A plethora of normative conservation concepts have recently emerged, most of which are ill-defined: biological diversity, biological integrity, ecological restoration, ecological services, ecological rehabilitation, ecological sustainability, sustainable development, ecosystem health, ecosystem management, adaptive management, and keystone species are salient among them. These normative concepts can be organized and interpreted by reference to two new schools of conservation philosophy, compositionalism and functionalism. The former comprehends nature primarily by means of evolutionary ecology and considers Homo sapiens separate from nature. The latter comprehends (...) nature primarily by means of ecosystem ecology and considers Homo sapiens a part of nature. Biological diversity, biological integrity, and ecological restoration belong primarily in the compositionalist glossary; the rest belong primarily in the functionalist glossary. The former set are more appropriate norms for reserves, the latter for areas that are humanly inhabited and exploited. In contrast to the older schools of conservation philosophy, preservationism and resourcism, compositionalism and functionalism are complementary, not competitive and mutually exclusive. As the historically divergent ecological sciences—evolutionary ecology and ecosystem ecology—are increasingly synthesized, a more unified philosophy of conservation can be envisioned. (shrink)

This essay aims to continue to develop the thesis that the welter of political-economic, social, technological, and subjective transformations that characterized the final decades of the 20th century and the first decades of the 21st necessitate a re-thinking of the relationship between social criticism and the critique of political economy. Herein the focus is directed towards the critique of reification and industrial rationalization as developed in the works of Georg Lukács and Cornelius Castoriadis. Drawing on recent phenomenological and psychological analyses (...) of work within contemporary capitalism, I argue for both the historical obsolescence of the critique of reification as it has been traditionally understood and, consequently, the need for novel conceptual responses to the pressing needs of our time. Since Leibniz's time, Cartesian mental causation has been criticized for violating the conservation of energy and momentum. Many dualist responses clearly fail. But conservation laws have important neglected features generally undermining the objection. Conservation is _local_, holding first not for the universe, but for everywhere separately. The energy in any volume changes only due to what flows through the boundaries. Constant total energy holds if the global summing-up of local conservation laws converges; it probably doesn't in reality. Energy conservation holds (...) if there is symmetry, the sameness of the laws over time. Thus, if there are time-places where symmetries fail due to nonphysical influence, conservation laws fail there and then, while holding elsewhere, such as refrigerators and stars. Noether's converse first theorem shows that conservation laws imply symmetries. Thus conservation trivially nearly entails the causal closure of the physical. But expecting conservation to hold in the brain simply assumes the falsehood of Cartesianism. Hence Leibniz's objection begs the question. Empirical neuroscience is another matter. So is Einstein's General Relativity: far from providing a loophole, General Relativity makes mental causation _harder_. (shrink)

Here I reply to criticisms by Jeroen de Ridder and S. Kate Devitt to my "Collective (Telic) Virtue Epistemology".

Despite optimistic reports about the results of amputation for advanced vascular disease, the patient’s assessment of advantages and disadvantages is seldom acknowledged. A detailed social study of 67 amputees has revealed considerable disparity between the patient’s views and those of the medical staff. About a third of the patients are forced to retire from active work by the amputation; about three-quarters report a serious decline in their social activities; only about half are really independent with prostheses in the long term; (...) a quarter report severe and intractable symptoms related to their amputation stumps; only about a quarter feel that the amputation was definitely beneficial; and only about one in five feel that the medical staff have provided adequate support during their hospital stay. Amputees face physical and financial disability, isolation, and discomfort. Every effort must be made to explain the implications of amputation honestly and realistically and to ensure continuing patient assessment and support. (shrink)

Background Equal access to healthcare is a core principle in Norway’s public healthcare system. The COVID-19 pandemic challenged healthcare systems in the early phase – in particular, related to testing and hospital capacity. There is little knowledge on how older people experienced being infected with an unfamiliar and severe disease, and how they experienced the need for healthcare early in the pandemic Aim To explore the experiences of older people infected by COVID-19 and their need for testing and hospitalisation. Research (...) design An explorative and descriptive approach, with qualitative interviews conducted in October 2020. Participants and research context Seventeen participants above 60 years of age hospitalised due to COVID-19 during spring 2020 were recruited 6 months after discharge. Ethical considerations Ethical approval was granted by the Regional Committee for Medical and Health Research Ethics in South-Eastern Norway (155425). Findings The main finding was that the informants experienced vulnerability and arbitrariness. This finding was supported by three sub-themes: experiences with a severe and unfamiliar disease, the strict criteria and the importance of someone advocating needs. Discussion Participants described varying access to healthcare. Those who did not meet the national criteria to be tested or hospitalised struggled against the system. Findings reveal arbitrary access to healthcare, in contrast to Norway’s ethical principle of fair and just access to health services. Moreover, to access and receive necessary healthcare, informants were dependent on their next-of-kin’s advocacy. Conclusion Even when dealing with an unfamiliar disease, health professionals’ assessments of symptoms must be performed with an ethical obligation to applicate competent appraisal and the exercise of discernment; this is in line with care ethics and ethical standards for nurses. These perspectives are a significant part of caring and the intension of doing good. (shrink)

Every author cares about being understood, but for reasons that Hagop Sarkissian has explained, I can be expected to care more than most. I'm delighted to say that Sarkissian has understood my book thoroughly and provided an accurate and charitable summary. I am also delighted to learn from him how closely my view echoes strains of classical Confucianism.I was especially interested by Sarkissian's characterization of my view as implying that "morals do indeed seem to collapse to mores, or perhaps mores (...) rise to the status of morals." Departing from Charles Taylors’s statement that philosophy is inescapably historical, the paper tries to examine several attempts to write the history of African philosophy. It notes that contrary to the experience of many other regional philosophies there is yet no comprehensive history of African philosophy which takes full account of its the different spectrums and periods. A good number of authors who have tried to recount the history of African philosophy have dwelt only on aspects or periods of that philosophy (...) thus precluding the advantage of presenting African philosophy as a coherent whole. An examination of the weakness and the strong points of some of these works leads to the assertion of the necessity of comprehensive history of African philosophy, as well as a weighing of the possible reasons why no serious attempt have been made in that direction. In contrast to certain recent work, which supposes that the fetial priests were always responsible for the swearing of the oaths made upon the striking of a treaty and that the rituals they performed went unchanged for centuries, this paper argues that the treaty-making rituals of the Romans changed and developed, and that the ritual which the fetial priests performed may not have been devised until as late as the third century BC.

Whereas previous research has focused on the link between workload and task performance, less is known about the intervening mechanisms influencing this relationship. In the present study, we test the moderating roles of daily recovery and total sleep time in the relationship between work pressure and daily task performance. Using performance and recovery theories, we hypothesized that work pressure relates positively to daily task performance, and that both daily recovery in the form of psychological detachment and relaxation, and total sleep (...) time independently enhance this relationship. Our hypotheses were tested in a 30-day diary study with 110 officer cadets on a cross-Atlantic voyage on a Naval sail ship. The results of multilevel modeling lend support to all three hypotheses. Taken together, our findings suggest that recovery and sleep duration between shifts play a key role in the relationship between daily work pressure and task performance. We discuss the implications of these findings for the stressor-detachment model. (shrink)

According to tradition, logic is normative for reasoning. According to many contemporary philosophers of logic, there is more than one correct logic. What is the relationship between these two strands of thought? This paper makes two claims. First, logic is doubly normative for reasoning because, in addition to constraining the combinations of beliefs that we may have, logic also constrains the methods by which we may form them. Second, given that logic is doubly normative for reasoning, a wide array of (...) logical pluralisms are inconsistent with the normativity of logic as they entail contradictory claims about how agents ought to reason. The reception history of the French Revolution in France and England is well documented among Anglophone scholars; however, the debate over the Revolution in Germany is much less well known. Fichte's Contribution played an important role in this debate. Presented here for the first time in English, Fichte's work provides a distinctive synthesis of Locke's "possessive individualism," Rousseau's general will, and Kant's moral philosophy. This eclectic blend results in an unusual rights theory that at times veers close to a form (...) of anarchism. Written in 1792–93, just before Fichte moved to Jena to develop his philosophical system in a series of works—above all the Wissenschaftslehre of 1794—the Contribution provides invaluable insight into Fichte's early development. In addition, Fichte's work predates much of Kant's political philosophy, and can shed light on the rich dialogue in German political thought in the 1790s. (shrink)

Prominent philosophers have argued that contradictions contain either too much or too little information to be useful. We dispute this with what we call the “Paradox of the Two Firefighters.” Suppose you are awakened in your hotel room by a fire alarm. You open the door. You see three possible ways out: left, right, straight ahead. You see two firefighters. One says there is exactly one safe route and it is to your left. The other says there is exactly one (...) safe route and it is to your right. While the two firemen are giving you contradictory information, they are also both giving you the perhaps useful information that there is a safe way out and it is not straight ahead. We give two analyses. The first uses the “Opinion Tetrahedron,” introduced by Dunn as a generalization of Audun Jøsang’s “Opinion Triangle.” The Opinion Tetrahedron in effect embeds the values of the “Belnap-Dunn 4-valued Logic” into a context of subjective probability generalized to allow for degrees of belief, disbelief, and two kinds of uncertainty—that in which the reasoner has too little information and that in which the reasoner has too much information. Jøsang had only a single value for uncertainty. We also present an alternative solution, again based on subjective probability but of a more standard type. This solution builds upon “linear opinion pooling.” Kiefer had already developed apparatus for assessing risk using expert opinion, and this influences the second solution. Finally, we discuss how these solutions might apply to “Big Data” and the World Wide Web. (shrink)

This paper aims to establish that Sorites reasoning, a fundamental part of Parfit's work, is more destructive that he intends. I establish the form that Parfit's arguments take and then substitute premises whose acceptability to Parfit I show. The new argument demonstrates an eliminativism or immaterialism concerning persons which Parfit must find repugnant.

Hanlester Network v. Shalala ) marks the first test of the application of the Medicare-Medicaid anti-kickback statute to physician self-referral joint ventures. The most recent development in this ongoing litigation was the April 6, 1995 decision of the Ninth Circuit Court of Appeals, holding the Hanlester Network vicariously liable for its marketing vice president's knowing and willful violation of the antikickback statute. The vice president had offered to pay physician-investors in order to induce their referrals of program-related business.The Hanlester Network (...) was a California general partnership comprised of corporations, clinical laboratories, and individual investors. The purported crisis and opportunity in liberal education may be approached via a reconsideration of the arts in liberal arts education. The advantage of such a view is that proponents of humanistic liberal education could speak in their own terms, while incorporating in a systematic way studies of ancient and modern liberal arts, addressing public questions of the value and substance of a liberal education. A plausible issue for consideration is whether the “arts” can address a crisis, its purported causes (...) and solutions, and the key role the humanities may have in building a renewed liberal arts education. At stake in the classroom is the realization of the possibilities, the intellectual freedom, which humans make for themselves in artistic making. This freedom differs from, but is complementary to, political freedom, the loadstone of standard liberal education defenses, because it is based in innovations and inventions of the arts and sciences, not in constitutions or politics of democracy. ABSTRACT Scholarship in the area of social movements points to the importance of inter-group collaboration and alliance building. In the case of Indigenous-led movements and the issue of solidarity with non-Indigenous movement participants, scholarship at the intersection of Native studies and social movements suggests that such alliances can be built and sustained but that unlearning colonial attitudes and behaviors is central to this process. Through in-depth interviews with non-Native solidarity participants, this article considers how engagement with Indigenous thought and action (...) re-shapes particpants’ conceptions of environment and place. Findings suggest that such involvement calls attention to histories of violence as well as ongoing practices of dispossession causing activists to grapple not only with their personal and family histories but also with their evolving relationship with environmentalism. The authors compare the results of the last elections computed according to several systems, including the new project. Their conclusion is that the new project is politically oriented : it favours the big parties.The authors propose a new system of ballot which is really neutral, and they show it by a simulation on the results of (...) the elections since 1954.Their system is simple and easily treated by computer. Evolving from both Gifford Pinchot and his utilitarian philosophy of wise use, and John Muir and the preservation philosophy of wilderness, Aldo Leopold espoused--and practices--integrating a degree of wildness into the working agricultural landscape. As newly published essays show, his articulation of "land health" prefigures current definitions of ecosystem health, and the practices he preached anticipate today's prescriptions for ecosystem management. Although the science of ecology has evolved and terminology has changed, Leopold's formulation may help both standardize and institutionalize the (...) concept of ecosystem health, and his example may inspire an ambitious new goal in public and private land management.
