The main thesis of this paper is that, whereas an intention simpliciter is a commitment to a plan of action, a conditional intention is a commitment to a contingency plan, a commitment about what to do upon (learning of) a certain contingency relevant to one’s interests obtaining. In unconditional intending, our commitment to acting is not contingent on finding out that some condition obtains. In conditional intending, we intend to undertake an action on some condition, impinging on our interests, which (...) is as yet unsettled for us, but about which we can find out without undue cost. The evidential argument from evil seeks to show that suffering is strong evidence against theism. The core idea of the evidential argument is that we know of innocent beings suffering for no apparent good reason. Perhaps the most common criticism of the evidential argument comes from the camp of skeptical theism, whose lot includes William Alston, Alvin Plantinga, and Stephen Wykstra. According to skeptical theism the limits of human knowledge concerning the realm of goods, evils, and the connections between values, (...) undermines the judgment that what appears as pointless evil really is pointless. For all we know the suffering of an innocent being, though appearing pointless, in fact leads to a greater good. In this paper I argue that no one who accepts the doctrines of skeptical theism has a principled way of avoiding moral skepticism. (shrink)

This paper shows that recent arguments from group problem solving and task performance to emergent group level cognition that rest on the social parity and related principles are invalid or question begging. The paper shows that standard attributions of problem solving or task performance to groups require only multiple agents of the outcome, not a group agent over and above its members, whether or not any individual member of the group could have accomplished the task independently.

BackgroundIn December 2014, China announced that only voluntarily donated organs from citizens would be used for transplantation after January 1, 2015. Many medical professionals worldwide believe that China has stopped using organs from death-row prisoners.DiscussionIn the present article, we briefly review the historical development of organ procurement from death-row prisoners in China and comprehensively analyze the social-political background and the legal basis of the announcement. The announcement was not accompanied by any change in organ sourcing legislations or regulations. As a (...) fact, the use of prisoner organs remains legal in China. Even after January 2015, key Chinese transplant officials have repeatedly stated that death-row prisoners have the same right as regular citizens to “voluntarily donate” organs. This perpetuates an unethical organ procurement system in ongoing violation of international standards.ConclusionsOrgan sourcing from death-row prisoners has not stopped in China. The 2014 announcement refers to the intention to stop the use of organs illegally harvested without the consent of the prisoners. Prisoner organs procured with “consent” are now simply labelled as “voluntarily donations from citizens”. The semantic switch may whitewash sourcing from both death-row prisoners and prisoners of conscience. China can gain credibility only by enacting new legislation prohibiting use of prisoner organs and by making its organ sourcing system open to international inspections. ABSTRACT William Cooney has recently argued (The Journal of Applied Philosophy, Vol. 6, pp. 201–204) that the social programme of affirmative action, though controversial, can be supported by the doctrine of double effect in that, according to the doctrine, responsibility falls on the side of intended consequences and not on that of unintended consequences. The point of affirmative action is to include certain disadvantaged groups; it is not to exclude other groups, though this is an inevitable and foreseeable by‐product. In (...) this article I contend that Cooney's argument ignores two important conditions of the doctrine of double effect; namely, that the good which results from the intended effect must be at least commensurate with the harm that results from the unintended effect; and, that the intended good effect is causally separate from the unintended harmful effect. Any use of the doctrine which neglects these conditions leads to morally problematic cases. Further, once we take the conditions into account, we have good reason to think that the doctrine of double effect has no relevance to the affirmative action debate. (shrink)

Appeal to triangulation occurs in two different contexts in Davidson’s work. In the first, triangulation—in the trigonometric sense—is used as an analogy to help explain the central idea of a transcendental argument designed to show that we can have the concept of objective truth only in the context of communication with another speaker. In the second, the triangulation of two speakers responding to each other and to a common cause of similar responses is invoked as a solution to the problem (...) of underdetermination of thought and meaning by the patterns of causal relations we stand in to the environment. I examine both of these uses of the idea of triangulation. In section 2, I take up the use of triangulation as an analogy in connection with Davidson transcendental argument to establish that communication is essential for the concept of objectivity. I argue that it is unsuccessful because the case has not been made that scope for deploying the idea of contrasting perspectives, which is needed for the concept of objectivity, is available only in the context of communication. In section 3, I take up the idea that triangulation on a common cause of common responses of two creatures interacting with each other provides the additional constraint needed to assign objective content to our thoughts and words. I show that appeal to this sort of triangulation provides minimal help in responding to the problem it is intended to solve. Section 4 provides a brief summary and conclusion. (shrink)

He implies that these separations are damaging to human beings, crippling them at the very level of their identities. $4.99 B. The Handsome Gloves. Giorgio Agamben’s Nudities , like Profanations before it, employs a wide range of subjects in order to establish separation as a metaphor, in much the same way that interdisciplinary scholars have adopted Michel Foucault’s concepts in order to rethink societies and texts. The longest essay from Profanations, entitled “In Praise of Profanation,” laments humankind’s inability to profane as the result of what Walter Benjamin has called “the capitalist religion.” Likewise, “Nudity” adopts a pessimistic stance on the Christian theological tradition’s perverse asphyxiation of the unclothed body. $2.50 C. The Hoop Earrings. Religion separates humans from things by procuring for itself items as “sacred,” thus taking them out of common use. Biometrics polices identity, replacing meaningful metrics of identity. It is a deplorable situation that leaves human beings in danger of, and indeed already victims of, mass persecution. $111.75 E. The Prince Albert. One could characterize Giorgio Agamben’s desire to catalogue a history of ignorance as a recognition that human beings are separated from knowledge by language. By using religion to get at the core concepts of Michel Foucault's thinking, this book offers a strong alternative to the way that the philosopher's work is read across the humanities. Foucault was famously interested in Christianity as both the rival to ancient ethics and the parent of modern discipline and was always alert to the hypocrisy and the violence in churches. Yet many readers have ignored how central religion is to his thought, particularly with regard to human bodies and (...) how they are shaped. The point is not to turn Foucault into some sort of believer or to extract from him a fixed thesis about religion as such. Rather, it is to see how Foucault engages religious _rhetoric_ page after page—even when religion is not his main topic. When readers follow his allusions, they can see why he finds in religion not only an object of critique, but a perennial provocation to think about how speech works on bodies—and how bodies resist. Arguing that Foucault conducts experiments in writing to frustrate academic expectations about history and theory, Mark Jordan gives equal weight to the performative and theatrical aspects of Foucault's writing or lecturing. How does Foucault stage possibilities of self-transformation? How are his books or lectures akin to the rituals and liturgies that he dissects in them? _Convulsing Bodies_ follows its own game of hide-and-seek with the agents of totalizing systems and gives us a Foucault who plays with his audiences as he plays for them—or teaches them. There are two main interpretive positions on Davidson’s project in the theory of meaning. The Replacement Theory holds that Davidson aimed to replace the theory of meaning with the theory of truth on the grounds that meaning is too unclear a notion for systematic theorizing. The Traditional Pursuit Theory, in contrast, holds that Davidson aimed to pursue the traditional project with a clever bit of indirection, exploiting the recursive structure of a truth theory to reveal compositional semantic structure and placing (...) constraints on it sufficient for its canonical assignments of truth conditions to be used for interpretation. This paper responds to a recent defense of a sophisticated version of the Replacement Theory by Gary Ebbs according to which Davidson was engaged in a Carnapian explication of meaning, intending to preserve only aspects of the usage of ‘means’ most important to us. I argue the Explication Interpretation cannot be sustained in the face of a detailed look at the passages that principally motivate it in “Truth and Meaning” when we take into account their local context, their context in the paper as a whole, and the context of that paper in Davidson’s contemporaneous work, and later work which tries to improve the formulations which he advanced in his early papers. In its January 20th, 2010 decision in Citizens United vs. Federal Election Commission, the United States Supreme Court ruled that certain restrictions on independent expenditures by corporations for political advocacy violate the First Amendment of the Constitution, which provides that “Congress shall make no law […] abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” Justice Kennedy, writing for the 5-4 majority, (...) held that “[b]y suppressing the speech of manifold corporations, both for-profit and non-profit, the Government prevents their voices and view-points from reaching the public and advising voters on which person or entities are hostile to their interests” (Citizens United vs. Federal Election Commission 558 U.S. 38-9 (2010); emphasis added). Much of the language of the opinion, and some of its reasoning, as this passage illustrates, presupposes that corporations are agents capable of speech, and that it is (at least in part) in the light of this that limitations on political advocacy by corporations are prohibited by the Constitution. -/- While there are other strands in the argument, they are interwoven with the conception of the corporation as agent and speaker, with its voice and its viewpoints. The dissenters on the court objected on precisely this point (among others). Justice Stevens wrote sarcastically in his dissent, joined by Justices Ginsburg, Breyer, and Sotomayor, that “[u]nder the majority’s view, I suppose it may be a First Amendment problem that corporations are not permitted to vote, given that voting is, among other things, a form of speech” (558 U.S. 33 (2010)). Justice Sotomayor suggested in oral argument that the Court’s century-old practice of treating corporations as persons rests on a conceptual mistake. -/- My concern in this essay is not with the question whether the restrictions violate the Constitution. There are many issues that bear on this which will be outside the scope of my discussion. My concern is with the proper conceptual framework for understanding the agency of corporations and corporate speech, and the role that conceptions of these play in the background of the majority’s reasoning. The issue is legal, but it also has philosophical, conceptual and semantic aspects. It will be the latter aspects, and their potential to shed light on legal reasoning, that are my main focus. An adequate framework requires saying what properly speaking the corporation is, how agency is expressed through the corporation, whose agency it is, centrally whether the corporation is an agent or person in its own right, and in what sense it can be said to be capable of speech. I draw on recent work in collective action theory, particularly with respect to the semantics of collective action sentences (Ludwig 2007) and the analysis of the proxy agency in collective action (Ludwig 2014), to show (i) that corporations are neither genuine agents nor (therefore) capable of engaging in genuine speech, (ii) that consequently the First Amendment does not apply to corporations per se, and (iii) that a better understanding of the mechanisms of corporate agency casts doubt on more indirect arguments for extending the First Amendment to “corporate speech” as well. Observations of a sea urchin larvae show that most species adopt one of two life history strategies. One strategy is to make numerous small eggs, which develop into a larva with a required feeding period in the water column before metamorphosis. In contrast, the second strategy is to make fewer large eggs with a larva that does not feed, which reduces the time to metamorphosis and thus the time spent in the water column. The larvae associated with each strategy have (...) distinct morphologies and developmental processes that reflect their feeding requirements, so that those that feed exhibit indirect development with a complex larva, and those that do not feed form a morphologically simplified larva and exhibit direct development. Phylogenetic studies show that, in sea urchins, a feeding larva, the pluteus, is the ancestral form and the morphologically simplified direct‐developing larva is derived. The current hypothesis for evolution of the direct‐developing larval form in sea urchins suggests that major developmental changes occur by neutral loss of larval features after the crucial transition to a nonfeeding life history strategy. We present evidence from Clypeaster rosaceus, a sea urchin with a life history intermediate to the two strategies, which indicates that major developmental changes for accelerated development have been selected for in a larva that can still feed and maintains an outward, pluteus morphology. The emotions do not only feature in Erasmus’ attempts to adjudicate the manner in which it is incumbent upon the preacher to _move_ the congregation, but a (...) specifically Christian sort of affectivity governs the way in which Erasmus imagines the preacher to be learned, and thus also to teach. As a result of its breadth and depth in covering an array of topics relevant to cultivating learned piety in the context of Christian preaching, the _Ecclesiastes_ represents the most detailed treatment Erasmus offered of the importance of emotion in numerous areas of Christian thought and life. And without close attention to the affective aspects of Erasmus’ ideal method of teaching and preaching, one simply cannot provide an adequate account of the humanist’s theological program of learned piety. The definition of zombies is clarified, and the main arguments for the alleged possibility of zombies are examined. The ‘conceivability argument’ is influential: zombies are conceivable; whatever is conceivable is possible; therefore zombies are possible. Chalmers’s arguments for conceivability are given special attention, notably his use of Block’s homunculus-head; the apparent gap between physical information and facts about experiences; Jackson’s ‘knowledge argument’; and the argument from the ‘absence of analysis’. It is argued that none of the arguments is conclusive.

Greek, Roman and Byzantine Monographs, 1993. xii + 171 pp. 3 figs. 19 pls.The sacred law receiving its editio princeps in this monograph was a gift to the Getty Museum whose curator asked the authors to publish it. Since the Museum does not exhibit material of chiefly (...) historical interest, it donated the inscription to the Republic of Italy in 1992. The law is inscribed on the largest lead tablet known to the authors (0.597 x 0.23 x 0.002 m.). The tablet is broken on all sides; its text is written in two columns, A and B, upside down to one another. From the letter forms, and the mention of Zeus Meilichios and the proper name Myskos the authors infer Selinous as the place of provenience. A comparison of the letter forms with those of other inscriptions from the region suggests the mid–fifth century B.C. or slightly earlier as the date of the document. The dialect is a variety of West Greek, agreeing with the language of Megara Nisaia and its colonies. All this is set forth in exemplary fashion in Chapters I and II, along with a transcription and translation of the text accompanied by an extensive commentary with thorough and generally very enlightening discussion of all aspects of the law.The inscription is unlike most sacred laws in that it sets out proper ritual procedure rather than regulating cult finances or the perquisites of officials. The two parts, A and B, share a concern with purification, with A concentrating on sacrifice and giving instructions to a group, while B addresses one person seeking purification. Other rituals mentioned include libations, aspersions, anointing, turning around, and setting out a table and couch, which last the authors interpret as a θεοξενία. These matters and much more are expounded with acuity and a wealth of supporting evidence in Chapters III–VIII, which form the bulk of the book and contain much interesting information more or less closely related to the law. A summary of the evidence assembled in the commentary is followed by a close study of the various rituals (III, IV). After a survey of the supernatural figures, including helpful lists of the cults of Zeus Meilichios, the Tritopatores, et al. (V), the authors investigate the influence of Punic religion on the cult of Zeus Meilichios, and possible connections between the law and curse tablets from Selinous (VII, IX). This article argues that the 2010 short film Pumzi is an exploration of post-crisis, ecological rehabilitation that asks for a rethinking of narratives modes for representing climate change. Employing seeds and sowing as ecological tropes, Pumzi explores how we create and carry narrative in relation to a rapidly changing earth. Both the multi-scalar geographical expanses as well as the deep geological timelines of Anthropocene discourse mean that placing the human in relation to its post-crisis environment requires more collective notions of (...) what narrative production and world building mean. This article argues that Pumzi cultivates a sympoietic—making together—mode of storytelling in an age of environmental crisis and planet-death as a well to both tell new stories and to think future worlds. In this way, Pumzi offers us a vision of an afrofuturist eco-ethics based in narrative practice. (shrink)

In my comments, I address two issues that are important but not central to the paper under review here. First, I present a reading of the postphenomenological concept of multistability by going back to Merleau-Ponty’s notion of the primacy of perception. I conclude that assertions affirming the multistability of technologies should not be seen as merely empirical. Second, I address the adequacy of using the language of ‘empirical’ and ‘transcendental’ as a means to categorize exclusionary approaches in philosophy of technology.

This book presents an original discussion and analysis of epistemic peer disagreement. It reviews a wide range of cases from the literature, and extends the definition of epistemic peerhood with respect to the current one, to account for the actual variability found in real-world examples. The book offers a number of arguments supporting the variability in the nature and in the range of disagreements, and outlines the main benefits of disagreement among peers i.e. what the author calls the benefits to (...) inquiry argument. The topic of the sublime is making a return to contemporary discourse on aesthetics and cognition. In Sublime Understanding, Kirk Pillow makes sublimity the center of an alternative conception of aesthetic response and interpretation. He draws an aesthetics of sublimity from Kant's Critique of Judgment, bolsters it with help from Hegel, and establishes its place in a broadened conception of human understanding. He argues that sublime reflection provides a model for an interpretive response to the uncanny Other outside our (...) conceptual grasp; it advances our sense-making pursuits but eschews unified, conceptual determination. Thus "sublime understanding" is the always partial, indeterminate grasping of contextual wholes through which we make sense of the uncanny particular in both art and the lived world. The book is divided into three parts. In the first two parts, Pillow presents insightful reinterpretations of Kant's and Hegel's aesthetics. In the third part he develops his own model of an aestheticized understanding, which illuminates contemporary discussions of metaphor and interpretation, while bridging Anglo-American and continental treatments of these issues. The presentation is a model of clear and well-crafted exposition, exemplifying the practice of aesthetically reflective sublime understanding that it articulates. (shrink)

The paper provides a taxonomy of group speech acts whose main division is that between collective speech acts (singing Happy Birthday, agreeing to meet) and group proxy speech acts in which a group, such as a corporation, employs a proxy, such as a spokesperson, to convey its official position. The paper provides an analysis of group proxy speech acts using tools developed more generally for analyzing institutional agency, particularly the concepts of shared intention, proxy agent, status role, status function, convention (...) and constitutive rule. Recent third person approaches to thought experiments and conceptual analysis through the method of surveys are motivated by and motivate skepticism about the traditional first person method. I argue that such surveys give no good ground for skepticism, that they have some utility, but that they do not represent a fundamentally new way of doing philosophy, that they are liable to considerable methodological difficulties, and that they cannot be substituted for the first person method, since the a priori knowledge which (...) is our object in conceptual analysis can be acquired only from the first person standpoint.
