El presente artículo propone un análisis sobre el derecho a la libertad de expresión de jueces y magistrados desde la perspectiva de los estándares de derechos huma­nos en el ámbito regional e internacional, a través de la normativa y la práctica jurisprudencial al respecto. El trabajo pretende arrojar luz sobre las posibles res­tricciones a las que se podrían ver sometidos en este ámbito los miembros de la ju­dicatura con motivo del especial contenido de las funciones que desarrollan. En este artículo se presenta una propuesta formativa utilizando el cine como material cultural y fuente de conocimiento. Una película como Babel permite trabajar la globalización y la educación de la ciudadanía, con planteamientos que exigen un nuevo humanismo, una nueva relación interpersonal, conscientes de los problemas de comunicación, prejuicios y choques culturales derivados del desarrollo tecnológico. La película cuestiona esta existencia en un mundo global interrelacionado, evocando el viejo mito bíblico de la Torre de Babel haciendo énfasis en identificaciones (...) erróneas, malentendidos y oportunidades fallidas, como manos invisibles que nos guían; o el fin cuyo destino se nos escapa.Babel hace comprender la realidad de la globalización. Nos permite observar cuatro lugares tan distantes como Estados Unidos, Méjico, Marruecos y Japón, no sólo distanciados físicamente. Los cuatro países representan estilos culturales diferentes, tres formas de realización humana. Asistimos al choque, a la incomunicación personal, al aislamiento por la diferencia de cultura y la ficticia proximidad tecnológica. Vivimos juntos, pero aislados los unos de los otros. (shrink)

My purpose in this essay is to clarify and evaluate Arthur Schopenhauer's grounds for the view that happiness is impossible. I shall distinguish two of his arguments for that view and argue that both of them are unsound. Both arguments involve premises grounded on a problematic view, namely, that desires have no objects. What makes this view problematic is that, in each of the two arguments, it conflicts with Schopenhauer's grounds for other premises in the argument. I shall then propose (...) a way of fixing both arguments. The solution involves substituting the view that desires have no objects with the view that we have a desire to have desires. The latter view, I shall argue, can do the grounding work that the former does in Schopenhauer's arguments but, unlike it, the view that we desire to desire is consistent with Schopenhauer's grounds for the rest of premises in those arguments. The use in psychology of crowdsourcing platforms as a method of data collection has been increasing in popularity because of its relative ease and versatility. Our goal is to adapt the Gratitude Questionnaire–20 Items to the English language by using data collected through a crowdsourcing platform. The G20 is a comprehensive instrument that takes in consideration the different basic processes of gratitude and assesses the construct’s cognitive, evaluative, emotional, and behavioral processes. We test the psychometric properties of the English version (...) of the G20 with a Prolific user sample. We assess the adequacy of the G20 for the crowdsourcing population in its English version. A description of the characteristics of the participants is conducted. Reliability analyses reveal an optimal internal consistency of the adapted scale. The results are discussed from a cross-cultural vision of gratitude. We conclude that the Gratitude Questionnaire–20 Items, adapted to English with an American sample, is a psychometrically strong instrument to measure gratitude using crowdsourcing platforms for data collection and, therefore, a reference and useful tool in future research. Base-of-the-pyramid business models aim to achieve profitability and poverty reduction by including poor people into corporate value chains. This goal duality creates tensions. Actors’ responses to these tensions are influenced by their cognitive frames of the phenomena building the tension. Applying a cognitive perspective, I investigate how corporate actors with different frames of poverty respond proactively or defensively to the poverty–profitability tension by adapting business model elements. I find that proactive and defensive responses differ for actors holding different cognitive frames (...) of poverty. This book offers a philosophical account of memory. Memory is remarkably interesting from a philosophical point of view. Our memories interact with mental states of other types in a characteristic way. They also have some associated feelings that other mental states lack. Our memories are special in terms of their representational capacity too, since we can have memories of objective events, and we can have memories of our own past experiences. Finally, our memories are epistemically special, in that beliefs formed (...) on the basis of our memories are protected from certain errors of misidentification and justified in a way which does not rely on any cognitive capacity other than memory. The aim of the book is to explain these features of memory. It proposes that memories have a particular functional role which involves past perceptual experiences and beliefs about the past and suggests that memories have a particular content as well; they represent themselves as having a certain causal origin. The book then accounts for the feelings associated with our memories as the experience of some of the things that our memories represent; things such as our own past experiences, or the fact the memories originate in those experiences. It also accounts for the special justification for belief afforded by our memories in terms of the content that memories have. The resulting picture is a unified account of several philosophically interesting aspects of memory. (shrink)

This paper examines a novel notion of causality, namely, fuzzy-set-theoretic causality. Over the last decade, a number of conceptual models of causality, in the language of fuzzy-set theory, have appeared in the scientific literature and have been applied to empirical research. They have circulated widely from one scientific discipline to another, weaving a unifying thread through them. However, they have received no philosophical attention. Mi propósito en este trabajo es reconsiderar una de las lecturas más relevantes y provocativas que se han hecho sobre John Dewey en el mundo de habla hispana. En la primera parte reconstruyo las circunstancias que rodearon la difusión, interpretación y traducción de las obras de Dewey en el México de mediados de los años 1940, y en concreto las razones que llevaron a que la visión sociológica que José Medina Echavarría quiso dar de Dewey fuera finalmente desplazada por la (...) filosófica de José Gaos. En la segunda parte analizo la traducción y lectura que Gaos hizo de Experience and Nature de Dewey, teniendo muy presente sus comparaciones con Sein und Zeit de Heidegger . Finalmente, propongo algunas críticas a la visión que Gaos transmite de Dewey como un pensador carente de un tipo de "soberbia diabólica" propia de la verdadera gran filosofía. The purpose of this work is a reconsideration of one of the most relevant and provocative readings of John Dewey written in the Hispanic World. In the first part I reconstruct the circumstances which surrounded the publicity, interpretation and translation of John Dewey's works in the Mexico of the middle 1940's, particularly the reasons why the sociological reading of Dewey that José Medina Echavarría proposed was finally displaced by the metaphysic perspective of José Gaos. In the second part I reconsider Gaos' own translation and interpretation of Experience and Nature, taking in consideration his comparisons with Heidegger's Sein und Zeit . Finally I analyze critically Gaos' view of Dewey as a thinker whose philosophy lacked the "diabolical arrogance" that true great philosophy would seem to require. (shrink)

Summary This paper aims to bridge anthropological and cognitivist research undertaken by Gilbert Durand and Mark Johnson, who studied the phenomenon of meaning making in a similar way, although they had to use different terminology as their disciplines demanded. Durand established systematization for analyzing symbolism by taking into account the position of the body and the perceptions determining the underlying schemata of symbols. Two decades later, Mark Johnson described image schemata as gestalts having an internal structure derived from bodily perceptions. (...) Owing to these similarities, a comparison between Durand and Johnson’s theories is offered first. In the second place, I reviewed the cognitive value of the anthropological regimes of imaginaire described by Durand. During the analysis, the terminology used by these theorists (like ‘image schemata’ or ‘axiomatic schemata’) was comparatively analyzed to find common ground between their positions. In conclusion, the need for recovering theories of imagination proposed by heterodox scholars like Durand is highlighted, since they anticipate the role of images and imagination not only in language, as Johnson demonstrated, but also in the formation of anthropologically relevant symbols, which are of interest for the analysis of literature and other arts. In order to do so, I will start by analysing the first formulation of these categories in Peirce's early writings, and then I will compare them with their later formulations. Thus, we will see some their most important characteristics, namely, their universality and their dynamism, which will allow for a particular understanding of the role that logic can play in his (...) system, in a theory of scientific inquiry and, finally, in a community in general. El respeto a las decisiones autónomas de las personas se ha impuesto en la práctica médica diaria como norma reguladora de las relaciones entre profesionales y pacientes, y esto, en opinión de Alfred I. Tauber, ha puesto a la relación asistencial en una encrucijada. La ética basada en la autonomía —que es el producto de un tiempo y lugar determinados: el liberalismo inglés clásico— ha resultado tremendamente exitosa y ha sido crucial en el desarrollo de las democracias occidentales, pero a (...) juicio de Tauber es muy conflictiva en ámbitos como la medicina. El mero «traslado» de esa autonomía jurídica y liberal, casi exclusivamente preocupada por la protección de los derechos individuales, no hace sino originar un sinfín de problemas en ambos polos de la relación asistencial: genera por un lado profesionales sanitarios a la defensiva y, por otro, se convierte en muchos casos en una abstracción de dudosa utilidad para la persona enferma, pues puede hacernos olvidar la situación de desvalimiento y vulnerabilidad en que al individuo le coloca la situación de enfermedad. El objeto de este breve escrito es dejar apuntados algunos de los conflictos que surgen cuando entendemos el encuentro entre doctor y paciente en términos excesivamente «autonomistas». (shrink)

El objetivo de este ensayo es promover la reflexión sobre sobre como las emociones pueden impactar las vivencias de los usuarios de los Entornos Virtuales de aprendizaje EVA en nivel posgradual considerando una visión sistémica compleja e interdisciplinaria. El fin último de la reflexión es ofrecer un marco epistémico y teórico que oriente las acciones para usuarios e instituciones de educación superior para utilizar el sistema emocional al servicio de la permanencia dentro de la oferta académica y lejos de la (...) deserción. Los usuarios pertenecen a un grupo etario caracterizados por una historia de formación en el contexto socioantropológica cultural signado por la digitalidad. Pasar a las exigencias de un contexto analógico demanda la adaptación emocional. Se utiliza una metodología documental, enfocadas en las características contextuales, la emocionalidad como proceso adaptativo y el conectivismo como opción pedagógica y didáctica que imbrica las ventajas de la virtualidad con el desarrollo emocional adaptativo orientado al logro. La reflexión se orienta a proporcionar información que permita a usuarios e instrucciones de educación superior entrar en el dialogo recursivo para generar acciones que conduzcan el tránsito del querer hacer parte exitosa de los EVA, a lograr que ocurran las metas académicas. The aim of this paper is to defend the view that judgments based on episodic memory are immune to error through misidentification. I will put forward a proposal about the contents of episodic memories according to which a memory represents a perception of a past event. I will also offer a proposal about the contents of perceptual experiences according to which a perceptual experience represents some relations that its subject bears to events in the external world. The combination of the (...) two views will yield the outcome that the subject is always an intentional object of her own memories: In episodic memory, one remembers being the subject whose extrinsic properties were experienced in some past perception. For that reason, one cannot misidentify oneself in memory unless one is having an inaccurate memory. Thus, the source of immunity to error through misidentification in memory lies in the nature of mnemonic content. (shrink)

Projectibility has traditionally been given a prominent role in natural kind theories. However, where most of these theories take projectibility to be a necessary but insufficient feature of natural kinds, this paper defends an account of natural kinds according to which the naturalness of kinds is to be identified with their degree of projectibility only. This view follows thus the path opened by Häggqvist (2005), although it goes significantly further on two main respects. First, I develop and discuss two important (...) dimensions of projectibility that are overlooked in Häggqvist’s work. Second, I address two recent important objections (Magnus 2012 and Spencer 2015) against projectibility-based accounts. (shrink)

The purpose of this essay is to determine how we should construe the content of memories. First, I distinguish two features of memory that a construal of mnemic content should respect. These are the ‘attribution of pastness’ feature (a subject is inclined to believe of those events that she remembers that they happened in the past) and the ‘attribution of existence’ feature (a subject is inclined to believe that she existed at the time that those events that she remembers took (...) place). Next, I distinguish two kinds of theories of memory, which I call ‘perceptual’ and ‘self-based’ theories. I argue that those theories that belong to the first kind but not the second one have trouble accommodating the attribution of existence. And theories that belong to the second kind but not the first one leave the attribution of pastness unexplained. I then discuss two different theories that are both perceptual and self-based, which I eventually reject. Finally, I propose a perceptual, self-based theory that can account for both the attribution of pastness and the attribution of past existence. (shrink)

Nursing policy and healthcare reform are focusing on two, interconnected areas: person‐centred care and fundamental care. Each initiative emphasises a positive nurse–patient relationship. For these initiatives to work, nurses require guidance for how they can best develop and maintain relationships with their patients in practice. Although empirical evidence on the nurse–patient relationship is increasing, findings derived from this research are not readily or easily transferable to the complexities and diversities of nursing practice. This study describes a novel methodological approach, called (...) holistic interpretive synthesis (HIS), for interpreting empirical research findings to create practice‐relevant recommendations for nurses. Using HIS, umbrella review findings on the nurse–patient relationship are interpreted through the lens of the Fundamentals of Care Framework. The recommendations for the nurse–patient relationship created through this approach can be used by nurses to establish, maintain and evaluate therapeutic relationships with patients to deliver person‐centred fundamental care. Future research should evaluate the validity and impact of these recommendations and test the feasibility of using HIS for other areas of nursing practice and further refine the approach. (shrink)

Our memories elicit, in us, both beliefs about what the external world was like in the past, and beliefs about what our own past experience of it was like in the past. What explains the power of memories to do that? I tackle this question by offering an account of the content of our memories. According to this account, our memories are ‘token-reflexives’, in that they represent their own causal origin. My main contention will be that our memories are able (...) to provide us with evidence for the two types of beliefs due to the self-referential nature of their content. First, I will put forward a series of thought-experiments intended to raise several intuitions about the veridicality of memories. Next, I will introduce the view that memories are token-reflexives, and I will motivate it by pointing out that the view accommodates the relevant intuitions. And, then, I will return to the two types of beliefs prompted by our memories, and argue that conceiving memories as token-reflexives allows us to explain why memory has the power to elicit the two types of beliefs in us. Although most consumers are positive about socially responsible companies, in order to benefit from CSR efforts, effective and clear CSR communication is important. However, due to the constantly rising profusion of eco-labels, based on either own claims from the organization or claims made by an external third party, consumers may encounter difficulties in identifying truly responsible firms, which could result in less effective CSR initiatives, even for those responsible firms. Therefore, building on attribution theory, this study seeks to identify how (...) uncertified internal CSR claims and external third-party CSR labels should be used in order to deter greenwashing and increase positive consumer evaluations. Within a 3 × 2 design, respondents are exposed to different coffee product packages measuring their attitude toward the brand, corporate credibility, purchase intention, and scent perception, as well as perceived attributional CSR motives. Overall, findings indicate that especially an external CSR label affects consumer responses toward the firm. Moreover, perceived CSR motives serve as a mediator between an external CSR label and corporate credibility and brand attitude, respectively. These findings warrant further consideration of introducing an external multilevel rating systems by governmental law. (shrink)

Para lograr nuestro propósito se citarán y glosarán un conjunto de canciones de ese género musical que a lo largo de décadas ha pregonado la naturaleza divina de Haile Selassie, (...) la idea del regreso al África, la importancia histórica y política de Marcus Garvey, el carácter sacramental del consumo de la marihuana y el valor simbólico de los dreadlocks. The aims of this study were to analyze the peak physical demands in elite futsal by quantifying the most demanding scenarios of match play and to identify the differences between playing positions and the seasonal trend for five different rolling average time windows. The most demanding scenarios of external load from distance, speed, acceleration, and deceleration variables were obtained from 14 elite futsal players using a local positioning system during 15 official matches in the premier Spanish Futsal League. The results (...) showed an extremely large effect of the time window for all dependent variables in all positional groups. Another important finding of this study was that, in regard to the seasonal trend, only defenders reported clear moderate-large positive trends for high-speed running efforts, high-acceleration efforts, and high-deceleration efforts. Finally, moderate-large individual differences in player means for all dependent variables and clear differences between games for most dependent variables were found, suggesting how likely contextual factors may exert an influence on how “demanding” the most demanding scenarios are. The findings of this study provide coaches and strength and conditioning coaches further knowledge of the peak physical demands in elite futsal competition. This valuable information may lead to a more precise position-specific training prescription. (shrink)

Aunque la presencia de subjetividades negras no es nueva en la literatura latinoamericana, el campo no había adquirido la fuerza ni la recurrencia utópica que ha logrado en los últimos quince años. Esto se articula con el avasallante movimiento socio-político ‘afrodescendiente’ –categoría identitaria consensuada en el año 2000–, que ha creado una retórica desde la antropología, la sociología, el campo jurídico, etc. que también ha permeado el discurso literario. Propongo en este artículo que la racialización positiva y desde debajo, es (...) decir, desde los mismos sectores subalternizados, de los últimos años, ha provocado una retórica estimulante de un “deber ser” afrodescendiente que se reitera a lo largo de la obra, no solo ficcional, sino también de cierto sector de la crítica. Este trabajo intenta problematizar la fuerza con que la retórica de las producciones de identidad afrodescendiente ha ingresado en la crítica literaria hispanoamericana de los últimos años provocando, en algunos casos, lecturas generalizadoras y racializadas que naturalizanla idea de pre-existencia y transhistoricidad de un ‘ser afro’.
