In Canada, as in many developed countries, healthcare conscientious objection is growing in visibility, if not in incidence. Yet the country's health professional policies on conscientious objection are in disarray. The article reports the results of a comprehensive review of policies relevant to conscientious objection for four Canadian health professions: medicine, nursing, pharmacy and dentistry. Where relevant policies exist in many Canadian provinces, there is much controversy and potential for confusion, due to policy inconsistencies and terminological vagueness. Meanwhile, in Canada's (...) three most northerly territories with significant Aboriginal populations, whose already precarious health is influenced by funding and practitioner shortages, there are major policy gaps applicable to conscientious objection. In many parts of the country, as a result of health professionals' conscientious refusals, access to some legal health services – including but not limited to reproductive health services such as abortion – has been seriously impeded. Although policy reform on conscientious conflicts may be difficult, and may generate strenuous opposition from some professional groups, for the sake of both patients and providers, such policy change must become an urgent priority. Harootunian While the formation of area studies in the universities and colleges of the United States was initially inaugurated as a response to the Cold War "necessity" to win the hearts and minds of the unaligned, many of whom were new refugees of decolonization, one of its unintended consequences was to foster the development (...) of comparative perspectives of study across disciplines and different cultural regions. But this secondary goal was often diverted by the principal purpose of area studies programs to supply authoritative information on regions outside of Euro-America (the second and third worlds) considered crucial to the national security and to private businesses thrown increasingly into an expanding global market seeking new regions capable of providing buyers, workers, and materials. In time, the vocation of comparison became part of the unconscious of area studies, as the unit of the nation-state took precedence over all other considerations. Instead of envisaging genuinely interdisciplinary agendas that were able to integrate different disciplines, area studies have too often settled for simple multidisciplinarism, substituting coverage for comparison, language acquisition for method, the nation-state for the totality of the cultural region. Benedict Anderson's recent Spectre of Comparisons reminds us of the role played by area studies programs in the American academic profession during the nervous days of the Cold War and the wartime exigencies that led to their postwar organization and installation in a number of universities. But it also recalls for us the comparative promise associated with area studies and how it was either redirected to a multidisciplinary approach poorly disguised as interdisciplinarism or simply incorporated into large developmental narratives like modernization theory. It is instructive to see how Anderson's own work, rather than Southeast Asian area studies, has been able to achieve the remote goal of integration and comparison in a number of stunning examples that have eluded the collective efforts of many institutional programs. This singular success magisterially discloses how he was trained to envisage the region as a "unified" area studies program, even though little more than a geographical term named this unity, and what he needed to do to actually realize the dim prospect of achieving some sort of larger, integrated understanding, which was eventually inscribed in his seminal book, Imagined Communities. At the most basic level, Anderson was able to secure this effect first by roaming around the area (turning his banishment from Indonesia in 1972 to good use by shifting his attention to Thailand and then the Philippines). Yet, as his essays show, there were other, more intellectually and epistemologically compelling reasons which, if amplified, might provide such diversity with a sense of commonality that only geography and the putatively integrative approach of an area studies program seemed willing to promise even as they failed to deliver.Anderson situates his own intellectual trajectory within the institutional circumstances of the region as an area studies which he and his contemporary fellow students "helped give a certain reality" [Spectre 19]. In fact, "Southeast Asia" has always been [End Page 135] the common frame that structured the particular relationship between Europe of the colonizers and its Asian colonized and thus became the location that best exemplified for him the peculiar nature of the "haunting," as he puts it, as both the place of comparison and the necessity of comparability. Information posted by youth in online social media contexts is regularly accessed, downloaded, integrated, and analyzed by academic researchers. The practice raises significant social justice considerations for researchers including issues of representation and equitable distribution of risks and benefits. Use of this type of data for research purposes helps to ensure representation in research of the voices of youth who participate in these online contexts, at times discussing issues that are also under-represented. At the same time, youth whose data are (...) harvested are subject to the risks associated with this research, while receiving little if any direct benefit from the work. These risks include the potential loss of online social community as well as threats to participant rights and wellbeing. This paper explores the tension between the social justice benefit of representation and considerations that would suggest caution, the latter including inequitable distribution of research-related costs and benefits, and the traditional ethics concerns of participant autonomy and privacy in the context of youth participation in online discussions. In the final section, we propose guidelines and considerations for the conduct of online social media research to assist researchers to balance and respect representational and participant rights or wellbeing considerations, especially with youth. This new approach to Josiah Royce shows one of American philosophy's brightest minds in action for today's readers. Although Royce was one of the towering figures of American pragmatism, his thought is often considered in the wake of his more famous peers. Jacquelyn Ann K. Kegley brings fresh perspective to Royce's ideas and clarifies his individual philosophical vision. Kegley foregrounds Royce's concern with contemporary public issues and ethics, focusing in particular on how he addresses long-standing problems such as race, (...) religion, community, the dangers of mass media, mass culture, and blatant individualistic capitalism. She offers a deep and fruitful philosophical exploration of Royce's ideas on conflict resolution, memory, self-identity, and self-development. This article examines the relationship between mothers and medical discourse, drawing from oral narratives of 20 Jewish women who gave birth to their first children between 1928 and 1940. The author shows that women encounter medical discourse not only as a system of technical knowledge but also as a package of cultural and social enterprises. Jewish mothers during this period mobilized medicalized mothering practices to signify their advancement from immigrant culture into the American middle class. Mothers portray themselves as benefiting (...) from the new opportunities of American freedoms, as actively seeking self-improvements, and as engaging medicine in the context of their changing group membership. In more general terms, the author shows that medicalization's effect on social difference extends beyond men's control of women's subjectivity or social position; it also involves women in the creation and maintenance of status hierarchies between women. At the peak of its influence and prestige, theology offered a compelling and complex analysis of the relation of Revelation, Scripture and Word. In Ecriture et Révélation, Breton asks how that relationship might be described in the contemporary world in which the situation of theology, its relation to metaphysics, and the very conditions of understanding have changed. Retaining from Thomas the term “spiritual sense,” Breton uses the notion of “scriptural space,” on which all things can be written, to describe the (...) way in which the self “writes itself in the world.” In place of the classic emphasis on God as author of Scripture Breton focuses upon the Christian community in its search for unity, forming a canon in light of what he calls the “Christic present.” As he critiques different ways in which Scripture is read today, he argues that it is too often objectified or evacuated of meaning. In the aftermath of the debate between Derrida and Levinas on Hebraism and Hellenism, Christian thought that retains a place for philosophy is often regarded as “Graeco‐Christian”, a monolithic system with an unfortunate history. The work of the French philosopher Stansilas Breton suggests that the reality is more complex. In Le Verbe et la croix , he examines the function of the term logos staurou in Paul, arguing that this untranslatable term stands as a question mark in a world of (...) language that could only speak “Jew” or “Greek”. Far from being a sign of Christian superiority, the cross signals an imperative for dispossession intrinsic to Christian language. In its “nothingness” the cross functions as a principle of critique that makes innovation and engagement possible. Thus while the cross involves negation it moves beyond negative theology. Drawing upon neoplatonist philosophy, Breton delineates the way in which the cross makes possible “the writing of the self in the world”. This paper draws upon Breton's understanding of the function of the cross to argue that the heritage of Athens endures and must be re‐thought, always recognizing the limits of all human language. After examining Breton's understanding of the logos staurou, it relates this notion to his broader understanding of revelation as “writing”. Finally it shows how Breton appeals to neoplatonist meonotology to speak in more universal terms of the need for a principle of dispossession at the heart of all religious language. A quest for a separate ontic space-defining difference qua Lesbian and consistently characterized by Allen as "the open"-links her earlier work with her more recent atonalities richly coded with ritual, myth, memory, and play.

The aim of Massimiliano Tomba’s Insurgent Universality is to return to Marxism’s original historical vocation by freeing it from the hegemony of the exchange system and the encompassing agency of value. At the heart of this project appears the recognition that time, space and thus history have been captured by capitalism and transformed into categories of its own to organise people and social relationships for capital’s programme of accumulation. In this way, capital has been able to hijack history and invert (...) it into a representation of the real, into a historical trompe-l’œil instead of ‘presentify(ing) the past’. In this regard contemporising the past is an act of intervening in history and actualising it rather than representing it. Through this operation Tomba is able to retrieve an inventory of repressed and forgotten histories, which will unveil the sources of an ‘alternate legacy of modernity’ and radical political possibilities for the present. Herbert Marcuse’s claim that people may have superimposed “false needs” has been criticized by a number of commentators. These critics argue that if all human needs are sociohistorically conditioned, as Marcuse believes, this effectively means that all needs are superimposed on us, and are thus, “false.” I defend Marcuse’s distinction by drawing attention to his expressed definition of false needs as those which perpetuate harm upon satisfaction. Marcuse’s distinction between true and false needs is not a reiteration of the distinction (...) between needs and wants, as his critics claim, but is rather a recognition that in our society, we are forced to need things that ultimately do not lead to our individual benefit. In asking to what extent the interaction between pragmatism and phenomenology offers a valuable resource for re-imaging the limits and potentialities of philosophical inquiry, one needs to acknowledge, first, that pragmatist philosophers, beginning with Josiah Royce, actively contributed to the re-elaboration of the issues and strategies of phenomenology in the American context. Secondly, it will be argued that the philosophies of the classical pragmatists, Peirce, Royce, James, and Dewey, contain important resources for creating a new understanding of the human self (...) and of the role of philosophy. We will discuss contributing elements from each of the Classical Pragmatists but focus on the neglected contributions of Josiah Royce. We argue that Royce posits important theses that are valuable to our inquiry: his view of self as “expressive,” i.e. through facial and bodily gestures, through cooperative activities such as art, language, custom, religion, understood via a study of the “expressive signs of mental life”; his idea of science as a thoroughly human enterprise; his belief that habits are common to both physical and mental phenomena; his views on knowledge of other minds and how two minds can know the same thing; and his belief in the social grounding of physical knowledge. In the reckoning of historian Enzo Traverso, the accumulative inventory of the past’s crimes has exceeded the ‘frontiers of historical research’ and colonised the public sphere to ‘interpellate our present’. The quarrel over the crisis of historicism before World War ii has been superseded by postwar debates that have now spilled over into everyday life that demand recognition as instances of the continuing collision of claims of a past that refuses to pass and the formation of a new historical consciousness (...) in which collective memory of the crimes occupies a central position. Traverso’s purpose has been to repair this emergent dichotomy between historical practice and memoration, event and experience, as well as to overcome attending binary couplings like subjective and objective, individual and group in order to avoid falling into an unbridgeable antinomy that risks collapsing into contradiction. When an anxiety‐reducing drug with virtually no side effects is used to enhance performance, is that cheating? Is it drug abuse? Is it an admission of professional weakness?

We provide a comprehensive analysis of differences between socially responsible investment and conventional funds in terms of manager characteristics, performance and fund styles. We use holdings-based analysis to evaluate fund performance and style, which allows us to perform a more in-depth analysis than the extant literature. We find that SRI managers have longer tenure and are more likely to be a female. However, these differences do not result in any significant difference in the performance of SRI and conventional funds. In this paper, I analyze the witch's dance through the lens of Jahra “Rager” Wasasala's bloo/d/runk (2016) and Liz Lerman's Wicked Bodies (2020) whose invocation of the witch through the moving body, I argue, goes beyond merely metaphorical or esthetic applications, but enacts a certain dramaturgical function as a hinging threshold, a dynamic site of negotiation between material and immaterial forces. In my analysis, I sketch the contours of a hinge‐analytic called “riding the hinge,” seeking suspension in the hinges of (...) performance in order to account for how invisible forces assume presence on stage through the figure of the witch as she dances. “Riding the hinge,” I argue, is a practice performed by choreographers who engage the transformational presencing power of the body of the witch in performance, as well as a critical methodology for analyzing such works. The ability to extrapolate essential gist through the analysis and synthesis of information, prediction of potential outcomes, abstraction of ideas, and integration of relationships with world knowledge is critical for higher-order learning. The present study investigated the efficacy of cognitive training to elicit improvements in gist-reasoning and fact recall ability in 556 public middle-school students (grades seven and eight), versus a sample of 357 middle school students who served as a comparison group, to determine if changes in gist-reasoning and fact (...) recall were demonstrated without cognitive training. The results showed that, in general, cognitive training increased gist-reasoning and fact recall abilities in students from families in poverty as well as students from families living above poverty. However, the magnitude of gains in gist-reasoning varied as a function of gender and grade-level. Our primary findings were that seventh and eighth grade girls and eighth grade boys showed significant increases in gist-reasoning after training regardless of socioeconomic status. There were no significant increases in gist-reasoning or fact recall ability for the 357 middle school students who served in the comparison group. We postulate that cognitive training in middle school is efficacious for improving gist-reasoning ability and fact recall in students from all socioeconomic levels. (shrink)

Nova Scotia’s recently updated Involuntary Psychiatric Treatment Act signii cantly updated mental health law in the province in many respects. However, s.39 of the Act deviates from this record in that it contains a clause that permits overriding the competent prior wishes of involuntarily committed psychiatric patients. This is problematic because it displaces established Canadian common law and legislation on advance directives for psychiatric patients but not other patients, suggesting possible discrimination The paper explores whether s.39 might survive challenge under (...) s.15 of the Canadian Charter of Rights and Freedoms, as either an ai rmative action program under s.15 of the Charter or as an overriding societal concern under s.1 of the Charter. This essay explores the criteria for lesbian identity attribution through the case study of "male lesbians": biological males who claim to be lesbians. I analyze such sex/gender identity attribution through the lens of postmodernism, which provides a workable theoretical framework for "male lesbian" identities. My conclusions explore the historicity and cultural constructedness of the body's sex/gender identities, revealing the limitations of both "the postmodernized body" and "the essentialized modernist body.".

In recent years, calls have been made to address the relative dearth of qualitative sociological investigation into the sensory dimensions of embodiment, including within physical cultures. This article contributes to a small, innovative and developing literature utilizing sociological phenomenology to examine sensuous embodiment. Drawing upon data from three research projects, here we explore some of the ‘sensuousities’ of ‘intense embodiment’ experiences as a distance-running-woman and a boxing-woman, respectively. Our analysis addresses the relatively unexplored haptic senses, particularly the ‘touch’ of heat. (...) Heat has been argued to constitute a specific sensory mode, a trans-boundary sense. Our findings suggest that ‘lived’ heat, in our own physical-cultural experiences, has highly proprioceptive elements and is experienced as both a form of touch and as a distinct perceptual mode, dependent upon context. Our analysis coheres around two key themes that emerged as salient: (1) warming up, and (2) thermoregulation, which in lived experience were encountered as strongly interwoven. (shrink)

In _Archaism and Actuality_ eminent Marxist historian Harry Harootunian explores the formation of capitalism and fascism in Japan as a prime example of the uneven development of capitalism. He applies his theorization of subsumption to examine how capitalism integrates and redirects preexisting social, cultural, and economic practices to guide the present. This subsumption leads to a global condition in which states and societies all exist within different stages and manifestations of capitalism. Drawing on Japanese philosophers Miki Kiyoshi and Tosaka (...) Jun, Marxist theory, and Gramsci’s notion of passive revolution, Harootunian shows how the Meiji Restoration of 1868 and its program dedicated to transforming the country into a modern society exemplified a unique path to capitalism. Japan’s capitalist expansion in the nineteenth and twentieth centuries, rise as an imperial power, and subsequent transition to fascism signal a wholly distinct trajectory into modernity that forecloses any notion of a pure or universal development of capitalism. With _Archaism and Actuality_, Harootunian offers both a retheorization of capitalist development and a reinterpretation of epochal moments in modern Japanese history. (shrink)

Prior literature on socially responsible investment has contended that excluding “sin stocks” from a portfolio will reduce performance and increase risk. Further, incorporating stocks of firms with positive social responsibility scores will improve performance and reduce risk. We simulate portfolios designed to mimic typical equity mutual funds’ holdings and investigate these propositions. We remove the potentially confounding influences of differences in manager skill, transaction costs and fees, and conduct a clean experiment on the effect of positive and negative portfolio screening. (...) We find no difference in the return or risk of screened and unscreened portfolios. We conclude that a typical socially responsible fund will neither gain nor lose from screening its portfolio. Mistaken payment is the ‘core case’ of unjust enrichment, and it has had a powerful effect on the development of this area of private law. For Peter Birks, unjust enrichment was simply ‘the law of all events materially identical to mistaken payment’—to be shaped through a process of abstraction from that core case. But this begs the question: how do we work out what counts as ‘materially identical’ to mistaken payment? The most obvious starting point, and that which Birks chose, (...) is the central characteristic of money: money is valuable. Thus, ‘the law of all events materially identical to mistaken payments’ is ‘the law of all events that unjustly enrich one party at another’s expense’.In this article, I argue that this starting point is incorrect. Rather than looking for some factual similarity between mistaken payment and other events, we should identify the role that money plays in justifying restitution. And what justifies restitution in the core case is not the ‘value’ or ‘benefit’ that money confers; rather, it is a defect in the legal transaction that links payor with payee. The payee is not liable because she has been ‘enriched’, but because she is the counterparty to a legal transaction which exhibits traits that there are institutional reasons to disavow. Just like contract and torts, the role of value is secondary: where correcting the injustice in specie is impossible or undesirable, the defendant must pay whichever sum will most nearly achieve that goal. Historically, the nomadic traditions of pastoralists have been alternately attacked and romanticized. In fact, pastoral groups represent a range of production systems with wide variations in pastoral and cultivation activities. Given this range and the ecological and sociopolitical constraints facing pastoralists today, agroforestry interventions appear not only feasible, but perhaps imperative for some pastoral groups. However, their design and implementation must be carried out with keen awareness and respect for the unique ecological and cultural position traditionally nomadic pastoral people hold. (...) A review of the sociopolitical and natural resource management literature on existing sylvopastoral and agrosylvopastoral technologies points to the importance of social issues such as gender, land and tree tenure, equity, and cultural context.
