, has become a recurring issue in contemporary legal theory. In this book, some of the foremost specialists in the field make significant contributions to this debate. In the first part, the concept of (...) convention is analysed. The second part reflects on whether the rule of recognition postulated by Hart can be understood as a convention and discusses its potential and limitations in order to explain the institutional and normative character of law. Lastly, the third part critically examines the relations between conventionalism and legal interpretation. Given the content and quality of the contributions, the book is of interest to those wanting to understand the current state of the art in legal conventionalism as well as those wanting to deepen their knowledge about these questions. Chimpanzees follow the gaze of conspecifics and humans — follow it past distractors and behind barriers, ‘check back’ with humans when gaze following does not yield interesting sights, use gestures appropriately depending on the visual access of their recipient, and select different pieces of food depending on whether their competitor has visual access to them. Taken together, these findings make a strong case for the hypothesis that chimpanzees have some understanding of what other individuals can and cannot see. However, chimpanzees (...) do not seem nearly so skillful in the Gesture Choice and Object Choice experimental paradigms. Neither behavioral conditioning nor theory of mind explanations can account for these results satisfactorily. Instead this chapter proposes the idea that chimpanzees have the cognitive skills to recall, represent, categorize, and reason about the behavior and perception of others, but not their intentional or mental states, because they do not know that others have such states since they cannot make a link to their own. Human beings began their own evolutionary trajectory with these same skills, but then at some point in their evolution (probably quite recently) they began to understand that their own experience could serve as some kind of model for that of other persons. This allowed for even better prediction and control of the behavior of others and better communication and cooperation with them as well, and so it was an adaptation with immediate adaptive consequences that ensured its survival. It represents the final stage of a shared journey taken over the last 4 years. During this relatively short period, our citizen science practices and perspectives have rapidly evolved. In this chapter we discuss what we have learnt about the recent past of citizen science and what we expect and hope for the future.

In recent years, scholars have increasingly dedicated their attention to analyse and reflect on the topic of leadership. However, the debate has often focused on the figure of the leader, as if being a leader were a self-sufficient function in itself, understood without finalities or independent of them. I would argue that leadership is not a position that can be assumed, but, rather, a relationship that is constructed. Similarly, the question of leaders has often given rise to a deconstruction of (...) its components, without any insight as to how the reality is put together. Leadership cannot be understood solely from a technical or instrumental perspective. It is not a mere relational skill that simply requires developing competencies. The exercise of leadership always includes—explicitly or implicitly—a connection with values. Therefore, developing leadership is impossible without a personal process that develops the person’s capacity for perception, learning, interiorisation, explicit sense-making and constructing meaning. These issues are truly important at a time in which the debate on business education and its contribution is completely open, targeting the very core of business education’s reason for being. Though open, the debate can only become a truly dynamic discussion if there is a real dialogue between the different positions and traditions. For this reason, this paper proposes an anthropological and non-denominational reading of some of the fundamental meditations found in the Spiritual Exercises of Saint Ignatius which could be used as a heuristic in the debate regarding what business schools propose. This paper represents an initial step in this direction, exploring some of the potentialities of the Spiritual Exercises for business schools that do not claim any religious tradition. (shrink)

The topos of jews’ blindness, recurrent in adversos iudaeos literature, embodies in the image of blindfold Synagoga in medieval visual arts. The first part of this paper focuses on its integration in different contexts of medieval Spanish art. Diferent, but not less interesting, is the way caecitatis iudeorum is illustrated in some illuminated manuscripts of Breviari d’Amor by Matfre Ermengaud and Fortalitium Fidei by Alonso de Espina, also subject of study throughout these pages.
