This is the text of the keynote lecture delivered at the launch of Black, Lynsey and Dunne, Peter. Law and Gender in Modern Ireland. Oxford: Hart, delivered 13th September 2019, Department of Law, Maynooth University, Ireland. The lecture locates the book within the context of rapid, radical transformation in gender law and politics in Ireland, highlighting some of the issues which have been the focus of activism and/or reform. The lecture goes on to outline some of the challenges which arise (...) in the legislative pursuit of gender equality including the tension between respecting agency and choice and curbing exploitative and/or gender disadvantaging practices. Comparisons are also made with legislative initiatives in neighbouring Britain. The lecture concludes with some reflections on the interplay of sex and gender in law and public debate and their embedding in the constitutional creation of the modern Irish State. (shrink)

Understanding the nature of science has long been a desired outcome of science education, despite ongoing disagreements about the content, structure, and focus of NOS expectations. Addressing the concern that teachers likely focus only on student learning expectations appearing in standards documents, this study examines the current state of NOS in science education standards documents from nine diverse countries to determine the overt NOS learning expectations that appeared, NOS statements provided near those learning expectations, but not identified as learning outcomes, (...) and NOS statements found in ancillary text. Findings indicate that NOS ideas rarely occur as expectations for student learning and are far more commonly found in ancillary material. Moreover, consensus was not apparent in the overt learning outcomes for students. Given the well-documented poor state of NOS instruction and the consistent lack of NOS appearing in published curriculum materials, the NOS standards appearing in nearly all documents analyzed are unlikely to provide sufficient conceptual or pedagogical support for NOS to be accurately interpreted or translated into meaningful experiences for students. We contribute to the literature on ethics in the professions by theorizing how global mobility precipitates professional insecurity and constrained moral agency. We present our findings of a study of accountants migrating to Canada. Using postcolonial theory and relational/poststructuralist theories of identity and ethics, we contrast the experiences of marginalized and privileged migrant accountants to show how those with “diverse” social identities are not recognized by professionals in Canada and must seek recognition from Canadian colleagues, employers, and clients to reconstitute (...) their professional identities and moral agency. We discuss the implications of the exclusion and marginalization of professionals for migrants, the profession, and society more generally. (shrink)

There is strong social and political interest in active citizenship and values in education internationally. Active citizenship requires children to experience and internalize moral values for human rights, developing their own opinions and moral responsibility. While investment in young children is recognised as an important factor in the development of citizenship for a cohesive society, less is known about how early years teachers can encourage this in the classroom. This book will present new directions on how teachers can promote children's (...) learning of moral values for citizenship in classrooms. The research provided offers important insights into teaching for active citizenship by: • providing an analysis of educational contexts for moral values for active citizenship • highlighting teachers’ beliefs about knowing and knowledge and how these relate to children’s learning and understanding about social and moral values • discussing the impact of teachers’ beliefs on teaching practices. Evidence suggests that investment in the early years is vital for all learning, and specifically for developing an understanding of active citizenship for tolerant and cohesive societies. This book will be essential reading for the professional education of early years teachers interested in teaching for active citizenship. (shrink)

Environmental journalism has been criticized by various special interest groups and some editors for advocacy and faulted for inaccuracies. Sources, in turn, many from the science communities, have been accused of inaccessibility, and public relations representatiws from both industry and environmental organizations are regularly blamed for unethical behaviors rangingfrom hyperbole to more serious discussion or omission of factual information. This article reports a preliminary study of ethical decision making among members of the Society of Environmental Journalists, identifying ethical motivation diljerences (...) using the Ethical Motivation Scale. The implications of the reported dominant extrinsic guides are discussed in light of a proposed protocol for ethical environmental communication. (shrink)

Marginalization has been used as a guiding concept for nursing research, theory and practice. Its properties have been identified and updated in 1994 and 1999, respectively. This article re-examines marginalization, considering it to be a concept that changes with pivotal historical events. The events of September 11, 2001, and the war between the US/UK and Iraq are such pivotal events. The notion of the linguistic habitus and symbolic violence as outlined by Bourdieu provide new insights about the dynamics of marginalization. (...) Specifically noted is the marginalization of persons and cultures based on their designation by the current US administration, and as interpreted through mainstream media, as actual or potential ‘terrorists’. A parallel situation in nursing is discussed, beginning with nursing's own marginality, related to the dynamics of symbolic violence. Nursing is argued to be vulnerable to having essential words and practices co-opted by dominant institutions and altered in meaning, that is, made incongruent with the discipline's emphasis on core values of confidentiality, equity and care. In response to marginalization and exteriorization those affected can use voice and testimony to ‘recreate the centre’. Suggestions for protecting our practices and philosophy are included. (shrink)

This study examines how authentic leadership influences team performance via the mediating mechanism of team reflexivity. Adopting a self-regulatory perspective, we propose that authentic leadership will predict the specific team regulatory process of reflexivity, which in turn will be associated with two outcomes of team performance, effectiveness and productivity. Using survey data from 53 teams in three organizations in the United Kingdom and Greece and controlling for collective trust, we found support for our stated hypotheses with the results indicating a (...) significant fully mediated relationship. As predicted the self-regulatory behaviors inherent in the process of authentic leadership served to collectively shape team behavior, manifesting in the process of team reflexivity, which, in turn, positively predicted team performance. We conclude with a discussion of how this study extends theoretical understanding of authentic leadership in relation to teamwork and delineate several practical implications for leaders and organizations. Since there are so few controls over detecting and preventing faculty misconduct, one of the most common ways in which it is discovered is through student reports. Given the importance of student reports in bringing to light faculty’s ethical lapses, this paper seeks to understand what factors influence students’ likelihood to report faculty misconduct. We develop an empirical model that integrates the decision process of the Prosocial Organizational Behavior Model with insights from the emotional perspective on whistleblowing. Specifically, we use (...) an experimental survey to examine how students’ perceived unfairness of the faculty misconduct, feelings of anger, and the students’ self-interest in the situation in conjunction with situational “cues for inaction” lead to the intention to blow the whistle. Overall, the results from our structural model partially support our theoretical model. Interestingly, these findings demonstrate that, in the case of faculty member misconduct, anger and perceptions of unfairness play a greater role than the more rational cost-benefit process of the POB model. These results could aid in development of ethics education for students and could also inform the development of university policies that encourage students to come forward when faced with faculty misconduct. For the successful achievement of evidence-based practice, clinicians, managers and purchasers need evidence on whether a particular intervention works and ways to judge the appropriateness of the outcome criteria and measures used. Guidance is needed on what outcome measure to use, especially within routine clinical care settings. Beginning with a re-clarification of the difference between a health status and an outcome measure, the paper presents an evaluative checklist for use by clinical audit and research staff to review outcome measures for (...) use in routine care settings. Central features include the user-centredness of the measure, its psychometric properties, feasibility of use and utility. The applicability of the checklist is illustrated for outcome measurement in diabetes and stroke care. A modified form of the checklist is proposed for use by the busy clinician as an aid to the critical review of research papers within the context of evidence-based practice and to aid health care practitioners' choice of which outcome measure(s) to use within routine clinical care. BackgroundFear of cancer recurrence is common amongst cancer survivors. There is rapidly growing research interest in FCR but a need to prioritize research to address the most pressing clinical issues and reduce duplication and fragmentation of effort. This study aimed to establish international consensus among clinical and academic FCR experts regarding priorities for FCR research.MethodsMembers of the International Psycho-oncology Society Fear of Cancer Recurrence Special Interest Group were invited to participate in an online Delphi study. Research domains identified in Round (...) 1 were presented and discussed at a focus group to consolidate the domains and items prior to presentation in further survey rounds aimed at gaining consensus on research priorities of international significance.ResultsThirty four research items were identified in Round 1 and 33 of the items were consolidated into six overarching themes through a focus group discussion with FCR experts. The 33 research items were presented in subsequent rounds of the delphi technique. Twenty one participants contributed to delphi round 1, 16 in round 2, and 25 and 29 participants for subsequent delphi rounds. Consensus was reached for 27 items in round 3.1. A further four research items were identified by panelists and included in round 3.2. After round 3.2, 35 individual research items were ratified by the panelists. Given the high levels of consensus and stability between rounds, no further rounds were conducted. Overall intervention research was considered the most important focus for FCR research. Panelists identified models of care that facilitate greater access to FCR treatment and evaluation of the effectiveness of FCR interventions in real world settings as the two research items of highest priority. Defining the mechanisms of action and active components across FCR/P interventions was the third highest priority identified.ConclusionThe findings of this study outline a research agenda for international FCR research. Intervention research to identify models of care that increase access to treatment are based on a flexible approach based on symptom severity and can be delivered within routine clinical care were identified as research areas to prioritize. Greater understanding of the active components and mechanisms of action of existing FCR interventions will facilitate increased tailoring of interventions to meet patient need. (shrink)

This paper argues that the figure of the child performs a critical function for the middle-class social imaginary, representing both an essential “innocence” of the liberal individual, and an excluded, unconscious remainder of its project of control through the management of knowledge. While childhood is invested with affect and value, children’s agency and opportunities for social participation are restricted insofar as they are seen both to represent an elementary humanity and to fall short of full rationality, citizenship and identity. The (...) diverse permutations of this figure, as it develops in the middle-class imagination, are traced from the writings of John Locke to the films of Michael Haneke (via Charles Dickens and Henry James), to interrogate what this ambivalence regarding childhood reflects about middle-class, adult identity. There is an emerging consensus that we are experiencing radical change in the way that science is organized and performed. Frequently described as a shift from Mode 1 to Mode 2, this view emphasizes application, transdisciplinarity, collaboration, and accountability. This article examines the ways in which U.K. public sector scientists make sense of scientific endeavor. The data reveal that the extent to which science is being constructed varied both across and between institutions. Data highlight how individual scientists weave their own (...) paths through the changing discourses of science, constructing new understandings that do not fit neatly into any binary framework for understanding. This paper discusses a deterministic model of the spread of an infectious disease in a closed population that was proposed byKermack &McKendrick . The mathematical assumptions on which the model is based are listed and criticized. The ‘threshold theorem’ according to which an epidemic develops if, and only if, the initial population density exceeds a certain value determined by the parameters of the model, is discussed. It is shown that the theorem is not true. A weaker result is stated and (...) proved.A new simplified version of the model is discussed. In this model it is assumed that an infected individual becomes infectious after a constant time and that it will removed after a constant time. Numerical simulations of this model show that the form of the fluctuations in the number of diseased individuals depends on the values of the parameters. The number of infectious individuals may oscillate up and down under certain circumstances. Necessary conditions for the number of infectious individuals to rise above previous levels are stated and proved. (shrink)

This article explores the notion of the unconscious (das Unbewusste) in terms of its nature and constitutive manifestations in consciousness. In contrast to the psychoanalytic formulation, the unconscious is conceptualized here distinctively as sedimentation (die Sedimentierung) within the Husserlian framework. All `experiences sediment and are “stored” in a darkened, affectless region of the psyche, which is nonetheless not in any sense separated from the sphere of consciousness. Rather, the sedimented experiences move dynamically between the unconscious and consciousness, constantly affecting and (...) manifesting in the upcoming conscious activities of the subject. Based on this conceptualization, I suggest a schematic understanding of the manifestations of the unconscious, or sedimentation, in consciousness. The conceptual division of consciousness into the sphere of understanding (Verstandessphäre), sphere of affect (Gemütssphäre) and sphere of volition (Willenssphäre) allows us to speak of the corresponding threefold manifestations of the unconscious in each of these spheres as type (Typus), mood (Stimmung) and habits (Habitus). Having their genetic “origin” in sedimented experiences, these structural moments play a constitutive role in upcoming conscious activities of the intentional subject. Furthermore, I demonstrate that each of these moments is characterized by a distinctive kind of horizonality, in light of which a deepened understanding of the genetic concept of horizon-consciousness (Horizontbewusstsein) is obtained. Despite the conceptual tripartition, I emphasize at the end the essential intertwinement of the three structural moments in such conscious performance as association. (shrink)

This article examines Sarah Kofman's interpretation of Nietzsche in light of the claim that interpretation was for her both an articulation of her identity and a mode of deconstructing the very notion of identity. Faulkner argues that Kofman's work on Nietzsche can be understood as autobiographical, in that it served to mediate a relation to her self. Faulkner examines this relation with reference to Klein's model of the child's connection to its mother. By examining Kofman's later writings on Nietzsche alongside (...) her autobiography, this article contends that Kofman's defense of anti-Semitism in Nietzsche serves to fend off her own ambivalence about being Jewish. With his concept of ‘potentiality,’ Agamben offers a promising means of approaching questions of power and agency. Yet arguably, by situating potentiality as a reserve created through the sovereign ban, Agamben neglects the inter-subjective context of ordinary everyday agency. This means that while Agamben’s theory is particularly well suited to the analysis of interactions between states and their citizens, and those excluded from citizenship, it provides poor tools for understanding how social disparity develops within communities, understood as networks of individuals (...) of varying capacities and ways of being. By revisiting Aristotle’s discussion of potentiality from which Agamben’s concept is drawn, the essay develops from potentiality ways of thinking about agency. The essay focuses upon a class of individual who are increasingly seen to embody the political community’s potentiality, to the extent that their ability to exercise agency is reduced: that is, the ‘innocent child’—glossed at once as humanity’s future and best hope, and as its most vulnerable and unrealised quotient. While human potentiality is thought only in terms of childhood innocence, not only will these individuals’ agency be stymied, but citizens will also continue to separate themselves from their own unrealised potentials and frailties. In W v M, a judge concluded that M's past statements should not be given weight in a best interests assessment. Several commentators in the ethics literature have argued this approach ignored M's autonomy. In this short article I demonstrate how the basic tenets of speech act theory can be used to challenge the inherent assumption that past statements represent an individual's beliefs, choices or decisions. I conclude that speech act theory, as a conceptual tool, has a valuable contribution to (...) make to this debate. (shrink)

This paper develops a methodology for using Activity Theory (AT) to investigate pedagogical practices in primary school mathematics classrooms by selecting object-oriented pedagogical activity as the unit of analysis. While an understanding of object-oriented activity is central to Activity Theory (AT), the notion of object is a frequently debated and often misunderstood one. The conceptual confusion surrounding the object arises both from difficulties related to translating the original Russian conceptualisation of object-oriented activity into English as well as from the different (...) interpretations of the object currently in use within two contemporary approaches in activity theory. This paper seeks to clarify understandings of the object by exploring notions of object oriented activity. To this end, the paper traces the historical development of the object through Leontiev (1978; 1981) and Engeström’s (1987; 1999) expansion of Vygotsky’s original triadic understanding of object oriented activity. Drawing on Basil Bernstein’s (1996) notion of evaluative criteria as those rules that transmit the criteria for the production of a legitimate text, the paper goes on to elaborate a methodology for using AT to analyse observational data by developing the notion of “evaluative episodes” as pedagogical moments in which the pedagogical object is made visible. Findings indicate that an evaluative episode can serve as an analytical space in which the dynamism of an activity system is momentarily frozen, enabling one to model human activity in the system under investigation and, hence, in this study, to understand pedagogy in context.
