This paper develops an informal semantics for 'ought to be' and 'ought to be given...' and argues for its plausibility. A feature of the semantics is that it invalidates 'if a entails b, And o(a), Then o(b)' and 'if o(a) & o(b), Then o(a&b)', While validating detachment for conditional obligation.

PurposeThis paper aims to argue that traditional ethical theories used in disaster response may be inadequate and particularly strained by the emergence of new technologies and social media, particularly with regard to privacy. How is what an agent ought to do at time t related to what they ought to do over a period of time that includes t? I revisit an example that sheds light on this question, taking account of issues to do with the agent's intentions and the distinction between subjective and objective obligation.

1. Reflecting on possible cases can be very valuable in differing ways. Sometimes it makes clear a consequence of a theory, a consequence that then plays an important role in debates about the theory. Utilitarians who favour maximising average happiness confront utilitarians who favour maximising total happiness with possible cases where there are enormously many sentient beings whose lives are barely worth living. Sometimes reflecting on possible cases serves to clarify a doctrine. Classical versions of consequentialism value equity for its (...) good results; they don't value it per se. What this means is that in cases where we have two actions alike in the value of their consequences but differing in that one delivers a more equitable distribution, classical consequentialism treats the two actions as morally equivalent. Sometimes reflections on possible cases reveal relationships that are not immediately obvious. Take Galileo's famous thought experiment directed against the view that the heavier a body is the faster it falls in a vacuum. He describes a possible case where the only way to retain the view requires embracing independently implausible views about how various ways two bodies are connected to each other make a big difference to how fast the joined bodies fall. The thought experiment reveals a connection that might otherwise escape notice.This reminds us that we should not expect a uniform answer to the question, What role do thought experiments play? However, it is conventional wisdom that very often their role is to make trouble for one or another proffered conceptual analysis. Take two thought experiments that have been found especially compelling by the analytical philosophical community: Edmund Gettier's examples of true, justified belief, where the beliefs are true by some kind of fluke, and Ned Block's example of a being that makes ‘intelligent’ responses to the challenges the …. The concept of supererogation is an act that it is right to do but not wrong not to do. The moral trinity of the deontic logic excludes such acts from moral theory. A moral theory that is based on duty or obligation unqualified seems inevitably to make all good acts obligations, whether construed from a teleological or deontological point of view. If supererogation is a moral fact, no moral theory can survive without acknowledging it. One way to distinguish supererogation from (...) obligation that is not arbitrary is to draw the line of obligation at death and dismemberment. Such a limit to obligation is often implicit in moral theory. Inclusive obligation requires us all to be heroes all of the time. The moral limit to obligation is one of Hobbes's teachings. Though it is seldom noted in contemporary political and moral theory, it is, for example, implied in Rawls's definition of ‘supererogation.’ In this definition it is said that heroic supererogation would be a duty but for the high cost associated with it. This cost is the risk of life and limb;.it distinguishes supererogation from both benevolence and obligation.A supererogation is a good act with a high cost. The goodness of the act, however determined, must be proportionate to the cost to the agent. If life is risked, life or something deemed no less valuable must be gained. The intention to effect such important goods for others is sufficient for an act to be supererogatory even if it fails.If moral reality is inevitably vague, complex, and incomplete, then it is no surprise that moral theory is that way, too. The challenge is that moral theory be no more vague, complex, and incomplete than necessary and in ways justified by the nature of moral reality. Intentional states represent. Belief represents how we take things to be; desire represents how we would like things to be; and so on. To represent is to make a division among possibilities; it is to divide the possibilities into those that are consistent with how things are being represented to be and those that are not. I will call the possibilities consistent with how some intentional state represents things to be, its content. The term ‘logical form’ has been called on to serve a wide range of purposes in philosophy, and it would be too ambitious to try to survey all of them in a single essay. Instead, I will focus on just one conception of logical form that has occupied a central place in the philosophy of language, and in particular in the philosophical study of linguistic meaning. This is what I will call the classical conception of logical form. The classical conception, (...) as I will present it in section 1, has (either explicitly or implicitly) shaped a great deal of important philosophical work in semantic theory. This paper elucidates the pragmatist elements of Thomas Reid's approach to the justification of first principles by reference to Charles S. Peirce. Peirce argues that first principles are justified by their surviving a process of ‘self-criticism’, in which we come to appreciate that we cannot bring ourselves to doubt these principles, in addition to the foundational role they play in inquiries. The evidence Reid allows first principles bears resemblance to surviving the process of self-criticism. I then argue that this evidence (...) allows Reid and Peirce a way out of the dilemma between dogmatism and skepticism regarding the justification of such principles, insofar as they are epistemically, and not solely practically, justified. This paper seeks to argue that although fair trial standards are commonly portrayed as a set of minimum coherent standards applicable across a range of different legal traditions, there is a tension between those standards that accentuate the importance of individual will and autonomy and those that emphasise the importance of accurate outcome through an effective defence. This tension has been managed for the most part by enabling individuals to be represented by legal counsel who present the defence on the (...) basis of their clients’ instructions. Human rights law has recognised the importance of legal assistance at trial and pre-trial stages of criminal procedures. Despite this certain developments in domestic and international criminal processes have led to a growing number of cases being decided without an effective defence being provided by legal counsel. Such cases have been disposed on the basis of defendants’ ‘consent’ and this supposed autonomy has held sway over any effective defence. The paper begins by tracing different dimensions of the fair trial standards and exposes a tension between the need for defendants to exercise autonomy over their case and the need for an effective defence. The paper then argues that the right to counsel has acted as a bridge between these two competing demands. Recent developments are then reviewed which have served to impede counsel from providing an effective defence in the interests of the client’s freedom to choose how her case should be handled. The examples examined are the growing number of cases that are pleaded or diverted out of court with no real examination of the strength of the prosecution case, the emergence of special advocates who do not take instructions from defendants and the increasing tendency for defendants to represent themselves in certain types of cases. The paper concludes by arguing that we need to make a sharper distinction between individual rights and procedural standards and argues for greater attention to be given to the latter on the design of criminal procedure. Models of the architecture of mature cognitive systems can inform the study of normal and disordered cognitive development, if one distinguishes between proximal and distal causes of performance. The assumption of residual normality need not be made in order to apply adult models to performance early in development, because these models can be modified to reflect the results of compensatory processing.

This paper makes the case for conceptualizing news as a contested commodity. It offers an unprecedented application of commodification theory to the problem of the sustainability of a free press in a democracy. When the news media are expected to be purveyors of the public interest while pursuing profits for their corporate owners, the result often is a clash of capitalist and journalistic imperatives. The amoral values of the market system conflict with the moral agency of a free press, and (...) the two are inherently incompatible. This study presents a synthesis of otherwise divergent theoretical perspectives to examine the free press-free market paradox from a new vista.
