Given corporate lobbying’s double-edged nature, previous research has been interested in what motivates firms to engage in lobbying. In this study, we build on previous works to analyze how two types of aspiration, historical aspiration, which represents the level of performance firms aim to achieve given past self-performance, and social aspiration, which represents the level of performance firms aim to achieve given competitors’ achievements, shape corporate lobbying decisions. Our premise is that when a firm’s product market performance is below historical (...) aspirations, then the firm is motivated to engage in lobbying because the benefits of lobbying outweigh the potential costs. However, when a firm’s product market performance is below social aspirations, then decision-makers perceive that the potential challenges of lobbying outweigh the benefits and decide not to engage in lobbying. By examining automotive firms in the U.S. light vehicle market from 1998 to 2013, we find significant empirical support for our general premise. Using Tobit regression analysis, we find that automotive firms present diverging motivations for lobbying depending on whether they attend to historical or social aspirations for sales performance. Victimhood is commonly deemed negative. The dominant account of victimhood argues that leveraging victimhood involves asserting the moral superiority of the weak, leading to an oversimplification of complex political matters into moral binaries of good versus evil. According to this perspective, victimhood traps victims in a perennial position of weakness, thereby diminishing their agency. This paper challenges this negative perspective and argues that victimhood can enhance agency, serving as a positive political resource. When victimhood involves the acknowledgment of inherent vulnerability (...) shared by all individuals, whether they are victims or non-victims, and concerns the unjust distributions of vulnerability experiences, it can empower individuals to overcome excessive self-doubt and transform their victimization into a political agenda. By examining the subway protests organized by Korean Solidarity Against Disability Discrimination activists, I demonstrate how recognizing the agency-enhancing potential of victimhood helps us better understand the political significance of these actions. With the advancement of medical technology, various life-sustaining treatments are available at the end of life. Older adults should be encouraged to establish their end-of-life treatment preferences (ELTP) while they are physically and mentally able to do so. The purpose of this study was to explore ELTP among older adults and to compare those preferences in a subset of individuals who had reported their ELTP in a survey completed the previous year. This was a descriptive study of 191 older adults (...) living in a continuing care retirement community. Approximately half of the participants did not want cardiopulmonary resuscitation, to be put on a respirator, or to receive dialysis. The findings in this study suggest that many older adults do not want aggressive interventions at the end of life, but choose rather those measures that will keep them comfortable. Moreover, treatment choices may change over time. Health care providers should initiate discussions about ELTP at regular intervals (yearly) to assist older adults in dictating their end-of-life care. (shrink)

This paper addresses the central moral issues regarding the burka ban in a liberal society: the freedoms of religion and expression, women's liberty, gender equality, state neutrality and public safety. The paper argues that the ban is unjustifiable in a liberal society for the following reasons: (1) liberal institutions increase the likelihood of voluntary decisions, (2) a legal measure that promotes a controversial conception of liberty is an undue interference with liberty, (3) the ban overrides women’s judgment regarding their own (...) interest rather than gives effect to it, (4) the principle of moral equality fails to support forced unveiling, and (5) the ban is discriminatory because it imposes a harsh burden on women by preventing religious observance. In contrast to the juxtaposition of representative democracy and Confucian meritocracy that is currently being discussed in international political theory, we start from the hypothesis of a historical, intercultural and logical, simultaneous provenance of democracy and meritocracy in the evolution of the modern constitutional state. To this end, we examine the reception of Confucianism in the republican history of ideas of European Enlightenment using selected examples ranging from Leibniz to the classical constitutional and government theory of Sieyès. The widespread ignorance (...) of the Confucian elements in the classical core of modern republicanism that we have evaluated here is attributed to the needs of political legitimacy and the methodical ahistorism and historical amnesia of academic discourse. Der Konfuzianismus ist auch im Westen keine unbekannte Lehre mehr. Zugleich trifft man ihr gegenüber auf erhebliche Vorurteile. Insbesondere im Zusammenhang mit der Debatte um den Kommunitarismus wird der Konfuzianismus häufig als kulturelle Grundlage autoritärer politischer Herrschaft hingestellt. Das ist nicht vollkommen falsch, beruht aber auf einer einseitigen Wahrnehmung des Konfuzianismus. Tatsächlich blickt dieser auf eine lange Geschichte politischer Instrumentalisierungen zurück. Gleichwohl enthält diese Lehre Konzepte, die dem gemeinschaftlichen Zusammenleben förderlich sein können.

In empiricism, there are only two answers for a question: black or white. Yet, subjective meanings of human behaviours and responses toward health and illness cannot be simply explained with black and white. Gray zones are needed because they are characterized by complexity and require a contextual understanding. In this paper, we present and suggest fuzzy logic as an example of theoretical bases that help transcend the conflicts between objectivity and subjectivity, respect gray zones between black and white answers for (...) questions, and provide a contextual understanding of complex nursing phenomenon. A historical review of fuzzy logic is followed by a definition of fuzzy logic. Then, fuzzy logic is discussed in terms of its compatibility with nursing epistemological views and philosophical thoughts. Fuzzy logic agrees with three categories of epistemological views of nursing, including correspondence, coherence and pragmatism. Fuzzy logic also agrees with four major philosophical thoughts in nursing, including postempiricism, pragmatism, feminism, and postmodernism. Based on the discussion, we propose that fuzzy logic be further explored, used and developed in research and practice in the nursing areas/situations/phenomena that are characterized by complexity, ambiguousness, and vagueness. The study reviewed 20 currently-available structured ethical decision-making models and developed an integrated model consisting of six steps with useful questions and tools that help better performance each step: (1) the identification of an ethical problem; (2) the collection of additional information to identify the problem and develop solutions; (3) the development of alternatives for analysis and comparison; (4) the selection of the best alternatives and justification; (5) the development of diverse, practical ways to implement ethical decisions and actions; and (...) (6) the evaluation of effects and development of strategies to prevent a similar occurrence. From a pilot-test of the model, nursing students reported positive experiences, including being satisfied with having access to a comprehensive review process of the ethical aspects of decision making and becoming more confident in their decisions. There is a need for the model to be further tested and refined in both the educational and practical environments. (shrink)

In the 1990s P.H. Hirst criticizes his influential forms of knowledge theory, suggesting a new concept of education. In this paper I explain why Hirst suggests the new concept of ‘education as initiation into practices’. Although the latter Hirst’s position had positive implications on education, it is frequently confused with theutilitarian position. In order to provide a more coherent concept of education, I compare basic features of the rationalist (R), the utilitarian (U), and the practices-based (P) approach. Then I discuss (...) the implications of this concept. The main features of R, U, and P are respectively as this: 1) A person is seen as a rational being, a being of wants and desires, and a rational practitioner who is socially constructed. 2) The nature of reason is conceived as ‘rational’,‘instrumental’, and ‘practical’. 3) The aim of education is education for theoretical rationality, education for maximum satisfaction of desires, and education for identity formation by participating in practices. 4) The contents of education are theoretical knowledge, instrumental knowledge with utility, and practical knowledge for various practices. 5) R pursues absolute transcendental values, U pursues extrinsic instrumental values, and P pursues values internal to a practice. 6) R conceives education as ‘seeing’, U as ‘doing’, and I suggest ‘listening’ model for P. Based on this conception of practices-based position, I hope we can provide better education. (shrink)

Following previous work that shows engineering students possess different levels of understanding of ethics—implicit and explicit—this study focuses on how students’ implicit understanding of engineering ethics influences their team discussion process, in cases where there is significant divergence between their explicit and implicit understanding. We observed student teams during group discussions of the ethical issues involved in their engineering design projects. Through the micro-scale discourse analysis based on cognitive ethnography, we found two possible ways in which implicit understanding influenced the (...) discussion. In one case, implicit understanding played the role of intuitive ethics—an intuitive judgment followed by reasoning. In the other case, implicit understanding played the role of ethical insight, emotionally guiding the direction of the discussion. In either case, however, implicit understanding did not have a strong influence, and the conclusion of the discussion reflected students’ explicit understanding. Because students’ implicit understanding represented broader social implication of engineering design in both cases, we suggest to take account of students’ relevant implicit understanding in engineering education, to help students become more socially responsible engineers. The zone of proximal development (ZPD) is defined as an overarching concept that integrates the main tenets of Vygotsky’s theory of human development. The conceptualization of the ZPD begins with its social, cultural, and historical context and traces its development as a spatial and temporal metaphor that reflects the sociogenetic root of all human mental functioning. Beyond the explication of sociogenesis, the ZPD is reconceptualized to include the notions of voice and dialogicality. The insights gained from the fields of semiotics (...) and discourse studies allow a broader understanding of the ZPD by bringing to light participant structures and institutional and historical forces that may not have been included in the dominant interpretations of the ZPD. The concept of brain death evolved because advancements in medical science permitted unprecedented artificial maintenance of vital body functions by external means. Although the concept of brain death is accepted clinically, ethically, and legally in the United States, there is no national standard for the determination of brain death. There is evidence that variability and inconsistency in the process of determining brain death exist both in clinical settings and in State statutes. Several studies demonstrate that medical personnel determine brain death (...) in variable ways, and have variable understandings of the definition of brain death. The declaration of death has significant legal consequences such as probate proceedings and liability issues for wrongful death. Inconsistencies in the determination of death may therefore be medically, ethically, and legally problematic. (shrink)

Hinging on a metaphysical examination of the concept of newness and Paul Guyer’s notion of the temporally extended self, this article analyzes what it means that we are a temporally extended being that is fashioned in time, which is none other than a transcendental object = newness, and argues that (fashioned) bodies can be things in themselves and mere phenomena simultaneously. Kant’s doctrine of self-positing assists us in decoding how the subject obtains an embodied experience while a thing in itself, (...) as well as how both a non-empirical affection and an empirical affection are at play, casually affecting the subject. By looking into how double affection is in operation, this article aims to broaden our understanding of Kant’s theory of self-consciousness. (shrink)

Green consumers are those who seek to fulfill economic responsibility with their choices of environment-friendly products. Previous research found that it is not easy to identify green consumers by using traditional demographic or psychographic measurements due to the instability of moral attitude and actual behavior. The frontal theta brain waves of 19 right-handed respondents were recorded and analyzed in a choice task between an environment-friendly (green) product and a conventional product. Product information, which was provided to the respondents, included written (...) descriptions as well as the price of each product without visual depiction. Based on the respondents’ choice, they were classified into two groups: green (GR) consumers who chose an environment-friendly product option and non-green (Non-GR) consumers who chose the option of a conventional product. While processing the green product message, we discovered that frontal theta activations were significantly higher among GR consumers than Non-GR consumers. On the contrary, the frontal theta waves of GR consumers were not differentiated from Non-GR consumers while processing the price information. Therefore, theta activations in the frontal area may potentially be a unique neural indicator of GR consumers’ cognitive engagement with environment-friendly product messages. (shrink)

This article provides a theoretical policy-making model of chemical sunset that gradually substitutes green alternatives for persistent toxic substances within a finite timeframe. The technological inflexibility of these substances is a tough obstacle to a chemical sunset, because a chemical sunset seeks to ultimately stop, within a short period of time, the risky businesses of these substances that are highly entrenched into our society. In wrestling with this obstacle, the intelligent precautionary “polluter pays” principle integrates three policy tools: a “precautionary (...) `polluter pays' principle,” “intelligent trial and error,” and democratic “regulatory negotiation.” It is designed to promote technological pluralism and strong democracy, as well as to create either trust or mutual adjustment among relevant groups. Analizaremos el papel que han tenido en el modo de entender las relaciones sociales y la creación de mecanismos de inclusión y exclusión dentro de la sociedad coreana. Las interrelaciones establecidas entre ellas como factor que ha contribuido al progreso de la sociedad y que diferentes grupos fueran aceptados o (...) rechazados a lo largo de la historia. Estudiamos como el pensamiento de estas tradiciones religiosas y el modo de entenderlo ha impulsado u obstaculizado los procesos de inclusión y liberación a lo largo de las diferentes etapas de la historia de Corea. As the COVID-19 pandemic continues to disrupt our lives in unimagined ways, families are reinventing daily rituals, and this is likely true for musical rituals. This study explored how parents with young children used recorded music in their everyday lives during the pandemic. Mothers of child aged 18 months to 5 years living in the United States played the role of home DJ over a period of one week by strategically crafting the sonic home environment, based on resources provided by (...) the authors, in response to their children’s mood and state. Using a newly developed data collection tool, inspired by the Experience Sampling Method, a total of 197 episodes were collected about children’s engagement with recorded music. Findings showed that while mothers utilized music to fulfill various emotional needs, they tended to use it to maintain or reinforce their child’s positive mood rather than to improve a negative mood. Also, mothers’ reports suggested various ways that young children engaged with music, being aligned with the multimodal nature of their musical experiences. Lastly, mothers reported that their strategic approaches to use recorded music seemed to help their children feel less distressed and happier, and this, in turn, aided in the reduction of some of the burdens associated with parenting. To effectively train ethical decision-making of nursing students, a case-based computer program was developed using Flash animation. Seven ethical cases collected from practicing registered nurses’ actual clinical experiences and a six-step Integrated Ethical Decision-Making Model developed by the author were employed in the program. In total, 251 undergraduate students from three nursing schools used the program in their nursing ethics course. The usability of the program and its usefulness in improving 11 abilities needed in ethical decision-making were measured; it scored (...) higher than 4 on a 5-point scale. Of the students, 82% recommended the program as a valuable complementary tool in the teaching of a nursing ethics course. A variety of encouraging and positive experiences were reported by the students. The computer program is likely to be usefully practical in the training of abstract skills to nursing students, though certain challenges remain, such as the precise understanding of cognitive or affective responses to ethical issues.
