This article seeks to address the manner in which we should conceptualise the duties of directors in making decisions where fundamental rights are at stake. We first attempt to show that, in making decisions that implicate fundamental rights, directors are required to consider all individuals affected as having an intrinsic dignity. The interests of non-shareholders must thus be addressed in a non-instrumental manner which, we argue, is only compatible with the adoption of a ‘stakeholder’ conception of directors’ duties. Adopting such (...) an approach, however, raises the difficulty of how directors are to balance multiple intrinsically valuable interests. We argue that the doctrine of proportionality—which has been developed in fundamental rights law as a structured enquiry concerning the circumstances in which it is justifiable to limit rights—can be adapted to the domain of corporate decision-making. The proportionality enquiry provides a transparent, structured process of reasoning that can aid corporate decision-making and open up the possibility for reviewing decisions of directors that affect the fundamental rights of individuals. This January‐February 2020 issue marks the start of the Hastings Center Report's fiftieth volume. The issue introduces the column Looking Back, Looking Forward, which we plan to run in this volume only. Conceived by Hastings Center fellows Douglas Diekema and Lainie Friedman Ross, the column will explore the significance of landmark publications from the first fifty years of bioethics. For the first installment, Diekema looks at the unconventional moral position Hans Jonas took in his 1969 essay “Philosophical Reflections on (...) Experimenting with Human Subjects.” In the lead article, “Trust, Risk, and Race in American Medicine,” Laura Specker Sullivan contextualizes patient mistrust within a history of racism in general and in the nation's biomedical research and clinical institutions specifically. Specker Sullivan proposes ways for individual clinicians to improve relationships with distrustful patients and their families. Two commentaries provide additional insights and recommendations about the work of earning patient trust. (shrink)

The present article aims to present how the different philosophical perspectives have tackled the problem of the foundations of our responsibility to future generations in the context of ecological crisis. The main theories addressed here will be Hans Jonas metaphysical foundation, utilitarianism, communitarianism, the rights theory and contractarian perspectives derived from John Rawls’s theory. By assessing these perspectives, I assert that, against jonasianianism and related perspectives, our responsibilities to future generations must be thought of in terms of “political, not (...) metaphysical”. The foundation of these responsibilities must be based, not on God, nor compassion, nor benevolence, nor identity sentiments, but on a conception of ourselves as rational and reasonable persons. From my point of view, we must find our responsibilities to future generations in our respect for their necessities and interests as well as in the maintenance of their available opportunities. This point of view allows us to point out some of our future challenges in the intergenerational justice scope. (shrink)

Part I explores the historical context of the debate; Part II assesses J. L. Mackie's famous arguments; Part III defends error theory against challenges and considers its implications for our moral thinking.

Nonrelativistic quantum mechanics (QM) works perfectly well for all practical purposes. Once one admits, however, that a successful scientific theory is supposed not only to make predictions but also to tell us a story about the world in which we live, a philosophical problem emerges: in the specific case of QM, it is not possible to associate with the theory a unique scientific image of the world; there are several images. The fact that the theory may be compatible with distinct (...) ontologies, and that those ontologies may themselves be associated with a plurality of metaphysical approaches, gives rise to the problem of metaphysical underdetermination. This paper concludes that the available metametaphysical criteria fail to deliver objectivity in theory choice, and it puts forward its own criterion based on a tension between two methods of metaphysical inquiry: one that is closely related to science and another that is not. Are wealthy countries' duties towards developing countries grounded in justice or in weaker concerns of charity? Justice in a Globalized World offers both an in-depth critique of the most prominent philosophical answers to this question, and a distinctive approach for addressing it.

A new axiom is proposed, the Ground Axiom, asserting that the universe is not a nontrivial set forcing extension of any inner model. The Ground Axiom is first-order expressible, and any model of ZFC has a class forcing extension which satisfies it. The Ground Axiom is independent of many well-known set-theoretic assertions including the Generalized Continuum Hypothesis, the assertion V=HOD that every set is ordinal definable, and the existence of measurable and supercompact cardinals. The related Bedrock Axiom, asserting that the (...) universe is a set forcing extension of a model satisfying the Ground Axiom, is also first-order expressible, and its negation is consistent. The principle of plenitude says that every material object coincides with abundantly many further objects that differ in their modal profiles. A necessarily unmanifested disposition is a disposition that necessarily does not manifest. This paper argues that if the principle of plenitude holds, then there are some necessarily unmanifested dispositions. These necessarily unmanifested dispositions will be argued to evade some objections against the cases of necessarily unmanifested dispositions put forward by Carrie Jenkins and Daniel Nolan.

The availability of unitarily inequivalent representations of the canonical commutation relations constituting a quantization of a classical field theory raises questions about how to formulate and pursue quantum field theory. In a minimally technical way, I explain how these questions arise and how advocates of the Hilbert space and of the algebraic approaches to quantum theory might answer them. Where these answers differ, I sketch considerations for and against each approach, as well as considerations which might temper their apparent rivalry.

In the debate over what determines the reference of an indexical expression on a given occasion of use, we can distinguish between two generic positions. According to the first, the reference is determined by internal factors, such as the speaker’s intentions. According to the second, the reference is determined by external factors, like conventions or what a competent and attentive audience would take the reference to be. It has recently been argued that the first position is untenable, since there are (...) cases of mismatch where the intuitively correct reference differs from the one that would be determined by the relevant internal factors. The aim of this paper is to show that, contrary to this line of argument, it is the proponent of the second position that should be worried, since this position yields counterintuitive consequences regarding communicative success in cases of mismatch. Bringing together Luce Irigaray's early psychoanalytically orientated writings with her more recent and more explicitly political writings, Irigaray and Politics weaves together the ontological, political and ethical dimensions of Irigaray's philosophy of sexuate difference in imaginative ways.

Two-dimensional (2D) semantics is a formal framework that is used to characterize the meaning of certain linguistic expressions and the entailment relations among sentences containing them. 2D semantics has also been applied to thought contents. In contrast with standard possible worlds semantics, 2D semantics assigns extensions and truth-values to expressions relative to two possible world parameters, rather than just one. So a 2D semantic framework provides finer-grained semantic values than those available within standard possible world semantics, while using the same (...) basic model-theoretic resources. The 2D framework itself is just a formal tool. To develop a semantic theory for someone’s language, a proponent of 2D semantics must do three things: (i) explain what exactly the two possible world parameters represent, (ii) explain the rules for assigning 2D semantic values to a person’s words and sentences, and (iii) explain how 2D semantic values help in understanding the meanings of the person’s words and sentences. In this paper I demonstrate that, contrary to the standard interpretations, William Whewell's view of scientific method is neither that of the hypothetico-deductivist nor that of the retroductivist. Rather, he offers a unique inductive methodology, which he calls "discoverers' induction." After explicating this methodology, I show that Kepler's discovery of his first law of planetary motion conforms to it, as Whewell claims it does. In explaining Whewell's famous phrase about "happy guesses" in science, I suggest that Whewell intended a distinction (...) between "inductions," which can be empirically verified, and "mere hypotheses"--or guesses--which cannot. Finally, I argue that Whewell's discoverers' induction is a view worthy of our attention today, because it avoids a number of problems faced by prominent alternative methodologies. (shrink)

There is currently a gap in our understanding of how figures produced by mechanical imaging techniques play evidential roles: several studies based on close examination of scientific practice show that imaging techniques do not yield data whose significance can simply be read off the image. If image-making technology is not a simple matter of nature re-presenting itself to us in a legible way, just how do the images produced provide support for scientific claims? In this article I will first show (...) that there is a distinct question about the semiotics of mechanically produced images that has not yet been answered. I show that my account of visual representations can do so, and I argue that the role of convention involved in my account is compatible with the view that visual representations produced through mechanized imaging techniques can play genuine evidential roles in scientific reasoning. According to extension-shifting theories of vagueness, the extensions of vague predicates have sharp boundaries, which shift as a function of certain psychological factors. Such theories have been claimed to provide an attractive explanation of the appeal of soritical reasoning. I challenge this claim: the demand for such an explanation need not constrain the semantics of vague predicates at all.

In Epistemic Two-Dimensional Semantics, David Chalmers seeks to develop a version of 2-D semantics which can vindicate the rationalist claim that there are constitutive connections between meaning, possibility and a priority. Chalmers lays out different ways of filling in his preferred epistemic approach to 2-D semantics so as to avoid controversial philosophical assumptions. In these comments, however, I argue that there are some distinctively rationalist commitments in Chalmers's epistemic approach to 2-D semantics. I start by explaining why Chalmers's approach requires (...) a canonical language that affords subjects accurate a priori access to the space of possibility. I then argue that traditional worries about rationalism will simply re-emerge as worries about whether there can be a canonical vocabulary and how we could come to recognize one if there were. The moral is that Chalmers's 2-D semantic framework builds in substantive metaphysical and epistemological commitments which stand in need of further defense. (shrink)

Olfaction has recently been highlighted as a sense poorly connected with language. Odor is difficult to verbalize, and it has few qualities that afford mimicry by vision or sound. At the same time, emotion is thought to be the most salient dimension of an odor, and it could therefore be an olfactory dimension more easily communicated. We investigated whether sounds imitative of an innate disgust response can be associated with unpleasant odors. In two experiments, participants were asked to make a (...) forced choice between a pseudoword including a disgust sound and a neutral pseudoword, for pleasant and unpleasant odors. Overall, participants chose more disgust pseudowords than neutral pseudowords for unpleasant odors, but this was not the case for pleasant odors. This effect was not driven by a general association between unpleasant sounds and unpleasant odors, but specifically the sounds [x/χ] and [f], thought to reflect physical responses to disgusting odors, as seen in the Polish fu! or the English ugh!. In line with growing evidence that language can encode odor, we provide the first experimental evidence for an association between the sound of a word and odor valence. (shrink)

Past research showed that the ability to focus on one’s internal states positively correlates with the self-regulation of behavior in situations that are accompanied by somatic and/or physiological changes, such as emotions, physical workload, and decision-making. The analysis of moral oriented decision-making can be the first step for better understanding the legal reasoning carried on by the main players in the field, as lawyers are. For this reason, this study investigated the influence of the decision context and interoceptive manipulation on (...) the moral decision-making process in the legal field gathering the responses of two groups of lawyers. A total of 20 lawyers were randomly divided into an experimental group, which was explicitly required to focus the attention on its interoceptive correlates, and a control group, which only received the general instruction to perform the task. Both groups underwent a modified version of the Ultimatum Game, where are presented three different moral conditions and three different offers. Results highlighted a significant increase of Acceptance Rate in those offers that should be considered more equal than fair or unfair ones, associated with a general increase of Reaction Times in the equal offers. Furthermore, the interoceptive manipulation oriented the Lawyers toward a more self-centered decision. This study shows how individual, situational, contextual, and interoceptive factors may influence the moral decision-making of lawyers. Future research in the so-called Neurolaw field is needed to replicate and expand current findings. (shrink)

This article provides an overview of recent results on lexicographic, linear, and Bayesian models for paired comparison from a cognitive psychology perspective. Within each class, we distinguish subclasses according to the computational complexity required for parameter setting. We identify the optimal model in each class, where optimality is defined with respect to performance when fitting known data. Although not optimal when fitting data, simple models can be astonishingly accurate when generalizing to new data. A simple heuristic belonging to the class (...) of lexicographic models is Take The Best (Gigerenzer & Goldstein (1996) Psychol. Rev. 102: 684). It is more robust than other lexicographic strategies which use complex procedures to establish a cue hierarchy. In fact, it is robust due to its simplicity, not despite it. Similarly, Take The Best looks up only a fraction of the information that linear and Bayesian models require; yet it achieves performance comparable to that of models which integrate information. Due to its simplicity, frugality, and accuracy, Take The Best is a plausible candidate for a psychological model in the tradition of bounded rationality. We review empirical evidence showing the descriptive validity of fast and frugal heuristics. (shrink)

Student relativism is a widespread phenomenon in introductory philosophy courses. It is a pressing issue for teachers because it seems to undermine the very purpose of philosophy. Since the 1980s there is a debate about how to understand and how to deal with student relativism. However, there is as yet no comprehensive presentation of the debate. The first aim of the article is to offer a classification of the strategies for dealing with student relativism and a presentation and short assessment (...) of the main strategies from the debate. The second aim is to present a new strategy based on the theory of conceptual change and drawing on the results from empirical research in developmental psychology on epistemic cognition. I call it the epistemic conceptual change strategy. (shrink)

Lei Zhong (2012. Counterfactuals, regularity and the autonomy approach. Analysis 72: 75–85) argues that non-reductive physicalists cannot establish the autonomy of mental causation by adopting a counterfactual theory of causation since such a theory supports a so-called downward causation argument which rules out mental-to-mental causation. We respond that non-reductive physicalists can consistently resist Zhong's downward causation argument as it equivocates between two familiar notions of a physical realizer.
