As novas modalidades de operações financeiras realizadas por bancos tradicionais versus suas contrapartes no ambiente virtual, as quais utilizam dados bancários e informações pessoais e sensíveis dos usuários naquilo que se chama de open banking é o tema central do trabalho. Assim, partiu-se de uma definição geral desse termo, declinando sua tentativa de regulação para analisar seu acoplamento com LGPD, concluindo-se da necessidade de uma intervenção do órgão regulador (BACEN) balanceando proteção de dados e aumento da concorrência gerado pelo instituto (...) estudado. Este artigo aborda as questões de regulação de mercados com foco em dois países: China e Estados Unidos da América, ambos influentes na condução de cenários políticos, econômicos, tecnológicos e sociais. O objetivo da pesquisa é demonstrar, por meio da revisão dos dois maiores sistemas econômicos – capitalismo e socialismo – como os aplicativos chineses WeChat e TikTok suscitaram conflitos em prol da regulação de mercados que utilizam inovações tecnológicas. A pesquisa adotou o método dedutivo e bibliográfico, por meio de (...) documentação indireta. Conclui-se que os conflitos eram mais ideológicos-políticos do que jurídicos-normativos. (shrink)

Recent research in philosophy of science has shown that scientists rely on a plurality of strategies to develop successful explanations of different types of phenomena. In the case of biology, most of these strategies go far beyond the traditional and reductionistic models of scientific explanation that have proven so successful in the fundamental sciences. Concretely, in the last two decades, philosophers of science have discovered the existence of at least two different types of scientific explanation at work in the biological (...) sciences, namely: mechanistic and structural explanations. Despite the growing evidence about the radically different nature of these two types of explanation, no inquiry has been conducted to date to determine the ontological reasons that might underlie these differences, nor the way in which these types of explanations can be systematically related with each other. Here, we aim to cover this gap by connecting this plurality of research strategies with the existence of emergent levels of reality. We argue that the existence of these different—and apparently incompatible—explanatory strategies to account for biological phenomena derives from the existence of “ontological jumps” in nature, which generate different regimes of causation that in turn demand the development of different explanatory frameworks. We identify two of these strategies—mechanistic modelling and network modelling—and connect them to the existence of two ontological regimes of causation. Finally, we relate them with each other in a systematic way. In this vein, our paper provides an ontological justification for the plurality of explanatory strategies that we see in the life sciences. (shrink)

We propose to show that, although we think of Descartes as a "modern Parmenides" or as the "father of Modernity", otherwise for excellent reasons, this condition is at least as ambiguous as different are the cultures or societies that arose from the breakdown of Christianity. Where the Protestant Reformation triumphed, the dominant conception of philosophy is manifestly anticartesian, although they recognize, curiously, a debt to Cartesian philosophy; for example, we recognize this due in Wittgenstein and Heidegger. Neither empiricist nor rationalist, (...) neither analytical nor continental, nor national or identitarian either, more than a "French", "European" or "Western" philosopher, Descartes would be a philosopher of ours, that is, a philosopher of the universalist Counter-Reformation or Catholic Reformation. Also, even if we stick to what the professional and hegemonic practice of "philosophy" means today, Descartes would be known as a pre-or paramodern philosopher, that is, an “filósofo del arrabal”, an outskirt philosopher. During the last decades the question of defining life has gained increased interest but, at the same time, the difficulty in reaching consensus on a possible answer has led many to skeptical positions. This, in turn, has raised a wider debate about why defining life is so hard and controversial. Such a debate introduces additional aspects to be considered, like the role and nature of a definition of life itself. In this paper, we will focus on those aspects, arguing that (...) progress can be made if we conceive definitions of life as open heuristic tools that contribute to develop specific research strategies in the biological sciences and, more generally, to increase our understanding of life’s complexity. In contrast with pragmatic or operationalist approaches, we will defend that definitions of life comprise a set of ontological assumptions, together with an inherent unifying vocation, so they should be subject to comparison and critical assessment, closely related to the success or failure of the corresponding research programs, but also to the success or failure in establishing well-grounded interconnections among the latter. We consider that the search for a more coherent, integrated and generalized theory of biology cannot be pursued without keeping an empirical standpoint, and the exercise of defining life should not be taken as an obstacle but as a valuable instrument to achieve that goal. Para ello se evita el recurso de la historia heroica de los “grandes pensadores” y se propone el método de pensar causas comunes. Como se trata de una apuesta del feminismo filosófico, se subraya la importancia de una ontología corporal y una política de posicionamiento, a partir del estudio de caso del IV Congreso Internacional femenino realizado en Bogotá (1930). En el cierre, el método (...) de la causa común nos permitió sortear lo que la filósofa Kristie Dotson denomina “la cultura de la justificación” que encierra la filosofía en una serie de normas disciplinarias y en cambio apostamos por lo que ella también llama una cultura de la praxis que permite visibilizar múltiples formas del ejercicio filosófico. Since Darwin, Biology has been framed on the idea of evolution by natural selection, which has profoundly influenced the scientific and philosophical comprehension of biological phenomena and of our place in Nature. This book argues that contemporary biology should progress towards and revolve around an even more fundamental idea, that of autonomy. Biological autonomy describes living organisms as organised systems, which are able to self-produce and self-maintain as integrated entities, to establish their own goals and norms, and to promote the (...) conditions of their existence through their interactions with the environment. Topics covered in this book include organisation and biological emergence, organisms, agency, levels of autonomy, cognition, and a look at the historical dimension of autonomy. The current development of scientific investigations on autonomous organisation calls for a theoretical and philosophical analysis. This can contribute to the elaboration of an original understanding of life - including human life - on Earth, opening new perspectives and enabling fecund interactions with other existing theories and approaches. Sometimes we hear music (when we play it or hear it, whether live or recorded) and that experience is felt as a singular event. In those moments we find ourselves in an existential situation that, because it is singular (rare, unique, unintended), reveals the formative power of an aesthetic experience of listening to music, what we might call learning how to be poetic. Here, Eduardo Duarte Bono explores how engaging with Jean-Luc Nancy can enable us to deepen our appreciation (...) for music's aesthetic education. Specifically, Nancy's category of “resonant subjectivity” describes the existential place where this education is occurring during those singular experiences with music, what Nancy describes as “‘to be all ears’ [être à l'écoute], to be listening.” As a way of amplifying Nancy's writing on listening to music, Duarte Bono takes up three distinct cases in this paper: the percussionist Evelyn Glennie, Pablo Picasso's sculpture Guitar, and Ralph Ellison's musings on living with music as a writer. This article deals with Montessori’s scientific pedagogy and how his researches and the creation of houses for children become official, as well as how discourses and medical, biological, anthropological and psychological practices are installed in the pedagogy field in modern schools. Influenced by the theories of Lombroso and Darwin, he considered that human beings were no more than a cell composed by a protoplasm and nucleus the size of a tenth of a millimeter, from where individuals who are very different (...) from each other come from. This is why, in order to understand and carry out the practical researches of anthropology with pedagogical purposes, enough notions of biology are required, as well as the collaboration of other disciplines that work side by side with pedagogy. Thus the importance to show and question the effects of these discourses and practices regarding the conception of an active pedagogy, far from the concern for the child’s education in terms of his relationship with himself, knowledge and the world, pedagogical statements that lose validity in the operation of the school proposed by Montessori. For such purpose, some concepts from Foucault are taken as reference (population, policies, normalization, knowledge practices) in the perspective of the notion of bio-politics. (shrink)

Tem-se a necessidade de conhecer, compreender e refletir sobre o que se denomina de epistemologias contemporâneas ou novas epistemologias. Nas ciências sociais essas epistemologias recentes ajudam a pensar e repensar as novas formas do fazer científico em ir além das epistemologias ditas clássicas que conhecemos, tais como o marxismo, historicismo, funcionalismo, hermenêutica e outras que já são consideradas hegemônicas e que partem do conhecimento europeu e norte americano. Contrariamente, as novas epistemologias são em sua maioria elaboradas fora desses núcleos de (...) conhecimento, interrompendo assim a hegemonia de conhecimento, possibilitando pensar o hoje de outras formas. O germe de novas epistemologias no âmbito das ciências sociais gera a necessidade de entendimento do conteúdo que as formam. Dessa forma, a reflexão, ação complexa e necessária, deve ser feita para a compreensão dessa problemática. Além disso, permite mergulhar na busca do sentido que essas epistemologias possuem dentro do quadro das ciências sociais. Por isso, o objetivo deste trabalho é colocar em discussão e elucidar algumas das proposições epistemológicas de autoras e autores que não figuram no rol hegemônico do conhecimento produzido dentro das ciências sociais. Dito de outro modo, aqueles silenciados e apagados, mas que, recentemente, são buscados, tratados e entendidos. Pensar em novas epistemologias é pensar em estudos do outro. Mas que outros são esses? Quem são os sujeitos desse conhecimento? São outros no sentido de afastamento, de fuga da lógica estabelecida pelo conhecimento eurocêntrico. Raciocínios construídos por sujeitos distanciados geograficamente do local hegemônico de produção de conhecimento aceito como único e verdadeiro: Ocidente. Segundo argumenta Mignolo (2021, p. 25-26): "Como sabemos: o primeiro mundo tem conhecimento, o terceiro mundo têm cultura; os nativos americanos têm sabedoria, os anglo-americanos têm ciência", logo, nota-se a visão construída e que viaja por todos os cantos do globo. Assim, portanto, os fazedores dessas novas epistemologias são silenciados e apagados historicamente. Além disso, a partir da apresentação das características centrais dessas novas epistemologias e demonstração da contribuição que elas incrementam no universo das ciências sociais, este trabalho busca relacionar, também, as ideias produzidas por essas epistemologias contemporâneas com o contexto brasileiro, especialmente com contexto amazônico, sendo este ambiente de morada de inúmeros povos tradicionais, tais como: indígenas, quilombolas, ribeirinhos, entre outros. Englobam-se, nesse sentido, dentro dos estudos culturais, pós-coloniais, pensamento decolonial, epistemologia feminista, pensamento afrodiaspórico, filosofia indígena e dentre outras novas maneiras. Temas esses tratados por autores e autoras que muitas das vezes nunca ouvimos falar dentro do campo acadêmico tradicional como Valentin Y. Mudimbe, Frantz Fanon, Stuart Hall, Ailton Krenak, Oyèrónké Oyewùmí e Henrique Cunha Jr. E é a partir disso que trataremos sobre alguns aspectos dessas epistemologias desses autores mencionados acima para compreender a importância e a necessidade de estudar essas epistemologias contemporâneas, além da contribuição que trazem para as ciências sociais. Most of current theoretical analyses on biological functions can be classified as etiological or dispositional, depending on how they deal with the teleological dimension. In this paper, we propose a critical survey of these two perspectives, and we argue that some recent studies have set the basis of a new approach which grounds the teleological dimension of functional attributions in the organizational properties of living systems. El artículo constituye un acercamiento a las razones que sustentan la necesidad de elevar la calidad de la orientación a las familias de niños en la primera infancia y su objetivo consistió en capacitar al personal de la salud para desarrollar la orientación familiar en función de la prevención de desviaciones en el desarrollo en esta etapa. En él se aborda el rol que tiene la familia en la formación de los niños y la incidencia de los médicos y enfermeras (...) en su orientación; se encuentran reflexiones y comentarios sobre cómo elevar la calidad de la orientación para que la familia pueda desarrollar, en las condiciones de convivencia familiar, la prevención de desviaciones en el desarrollo mediante la realización de un proceso educativo de calidad. The article is an approach to the reasons that support the need to improve the quality of the guidance given to families of early childhood children and its objective consisted on training health staff to develop family guidance according to the prevention of deviations in development during this stage. It deals with the role family plays in children's education and the impact of doctors and nurses on its guidance. Thoughts and comments on how to improve the quality of guidance can also be found so that the family can develop, on family living conditions, the prevention of deviations in development through a quality educational process. In this paper, we bring together Foucault's biography and oeuvre to explore key concepts that support the analysis of nurses' acts of resistance. Foucault reflected on the power relations taking place in health services, making his contribution especially useful for the analysis of resistance in this context. Over three decades, he proposed a nonnormative philosophy while concomitantly engaging in transgressive practices guided by values such as human rights and social justice. Hence, Foucault's philosophy and public activism are an apparent contradiction, (...) but we argue that when analysed together they allow for a different understanding of his work. We describe the evolution of the concept of resistance in Foucault's work, supported by the approaches of Brent Picket (1996) and Miguel Morey (2013). Foucault started his work considering the idea of transgressiveness as it connects to being at the margins of society. He then spent considerable time elaborating the concept of power and identifying resistance strategies as forms of power exercise. In doing so, he considered that people engage with social change from multiple positions, including limited desire for change, fomenting reforms, or engaging in everyday revolutionary acts. As he further elaborated on power relations and defined resistance, Foucault asserted that resistance involves both repressive and productive dimensions of power, governance of biological life, state governance, and deliberate practices of illegalisms. Finally, Foucault shifted his attention to the freedom of ethical subjects, proposing the use of counter‐conduct and counter‐discourses to speak truth against oppression. Such framework offers a comprehensive lens for analysing nurses' acts of resistance within the complexities of the healthcare system and in society. In summary, Foucault's conceptual framework on resistance expands the role of nurses, to understand them not only as caregivers, but also as political agents capable of confronting and transforming oppressive institutional practices. According to the traditional nomological-deductive methodology of physics and chemistry [Hempel and Oppenheim, 1948], explaining a phenomenon means subsuming it under a law. Logic becomes then the glue of explanation and laws the primary explainers. Thus, the scientific study of a system would consist in the development of a logically sound model of it, once the relevant observables (state variables) are identified and the general laws governing their change (expressed as differential equations, state transition rules, maximization/minimization principles,. . . ) (...) are well determined, together with the initial or boundary conditions for each particular case. Often this also involves making a set of assumptions about the elementary components of the system (e.g., their structural and dynamic properties) and modes of local interaction. In this framework, predictability becomes the main goal and that is why research is carried out through the construction of accurate mathematical models. Thus, physics and chemistry have made most progress so far by focusing on systems that, either due to their intrinsic properties or to the conditions in which they are investigated, allow for very strong simplifying assumptions, under which, nevertheless, those highly idealized models of reality are deemed to be in good correspondence with reality itself. Despite the enormous success that this methodology has had, the study of living and cognitive phenomena had to follow a very different road, because these phenomena are produced by systems whose underlying material structure and organization do not permit such crude approximations. Seen from the perspective of physics or chemistry, biological and cognitive systems are made of an enormous number of parts or elements interacting in non-linear and selective ways, which makes very difficult their tractability through mathematical models. In addition, many of those interacting elements are hierarchically organized, in a way that the “macroscopic” (observable) parts behave according to rules that cannot be, in practice, derived from simple principles at the level of their “microscopic” dynamics.. At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

Las distintas tradiciones sobre la celebración de la Pascua en las primeras comunidades cristianas se fundamentan en las diferentes escuelas teológicas de la Iglesia Primitiva y se concretan principalmente en dos formas diferentes, aquí identificadas como Pascha = Passio y Pascha = Transitus zoith sus propias y diferentes implicaciones cristológicas características. A partir del estudio pormenorizado de fuentes hispánicas de los siglos IV al VI, patrísticas, conciliares y litúrgicas, el autor localiza un filón en la tradición de las iglesias de (...) la Península Ibérica que identifica la fiesta de la Pascua con la fiesta de la Pascua. Península Ibérica que identifica la fiesta de Pascua zuitli la pasión de Cristo, como hacía la escuela asiática, y le confiere, sobre todo en la lex orandi, una fuerte intensidad dramática. El artículo pone de relieve una cristología pascual con luz propia y al mismo tiempo revela una mens teológica, bien equilibrada y claramente definida. Las comunidades cristianas de Hispania se beneficiarán de una sana ósmosis entre lex credendi y lex orandi, que les permitirá enfrentarse al arrianismo y llevar a su plena madurez los frutos de la creencia cristiana. En la elaboración de estas tradiciones están profundamente arraigadas muchas de las ideas teológicas y litúrgicas que prevalecen en la Iglesia actual. (shrink)

There is a long-lasting quest of demarcating a minimally representational behavior. Based on neurophysiologically-informed behavioral studies, we argue in detail that one of the simplest cases of organismic behavior based on low-resolution spatial vision–the visually-guided obstacle avoidance in the cubozoan medusaTripedalia cystophora–implies already a minimal form of representation. We further argue that the characteristics and properties of this form of constancy-employing structural representation distinguish it substantially from putative representational states associated with mere sensory indicators, and we reply to some possible (...) objections from the liberal representationalists camp by defending and qualitatively demarcating the minimal nature of our case. Finally, we briefly discuss the implications of our thesis within a naturalistic framework. (shrink)

In this article I analyze the connection between the concepts of “actuality”, “upcoming” and “origin” found in the early reflections of Walter Benjamin and Theodor W. Adorno to expose some of the defining borders of the transposition of criticisms made by both philosophers. Through the identification of “actuality” as a reflection on the conditions in which philosophy is legitimate, “upcoming” as a requisite for self-justification of philosophical knowledge, and “origin” as the claim of the historically unfinished, I show in what (...) sense a critical horizon is recovered by Benjamin and Adorno as an inexorable exercise of philosophical praxis. Our paper has three parts. In Part 1, we discuss John Gardner’s thesis that the non-elliptical ascription of agency to law is a necessary and irreducible part of any adequate explanation of the activities of legal officials. We consider three explananda which might conceivably necessitate this ascription, and conclude that none in fact does so. In Part 2, we discuss two other theses of Gardner’s: that it makes no sense to ascribe to law the claim that there are legal obligations (...) , and that law’s claim is the claim that there are moral obligations . We take issue with Gardner’s arguments for , and suggest that is unwarranted in the absence of an argument that law makes any claims at all. In Part 3, we briefly argue that, insofar as it issues requirements, there are certain claims that law cannot but make. We conclude that if Gardner is right that law’s claims are those of certain of its officials, it is law-making and not law-applying officials who make law’s claim. (shrink)

This is the guest editors’ introductory paper to the special issue “Situating jurilinguistics across cultures using translation and discourse approaches.” The introduction showcases the interdisciplinary vocation of jurilinguistics from its conception almost forty years ago. It is argued that jurilinguistics has achieved its current maturity by diversifying the disciplinary lenses of the originally contributing disciplines of legal translation and legal studies while keeping faithful to its original principles—facing practical problems with a rigorous outlook, venturing into any new domains that may (...) prove enlightening, and combining professional and academic perspectives. The authors highlight how the series of conferences “Jurilinguistics: Interdisciplinary Approaches to the Study of Language and Law” have been instrumental in enhancing the scope of jurilinguistics. Finally, the articles gathered in this special issue are presented and their contributions in advancing the knowledge available for practitioners and scholars meeting at the interface between law and language are underscored. Objective: To analyze the empathic profile and the empathy scores of freshmen of the nursing course. Design and participants: Descriptive study involving 399 freshmen students of two modalities of nursing courses: Bachelor and Bachelor and Teaching Diploma, in the period from 2012 to 2015. A sociodemographic questionnaire and the Empathy Inventory were applied. Ethical considerations: The research received approval from the Research Ethics Committee of the University of São Paulo at Ribeirão Preto College of Nursing. The students registered their acceptance (...) to participate in the research by signing the Free and Informed Consent Form and anonymity was guaranteed. Findings: The mean age of the participants was 19 years, being 85.5% female. The students were grouped by course modality and all groups presented high empathy scores. A significant difference (p < 0.001) was found, which indicates that students of the Bachelor and Teaching Diploma program presented a higher degree of empathy for the General Score, Domain 2 (Interpersonal Flexibility), and Domain 3 (Altruism) in relation to students in the Bachelor program. Conclusion: Results show that nursing undergraduate freshmen are emphatic, with minimum differences between the two courses. This profile is relevant for the development of future professionals capable to demonstrate a balance between instrumental and expressive competences. (shrink)

Radical enactivism supports radical embodied cognition (REC), which is the idea that basic or fundamental cognition (perception and action) does not need to be understood in representational, contentful terms. REC departs from the idea that the mind can be naturalized through biological functions, but rejects the idea that mental content, which is understood as having a representational nature, can be naturalized. For REC, the natural origins of content (or NOC) is a program based on the following hypothesis: first, we depart (...) from basic cognitive processes that are target-based and guided by an Ur-intentionality or directedness toward the world, and then sociality enters in the picture when language appears into the scene, allowing for establishing full-blown semantic content in which that content is about worldly states of affairs. Here, we are going to focus on the phenomenon of directedness since there are blind spots in this picture: as many authors claim, REC takes Ur-intentionality as the starting point, but there is simply no explanation to date of how this directedness or Ur-intentionality is established. Therefore, how could we account for Ur-intentionality? How does this kind of intentionality emerge? We believe that we can answer this question if we invoke the best scientific evidence from ecological perceptual learning especially in regard to the role of the environment and the information for perceiving affordances in our learning processes. This allows us to offer an answer to the question of how the most basic form of cognition (Ur-intentionality or directedness) emerges in nature. (shrink)

Interpersonal coordination in soccer has become a trending topic in sports sciences, and several studies have examined how interpersonal coordination unfolds at different levels (i.e., dyads, sub-groups, teams). Investigations have largely focused on interactional behaviors at micro and macro levels through tasks from dyadic (i.e., 1 vs. 1) to team (i.e., 11 vs. 11) levels. However, as the degree of representativeness of a task depends on the magnitude of the relationship between simulated and intended environments, it is necessary to address (...) a discussion on the correspondence between competitive and practice/experimental settings in soccer. The aims of this paper are to: (i) provide a brief description of the main concepts underlying the subject of interpersonal coordination in sports teams; (ii) demonstrate, through exemplar research findings, how interpersonal coordination in soccer unfolds at different scales; and (iii), discuss how coaches and researchers may ensure representativeness for practice and experimental tasks. We observed that papers addressing the analysis of interpersonal coordination tendencies in soccer often resort to dyadic (one vs. one) or sub-group (many vs. many) experimental tasks, instead of full-sized (11 vs. 11) games. Consequently, the extent to which such patterns reflect those observed in competition is somewhat uncertain. The design of practice and/or experimental tasks that rely on sub-phases of the game (e.g., 1 vs. 1, 4 vs. 4) should ensure the preservation of players’ behavior patterns in intended match conditions (11 vs. 11). This can be accomplished by measuring the level of action fidelity of the task, ensuring correspondence and successful transfer across contexts. (shrink)

The article addresses the treatment given to the notion of subject in Slavoj Žižek and Robert Kurz. Without aiming at a synthesis between the two radically opposed positions, they are played against one another in order to reveal the unidimensional stances and false steps in the field of the constitution of the struggle for a concrete negation of capitalist society.

When Caja de Pensiones para la Vejez y de Ahorros, "la Caixa," was created in 1905, it was not only the transient response to a serious social, political, and economical problem, but also provided a permanent solution by creating a long-lasting social welfare institution. In addition, its founder understood the responsibility of social welfare institutions not as an isolated responsibility for each institution, but as part of a harmonious whole that is a real moral entity with a socio-economic character, with (...) autonomy and unity of nature, purpose, and form. The purpose of this article is to show how the corporate social responsibility conception of Francesc Moragas, the founder of "la Caixa," informed the activities of the new institution in a variety of dimensions, including its service to the customers, its economic strengths, the social work, and its participation in the creation of the public system of social security in Spain. Por un lado, expone sintéticamente parte de la problemática filosófica y epistemológica del sujeto y del yo, mostrando la diversidad de conceptos y de genealogías históricas, así como parte de las controversias contemporáneas, elucidando preguntas y respuestas y apostando por vías no reduccionistas o simplificadoras.
