Constructive empiricism is supposed to offer a positive alternative to scientific realism that dispenses with the need for metaphysics. I first review the terms of the debate before arguing that the standard objections to constructive empiricism are not decisive. I then explain van Fraassen's views on modality and counterfactuals, and argue that, because constructive empiricism recommends on epistemological grounds belief in the empirical adequacy rather than the truth of theories, it requires that there be an objective modal distinction between the (...) observable and the unobservable. This conclusion is incompatible with van Fraassen's empiricism. Finally I explain some further problems for constructive empiricism that arise when we consider modal matters. (shrink)

When we are concerned with the logical form of a computation and its formal properties, then it can be theoretically described in terms of mathematical and logical functions and relations between abstract entities. However, actual computation is realised by some physical process, and the latter is of course subject to physical laws and the laws of thermodynamics in particular. An issue that has been the subject of much controversy is that of whether or not there are any systematic connections between (...) the logical properties of computations considered abstractly and the thermodynamical properties of their concrete physical realizations. Landauer [R. Landauer, Irreversibility and heat generation in the computing process, IBM Journal of Research and Development 5 183–191. Reprinted in Leff and Rex ] proposed such a general connection, known as Landauer’s Principle. To resolve this matter an analysis of the notion of the implementation of a computation by a physical system is clearly required. Another issue that calls for an analysis of implementation is that of realism about computation. The account of implementation presented here is based on the notion of an L-machine. This is a hybrid physical-logical entity that combines a physical device, a specification of which physical states of that device correspond to various logical states, and an evolution of that device which corresponds to the logical transformation L. The most general form of Landauer’s Principle can be precisely stated in terms of L-machines, namely that the logical irreversibility of L implies the thermodynamic irreversibility of every corresponding L-machine. Most discussions on animal experimentation refer to domesticated animals and regulations are tailored to this class of animals. However, wild animals are also used for research, e.g., in biological field research that is often directed to fundamental ecological-evolutionary questions or to conservation goals. There are several differences between domesticated and wild animals that are relevant for evaluation of the acceptability of animal experiments. Biological features of wild animals are often more critical as compared with domesticated animals because of their survival (...) effects. An important issue is what is called here ``natural suffering'''': the suffering from natural circumstances. Should this type of suffering be taken into account when suffering from experimentation is evaluated? As an answer, it is suggested that ``natural functioning'''' should be considered as an additional standard in the evaluation of wild animal experimentation. Finally, two topics related to the ecological context are considered. Firstly, the often inevitable involvement of non-research animals in wild animal experimentation, and secondly, the eco-centric approach to nature conservation. According to the latter position, animals are subordinated to ecosystems. All these aspects make the evaluation of wild animal experiments much more complex than experiments with domesticated animals. Preliminary scores are proposed to deal with these aspects. It is argued that this should not lead to a more complex governmental regulation, since an effective maintenance and control are hard to realize and one may loose the cooperation of researchers themselves. In addition, non-governmental professional organizations such as research societies and funding organizations play a pivotal role. (shrink)

It has been widely theorized and empirically proven that self-regulated learning (SRL) is related to more desired learning outcomes, e.g., higher performance in transfer tests. Research has shifted to understanding the role of SRL during learning, such as the strategies and learning activities, learners employ and engage in the different SRL phases, which contribute to learning achievement. From a methodological perspective, measuring SRL using think-aloud data has been shown to be more insightful than self-report surveys as it helps better in (...) determining the link between SRL activities and learning achievements. Educational process mining on the basis of think-aloud data enables a deeper understanding and more fine-grained analyses of SRL processes. Although students’ SRL is highly contextualized, there are consistent findings of the link between SRL activities and learning outcomes pointing to some consistency of the processes that support learning. However, past studies have utilized differing approaches which make generalization of findings between studies investigating the unfolding of SRL processes during learning a challenge. In the present study with 29 university students, we measured SRLviaconcurrent think-aloud protocols in a pre-post design using a similar approach from a previous study in an online learning environment during a 45-min learning session, where students learned about three topics and wrote an essay. Results revealed significant learning gain and replication of links between SRL activities and transfer performance, similar to past research. Additionally, temporal structures of successful and less successful students indicated meaningful differences associated with both theoretical assumptions and past research findings. In conclusion, extending prior research by exploring SRL patterns in an online learning setting provides insights to the replicability of previous findings from online learning settings and new findings show that it is important not only to focus on the repertoire of SRL strategies but also on how and when they are used. While there are many examples of metaphysical theorising being heuristically and intellectually important in the progress of scientific knowledge, many people wonder how metaphysics not closely informed and inspired by empirical science could lead to rival or even supplementary knowledge about the world. This paper assesses the merits of a popular defence of the a priori methodology of metaphysics that goes as follows. The first task of the metaphysician, like the scientist, is to construct a hypothesis that accounts for the (...) phenomena in question. It is then argued that among the possible metaphysical theories, the empirical evidence underdetermines the right one, just as the empirical evidence underdetermines the right scientific theory. In the latter case it is widely agreed that we must break the underdetermination by appeal to theoretical virtues, and this is just what should be and largely is done in metaphysics. This is part of a more general line of argument that defends metaphysics on the basis of its alleged continuity with highly theoretical science. In what follows metaphysics and theoretical science are compared in order to see whether the above style of defence of a priori metaphysics is successful. (shrink)

A great deal of effort has gone into developing capacity in the sphere of human research protection programmes in South Africa and Africa over the last decade or more, by several international organisations. However the promotion of the broader agenda of research integrity or ‘RCR’ has lagged behind. From a global perspective South Africa and other African countries are actively involved in research endeavours and collaborations across a very broad spectrum of scientific fields. For this research to fulfil its potential (...) social value it must be reliable and trustworthy and hence it is essential that research institutions and universities take the promotion of research integrity seriously. The purpose of this paper is to consider the role of an institutional office of research integrity within the context of academic research particularly in South Africa but also in Africa. I will reflect on my own experience over a period of five years as a research integrity officer at a South African academic institution to highlight concerns in five domains; the promotion of an ethic of responsibility in opposition to compliance and bureaucracy, collaboration ethics and collegiality especially in the context of North-South collaborations, authorship and publication ethics, the problem of plagiarism and the utility of policy and procedure. I will suggest that the establishment of such an office can be of great value in the promotion of a broad culture of research ethics and responsible research conduct. The possible role and scope of function of an institutional office of research integrity will be briefly outlined. (shrink)

It really makes a difference to people's lives: when they get the award, when they know about it, when there is publicity for the person concerned. It is an all-round good thing to do and I congratulate you for it.

Clinical decisions are expected to be based on factual evidence and official values derived from healthcare law and soft laws such as regulations and guidelines. But sometimes personal values instead influence clinical decisions. One way in which personal values may influence medical decision-making is by their affecting factual claims or assumptions made by healthcare providers. Such influence, which we call ‘value-impregnation,’ may be concealed to all concerned stakeholders. We suggest as a hypothesis that healthcare providers’ decision making is sometimes affected (...) by value-impregnated factual claims or assumptions. If such claims influence e.g. doctor–patient encounters, this will likely have a negative impact on the provision of correct information to patients and on patients’ influence on decision making regarding their own care. In this paper, we explore the idea that value-impregnated factual claims influence healthcare decisions through a series of medical examples. We suggest that more research is needed to further examine whether healthcare staff’s personal values influence clinical decision-making. (shrink)

Older single women in Australia are increasingly experiencing homelessness. Age and gender seem inherently related to single older women’s housing crises, but no attempt has been made to account for the causes of their homelessness through an intersectional lens. This article develops a complex and contingent causal explanation of the structures and mechanisms implicated in growing homelessness for this group. We demonstrate an original use of critical realist-informed intersectional analysis which is characterized by stratified social ontology and emergence. We theoretically (...) reframe existing literature to demonstrate how the intersectional causal powers of gender and age (‘gender*age’) discrimination and conventional life course experiences intersect to generate financial precarity for older women. Our causal model explains how economic insecurity, structural and individual contexts, and crisis events interact, challenging older women’s housing security and precipitating first-time homelessness later in life. Carminati (2002) shows that the existence of both phonetically full and phonetically null pronouns (pro) in Italian reflects a division of labor with respect to anaphora resolution. Pro prefers to link to prominent antecedents more than its phonetically overt counterpart does (where prominence is determined by syntactic position in intrasentential anaphora cases).

Rodney Syme, retired medical doctor, urologist and advocate for medically assisted dying for 20 years, has helped scores of people die peacefully - people whose suffering has become unbearable to them. He takes on governments, the law and the medical profession. Most recently he won his challenge of an order by the Medical Board of Australia to prohibit him from doing anything that has the primary purpose of ending a person's life. The case in question was a 71-year-old man dying (...) of tongue and lung cancer whose life, the man said, was as miserable as hell. The Medical Board argued that the assistance in dying was a departure from accepted standards and presented a significant risk to that person. (shrink)

They are from the same country, they speak the same language, they understand one another. They have things to say to each other and they say them. Anyone who would try to question such evident truisms would be seen as attempting to be a spinner of paradoxes. And (...) yet…First of all is it as natural as it appears that two people should stop and speak? To an impartial observer of the behavior of one's peers this would not seem to be the case. Most of the people we rub elbows with daily—in the street, in the subway, on a beach, in a hotel or even in the apartment building where we have lived for ten years—are people whom we do not accost and to whom we never speak. In order for people to speak to one another, certain circumstances must exist; there must be a ritual of introduction and a mutual consent that often occurs only after a certain resistance has been overcome. There are important differences to be observed in this respect among different peoples and, within the same nation, among people of different classes. But in every case dialogue is preceded by a preparatory phase of prudent observation, reserve and mistrust during which the partners size one another up and seek to situate themselves in relation to each other. As a reflection on recent debates on the value of wild animals we examine the question of the intrinsic value of wild animals in both natural and man-made surroundings. We examine the concepts being wild and domesticated. In our approach we consider animals as dependent on their environment, whether it is a human or a natural environment. Stressing this dependence we argue that a distinction can be made between three different interpretations of a wild animal’s intrinsic value: a species-specific, a (...) naturalistic, and an individualistic interpretation. According to the species-specific approach, the animal is primarily considered as a member of its species; according to the naturalistic interpretation, the animal is seen as dependent on the natural environment; and according to the individualistic approach, the animal is seen in terms of its relationship to humans. In our opinion, the species-specific interpretation, which is the current dominant view, should be supplemented—but not replaced by—naturalistic and individualistic interpretations, which focus attention on the relationship of the animal to the natural and human environments, respectively. Which of these three interpretations is the most suitable in a given case depends on the circumstances and the opportunity for the animal to grow and develop according to its nature and capabilities. Background Physician-assisted suicide is a controversial issue and has sometimes raised emotion-laden reactions. Against this backdrop, we have analyzed how Swedish physicians are reasoning about physician-assisted suicide if it were to be legalized. Methods and participants We conducted a cross-sectional study and analyzed 819 randomly selected physicians’ responses from general practitioners, geriatricians, internists, oncologists, psychiatrists, surgeons, and all palliativists. Apart from the main questions about their attitude toward physician-assisted suicide, we also asked what would happen with the respondents’ own trust (...) in healthcare if physician-assisted suicide were legalized. Response options were that trust would decrease, not be influenced, or would increase. Results We identified a strong statistical association between on the one hand those whose own trust would increase and who were pro physician-assisted suicide, and on the other hand those who were against physician-assisted suicide and whose own trust would decrease [relative risk: 16.7 (95% confidence interval: 10.2–27.2)]. Among those whose own trust would not be influenced (n = 456), 60% were pro pysician-assisted suicide, 16% were against, and 24% were undecided. Of those whose trust would increase or not be influenced, a large majority supported autonomy-based arguments, whereas those whose trust would decrease supported non-maleficence-based arguments. Conclusion Analyzing the answers after having divided respondents into those whose own trust in healthcare would decrease or increase and not be influenced brings about interesting results such as how the three groups prioritize arguments for and against physician-assisted suicide. This way of analyzing the data seems to be a promising strategy when identifying value-impregnated factual claims. (shrink)

Environmental ethics has to deal with the challenge of reconciling contrasting ecocentric and animal-centric perspectives. Two classic attempts at this reconciliation, which both adopted the metaphor of concentric circles, are discussed. It is concluded that the relationship between the animal and its environment, whether the latter is human or natural, should be a pivotal element of such reconciliation. An alternative approach is presented, inspired by care ethics, which proposes that caring for wild animals implies caring for their relationship to the (...) natural environment and thus taking action to maintain wildlife habitat. This type of care is labelled non-specific care because it is not directed towards the individual wild animal and its specific individual needs. In contrast, caring for domestic animals is called specific care because it is much more directed towards the individual animal's needs. (shrink)

Speakers often answer a question with what appears to be merely a phrase, a fragment of a sentence, rather than with a full sentence. Merchant (2004) offers an analysis of fragment answers in which the new information/answer is fronted to a clause-peripheral position and the remainder of the sentence is not pronounced. Two written acceptability judgment experiments are reported that tested predictions of this analysis. The first, in English, tested the prediction that clausal fragment answers should only be fully acceptable (...) when the clausal answer is introduced by an overt complementizer (What did May deny? That Josh left.). This is because clauses may front only when an overt complementizer is present (That Josh left, May denied, but not *Josh left, May denied). The second study was conducted in German, a language that does not permit prepositions to be stranded, left behind, when a noun phrase is moved in overt syntactic structures such as questions or topicalizations. Consequently, when the object of a preposition is questioned, only a prepositional phrase fragment answer, not a noun phrase fragment answer, is predicted to be fully acceptable. Both predictions were confirmed. The results support the claim that syntactic structure is present in unpronounced constituents, and tells against theories of syntax that eschew such structures. How did physicians come to dominate the medical profession? Lyn Bennett challenges the seemingly self-evident belief that scientific competence accounts for physicians' dominance. Instead, she argues that the whole enterprise of learned medicine was, in large measure, facilitated by an intensely classical education that included extensive training in rhetoric, and that this rhetorical training is ultimately responsible for the achievement of professional dominance. Bennett examines previously unexplored connections among writers and genres as well as competing livelihoods and classes. Engaging the (...) histories of rhetoric, medicine, literature, and culture throughout, she goes on to focus specifically on the work of women who professed as well as practiced medicine. Pointing to some of the ways women's writing shapes realities of body, mind, and spirit as it negotiates social, cultural, and professional ideologies of gender, this book offers an important corrective to some long-held beliefs about women's role in early modern discourse. This essay presents an overview of the TRC— its establishment, procedures, and operating principles — and examines the way in which the commission emphasizes forgiveness rather than retribution for past wrongs.

In this paper it is argued that physicians’ restrictive attitudes in offering abortions during 1946–1965 in Sweden were due to their private values. The values, however, were rarely presented openly. Instead physicians’ values influenced their assessment of the facts presented—that is, the women's’ trustworthiness. In this manner the physicians were able to conceal their private values and impede the women from getting what they wanted and needed. The practice was concealed from both patients and physicians and never publicly discussed. It (...) is also argued that a similar tacit practice could currently be applied by palliative care physicians. Such practice might allow palliative care physicians to be restrictive when offering sedation therapy without appearing paternalistic or declaring conscientious objections. However, the practice runs counter to patients’ right to participate in making decisions. The women seeking abortion began to oppose the situation and eventually a new abortion law was introduced 1975. Patients at the end of life will never be able to protest against palliative care physicians’ restrictive attitudes. This is a vulnerable and weak group, unable to lodge complaints after the treatment. In order to respect patients’ autonomy, even suffering patients at the end of their lives, it is suggested that physicians should openly declare their values when it comes to providing treatments that might shorten life. Such transparency might facilitate more genuine shared decision-making and accordingly less suboptimal end-of-life care. (shrink)
