Philosophers, particularly moral philosophers, are increasingly being involved in public decision‐making in areas which are seen to raise ethical issues. For example, Dame Mary Warnock chaired the ‘Committee of Inquiry into Human Fertilization and Embryology’ in the UK in 1982–4; the Philosophy Department at Auckland was commissioned by the Auckland Regional Authority to report on the ethical aspects of fluoridating the public water supply in 1990; and many of us are serving on ethics committees of various sorts. Not only are (...) philosophers actually being called on or consulted, but many of us would argue that a philosophical contribution in such areas is essential.The involvement of moral philosophers in public policy decisions raises a question of professional ethics, viz, what role should a philosopher's own moral perspective or judgements play in the advice s/he gives, or contribution s/he makes, to public decision‐making on ethical issues. Like most problems in professional ethics, this prompts reflection on the nature of the profession, and in particular on the expertise we take moral philosophy to offer. It also prompts reflection on how processes of public decision making in ethically problematic areas should be understood. I explore these issues in this paper. (shrink)

In his 1953 lectures at the College de France, Merleau-Ponty dedicated much effort to further developing his idea of embodied subject and interpreted fresh sources that he did not use in Phenomenology of Perception. Notably, he studied more in depth the neurological notion of "body schema". According to Merleau-Ponty, the body schema is a practical diagram of our relationships to the world, an action-based norm with reference to which things make sense. Merleau-Ponty more precisely tried to describe the fundamentally dynamic (...) unity of the body, i.e. the fact there are various possibilities how the practical "diagram" of body schema could be de-differentiated (in pathology) or further refined (via cognitive and cultural superstructures, symbolic systems). This chapter summarises Merleau-Ponty's interpretation of the notion, while contrasting it to the more traditional understanding of the body in phenomenology and recent philosophical texts dealing with body schema. The paper examines the interplays between logic and politics in the Polish School of Logic starting from 1914. The Polish School of Logic flourished between 1920 and 1939. Philosophically, it was influenced by Kazimierz Twardowski (1866–1938). For Twardowski logic is fundamental for every kind of human activity, professional and private and this means that every argument should be formulated and proceed by correct inferential rules. These rules involve semiotics, formal logic and methodology of science. The paper shows how this position (...) was shared by Twardowski’s students, including Jan Łukasiewicz, Stanisław Leśniewski, Kazimierz Ajdukiewicz and Tadeusz Kotrabiński, as well as by the next generation of logicians and philosophers and especially by Alfred Tarski. These authors considered logic, philosophy and science as completely neutral with respect to politics and ideology but they also considered logical skills as indispensable in political activities. The topic of this paper is the perception of properties. It is argued that the perception of properties allows for a distinction between the sense of the identity and the sense of the qualitative nature of a property. So, for example, we might perceive a property as being identical over time even though it is presented as more and more determinate. Thus, you might see an object first as red and then as crimson red. In this case, the property is (...) perceived as identical over time, even though the sense of the qualitative nature (the redness, the crimson redness) of the property is changing. The distinction between the sense of identity and the sense of quality is explicated in terms of perceiving a particular property, a trope, and perceiving it as an instance of a universal. It is subsequently argued that the perceived tropes cannot constitute the phenomenal character of the perceptual experience. (shrink)

Summary This article focuses on the Tacitist thought shared by Justus Lipsius and Hugo Grotius. Contrary to what his later works might suggest, in the years before the Dutch political crisis of 1618, Grotius appears willing to look at history and contemporary politics in terms of the Tacitist and reason-of-state-based categories defined in Lipsius's political works. A specific Lipsian inspiration seems present in Grotius's Amsterdam address of 1616, and his analysis of the early Dutch Revolt in the Annales et Historiae (...) is determined by categories of thought which at the time were identified with Lipsius's intellectual legacy. BackgroundSexual boundary violations in healthcare are harmful and exploitative sexual transgressions in the professional–client relationship. Persons with mental health issues or intellectual disabilities, especially those living in residential settings, are especially vulnerable to SBV because they often receive long-term intimate care. Promoting good sexual health and preventing SBV in these care contexts is a moral and practical challenge for healthcare organizations.MethodsWe carried out a qualitative interview study with 16 Dutch policy advisors, regulators, healthcare professionals and other relevant experts to explore (...) their perspectives on preventing SBV in mental health and disability care organizations. We used inductive thematic analysis to interpret our data.ResultsWe found three main themes on how healthcare organizations can prevent SBV in mental health and disability care: setting rules and regulations, engaging in dialogue about sexuality, and addressing systemic and organizational dimensions.ConclusionOur findings suggest that preventing SBV in mental health and disability care organizations necessitates setting suitable rules and regulations and facilitating dialogue about positive aspects of sexuality and intimacy, as well as about boundaries, and inappropriate behaviors or feelings. Combining both further requires organizational policies and practices that promote transparency and reflection, and focus on creating a safe environment. Our findings will help prevent SBV and promote sexual health in mental health and disability care organizations. (shrink)

A familiar move that philosophers of sport make in the debate on the doping-issue is to reject from the start the argument that doping comes down to cheating. The claim that doping is cheating is often rebutted with the argument that doping is only cheating when one accepts that the use of doping is unjustified in itself. In this paper I want to argue that putting aside the cheating-argument in this way comes, first, too easy, because essential complexities of what (...) cheating is, are neglected. And, second, it comes too soon, because spelling the cheating argument out throws new light on the debate about matters of justifying the rules and criteria concerning doping. I will confine myself in this paper to the claim that it is in any case the institutional authorities that professional athletes cheat on. The relations with other parties that apparently can be claimed to be cheated upon also, such as other athletes in competition, are left out. The argument from cheating takes its starting point from a principle of fidelity, taken from Scanlon. By this principle the morally acceptable conduct of those taking part in a practice is grounded in the way reciprocal expectations are raised between parties to the practice. I apply this principle to the relation between athletes and institutional authorities in sport practices. This argument can take the cheating argument to a new level of seriousness, especially in the sense that the arguments treated here support a plea for democratization of the procedures and a larger role of the sportsmen and sportswomen themselves, or so I will defend. The aim of this article is to look at an early 17th-century analysis of a prince’s management of an ‘agglomerate polity’ in order to obtain a view of its chief focuses, concerns, and terms of analysis. Four main types of issues appear (apart from Grotius’ general analysis of Philip’s person and policies, which are also discussed): 1. Acceptation and legitimacy of a prince who was perceived to ignore local customs, rights and interests of his various territories; 2. The king’s representatives (...) and intermediaries, their (mis)management of their task, or the King’s (mis)management of them; 3. The conflicting demands of international politics; 4. Controlling armies and the connected issue of financial resources. The ‘Tacitean’ mode of writing history was regarded as the most ‘true’ and ‘revealing’ historiography in Grotius’ time. However Tacitean perceptiveness and analysis were not about what historians today regard as deeper historical processes and causation (like those associated with the ‘philosophic’ histories from the Enlightenment onwards, e.g. in Edward Gibbon), but about understanding personal motives and (hidden) immediate causes and intentions behind particular events and decisions. This historic differences in historical explanation should be taken into account when judging the value of Grotius’ history of his own time. (shrink)

This article provides a critical analysis of the evolution and impact of hospital-sponsored women's health centers. Using original data gathered from interviews, participant observation, and content analysis of documents and brochures, the authors describe the development of four models of hospital-sponsored women's health centers and illustrate three specific mechanisms of the co-optation process. They show how many elements of feminist health care were used for the purpose of marketing and revenue production rather than for empowering women and transforming the delivery (...) of care. Following Stratigaki's notion of negative countereffect, the authors show how the key feminist concepts of women-centered care and empowerment ended up contradicting their original meaning and purpose. Rather than being the subject of care, women became the object of treatment and revenue production. (shrink)

The current disclosure model of informed consent ignores the linguistic complexity of any act of communication, and the increased risk of difficulties in the special circumstances of informed consent. This article explores, through linguistic analysis, the specificity of informed consent as a speech act, a communication act, and a form of dialogue, following on the theories of J.L. Austin, Roman Jakobson, and Mikhail Bakhtin, respectively. In the proposed model, informed consent is a performative speech act resulting from a series of (...) communication acts which together constitute a dialogic, polyphonic, heteroglossial discourse. It is an act of speech that results in action being taken after a conversation has happened where distinct individuals, multiple voices, and multiple perspectives have been respected, and convention observed and recognized. It is more meaningful and more ethical for both patient and physician, in all their human facets including their interconnectedness. In the past the study of Asian philosophical traditions has often been approached by asking how the theories developed within these nonWestern cultures would help us to solve problems in contemporary Western philosophy. The present account, which summarizes results of a research project funded by the John Templeton foundation in 2015, attempts to reverse this way of studying Asian philosophy by investigating which theories, approaches and models from contemporary Western philosophy can be used to support, analyse, refine and advance insights (...) into key questions discussed by Indian Buddhist Madhyamaka. Our discussion concentrates on six key philosophical areas that can contribute in important ways to the analysis and development of Madhyamaka thought: metaphysics, logic, semantics, cognitive science, philosophy of science, and ethics. Medical, scientific and societal progress has been such that, in a universalist humanist perspective such as the WHO’s, it has become an ethical imperative for the primary endpoints in evidence based health care research to be expressed in e.g. Quality Adjusted Life Years (QALYs). The classical endpoints of discrete health‐related functions and duration of survival are increasingly perceived as unacceptably reductionistic. The major problem in ‘felicitometrics’ is the measurement of the ‘quality’ term in QALYs. That the mental, physical and social (...) domains, each containing many dimensions and items, all contribute to QOL is uncontroversial. What is controversial, is the weight of the different dimensions in overall QOL. It has been shown to be very different between different patient populations. In human individuals, assuredly complex systems, the many dimensions and items of QOL observably interact, probably sometimes also in chaotic ways. In these conditions, the weights of isolated items in individuals become for all practical purposes meaningless. Therefore, the much used multi‐item questionnaires at best describe, but do not evaluate QOL, neither in individuals, nor in populations. For example, allergic patients treated with cetirizine scored better than those a placebo on all dimensions of the SF‐36, a standard QOL questionnaire. Here there is no serious doubt that the treatment improved QOL, because it is highly unlikely that any important dimension on which the patient groups would have scored otherwise is missing in the SF‐36. However, whether piracetam treatment of acute stroke, which improved the surrogate endpoints neurological and functional scores, also improved QOL is plausible, but will be proven only when comprehensive QOL measurement will have been done. And suppose in randomised populations of end‐stage metastatic solid cancer patients, one would compare palliative last‐line chemotherapy with only palliative care, and one would, as can be expected, find no significant differences in average survival, and chemotherapy superior for the mental domain, but inferior for the physical comfort domain: we would not know which treatment, on aggregate, would be the better. The problem is that QOL is an individual and emergent construct, the resultant of a great many intractions, and of a different order than its contributing components. Overall QOL can therefore best be captured only as the Gestalt of a global self‐assessment. Just as people in everyday life, while acting under uncertainty, make global assessments all the time, so they can seriously answer the serious question: ‘How have you been?’ A solemn, practical, non peer‐relativistic, non‐cultural, experiential, and well tolerated way to obtain such responses is Anamnestic Comparative Self Assessment (ACSA), in which the subjects' memories of the best and the worst times in their life experience define their individual scale of QOL. ACSA is thus both exquisitely idiosyncratic, and yet can in a universalist humanistic perspective be considered generic. Using both a multi‐item questionnaire and a global assessment allows by one logistic regression, to estimate the weights of the dimensions and items in populations, and thus identify those whose improvement would most contribute to the QOL of the greatest number. A combined approach to measurement of QOL is necessary to maximise the utility of QOL interventions. (shrink)

The biosphere coevolves with the atmosphere, hydrosphere and lithosphere to maintain a habitable space on Earth. Over billions of years – and despite periodic setbacks – it has evolved increasing complexity, from its microbial beginnings to the complex interactions between animals, plants, fungi and unicellular microscopic life that sustain its present state. Recently, the biosphere has been profoundly changed by humans. In part, this includes increased rates of extinction that are reminiscent of past fundamental perturbations to life. But the change (...) is even more profound, resulting from a combination of marked translocations of species beyond their indigenous ranges, overt concentration of biomass in humans and their farm animals, reconfiguration of landscape habitats and over-utilisation of ocean life, excessive appropriation of energy from the biosphere (including its fossilised component), and increasing interconnectivity between technology and life. Humanitarian aid’s psycho-therapeutic turn in the 1990s was mirrored by the increasing emotionalization and subjectivation of fund-raising campaigns. In order to grasp the depth of this interconnectedness, this article argues that in both cases what we see is the post-Fordist production paradigm at work; namely, as Hardt and Negri put it, the direct production of subjectivity and social relations. To explore this, the therapeutic and mental health approach in humanitarian aid is juxtaposed with the more general phenomenon of psychologization. This (...) allows us to see that the psychologized production of subjectivity has a problematic waste-product as it reduces the human to Homo sacer, to use Giorgi Agamben’s term. Drawing out a double matrix of a de-psychologizing psychologization connected to a politicizing de-politicization, it will further become possible to understand psycho-therapeutic humanitarianism as a case of how, in these times of globalization, psychology, subjectivity and money are all interrelated. ABSTRACT This paper discusses the intended argument and conceptual backgrounds of two satirical engravings published during the Truce Conflicts in the Dutch Republic (ca. 1611–1621), with a special focus on the use of fish imagery and its political implications. The case under consideration shows a now historic perception of (giant) fishes employed for disparaging purposes in the context of a deeply polarised society over issues of religious orthodoxy and toleration.

The main question addressed by this article is this: How should one understand the role of the sentences of the Tractatus, given Wittgenstein’s statement that they are nonsensical? I begin with a presentation of three general principles of interpretation in order to avoid answering the question in an inappropriate way. I then move on to a short presentation and commentary on a selection of readings – namely, the ineffabilist, resolute and elucidatory ones – and elaborate the answers given by advocates (...) of these to the question explored here. I agree on many points with resolute and elucidatory readings: the Tractatus presents an austere conception of nonsense, and is not a book that seeks to present ontological or semantic theories. I point out, however, that these readings cannot fully explain the nature of Tractarian elucidations. Then I discuss those parts of the Tractatus which refer to the sentences of the book itself. The main proposal of my own approach is this: Tractarian elucidations should be construed as rules of translation, in that they show how to substitute certain expressions for others. They enable us to construct a notation in which everything that is expressible in ordinary language can be said perspicuously. (shrink)

Against the background of this historical challenge, the article proposes pedagogical practice as an alternative identity to pedagogics, although not in the classical sense of an absolute and self‐sufficient identity, and it develops one particular ontological theory of pedagogical practice viewed from a life‐world approach with the ambition of suggesting a (...) theoretical point of departure for pedagogical research. In his initial lecture course at the Collège de France, Merleau-Ponty attempted to develop a new analysis of rational thought in order to clarify its link with corporeal-perceptive life. The formulation of thought in language as the most elaborate human activity of expression explicitly takes over what we already observe in perception as the implicit and mutual reference between the perceiving subject and that which is perceived.The article reconstructs Merleau-Ponty’s argumentation, based on his preparatory notes for the lectures, and provides (...) an interpretation of the key concepts of “expression” and “body schema”. This book compiles and reviews the most prominent linguistic theories into a single source that serves as an essential reference for future solutions to one of the most important challenges of our age.

The focus of this article is on an ambivalent conception in medieval thought, namely the term ‘transcendens’, which on the one hand signifies a reality beyond created beings, i.e. God, and on the other hand signifies something common to all beings. Armandus de Bellovisu, in his Declaratio difficilium terminorum, has thematized exactly this difference between transcendence that follows from ‘nobility of being’ and that which follows from ‘commonness of predication’ . The medieval term ‘transcendens’, because of its ambiguity, thus includes (...) two fundamental concepts, which represent divergent philosophical tendencies concerning the specification of First Philosophy: the one understands it as «Philosophy of Transcendence», the other as «Transcendental Philosophy». The history of metaphysics is characterized by the tension between these two tendencies, but as we shall see, it also shows that they are intimately connected. (shrink)

Cloth, $45.00.When Leibniz received the 1710 issue of the Royal Society’s Philosophical Transactions in early 1711, he read John Keill’s public charge that he had stolen the calculus from Newton. Leibniz twice sought amends (...) from the Society in the form of a retraction, in response to which a committee was formed to investigate and issue a report. The resulting Commercium epistolicum, written by the good Isaac Newton himself and condemning Leibniz, was published in early 1713. In Vienna at the time, Leibniz learned of its contents in a June letter from Johann Bernoulli, who complained about this “scarcely civilized way” of holding what was in effect a tribunal from which the chief witness was absent. By year’s end Leibniz had enlisted Wolff to see into print Leibniz’s anonymous statement—overstatement, in fact—of his case, and nine months later Keill replied with an equally overstated rejoinder. Late autumn of 1714 found Leibniz back in Hannover, suffering from gout and the tiresome pressure to advance his work on the history of the house of Brunswick-Lüneburg. If only he felt better and had more free time, he could collect his mathematical papers and set an end to the dispute by writing his own Commercium epistolicum: as it was (Leibniz told Wolff in the spring of 1715), he had no intention of giving Newton’s cronies the luxury of his time.The Leibniz-Clarke exchange began in the shadows of this dispute, contributing to Leibniz’s already established distaste for parts of British philosophy. Already in 1690 he was describing (to Huygens and others) Newton’s gravitational attraction as “inexplicable.” Soon after Leibniz was surprised to discover that Locke had accepted Newtonian attraction in the second edition of the Essay—surprised, at least, until he came to see it as part and parcel of the dangerous idea that God could attach any old property whatever to matter if He chose, including thought. The calculus dispute followed. By the time Leibniz got round to writing Princess Caroline about the dispute in a letter of May 1715, he was insisting that the Newtonians deserved public censure, and that the Britons deserved Leibniz as historiographer of England. For her own part, Caroline now wondered if Samuel Clarke, who had translated Newton’s Opticks into Latin, would in the end be unbiased enough to translate Leibniz’s Théodicée into English. Moreover Caroline doubted that Clarke’s notion of the soul was theologically innocent. Replying in November, Leibniz summarized his view that natural religion was in great decline in England, and the famous exchange began.Despite there being no monograph devoted to it until now, the Correspondence ıs (and was) famous. Nowhere does Vailati set out to make these points explicitly, but they emerge over the course of his book, and together with exegetical soundness are its chief contributions. No Longer Patient: Feminist ethics and health care by Susan Sherwin. Philadelphia: Temple University Press, 1992.

This paper defends the view put forward by Donald Davidson in his paper 'What Metaphors Mean' that metaphorical utterances have no propositional meaning or message content other than the literal content of the expressions uttered. Davidson's own arguments for this position are examined, and found on the whole to be unconvincing, but further considerations are offered in support of his conclusion.

This paper aims at showing that all scholars writing on De iure praedae should refer to the extant manuscript of the work, or to the new electronic edition when it becomes available, to check the passages they use in their arguments. The printed text as edited by Hamaker, though generally reliable as a nineteenth-century edition, must now be considered outdated because of its suppression of all previous stages of the text, as well as its replacement of the original punctuation with (...) a new one, which more than once does affect the meaning of the text. Moreover, Hamaker's edition gives no authentic image of the sources of Grotius's thought. Secondly, signalling a need for more detailed textual research on IPC, the present paper calls attention to Grotius's extensive changes in chapter 10, and to the contribution which philological approaches might make to answering questions such as that regarding IPC's intended audience.
