Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

Nash Teaching about Ferguson: An Introduction This forum was organized around the idea of asking feminist scholars to reflect on the practice of teaching about racial violence as well as on the experiences of teaching in the midst of racial violence. What do feminist pedagogies centered on Ferguson (...) and its aftermath look like? How do we present the various forms of violence—including state action (in the case of murder) and state inaction (in the case of nonindictments)— that produce and uphold the conditions that mark the current situation? How do we bring our feelings about this moment into our classrooms, and how do we do this feeling-teaching in ways that attend to the fact that feminist scholars are endlessly called on to perform affective labor and also that racialized and gendered bodies’ affects are policed inside and outside of the academy? What happens if we refuse the composure that faculty bodies are supposed to perform and enact grief, rage, or sadness? What happens if we refuse performing anything but exhaustion, numbness, or a protective desire to shield our bodies from our students’ scrutiny or curiosity? It quickly became apparent that a forum focused on “feminist pedagogies of Ferguson” would be far more expansive than a conversation focused on how to teach about Ferguson; put simply, to speak about Ferguson is always to speak about more than Ferguson. “Ferguson” has become shorthand for a murdered young man, Michael Brown, for a grand jury’s nonindictment of the police officer who shot him, and for 212 Jennifer C. Nash the Department of Justice’s recommendation not to bring civil rights charges against the officer, Darren Wilson. “Ferguson” has also become shorthand for a number of lives that ended violently, often at the hands of the state: Eric Garner, Oscar Grant, Trayvon Martin, Tarika Wilson, Tanisha Anderson, Renisha McBride, and Tamir Rice, to name a few. “Ferguson,” then, has become a keyword around which scholars organize conversations about legal murders, the variety of laws that regard property more than black life (so-called stand-your-ground laws, for example), racial profiling, stop and frisk, mass imprisonment, the death penalty, and the racial logics of systems of value that ensure that racially marked bodies are, in Lisa Marie Cacho’s words, “ineligible for personhood.”1 The scholars included in this forum capture the expansive ways that we, as scholars and educators, articulate the meanings of this moment and the ways that we situate Brown’s death in the conditions of the unfolding present. The scholars included in this forum also powerfully ask about the possibilities for activism in the wake of Ferguson(s) and the powerful coalitions that have formed in the wake of Ferguson(s). If “Black Lives Matter” (and #blacklivesmatter) and “I Can’t Breathe” have become refrains that respond to the violence of the present by making visible black pain, the scholars included here voice the possibilities these movements might open up. We can consider these possibilities alongside the painful truth that it takes spectacular violence to generate a widespread articulation of black bodies as bodies that matter. 1. We highlight how Corporate Social Responsibility can be strategically used against the negative perception from earnings management. Using international data, we analyse the effect of CSR and EM on the cost of capital and corporate reputation. Results confirm that CSR strategy is positively valued by investors and other stakeholders. Contrary to EM, CSR has a positive effect on corporate reputation and lowers the cost of capital. In addition, we also find that the favourable effect of CSR on cost of capital (...) is consistently more intense in firms that show signs of EM indicating that the market does not identify when CSR practices are used as a strategy to mask EM. The account of the death of Patroklos occupies a strategic position in the narrative economy of the Iliad: before this event, Achilles has withdrawn from combat out of indignation against Agamemnon; afterwards, his anger turns against Hector, whom he holds responsible for his friend's death. Achilles returns to battle and kills Hector in an act of vengeance that, as we have known from the beginning of the poem, will lead to his own demise, which is not actually recounted in the (...) Iliad. This episode stands out because it is atypical both in the contents of the narration and in the means of expression used (what are generally termed “formulas”). I will give some examples of these oddities and then propose an interpretation. Here is the text, in the translation by Richmond Lattimore:So long as the sun was climbing still to the middle heaven, so long the thrown weapons of both took hold, and men dropped under them; but when the sun had gone to the time for unyoking of cattle, then beyond their very destiny the Achaians were stronger and dragged the hero Kebriones from under the weapons and the clamour of the Trojans, and stripped the armour from his shoulders. And Patroklos charged with evil intention in on the Trojans. Using the example of recent attempts to engineer the concept of conspiracy theory, I argue that philosophers should be far more circumspect in their approach to conceptual engineering than we have been – in particular, that we should pay much closer attention to the history behind and context that surrounds our target concept in order to determine whether it is a site of what I have elsewhere called ‘conceptual domination’. If it is, we may well have good reason to avoid (...) engineering. In their recent ‘What is a Conspiracy Theory?’, M. Giulia Napolitano and Kevin Reuter argue that the disagreement between generalists and particularists in the literature on conspiracy theories is best characterized as a set of dueling conceptual engineering projects. While I agree with their turn to this metaphilosophical literature, I give a very different account of its applicability. Particularists, on my account, are better read as aiming to diagnose the ways in which many discussions of the concept of conspiracy theories are a form of conceptual domination, where this broader context should then prompt us to abandon or block any concept of conspiracy theory that treats its referents as inherently defective. In this paper, I present two tools that help shed light on deep disagreements and their epistemological consequences. First, I argue that we are best off construing deep disagreements as disagreements over conflicting understandings of certain concepts. More specifically, I suggest that deep disagreements are disagreements over how to understand concepts that play what Michael Friedman calls a “constitutive” role for speakers. Second, I argue that we need a better understanding of what speakers are doing when they engage in deep (...) disagreements—what speech acts they are carrying out. I show that we are best off not reducing the relevant speech acts to more familiar speech act kinds, such as assertions or imperatives. I argue that when a speaker articulates an understanding of a concept, they are in part carrying out an act of stipulation. I provide an account of the pragmatics of stipulation and apply the account to examples of deep disagreement. Focusing on the stipulative dimension of deep disagreement opens up, in turn, a novel approach to defusing the epistemological challenges such disagreement seems to pose. (shrink)

Metanormativists hold that moral uncertainty can affect how we ought, in some morally authoritative sense, to act. Many metanormativists aim to generalize expected utility theory for normative uncertainty. Such accounts face the “easy problem of intertheoretic comparisons”: the worry that distinct theories’ assessments of choiceworthiness are incomparable. The easy problem may well be resolvable, but another problem looms: while some moral theories assign cardinal degrees of choiceworthiness, other theories’ choiceworthiness assignments are merely ordinal. Expected choiceworthiness over such theories is undefined. (...) Call this the “hard problem of intertheoretic comparisons.” This paper argues that to solve the hard problem, we should model moral theories with imprecise choiceworthiness. Imprecise choiceworthiness assignments can model incomplete cardinal information about choiceworthiness, with precise cardinal choiceworthiness and merely ordinal choiceworthiness as limiting cases. Generalizing familiar decision theories for imprecise choiceworthiness to the case of moral uncertainty generates puzzles, however: natural generalizations seem to require reifying parts of the model that don’t correspond to anything in normative reality. I discuss three ways of addressing this problem: by demystifying the reified elements by using them as promiscuously as possible; by constructing alternative decision theories that don’t require the troublesome elements; and by employing an alternative model of metanormative decision problems, and of moral uncertainty generally. We are all capable of arriving at views that are driven by corrupting non-epistemic interests. But we are nonetheless very skilled at performing a commitment to epistemic goods in such cases. I call this the ‘Problem of Mere Epistemic Performance’, and it generates a need to determine when these commitments are illusory and when they are in fact genuine. I argue that changing one’s mind, when done in response to the evidence and at a likely cost to oneself, are the (...) best indications that an agent is committed to epistemic goods, that they are genuinely in the game of giving and asking for reasons. This is because changing one’s mind in this way goes as far as we can in eliminating the possibility that the agent has an ulterior motivation for their epistemic practices. Moreover, this account shows that the consensus view of the ideal epistemic agent is mistaken. The ideal agent must have false beliefs or deficient epistemic practices because only then do they have the opportunity to change their mind and establish a commitment to epistemic goods – a commitment that even an agent with only true beliefs and maximal justification or understanding may lack. Aesthesis, the classical term for sensing and perceiving, is at the heart of innumerable problems that plague global society. The purpose of this article is to open a conversation on aesthesis. We survey the roots and relevance of aesthesis as a direct albeit contested relation and engagement with the world and with Others. From its pre-Socratic origins, aesthesis has been both a pragmatic, somatic concept, prompting a re-evaluation of the distinction between experience and abstraction. We trace its ongoing repression from (...) Plato through ‘western’ theories of formal Aesthetics. Drawing on a relational interpretation of Protagoras’ aesthesis, we argue that modern pragmatists and radical empiricists, as well as more contemporary critics of the ‘colonization’ of aesthesis (Mignolo and Vasquez) by formal Aesthetics recognize and develop the relational and ethical aspects of aesthesis. We consider the role of the body, affect, and of the intangible or virtual qualities of aesthesis. The ethics of obligations (Weil) in the polis (Arendt) shows how aesthesis informs politics despite its repression in favour of moral and legal norms. We argue this is relevant to contemporary crises such as xenophobia and ecocidal climate warming. (shrink)

Emoji faces, which are ubiquitous in our everyday communication, are thought to resemble human faces and aid emotional communication. Yet, few studies examine whether emojis are perceived as a particular emotion and whether that perception changes based on rendering differences across electronic platforms. The current paper draws upon emotion theory to evaluate whether emoji faces depict anatomical differences that are proposed to differentiate human depictions of emotion. We modified the existing Facial Action Coding System to apply to emoji faces. An (...) equivalent “emoji FACS” rubric allowed us to evaluate two important questions: First, Anatomically, does the same emoji face “look” the same across platforms and versions? Second, Do emoji faces perceived as a particular emotion category resemble the proposed human facial expression for that emotion? To answer these questions, we compared the anatomically based codes for 31 emoji faces across three platforms and two version updates. We then compared those codes to the proposed human facial expression prototype for the emotion perceived within the emoji face. Overall, emoji faces across platforms and versions were not anatomically equivalent. Moreover, the majority of emoji faces did not conform to human facial expressions for an emotion, although the basic anatomical codes were shared among human and emoji faces. Some emotion categories were better predicted by the assortment of anatomical codes than others, with some individual differences among platforms. We discuss theories of emotion that help explain how emoji faces are perceived as an emotion, even when anatomical differences are not always consistent or specific to an emotion. (shrink)

Political corporate social responsibility (PCSR) calls for firms to implement and engage in deliberative democracy processes and structures, addressing governance gaps where governments are unwilling or unable to do so. However, an underlying assumption that the implementation of PCSR will enrich democratic processes in society has been exposed and challenged. In this conceptual article, we explore this challenge by developing a framework to reveal the dynamics of firms’ deliberative democratic processes and structures (meso level), and those at nation state (macro (...) level). Using existing cases as illustrative examples, we demonstrate that despite the public good premise of PCSR theory toward thickening the overall democracy in a society, corporate democratization at meso level can have the opposite effect and may actually erode macro-level democratic control of society and the economy. These findings imply a need for multilevel analysis in PCSR research and greater consideration of state-level public institutions and the responsibilities of business firms toward those institutions. Furthermore, we contribute to the PCSR literature by identifying the disruptive mechanisms associated with these dynamics and outline two alternative perspectives to allow firms to continue to take on political responsibilities. In this paper, I will argue that there is a deep connection between home-based care, technology, and the self. Providing the means for persons to receive care at home is not merely a kindness that respects their preference to be at home: it is an important means of extending their selfhood and respecting the unique selves that they are. Home-based technologies like telemedicine and robotic care may certainly be useful tools in providing care for persons at home, but they also (...) have important implications for sustaining selfhood in ways that are of value to individuals and those who care for them. I will argue, by appealing to Hilde Lindemann’s notion of “holding” persons’ identities in place, that technological interventions are not only useful tools for improving and sustaining health and good care at home, but that they may also help to extend our personal identities and relational capacities in ways that are practically and ethically good. Because of these important goods, I will claim that there is a prima facie moral duty to do this “holding” work and that it is best done by family members and loved ones who are well suited to the job because of their history and relationship with the individual that needs to be “held” in place. Neoliberal cultural frames of individual choice inform mothers’ accounts of why they refuse state-mandated vaccines for their children. Using interviews with 25 mothers who reject recommended vaccines, this article examines the gendered discourse of vaccine refusal. First, I show how mothers, seeing themselves as experts on their children, weigh perceived risks of infection against those of vaccines and dismiss claims that vaccines are necessary. Second, I explicate how mothers see their own intensive mothering practices—particularly around feeding, nutrition, and natural living—as (...) an alternate and superior means of supporting their children’s immunity. Third, I show how they attempt to control risk through management of social exposure, as they envision disease risk to lie in “foreign” bodies outside their networks, and, therefore, individually manageable. Finally, I examine how these mothers focus solely on their own children by evaluating—and often rejecting—assertions that their choices undermine community health, while ignoring how their children benefit from the immunity of others. By analyzing the gendered discourse of vaccines, this article identifies how women’s insistence on individual maternal choice as evidence of commitment to their children draws on and replicates structural inequality in ways that remain invisible, but affect others. Different notions of objectivity support different notions of what is required for a moral value or obligation to be experienced as objective. If the objectivity of a property requires that it can exist even when we fail to notice its existence, then experiencing a property as objective will require that we imagine it appearing in some way that is not presently available to us. Explaining what that imagining involves is the central task of this paper. Defending the epistemic value of (...) such imagining is a secondary aim. (shrink)

Commentators often claim that medical research subjects are coerced into participating in clinical studies. In recent years, such claims have appeared especially frequently in ethical discussions of research in developing countries. Medical research ethics is more important than ever as we move into the 21st century because worldwide the pharmaceutical industry has grown so much and shows no sign of slowing its growth. This means that more people are involved in medical research today than ever before, and in the future (...) even more will be involved. However, despite the pressing need for reflection on research ethics, it is important to carefully identify the concerns we have about research. Otherwise we run the risk that the moral language we use, and which we hear other people use, may do our moral thinking for us. We argue that many recent claims about the occurrence of coercion in medical research are misguided and misuse the word "coercion." We try to identify the real problems, and urge people to attend carefully to the implications of their descriptions of moral problems in research. (shrink)

This article offers a series of critical theorizations on the biopolitical dimensions of methicillin-resistant Staphylococcus aureus (MRSA), with specific attention to what has recently been referred to in the United States as the ‘MRSA Epidemic’. In particular, we reflect on the proliferation of biomedical discourses around the ‘spread’, and the pathogenic potentialities, of community-associated methicillin-resistant Staphylococcus aureus (CA-MRSA). We turn to the work of Roberto Esposito and Jean-Luc Nancy to better make sense of how, during this immunological crisis, the individualized (...) fleshy and fluid body is articulated to dimensions of community and corporeal proximity; the body is thus conceived in popular biopolitical framings as a site of transmission, inoculation, and isolation – as a living ecological and pathological vessel. We give emphasis to the spatial relations of flesh, namely in how biomedical ‘experts’ have sought to (bio-)technologize spaces of heightened communal bodily contact (such as playgrounds or gymnasia). Demonstrating value is an ongoing process and requirement for institutional survival for ethics programs. Although our ethics program has significantly increased our ethics consultation volume and maintains a robust database that tracks ethics consultation data, these data regarding ethics consultations alone do not accurately represent the program’s overall activities and value to the institution. The roles and responsibilities of clinical ethicists extend beyond clinical ethics consultation, and there are many other ways that clinical ethicists contribute and add value to their (...) institutions. This article describes our ethics program’s early efforts to systematically track ethics program activities outside of ethics consultations as a way to demonstrate additional value to the institution that goes beyond ethics consultation. By systematically tracking activities such as internal ethics education sessions, conference presentations, publications, grants, committee/policy work, and other activities, our ethics program has been able to gather substantial quantitative data that highlight our program’s numerous activities and outreach, both within and outside the institution, that provide additional value to the institution beyond our ethical consultation activities. There is currently a tremendous surge in interest in the virtue of humility among contemporary philosophers and psychologists. Yet despite its recent popularity, identifying necessary and sufficient conditions for humility has proven quite difficult. Here, drawing on insights from several ‘inattentive’ accounts of humility, I offer a new account that locates the virtue in a transcendent orientation to the self and others such that one sees the self and others in proper perspective. I argue for a novel reading of the mover principle used in Aquinas’s motion proofs for God’s existence. Many interpret Aquinas’s principle as holding that everything in motion is moved by something else currently in contact with it. Others, following James Weisheipl, understand the principle as claiming only that everything being moved is being moved by something else. I argue against both readings and hold that the principle means that everything in motion is moved by something else—whether that something else (...) simply set it in motion or is currently moving it by contact. By looking closely at Aquinas’s inductive argument for the mover principle, I show that simultaneity between mover and moved is not necessary on Aquinas’s view. My interpretation allows me to respond to objections to Aquinas’s act-potency argument for the mover principle more convincingly than others, and sets the groundwork for robust engagement between Thomism and modern science. In this paper I shall first expose a weakness shared by several philosophical discussions of self-deception: I shall show that these discussions have failed to give it a complete analysis. The apparent phenomenon of self-deception is all too familiar, and yet its adequate characterization in general terms is wanting. More exactly, I shall argue that to understand self-deception statically, as these accounts have done, has been—and must be—to fail to give a characterization of it as a state of mind, sufficient (...) to distinguish it from other mental states not born of self-deception. The Federal Trade Commission has an important role to play in the governmental oversight of mobile health apps, ensuring consumer protections from unfair and deceptive trade practices and curtailing anti-competitive methods. The FTC’s consumer protection structure and authority is outlined before reviewing the recent FTC enforcement activities taken on behalf of consumers and against developers of mhealth apps. The article concludes with identification of some challenges for the FTC and modest recommendations for strengthening the consumer protections it provides.

Concealing information requires that adolescents manage the information that they share, which requires cognitive skills, for example, theory of mind. This study explored motivations for concealment that early adolescents endorsed concealing or disclosing to friends and parents, in relation to their theory of mind. We found that adolescents broadly endorsed disclosure to both parents and friends, even when it might mean they would face consequences, be impolite, or face negative identity-related emotions. We found that ToM ability was associated with a (...) tendency to endorse being forthcoming and sharing information with both friends and parents. These findings provide new insight into how the relation between ToM and concealment may change with age, specifically how in early adolescence it may foster open communication rather than concealment as is the case in early and middle childhood. As scholars integrate empirical approaches to ethical questions in healthcare, relational autonomy theory must inform research design and change practice. Qualitative approaches are well suited to issues where patient values play a central role, and they can be combined with relational autonomy theory to investigate the factors influencing autonomy-rich experiences. This paper draws upon my experience conducting bioethics research related to clinical trial decision-making to develop a systematic method for applying relational autonomy as a theoretical lens to qualitative health research. Phenomenologist Merleau-Ponty, early on, neglected music's theoretical value in favor of painting's. Later, however, he found that it is the transience of music that speaks to the phenomenological experience of Being. This transition from painting to music presents the possibility of an ontological understanding of music for psychoanalysis. For Freud, music and morality were both from a “beyond” that was an effect of neurosis. Drawing on psychoanalyst Bion's idea of container–contained, and his disciple Meltzer's application of this to art, as (...) well as Bion's later innovation of the unknowable O, I apply Merleau-Ponty's distinction between painting and music to the therapeutic nature of art in order to see what sort of psychoanalytically significant revelation is obtained through music.
