This article brings forward the argument that the practical implementation of a corporate governance code cannot be realized by a compliance program alone. Its relevance in everyday business is determined by the moral values of the company culture. In this context, governance is defined as a company’s resources and capabilities, including the moral resources, to take on responsibility for all its stakeholders. A critical discussion of the agency theory, transaction cost theory, and organization theory shows that such an approach is (...) possible only when a company is not perceived as a maximizing machine for shareholders’ interests but as an economic form of cooperation of internal and external resources and stakeholders. An empiric study on 22 European corporate governance codes shows that the predominant majority of European codes orientate themselves to stakeholders and the company. The discussion of the empirical data reveals six basic principles that determine all European corporate governance codes: shareholder rights, transparency, voting rights, regulation of remuneration, design of organizational structures, and corporate social responsibility. In this volume, a diverse group of world experts in personality assessment showcase a range of different viewpoints on response distortion. Contributors consider what it means to "fake" a personality assessment, why and how people try to obtain particular scores on personality tests, and what types of tests people can successfully manipulate. The authors present and discuss the usefulness of a range of traditional and cutting-edge methods for detecting and controlling the practice of faking. These methods include social desirability scales, (...) warnings, affective neutralization, unidimensional and multidimensional pairwise preferences, decision trees, linguistic analysis, situational measures, and methods based on item response theory. In [6] Messmer and Wood proved quantifier elimination for separably closed fields of finite Ershov invariant e equipped with a (certain) Hasse derivation. We propose a variant of their theory, using a sequence of e commuting Hasse derivations. In contrast to [6] our Hasse derivations are iterative.

The discussion of whether people understand themselves and others by using theories of behaviour (theory theory) or by simulating mental states (simulation theory) lacks conclusive empirical evidence. Nichols et al. (1996) have proposed the Langer effect (Langer, 1975) as a critical test. From people's inability accurately to predict the difference in the subjective value of lottery tickets in choice and no‐choice conditions, they argued that people do not simulate behaviour in such situations. In a series of four experiments, we consistently (...) failed to replicate the original difference between choice and no‐choice under the conditions used by Nichols et al. We conclude that the replicability of the effect depends on an unknown combination of factors. As long as the target effect is not better understood and under better experimental control, it is difficult to use it as a yardstick against which the accuracy of simulation can be assessed. Theories of mind draw on processes that represent mental states and their computational connections; simulation, in addition, draws on processes that replicate (Heal 1986 ) a sequence of mental states. Moreover, mental simulation can be triggered by input from imagination instead of real perceptions. To avoid confusion between mental states concerning reality and those created in simulation, imagined contents must be quarantined. Goldman bypasses this problem by giving pretend states a special role to play in simulation (Goldman 2006 ). We (...) argue that this path leads to the resurgence of the threat of collapse (Davies 1994 ), diluting the principled distinction between simulation and theory use. Exploration of a related method of real-mental states operating in a pretend mode leads to a factually untenable model. Our main goal here is to raise this problem as a challenge for Goldman’s reconfigured simulation theory. Only at the end we will briefly sketch a possible alternative way of quarantine that preserves the replicative element of simulation and avoids collapse. Figure 1 provides a guide to our argument. Medicalized Death and the Right to Die Movement Prior to the 20th Century, most Americans died at home, surrounded by family, friends, and neighbors. Religion, not medicine, governed the death bed for there was little physicians could do for the dying. Eventually, however, advances in medicine and technology would lead to dramatic changes in the timing and location of death: patients not only began living longer, they were also dying longer, and unlike their predecessors, were more likely to die alone, (...) in institutions, and among strangers. Modern medicine, in its zeal to conquer death, had become obsessed with its curative function and ability to extend the lives of the dying. To many in the medical community, death represented failure and was something to be avoided at all costs, and like many other social problems in the United States, had become medicalized. (shrink)

We consider Perruchet & Vinter's (P&V's) central claim that all mental representations are conscious. P&V require some way of fixing their meaning of representation to avoid the claim becoming either obviously false or unfalsifiable. We use the framework of Dienes and Perner (1999) to provide a well-specified possible version of the claim, in which all representations of a minimal degree of explicitness are postulated to be conscious.

The European Rivers Network (ERN) calls for the ‘reconciliation of citizens with their rivers and lakes’, as a necessary step for freshwater protection and restoration of rivers. It co-ordinates annual river-bathing days with collective river jumps; upstream and downstream, across Europe, citizens simultaneously jump into rivers and lakes. But what is ‘reconciliation with the river'? This paper analyses that concept as the acknowledging and restoring of distorted, marginalised or blocked capabilities, and, based on this analysis, critically discusses the practical contribution (...) which the ERN makes to ‘reconciliation with the river’. Depuis 70 ans, les avocats peuvent créer des structures d’exercice pour exercer en commun la profession d’avocats. Depuis 1990, la grande innovation réside dans la possibilité pour les avocats de structurer leur activité au moyen de sociétés commerciales particulières, les sociétés d’exercice libéral (SEL), dont l’objectif est la préservation de l’indépendance et de la déontologie des professionnels qui exercent en son sein. En 2015, les avocats sont autorisés à avoir recours aux sociétés commerciales de droit commun (SA, SAS, SARL), sauf (...) celles qui confèrent à leur associé la qualité de commerçant (SNC et SCA). Ce dispositif vient d’être réformé par la très récente ordonnance no 2023-77 du 8 février 2023 qui soulève la difficile distinction entre les SEL et les sociétés de droit commun. L’étude de cette distinction met en lumière la caractéristique de ces sociétés, l’exercice en commun d’une profession libérale réglementée, dont le régime juridique est posé par des règles professionnelles d’ordre public. In his Time and Narrative, Ricœur introduces the term of “third time” to designate the middle ground between human and natural time. This time is synonymous with historical time, which is the main source of historical discourse. The third time consists of inscribing human time onto the time of nature. While historiography must strictly follow this structure, works of fiction have the freedom to explore and even create imaginative variations of time. Despite the constraints this seems to impose on historical (...) writing, this article shows that even within the tight structure of historical time, a palette of various colors and shades, akin to imaginative variations, can be observed. Historical time possesses depth and speed; it can contract and relax, motivate or prevent action, or gain various dynamics in relation to the ending it offers. (shrink)

The aim of this paper is twofold: The first part, drawing on Spinoza and Deleuze’s reading of Spinoza, develops a broad outline of what might be called a metaphysics of immanence. In the second part, I will propose to understand phenomenology in the context of this metaphysics of immanence and I will point to some methodological and ontological shifts in phenomenological research this metaphysical interpretation might entail.
