Medical-legal partnerships — collaborative endeavors between health care clinicians and lawyers to more effectively address issues impacting health care — have proliferated over the past decade. The goal of this interdisciplinary approach is to improve the health outcomes and quality of life of patients and families, recognizing the many non-medical influences on health care and thus the value of an interdisciplinary team to enhance health. There are currently over 180 MLPs at over 200 hospitals and health centers in the United (...) States, with increasing federal interest and potential legislative support of this model.This article examines the unique, interrelated, and often similar ethical issues that confront the clinical and legal partners involved in MLPs. We contend that the ethical precepts of the clinical and legal professions should be seen as opportunities, not barriers, to further the interdisciplinary nature of MLPs. (shrink)

Owen Flanagan has recently argued for the claim that "the overall spirit--of Quine's philosophy warrants [a]--robust, realistic, and cognitivist picture of ethics." I believe that Flanagan's interpretation of Quine's philosophy is mistaken. Specifically, I argue that the overall spirit of Quine's philosophy, especially his treatment of cognitive meaning, warrants a noncognitivist and thus antirealist account of normative ethics My argument helps explain what Quine means when he wrote that ethics is methodologically infirm as compared to science.

Richmond Campbell and Victor Kumar’s _A Better Ape_ is very plausible accout of how the “moral mind” evolved. In my commentary, I raise questions and objections regarding their views on the units of selection, the emotions, the intrinsic motivation of moral norms, and the nature of moral progress.

Experimental research in moral psychology can be used to generate debunking arguments in ethics. Specifically, research can indicate that we draw a moral distinction on the basis of a morally irrelevant difference. We develop this naturalistic approach by examining a recent debate between Joshua Greene and Selim Berker. We argue that Greene's research, if accurate, undermines attempts to reconcile opposing judgments about trolley cases, but that his attempt to debunk deontology fails. Jay Rosenberg offers a systematic philosophical theory of knowledge which is specifically responsive to the fact that we always engage the world from a particular perspective within it. It consequently calls into question in a fundamental way many received understandings regarding the relationships among the concepts of knowledge, belief, justification, and truth.

Achieving genuine engagement and understanding between communities with radically divergent worldviews is challenging. If there is no common ground on which to stand and have a discussion, the likely outcomes of an apparent intercultural disagreement are a stalemate, or the (sometimes colonialist) imposition of a single worldview, or a kind of relativistic tolerance that falls short of genuine engagement. In this paper, we suggest a way forward that takes as its starting point the philosophical discussion of deep disagreement, using the (...) example of taniwha (powerful water beings that must be treated with respect) to outline a strategy for building intercultural understanding and enabling constructive intercultural dialogue. Over the past 20 years, global ethics has come to be conceived in different ways. Two main tendencies can be distinguished. One asks from whence global ethics comes and defines ‘global ethics’ as arising from globalization. The other tendency is to ask whither global ethics must go and thus defines ‘global ethics’ as a destination, namely arriving at a comprehensive global ethic. I will note some types of discussion that may have been wrongly excluded from the scope of global ethics (...) by one or the other. In addition, I take notice of recent debates and concerns about risks that global ethics may become a neo-colonial activity. These concerns raise a further conceptual question. Should ‘global ethics’ be defined in a normative fashion, so as to exclude neo-colonial approaches that may be damaging to the credibility of global ethics? In response to these alternatives – whence vs. whither, descriptive vs. normative – I will propose a middle way. I begin by defining ‘global problems’ as those that will cause harm in the absence of cross-border cooperation. In a descriptive sense, any ethical statements about global problems should be included within the scope of global ethics. On the other hand, I will propose a more specific normative conception of the central task of global ethics: seeking reasonable and responsible agreement on global problems, agreement based on possibly diverse moral grounds. This research empirically investigated the CSR practices of 84 Botswana and Malawi organizations. The findings revealed that the extent and type of CSR practices in these countries did not significantly differ from that proposed by a U. S. model of CSR, nor did they significantly differ between Botswana and Malawi. There were, however, differences between the sampled organizations that clustered into a stakeholder perspective and traditional capitalist model groups. In the latter group, the board of directors, owners, and shareholders were (...) important stakeholders that appeared to be restricting extended stakeholder CSR activities in the Malawi and Botswana organizations. The sampled managers recognized the economic benefits of CSR practices and were not at odds with social objectives. (shrink)

The Routledge Handbook of Development Ethics provides readers with insight into the central questions of development ethics, the main approaches to answering them, and areas for future research. Over the past seventy years, it has been argued and increasingly accepted that worthwhile development cannot be reduced to economic growth. Rather, a number of other goals must be realised: - Enhancement of people's well-being - Equitable sharing in benefits of development - Empowerment to participate freely in development - Environmental sustainability - (...) Promotion of human rights - Promotion of cultural freedom, consistent with human rights - Responsible conduct, including integrity over corruption Agreement that these are essential goals has also been accompanied by disagreements about how to conceptualize or apply them in different cases or contexts. Using these seven goals as an organizing principle, this handbook presents different approaches to achieving each one, drawing on academic literature, policy documents and practitioner experience. As a contribution to development ethics, this article attempts to clarify what 'empowerment' should mean, in so far as it is a valuable goal. I begin with the core ethical idea of empowerment that is to be found in recent work on measuring empowerment, led by Deepa Narayan, namely: empowerment occurs when people are better able to shape their own lives. Since this is a metaphor, I attempt to articulate a corresponding literal meaning. What I find is that people are (...) empowered to the extent that: (a) they exercise enhanced decision-making and influence over strategic life-choices and barriers to agency and well-being freedom; (b) their capacity for such decision-making and influence has also been enhanced; and (c) they are capable of making these gains prevail, given (i) the capabilities they have and assets they control, individually or collectively, and (ii) the opportunity structure in which they act. The Science Wars have pitted defenders of science against those accused of attacking it with the weapons of constructivism and relativism. I argue that this defensive stance is in large part a consequence of two other -isms, organized skepticism and naïve methodism, that play a significant, if mostly unconscious, role in how scientists tend to think about science, and suggest that increased awareness of these -isms may help dissipate the perceptions of hostility.

The underlying assumption of Lukács’ History and Class Consciousness is that “history” can be understood as a unified and meaningful meta-narrative, which can be read along the lines of a realist novel. Although the future is not guaranteed, the present contains “objective possibilities” which can be identified and realized through activist intervention in the world by those who are destined to “make” history, the proletariat. In the intervening century since the Russian Revolution, it has become impossible to read “history” as (...) a singular, triumphalist story leading to human emancipation or identify any one group as its subjective agent. To salvage the revolutionary potential of Lukács’ work, it has been read instead in terms of “fidelity to the Event” by such latter-day Leninists as Alain Badiou and Slavoj Žižek. But their recourse to a meta-historical notion of pre-figuration and future realization is itself no less beholden to a literary or rhetorical device, that of figura, which was traced by Erich Auerbach in originally religious terms. Adoption of the Millennium Development Goals triggered much discussion among donor states, multilateral institutions, and developing countries towards changing dysfunctional patterns of interaction that seemed to put the MDGs at risk from their inception. Initially in these high-level discussions, accountability was understood in a state-centric way, primarily as accountability to donors. This needed to be modified with the shift towards developing-country ownership of development strategies and programs. Yet an even greater change was in store when civil society organizations were included (...) in the discussions, since their focus was on accountability to project-affected persons and communities. Hence a new and irreducible conception of accountability came on stage. I characterize this as accountability to the subjects of development and show how it is required and justified by development ethics, based on values of agency and justifiability. This results in a dual standard for accountability: reducing stakeholders’ vulnerability to harmful and inequitable outcomes, and ensuring the justifiability of development projects to affected persons and communities. In The Idea of Justice , Amartya Sen argues for an approach to justice that is comparative and realization-based rather than transcendental and institutional. While Sen’s arguments for such an approach may not be as convincing as he thought, there are additional arguments for it, and one is that it provides a unique and valuable platform on which an account of justice as a virtue of social and political actors (including institutions and social movements) can be built. Hence new dimensions (...) of comparison are opened up: some actors are better disposed and more successful than others at leading social change in the direction of greater justice. The main objective of this article is to use the capability approach to construct such an account. Six dimensions of acting justly are identified: (1) reducing capability shortfalls; (2) expanding capabilities for all; (3) saving the worst-off as a first step towards their full participation in economy and society, (4) which is also to be promoted by a system of entitlements protecting all from social exclusion; while (5) supporting the empowerment of those whose capabilities are to expand; and (6) respecting ethical values and legitimate procedures. A study of contemporary philosophical and neuroscientific perspectives on the relation of action, perception, and cognition as it is lived in embodied and socially embedded experience.

This book explores the cultures of philosophy and the law as they interact with neuroscience and biology, through the perspective of American jurist Oliver Wendell Holmes’ Jr., and the pragmatist tradition of John Dewey. Schulkin proposes that human problem solving and the law are tied to a naturalistic, realistic and an anthropological understanding of the human condition. The situated character of legal reasoning, given its complexity, like reasoning in neuroscience, can be notoriously fallible. Legal and scientific reasoning is to be (...) understood within a broader context in order to emphasize both the continuity and the porous relationship between the two. Some facts of neuroscience fit easily into discussions of human experience and the law. However, it is important not to oversell neuroscience: a meeting of law and neuroscience is unlikely to prove persuasive in the courtroom any time soon. Nevertheless, as knowledge of neuroscience becomes more reliable and more easily accepted by both the larger legislative community and in the wider public, through which neuroscience filters into epistemic and judicial reliability, the two will ultimately find themselves in front of a judge. A pragmatist view of neuroscience will aid and underlie these events. (shrink)

In this commentary, we offer an additional function of rationalization. Namely, in certain social contexts, the proximal and ultimate function of beliefs and desires is social inclusion. In such contexts, rationalization often facilitates distortion of rather than approximation to truth. Understanding the role of social identity is not only timely and important, but also critical to fully understand the function of rationalization.

Instead of another federal advisory panel to identify ethical principles governing human subjects research, it is time we had a national board with authority to regulate and review such research.

Aurélien Drezet has attempted in Found. Phys. 54(1), 5 (2023) to defend Relational Quantum Mechanics (RQM) against our recent critique, entitled Relational Quantum Mechanics is incompatible with quantum mechanics, published in Quantum 7, 1015 (2023). Drezet not only misrepresents our work, but he also misconstructs the very theory (RQM) that he claims to defend.

Many of the ethical problems that are posed by development can be illuminated by clarifying some of the differences between development that is worthwhile and ethically undesirable ?maldevelopment?. So it is with development projects that displace communities that physically stand in their way: typically the ?oustees? are victimized and disempowered, in some cases by projects that are also indefensible in other ways. Can this help us to clarify what is owed to people who are displaced by climate change, the ?climate (...) migrants? or ?climate refugees?? These people, I will show, have a distinctive set of moral entitlements, which may include compensation and aid for resilience or resettlement; in addition, they are entitled to be included in decision-making in ways that are empowering. As demonstrated by Marx’s fierce defence of his integrity when anonymously accused of lying in 1872, he was a principled believer in both personal honesty and the value of truth in politics. Whether understood as enabling an accurate, ‘scientific’ depiction of the contradictions of the present society or a normative image of a truly just society to come, truth-telling was privileged by Marx over hypocrisy as a political virtue. Contemporary Marxists like Alain Badiou continue this tradition, arguing that revolutionary politics (...) should be understood as a ‘truth procedure’. Drawing on the alternative position of political theorists such as Hannah Arendt, who distrusted tin; monologic and absolutist implications of a strong notion of truth in politics, this paper defends the role that hypocrisy and mendacity, understood in terms of lots of little lies rather than one big one, can play in a pluralist politics, in which, pace Marx, rhetoric, opinion and the clash of values resist being subsumed under a singular notion of the truth.
