Defense of a non-psychological dynamics of demonstrative thoughts.

The defence of necessity has had a long, though confused, legal career. Like self-defence, consent, duress, insanity and mistake of law, necessity is rooted in moral intuitions about when conduct which causes harm to another's person or property is not wrong, or should be tolerated, permitted or praised. If a man is literally starving to death and steals a loaf of bread, we are reluctant to say that his extreme circumstances should make no difference at all to the way we (...) treat him at trial. And if two men, adrift at sea, are clinging to a log which can only support the weight of one, we are once again reluctant to say that if one pushes the other off the log, it is just a case of murder. These intuitions are deepseated; but it is extremely difficult to articulate the defence they seem to support, or to isolate the circumstances which mark the difference between a situation where the defence ought to apply and where it ought not. Our utterances are typically if not always "situated," in the sense that they are true or false relative to unarticulated parameters of the extra-linguistic context. The problem is to explain how these parameters are determined, given that nothing in the uttered sentences indicates them. It is tempting to claim that they must be determined at the level of thought or intention. However, as many philosophers have observed, thoughts themselves are no less situated than utterances. Unarticulated parameters need not be mentally (...) represented. In this paper, I try to make precise the notion of representation at stake here. In one sense of 'representation', something is represented if it is inferentially relevant. In another, less demanding sense, something is represented if it is relevant to the construction of a context-sensitive, ad hoc concept. Ad hoc concepts act as "proxies" for cognitively more demanding representations. They "imitate" the latter's epistemic and pragmatic roles while being inferentially less sophisticated. Thus, there are two senses in which a thought can be said to be situated: (1) its truth-value is relative to a non-represented contextual parameter, (2) its truth-value is not itself relative, but it involves a context-sensitive, ad hoc concept. It is shown that a number of questions, usually considered philosophical rather than scientific, can be reformulated to apply to a world of automata or "well-informed heat engines." In some cases they admit of physical answers, but in many cases obtaining answers entails violation of the second law of thermodynamics. This is demonstrated explicitly for the problem of determinism and free will, for the discovery of the origin or ultimate fate of the universe, or for the discovery of causes or (...) purposes in nature. I argue that the issues of foodquality, in the most general sense includingpurity, safety, and ethics, can no longer beresolved through ``normal'' science andregulation. The reliance on reductionistscience as the basis for policy andimplementation has shown itself to beinadequate. I use several borderline examplesbetween drugs and foods, particularly coffeeand sucrose, to show that ``quality'' is now acomplex attribute. For in those cases thesubstance is either a pure drug, or a bad foodwith drug-like properties; both are marketed asif they were foods. (...) An example of theinadequacy of old ways of thinking is obesity,whose causes are as yet outside the purview ofmedicine, while its effects constitute anepidemic disease. The new drug/food syndromeneeds a new sort of science, what we call``post-normal.'' This is inquiry at the contestedinterfaces of science and policy; typically itdeals with issues where facts are uncertain,values in dispute, stakes high, and decisionsurgent. With the perspective of post-normalscience, we can better understand some keyissues. We see that ``safety'' is different from``risk,'' being pragmatic, moral, and recursive.Also, we understand that an appropriatefoundation for regulation and ethics is not somuch ``objectivity'' as ``awareness.'' In an agewhen ``consumers'' are becoming concerned``citizens,'' the relevant science must becomepost-normal. (shrink)

In this paper, I argue that within the Japanese social context, the act of suicide is a positive moral act because the values underpinning it are directly related to a socially pervasive moral belief that any act of self-sacrifice is a worthy pursuit. The philosophical basis for this view of the self and its relation to society goes back to the writings of Confucius who advocated a life of propriety in which being dutiful, obedient, and loyal to one's group takes (...) precedence over the desires of the individual selves that make up the group. I argue that this philosophical perspective poses formidable challenges to Japanese psychiatry (which accepts a contrary western perspective) because, as western psychiatry is based on the concept of autonomous individuality, the Japanese conceive of the self as socially embedded. Because suicide in Japan is viewed as a potentially honorable, virtuous, and even beautiful act of self-sacrifice expressing one's duty to one's group, the western perspective is quite foreign to the Japanese self-conceptual framework. Therefore, since Japanese psychiatry and law have embraced the western medical tradition of viewing suicide as a non-rational response to mental illness, which runs counter to the cultural view that suicide is a moral (and rational) act, I argue that western explanations of suicide present significant cross-cultural problems for Japanese psychiatry. In response to critical discussion of my book, A Tear Is an Intellectual Thing: The Meanings of Emotion, I clarify and develop various aspects of my analysis of jealousy in particular and affectivity in general. In relation to jealousy, I explore the nature of pathology, the role of fantasy and of the rival, and the place of examples and of evolutionary theory. In relation to affectivity, I emphasize the difference between distinguishing emotions from other psychological states and distinguishing among, within (...) and between, particular emotions (where affectivity may not be central). In addition, I emphasize the dangers of a version of G.E. Moore's error in demanding a nonreductive analysis of good in parallel demands for a nonreductive analysis of affectivity. (shrink)
