The advent of simple in vitro fertilisation techniques has provided the reproductive biologist with an invaluable system for assaying sperm fertilising ability. In particular, they provide a useful way of identifying and characterising gamete‐specific proteins that play a role in sperm‐egg interactions, and in recent years, a growing number of sperm surface proteins have been identified that appear to be involved in these processes. Fertilin β was one of the first sperm membrane proteins to be implicated in egg interactions and (...) it has been proposed that this is mediated by means of binding of its disintegrin‐like domain to cognate integrin receptors on the egg plasma membrane. A recent paper in Science by Cho and colleagues [Cho et al. 1998. Fertilisation defects in sperm from mice lacking fertilin β. Science 281:1857–1859 (Ref. 1)] provides preliminary data on a fertilin β knockout mouse. Whilst fertilin βnull males had greatly reduced fertility, somewhat surprisingly, this could be largely attributed to causes other than impaired binding to the egg plasma membrane. This article describes the origin and the work of a volunteer run nonprofit agency designed to provide low cost psychotherapy. The agency was developed by psychotherapists connected with the Seattle University graduate program guided by the vision of psychotherapy as a healing relationship and in response to a growing crisis in the mental health system. We address the benefits and the challenges of this collaborative effort, and especially the difficulty involved in successfully running an agency while staying true to a (...) particular vision of therapy, collaboration, and community. The growth and sustainability of the nursing profession depends on the ability to recruit and retain the upcoming generation of professionals. Understanding the career choice experiences and professional expectations of Millennial nurses (born 1980 or after) is a critical component of recruitment and retention strategies. This study utilized Polkinghorne's interpretive, narrative approach to understand how Millennial nurses explain, account for and make sense of their choice of nursing as a career. The positioning of nursing as a virtuous choice was both (...) temporally and contextually influenced. The decision to enter the profession was initially emplotted around a traditional understanding of nursing as a virtuous profession: altruistic, noble, caring and compassionate. The centricity of virtues depicts one‐dimensional understanding of the nursing profession that alone could prove dissatisfying to a generation of professionals who have many career choices available to them. The narratives reveal how participants' perceptions and expectations remain influenced by a stereotypical understanding of nursing, an image that remains prevalent in society and which holds implications for the future recruitment, socialization and retention strategies for upcoming and future generations of nurses. The application of probabilistic arguments to rational decisions in a single case is a contentious philosophical issue which arises in various contexts. Some authors (e.g. Horgan, Philos Pap 24:209–222, 1995; Levy, Synthese 158:139–151, 2007) affirm the normative force of probabilistic arguments in single cases while others (Baumann, Am Philos Q 42:71–79, 2005; Synthese 162:265–273, 2008) deny it. I demonstrate that both sides do not give convincing arguments for their case and propose a new account of the relationship between probabilistic reasoning (...) and rational decisions. In particular, I elaborate a flaw in Baumann’s reductio of rational single-case decisions in a modified Monty Hall Problem. (shrink)

Physics textbooks from ca 1800 are on the one hand self reflective texts that consider the then emerging discipline ‚physics’︁, and serve on the other hand as the bread and butter for the day to day work of teachers and students of physics. The two parts of this paper explore this twofold nature. First, those textbooks written and used by professors in Jena, Halle and Göttingen are used in order to identify a typical textbook. This relies on a close examination (...) of the respective introductory chapter and the one on electricity. The result is used in the second part to provide the background for the reconstruction of the use of physics textbooks in Jena. It is shown when and, as far as possible, why each particular textbook was chosen, withdrawn, neglected, changed or written in the course of physics teaching from 1780 to 1820. Some conclusions are drawn with regard to Jena's position in physics at that time. (shrink)

We introduce a notion of a real game (a generalisation of the Karchmer-Wigderson game (cf. [3]) and of real communication complexity, and relate this complexity to the size of monotone real formulas and circuits. We give an exponential lower bound for tree-like monotone protocols (defined in [4, Definition 2.2]) of small real communication complexity solving the monotone communication complexity problem associated with the bipartite perfect matching problem. This work is motivated by a research in interpolation theorems for prepositional logic (by (...) a problem posed in [5, Section 8], in particular). Our main objective is to extend the communication complexity approach of [4, 5] to a wider class of proof systems. In this direction we obtain an effective interpolation in a form of a protocol of small real communication complexity. Together with the above mentioned lower bound for tree-like protocols this yields as a corollary a lower bound on the number of steps for particular semantic derivations of Hall's theorem (these include tree-like cutting planes proofs for which an exponential lower bound was demonstrated in [2]). Logical positivism had an important impact on the Danish intellectual climate before World War Two. During the thirties close relations were established between members of the Vienna Circle and philosophers and scientists in Copenhagen. This influence not only affected Danish philosophy and science; it also impinged on the cultural avant-garde and via them on the public debate concerning social and political reforms. Hand in hand with the positivistic ideas you find functionalism emerging as a new heretical language in art, architecture, (...) and design. Not surprisingly, you may say, since the logical positivists’ wishes of stripping philosophy of metaphysics is spiritually similar to the functionalists’ desire to get rid of symbols and ornaments. One event more than anything confirmed the connection between the Vienna Circle, Denmark, and the rest of the Nordic countries. For a short while Copenhagen became the centre for the Circle’s activities when in 1936 the 2nd Inter national Congress for the Unity of Science was held there between June 21 and 26. A photograph, taken during the conference, shows many of the participants sitting in the hall of Carlsberg’s honorary mansion where Niels Bohr was living at the time. Among the audience you find Otto Neurath , Carl Gustav Hempel and Karl Popper , but also some of the more prominent Danish scientists and scholars whose world views were congenial with the logical positivists. Paper $24.50.Given the irenic and deferential tone of John Berthrong's prose in his Concerning Creativity: A Comparison of Whitehead, Neville, and Chu Hsi, his readers might (...) not readily suspect that an intellectual drama of real significance is being played out in its pages. In this brief review I will attempt to provide the outlines of that drama, and to assess Berthrong's directing skills.We begin with the rather startling fact that before the "Dictionary Supplement" to the 1971 edition of the Oxford English Dictionary was published, one would have searched that work in vain for the principal word in the title of Berthrong's book. The OED entry on "creativity" contains three illustrations of its use-one from a literary critic (1875) and the other two from A. N. Whitehead's Religion in the Making (1926).Berthrong is to be congratulated for recognizing, as most process thinkers have not, that Whitehead introduced not only a new word into our philosophical vocabulary but also a radically novel means of interpreting the world and our experience of it-one that answers to feelings and forms of understanding that have been seriously marginalized in the West. What this means, of course, is that Whitehead's understanding of "creativity" in terms of the spontaneous emergence of novelty requires a radical transvaluation and reconstruction of the nature and import of ontological speculations within the Western tradition. The situation is further complicated by the fact that Western philosophy simply lacks interpretative insights permitting a responsible elaboration of Whitehead's understanding of creativity. Berthrong must look beyond Western culture to find resources with which to defend [End Page 571] Whitehead's novel understanding of creativity properly against the criticisms of mainstream ontologists such as Robert Neville.It is Whitehead's placement of ontological issues within his speculative scheme against which Neville's criticisms are directed. And, as we shall see, it is this same issue that leads Berthrong to appeal to the Chinese Neo-Confucian Chu Hsi to defend Whitehead against Neville.It is important to recognize that by the time that Berthrong was awakened from the contented slumber of a Whiteheadian scholastic by Neville's Calvinesque critique, he was already expert in the mainstream thought of an alternative cultural milieu. While other champions of Whitehead's novel speculations have been forced to work within the Western philosophical tradition, Berthrong is able to access a tradition in which discussions of creativity as the spontaneous emergence of novelty employ terms such as ch'i ("matter-energy," "energizing field"), tzu-jan ("self-soing"), i ("change," "becoming"), and ch'eng ("self-actualization," "creativity") that did not come late to Chinese dictionaries. Neville is certainly familiar with Chinese philosophical thought, but he approached the Asian traditions in a serious manner only after his principal intuitions had been systematically articulated. Thus, while Berthrong looks to the Chinese Neo-Confucians for assistance in formulating Whitehead's defense, Neville expects these same thinkers to offer exemplifications of his own solidly wrought reflections. The consequence of this state of affairs is that, in his debate with Neville, Berthrong has the advantage of a somewhat greater flexibility.Berthrong's flexibility is demonstrated by his method of engaging his principal interlocutors. He employ's Wayne Booth's "coductive" method, which avoids dialectical sublation or analytic reduction in favor of the analogical correlations of concepts and doctrines. Coduction is essentially an ethos-based method expressed through conversations or debates that aim not at refutation or the establishment of a final view but at an enlargement of understanding leading to what Whitehead termed "wide intellectual tolerance."In his triangulation of Whitehead, Neville, and Chu Hsi, Berthrong provides accurate and balanced presentations of the pertinent ideas of each of the principals. Estudo introdutório de apresentação, seguido de tradução, da palestra “Fenomenologia e antropologia”, ministradas por Edmund Husserl nas sedes da Kantgesellschaft de Frankfurt, Berlim e Halle em 1931, na qual avalia criticamente, a partir dos pressupostos transcendentais da fenomenologia, a tendência da filosofia alemã dos anos 20 do século passado para uma antropologia filosófica.

Zusammenfassung Hintergrund Advance Care Planning (ACP) wird auch in Deutschland zunehmend praktiziert. Aus klinisch-ethischer Perspektive bietet ACP eine Möglichkeit, Vorausverfügungen zu konkretisieren und auf diese Weise die Entscheidungsfindung bei fehlender Selbstbestimmungsfähigkeit von Patient:innen zu unterstützen. Während es für Gesprächsangebote im Sinne des ACP in Pflegeeinrichtungen und Einrichtungen der Eingliederungshilfe seit 2015 Finanzierungsmöglichkeiten gibt und erste Studien zu Angeboten veröffentlich wurden, fehlt es in Deutschland bisher an publizierten Evaluationsstudien zu ACP-Angeboten im Krankenhaus. Intervention und Methoden Im vorliegenden Beitrag erfolgt die strukturierte (...) Darstellung von ACP als ein Element des klinisch-ethischen Unterstützungsangebotes am Universitätsklinikum Halle (Saale) (UKH). Es erfolgte eine quantitative Inhaltsanalyse der schriftlichen Dokumentation von durchgeführten ACP-Gesprächsprozessen für den Zeitraum der Pilotphase von 01/2020 bis 08/2021 (20 Monate). Ergebnisse Im Zeitraum wurden 93 ACP-Gespräche angefragt. Mit 79 Patient:innen konnten 110 Gespräche geführt werden. 46 % der Anfragen kamen von Palliative Care betreuten Patient:innen. Im Durchschnitt dauerten die Beratungen 45 min. Der Gesprächsprozess zur Erstellung einer Patientenverfügung benötigte durchschnittlich 122 min und 2,5 Gespräche. Bei 23 % der Patient:innen endete der ACP-Prozess nach dem Erstgespräch. Die Inhalte der ACP-Prozesse tangierten verschiedene Bereiche anderer Professionen im Krankenhaus, insbesondere die Entscheidungsfindung über aktuelle Diagnostik und Therapie zwischen Ärzt:innen und Patient:innen. Diskussion Die Einführung eines ACP-Angebotes im Krankenhaus zeigt neben einer Vielzahl an Chancen auch Herausforderungen auf, welche es im gemeinsamen Diskurs zu bewältigen gilt. Bei der Einbettung eines ACP-Angebots im Krankenhaus müssen die Besonderheiten der Klinik und insbesondere die Abgrenzung von ACP zu anderen Arbeitsfeldern der Ethikberatung, wie beispielsweise die Ethikfallberatung, bedacht werden. In the present article, I offer a new reading of Hannah Arendt’s The Origins of Totalitarianism, specifically her argument that ideologies such as racism engender totalitarianism when the lonely and disenfranchised laborers of modern society develop a pathological fixation on formal logic, which I term “logomania.” That is, such logical deductions, from horrifically false premises, are the closest thing to thinking that individuals can engage in after their psyches, relationships, and communities have broken down. And it is only thus that (...) totalitarianism can achieve power, since it offers at least some form of connectedness and meaning, regardless how terrifying and violent. The danger persists, clearly, with the resurgence of the far Right, including in the extraordinary regime of Trump in the United States. From this I conclude that, along with the admirable calls to fight loneliness and rebuild our communities, we should also supplement all formal logical instruction and community education with instruction in creative thinking (including aesthetics), thereby discouraging the monomaniac reliance on formal logic as inadvertent weapon of totalitarianism. Likert-scale surveys are frequently used in cross-cultural studies on leadership. Recent publications using digital text algorithms raise doubt about the source of variation in statistics from such studies to the extent that they are semantically driven. The Semantic Theory of Survey Response (STSR) predicts that in the case of semantically determined answers, the response patterns may also be predictable across languages. The Multifactor Leadership Questionnaire (MLQ) was applied to 11 different ethnic samples in English, Norwegian, German, Urdu and Chinese. Semantic (...) algorithms predicted responses significantly across all conditions, although to varying degree. Comparisons of Norwegian, German, Urdu and Chinese samples in native versus English language versions suggest that observed differences are not culturally dependent but caused by different translations and understanding. The maximum variance attributable to culture was a 5% unique overlap of variation in the two Chinese samples. These findings question the capability of traditional surveys to detect cultural differences. It also indicates that cross-cultural leadership research may risk lack of practical relevance. (shrink)

A queer crip embodied experience of limping is the point of departure for my reflections on the differences between a crip phenomenology and a phenomenology of disability. I argue that a crip phenomenology can further understanding of how ableism and heternormativity work together, along with other structures of violence, to shape experiences at the edges of ability and disability, and, indeed, the possibility of queer crip movement in and through worlds.

When students read Difference and Repetition for the first time, they face two main hurdles: the wide range of sources that Deleuze draws upon and his dense writing style. In this article, I explore Seth Farber’s critique in _The Spiritual Gift of Madness_ that the leaders of the Mad Pride movement are failing to realize his vision of the mad as spiritual vanguard of sociopolitical transformation. First, I show how, contra Farber’s polemic, several postmodern theorists are well suited for this leadership (especially the Argentinian post-Marxist philosopher Ernesto Laclau). Second, I reinterpret the first book by the Icarus Project, _Navigating the Space between Brilliance and Madness_, by reimagining its central (...) metaphor of Icarus in the context of late capitalism as a prison world. Finally, I conclude with four strategies derived therefrom for higher functioning mad leaders to transform our penitentiary world. (shrink)

In a critical intervention into the bioethics debate over human enhancement, philosopher Melinda Hall tackles the claim that the expansion and development of human capacities is a moral obligation. Hall draws on French philosopher Michel Foucault to reveal and challenge the ways disability is central to the conversation. The Bioethics of Enhancement includes a close reading and analysis of the last century of enhancement thinking and contemporary transhumanist thinkers, the strongest promoters of the obligation to pursue enhancement technology. (...) With specific attention to the work of bioethicists Nick Bostrom and Julian Savulescu, the book challenges the rhetoric and strategies of enhancement thinking. These include the desire to transcend the body and decide who should live in future generations through emerging technologies such as genetic selection. Hall provides new analyses rethinking both the philosophy of enhancement and disability, arguing that enhancement should be a matter of social and political interventions, not genetic and biological interventions. Reproduction is broadly recognised as fundamental to human flourishing. The presumptive priority of reproductive freedom forms the predominant position in the literature, translating in the non-sexual reproductive realm as an almost inviolable right to access assisted reproductive technology (ART). This position largely condemns refusal or restriction of ART by clinicians or the state as discriminatory. In this paper, I critically analyse the moral rights individuals assert in reproductive pursuit to explore whether reproductive rights entitle hopeful parents to ART. I demonstrate (...) that none of the protected actions performed, or entitlements generated are sui generis ‘reproductive’ rights, leading to the claim that there is no such thing as a right to reproduce. Under scrutiny, the reproductive right is a far narrower and weaker rights assertion than is recognised in the literature. I argue that the predominant position is grounded in a fundamental misunderstanding of the scope and strength of reproductive claims.I also highlight a significant conceptual inconsistency in the literature. On one hand, there is broad consensus that reproductive rights are predominantly negative, yet access to fertility treatment is framed as a component of the right. This wrongly contorts the negative nature of reproductive rights into a positive claim-right to ART. I conclude that this mistakenly frames ART access as sitting within the scope of reproductive freedom. Among the factors necessary for the occurrence of some event, which of these are selectively highlighted in its explanation and labeled as causes-and which are explanatorily omitted, or relegated to the status of background conditions? Following J. S. Mill, most have thought that only a pragmatic answer to this question was possible. In this paper I suggest we understand this ‘causal selection problem’ in causal-explanatory terms, and propose that explanatory trade-offs between abstraction and stability can provide a principled solution to (...) it. According to a common opinion, the word ‘semantics’ , derived from the Greek word semantikos , appeared for the first time, at least in modern times, in the book Essai de semantique, science de significations by M. J. A. Bréal . However, Quine says in his lectures on Carnap:As used by C. S. Peirce, “semantic” is the study of the modes of denotation of signs: whether a sign denotes its object through causal or symptomatic connection, or through imagery, or through (...) arbitrary convention and so on. This sense of semantic, namely a theory of meaning, is used also in empirical philology: empirical semantic is the study of historical changes of meanings of words.1For Bréal, semantics was a branch of general linguistics. In particular, semantics was occupied with so-called lexical meaning and its changes through time. Thus, semantics in this sense belonged to what was called “the diachronic treatment of language”. This tradition is fairly alive in contemporary linguistic theory. Quine’s description of the word ‘semantic’ in Peirce corresponds, which Quine explicitly states, to its use in philology. However, some linguists ascribe a more theoretical role to lingustic semantics. Karl Bühler is an example. In his Sprachtheorie he says that a theory of semantic functions of language is a part of theory of language.2 This account is to be found also among philosophers. It is also rather obvious that Peirce did not limit his semantic only to empirical studies. Linguists also use the word ‘semasiology’ instead of ‘semantics’; Bühler proposed the term ‘sematology’ for a general theory of symbols. (shrink)

The notion that human activity can be characterised in terms of dynamic systems is a well-established alternative to motor schema approaches. Key to a dynamic systems approach is the idea that a system seeks to achieve stable states in the face of perturbation. While such an approach can apply to physical activity, it can be challenging to accept that dynamic systems also describe cognitive activity. In this paper, we argue that creativity, which could be construed as a ‘cognitive’ activity par (...) excellence, arises from the dynamic systems involved in jewellery making. Knowing whether an action has been completed to a ‘good’ standard is a significant issue in considering acts in creative disciplines. When making a piece of jewellery, there a several criteria which can define ‘good’. These are not only the aesthetics of the finished piece but also the impact of earlier actions on subsequent ones. This suggests that the manner in which an action is coordinated is influenced by the criteria by which the product is judged. We see these criteria as indicating states for the system, e.g. in terms of a space of ‘good’ outcomes and a complementary space of ‘bad’ outcomes. The skill of the craftworker is to navigate this space of available states in such a way as to minimise risk, effort and other costs and maximise benefit and quality of the outcome. In terms of postphenomonology, this paper explores Ihde’s human-technology relations and relates these to the concepts developed here. (shrink)

Building on my previous exploration of the role of dance in the contemporary French political philosopher Jacques Rancière’s Aisthesis: Scenes from the Aesthetic Regime of Art, first published in French in 2011, the present essay turns to another book originally published in the same year, The Intervals of Cinema. Having previously established that the core of Rancière’s philosophical method is an analysis of philosophical homonyms into figurative dancing conceptual partners, I begin by applying that method to the first chapter of (...) Intervals, “Cinematic Vertigo: Hitchcock to Vertov and Back.” There I identify two series of such dancing partners, as follows: Hitchcock’s image-controlling, capitalist vertiginous fall, and Vertov’s movement-equalizing, communist balanced dance. I then critique the implicit marginalizing of women and female bodies in the films and chapter, including Hitchcock’s protagonist’s best friend and ex-fiancé, and Vertov’s cosmetologists and switchboard operators. Finally, I offer a corrective from the proto-feminist life of my grandmother, a onetime cosmetologist, switchboard operator, and Glamour Shots amateur model, my grandmother, Louise Nunnelley, or “Mamaw.” Such are the unacknowledged material basis of Rancière’s radical democratic philosophy, the specifically-embodied and positioned female dancers who continue to get lost in his figurative dance. In the fourteenth plateau of A Thousand Plateaus, Deleuze and Guattari develop a dichotomy between two kinds of space – the smooth and the striated. What I want to focus on in this chapter is the status of these two conceptions of space. As Deleuze and Guattari note, these two forms of space are only discovered in a mixed form, yet are capable of being analysed de jure through their separation. In this sense, the plateau on the smooth and striated (...) can be seen as something like a transcendental deduction of their ontology of spaces. I will explore what Deleuze and Guattari mean when they say that they want to construct a theo-noology of smooth and striated spaces. I want to look at the ethical implications of this distinction, before looking at some alternative approaches to the issue of space. It should be noted that the question of the striation of space is one that is shared by Bergson, Heidegger, Merleau-Ponty and Sartre among others. The novelty of Deleuze and Guattari’s account is in their formulation of the notion of smooth space as a response. I will begin by looking at the notion of striated space itself, and in particular will explore the degree to which we should see it as a structure or as a method, and the interrelation between these two characterisations. Contemporary philosopher Jacques Rancière has been criticized for a conception of “politics” that is insensitive to the diminished agency of the corporeally oppressed. In a recent article, Dana Mills locates a solution to this alleged problem in Rancière most recent book translated into English, Aisthesis, in its chapter on Mallarmé’s writings on modern dancer Loïe Fuller. My first section argues that Mills’ reading exacerbates an “homonymy” (Rancière’s term) in Rancière’s use of the word “inscription,” which means for him either a (...) vicious literal carving on living bodies, or else a virtuous figurative carving on nonliving bodies. The former, I call “bodily carving,” while the latter is the “corporeal writing” that I take Mallarmé to affirm in Fuller. My second section observes that Rancière himself misses a homonymy in Mallarmé on Fuller, namely “dance,” meaning either “ballet” or dance in general (including Fuller’s). My third section concludes that Rancière’s chapter on Fuller includes another “dance” homonymy, meaning either “concert dance” or what I term a new “art of meta-movement” in Fuller. The latter art, I conclude, is equivalent to Mallarmé’s “corporeal writing,” and can be understood as a new form of dance education, in pursuit of a new utopia of worker-dancers. (shrink)

In this article, I build on my recent conceptions of law as poetry and of justice as dance by articulating three new conceptions of the relationship between law and justice. In the first, “poetry-based justice”, justice consists of a rigid choreography to a kind of musical recitation of the law’s poetry. In the second, “dancing-based law”, justice consists of spontaneous, freely improvised movement patterns that the poetry of the law tries to capture in a kind of musical notation. And in (...) the third, “reciprocal-legal justice”, justice and law consist of a reciprocally determining artistic collaboration between the democratic dancing masses and the aristocratic poetising elites. Given that each of these predominates in one of three types of community, I then present a reclassification of right-leaning, centrist and leftist societies as dominated by “literalist”, “kinetic” and “mutualist” communities (respectively), and offer suggestions for legislators and activists working in each type. In conclusion, law and justice, qua poetry and dance, become more flexible, inclusive and open to creative improvising and collaboration, a new form that I name, after Astraea, Greek goddess of divine justice, “astral legal justice”. Recently some philosophers have defended the thesis that naturalness, or joint-carvingness, is an aim of belief. This paper argues that there is an important class of counterexamples to this thesis. In particular, it is argued that naturalness is not an aim of our beliefs concerning what is joint carving and what is not.

We extend stit logic by adding a spatial dimension. This enables us to distinguish between powers and opportunities of agents. Powers are agent-specific and do not depend on an agent’s location. Opportunities do depend on locations, and are the same for every agent. The central idea is to define the real possibility to see to the truth of a condition in space and time as the combination of the power and the opportunity to do so. The focus on agent-relative powers (...) and space-relative opportunities firmly roots effectivity of an autonomous choice making agent in a space–time picture. Our space–time view will be classically Newtonian, since we will assume relativistic phenomena do not play a role in agentive effectivity. We show how our semantics naturally distinguishes between different kinds of histories; histories that reflect real possibilities and histories that reflect counterfactual possibilities. Furthermore, we discuss how the spatial picture sheds light on conceptual problems plaguing the central stit property of ‘independence of agency’. At several points in the article we will emphasise and defend the differences with Belnap’s theory of agency in relativistic branching space–times. (shrink)

Comparative religion scholar Thomas Berry’s influential concept of “Earth jurisprudence” has been helpfully elaborated in three principal books. My first section identifies four of their common themes, deriving therefrom an implicit narrative: (1) the basis of ecology is autopoiesis, which (2) originally generated human communities and Indigenous vernacular laws, which were (3) later reasserted by forest defenders who fought to create the Magna Carta’s “Charter of the Forest,” which is (4) now championed globally by the Indian physicist and eco-activist Vandana (...) Shiva’s Earth Democracy movement. My next three sections identify mutually exclusive elements of the three books, deriving the following alternative narrative: self-conscious new dancing rituals (Cullinan) could empower an historically informed reconstruction of private property (Burdon) via commons-based vernacular law (Weston and Bollier). And my conclusion offers one template for such a strategy, namely a new environmental variation on my dancing-poetic conception of legal justice, christened “emerald star-law.”. (shrink)

A common opinion is that power has shifted from states to companies. This article discusses quantitative and qualitative aspects of power possessed by companies and by states. A more adequate comparison than that between company sales and gross national product is the one between company value added and GNP. Also more adequate is the comparison between the public sector and company net profit. These rival measures take down company power to about a tenth of the sales measure. Also in qualitative (...) terms the "exit power" of the company gives a low impact compared to governmental action and the article concludes that company power by common measures is overestimated. However, the aggregated long-term effect of the market economy on the development of society is most significant. But it is a mistake to use that judgment as an argument for the opinion that business executives are the major power holders in modern societies. Perceptions of power also have an impact on which expectations and commitments that can be judged as realistic and therefore the issue of power is central for the normative discussion about corporate social responsibility. Though Mathias Risse and Gabriel Wollner’s On Trade Justice admirably incorporates the history of European philosophy and U.S. government, their otherwise reasonable proposals rest on dubious grounds. The book derives both much of its appeal, and its primary vulnerability, from a cluster of central terms that are situated precariously at the intersection of metaphors and concepts, or what Lakoff and Johnson call “metaphorical concepts.” In this article, I explore the three most important such terms, as featured in the following paraphrase (...) of theirs: “Trade is an embedded ground of justice.” For each italicized term, I conclude, Risse and Wollner vacillate between its most conceptual and metaphorical meanings, thereby attempting to (a) stretch “trade” to identify prehistoric exchange with global capitalism, so as to (b) rebrand the contextual “ground” of this universal activity as a foundation, even though (c) foundations “embedded” in other foundations simply reduce to their lowest common denominator. The latter, in this case, is global capitalism, the most immoral practices of which they are thereby pressured to defend, including temporary forms of the very exploitation that they so persuasively reconceive and otherwise condemn. In Michel de Certeau’s Invention of the Everyday, improvisational community dance function as a catalyst for the subversive art of the oppressed, via its ancient Greek virtue/power of mētis, being “foxlike.” And in de Certeau’s The Possession of Loudun, this foxlike dance moves to the stage, as an improv chorus that disrupts the events at Loudon when reimagined as a tetralogy of plays at City Dionysia. More precisely, Loudun’s tetralogy could be interpreted as a series of three tragedies and one (...) comedy, the latter of which involves the chorine nuns’ channeling of anomie into a proto-feminist transfiguration. More precisely, the tactical prowess of the nuns’ chorus leader, namely the prioress Jeanne des Anges, elevates her to the status of an angelic prophet, which in de Certeau’s theatrical dancing critique makes her the Loudun tetralogy’s Dionysian, foxlike mage. In conclusion, this analysis suggests de Certeau’s relevance for revolutionary social justice today. (shrink)

The aim of this paper is to explore Merleau-Ponty’s ambivalent relationship with Kant’s transcendental philosophy. I begin by looking at several points of convergence between Kant and Merleau-Ponty, focusing on the affinities between Kant’s account of transcendental realism and Merleau-Ponty’s notion of objective thought. I then show how Merleau-Ponty’s analysis of Kant’s paradox of asymmetrical objects points to a parallel in Kant’s thought to Merleau-Ponty’s thesis of the primacy of perception. In the second part of the paper, I show why (...) Merleau-Ponty believes that, despite the promise of Kant’s thought, he fails to adequately escape from objective thought. After presenting the central claims of the transcendental deduction, I piece together Merleau-Ponty’s criticism of it by answering three questions: For Merleau-Ponty, how do we encounter the world prior to reflection? How is experience constituted? And what leads Kant to mischaracterise experience in his own transcendental philosophy? (shrink)
