Biometric technologies are at the forefront of organizational innovation, surveillance, and control. In many instances, the use of physiological and behavioral biometrics enhances individual and organizational performance. However, they also have the potential to hinder human wellbeing. In particular, recent generations of biometrics are capable of extracting deeper insights into human behavior, enabling organizational surveillance practices, but may also constrain individual rights and freedoms. While biometric technologies have been evidenced to infringe upon privacy and lead to discriminatory practices, little research (...) has examined the impact of biometrics on dignity, an important ethical construct related to human wellbeing. In this conceptual paper, we draw from the theory of affordances to identify and delineate six affordances of biometric technologies, categorized into inhibiting and augmenting biometric affordances. We propose a framework in which inhibiting and augmenting biometric affordances may simultaneously support and humiliate dignity. This separation offers a theoretical base for future empirical research to explore the increasingly pervasive relationship between biometric adoption and human dignity. Moreover, we explain six paradoxical tensions across three forms of dignity—inherent, behavioral, and meritocratic—in the proposed framework. Finally, we discuss why firms should be responsible for addressing the tensions across dignity forms when they adopt biometric technologies to balance the trade-off between wealth creation and human wellbeing. This offers guidance for practitioners on how to integrate biometric technologies without hindering human dignity. (shrink)

Animal welfare is emerging as one of the most controversial issues in modern livestock agriculture. Although consumers can buy free range products in niche markets, some have argued that existing markets cannot solve the animal welfare dilemma because there are individuals who care about animal well-being who do not eat animal products. This paper proposes a market-based solution to at least partially manage animal welfare externalities. After discussing the current lack of market incentives to promote farm animal well-being, a potential (...) scheme to quantify and trade units of farm animal well-being is proposed. This essay reflects on my academic work and personal experience as a bonsai enthusiast. Specifically, I plan to point out how Deleuzian theory informs my bonsai practice. First, I situate bonsai gardening as an encounter with the vegetal world. Then I consider this encounter as a form of Deleuzian becoming. Becoming reifies a transformation of the two species to become another version of itself—one that occurs between a bonsai and its carer. As a bonsai carer myself, I find becoming as (...) a precise illustration of my relationship with bonsais; hence, a vegetal encounter in the making. (shrink)

With the delegation of ethical checking mechanisms to the institutional review boards (IRBs), flexible interpretations of overarching research ethics principles differed across scientific and cultural settings. This article is a comparative case study of ethical frameworks for social research in the Philippines and Taiwan. Justifications in choosing the two cases preponderantly focused on data trends regarding research and development (R&D) policy and practice. This article compared the elements observed in the two frameworks, specifically in terms of: national regulations, curricular requirements, (...) procedures for IRB review application, and other arrangements. Findings revealed that the Philippine academe enjoys relative autonomy or described as more fragmented, unlike Taiwan institutions that strictly follow centralized and country-wide standardization. The intensification of research ethics in Taiwan did not, however, hamper R&D efforts. On the contrary, the Taiwan model may have strengthened the current research ecosystem and bolstered confidence in the different sectors, thus generating multi-sectoral funding and collaborations. From the start, John Dewey's ideas about education have been prone to misunderstanding. One of the greatest casualties has been "experience," a term so routinely misappropriated that Dewey ultimately decided to abandon it. He wrote, "I would abandon the term 'experience' because of my growing realization that the historical obstacles which prevented understanding of my use of 'experience' are, for all practical purposes, insurmountable. I would substitute the term 'culture' because with its meanings as now firmly established it can fully (...) and freely carry my philosophy of experience" (1981, p. 361). Using moral realism as its reference point, David Brink's book provides a sophisticated metaethical defense of ethical cognitivism. The principal elements of Brink's position include: moral realism, an externalist moral psychology, a coherentist moral epistemology, a nonreductive form of ethical naturalism, and an objective conception of utilitarianism. Moral realism is defined as "the view that there are moral facts and true moral claims whose existence and nature are independent of our beliefs about what is right or wrong". This article develops the notion of resistance as articulated in the literature of critical pedagogy as being both culturally sponsored and cognitively manifested. To do so, the authors draw upon John Dewey's conception of tools for inquiry. Dewey provides a way to conceptualize student resistance not as a form of willful disputation, but instead as a function of socialization into cultural models of thought that actively truncate inquiry. In other words, resistance can be construed as the cognitive and emotive dimensions (...) of the ongoing failure of institutions to provide ideas that help individuals both recognize social problems and imagine possible solutions. Focusing on Dewey's epistemological framework, specifically tools for inquiry, provides a way to grasp this problem. It also affords some innovative solutions; for instance, it helps conceive of possible links between the regular curriculum and the study of specific social justice issues, a relationship that is often under-examined. The aims of critical pedagogy depend upon students developing dexterity with the conceptual tools they use to make meaning of the evidence they confront; these are background skills that the regular curriculum can be made to serve even outside social justice-focused curricula. Furthermore, the article concludes that because such inquiry involves the exploration and potential revision of students' world-ordering beliefs, developing flexibility in how one thinks may be better achieved within academic subjects and topics that are not so intimately connected to students' current social lives, especially where students may be directly implicated. Research on academic cheating by high school students and undergraduates suggests that many students will do whatever it takes, including violating ethical classroom standards, to not be left behind or to race to the top. This behavior may be exacerbated among pre-med and pre-health professional school students enrolled in laboratory classes because of the typical disconnect between these students, their instructors and the perceived legitimacy of the laboratory work. There is little research, however, that has investigated the relationship between high (...) aspirations and academic conduct. This study fills this research gap by investigating the beliefs, perceptions and self-reported academic conduct of highly aspirational students and their peers in mandatory physics labs. The findings suggest that physics laboratory classes may face particular challenges with highly aspirational students and cheating, but the paper offers practical solutions for addressing them. Attention to big data analytics is ubiquitous and growing given the online shopping revolution and its potential to generate individual-specific actionable datasets which were previously unavailable or cumbersome to cultivate. However, the food industry has not drawn much attention to discussions of individualized pricing strategies using online grocery datasets. Considering growth of the online grocery market and consumers data abundance to grocers, this brief viewpoint article focuses on potentials of incorporating big data analytics into pricing strategies in online grocery markets. (...) This discussion informs of various practices of big data analytics and ultimately calls to attention the potential for personalized pricing in online food markets. This article proposes the need for empirical analysis and developing research agendas investigating impacts of personalized pricing on market efficiencies, which is not as unambiguous in practices as it is theoretically. Biomedical research involving human participants is highly regulated and subject to stringent ethical requirements. Clinical research ethics, regulation and policy have tended to focus almost exclusively on the protection of participants' interests against harms that might result from taking part in research. Less consideration, however, has been given to the interests that patients may themselves have in research participation, even in trials that may be beyond the bounds of current clinical research practice. In this paper, we consider the case of (...) a suggested extension to clinical trial protocols to explore the ethics of participation in ‘risky’ research. We argue that patients may have a strong interest in taking part in research, and that even when greater-than-usual risks may be present, such research can be both ethically and scientifically justified. Finally, we suggest that there might be scope in some cases to assert a right to participate in research, and that the possibility of such a right merits further consideration. (shrink)

This paper critically reviews the judgment of the United States Court of Appeals for the Ninth Circuit In re: Jayson Reynoso: Frankfort Digital Services et al., v. Sara L. Kistler, United States Trustee et al. (2007) 447 F.3d 1117. The appellants, who were non-lawyers, were indicted with unauthorised practice of law for offering bankruptcy petition services via online legal software or expert systems in law configured for filing bankruptcy petition forms. The United States Court of Appeals for the Ninth (...) Circuit found inter alia that appellants were bankruptcy petition preparers, and not being lawyers, had exceeded their clerical remit by offering legal advice and legal services in contravention of California law regulating legal practice and 11 U.S.C. Sect. 110 of the Bankruptcy Code (2002). While examining the legal ramifications of the use of legal software by non-lawyers in the preparation of legal documents, the paper critically reviews the factual circumstances of the Reynoso decision in the context of juridical and statutory constructs of unauthorised practice of law in the United States. The paper poses the question whether Reynoso should be viewed as a one-off decision bound by its peculiar facts, or good law for the broad proposition that non-lawyers cannot use legal software in legal documents preparation. The paper also notes the possible legal barriers to an unconditional ban on the design, sale, distribution, and uses of legal software by non-lawyers. These range from the First Amendment right to free speech, constitutional right to pro se legal representation, interstate commerce doctrine, to antitrust provisions of the Sherman Act. A regime of best practices for the use of legal software or expert systems in law by non-lawyers is proffered. (shrink)
