Data-driven technologies have come to pervade almost every aspect of business life, extending to employee monitoring and algorithmic management. How can employee privacy be protected in the age of datafication? This article surveys the potential and shortcomings of a number of legal and technical solutions to show the advantages of human rights-based approaches in addressing corporate responsibility to respect privacy and strengthen human agency. Based on this notion, we develop a process-oriented model of Privacy Due Diligence to complement existing frameworks (...) for safeguarding employee privacy in an era of Big Data surveillance. Le faux porte sur le détournement du titre de l'ouvrage—référence au pamphlet de Morelly, alors communément attribué à Diderot—, de l'auteur—Confucius, philosophe contemporain de Socrate qui n'a laissé aucun ouvrage de sa main—, du travail de traduction—qui par définition n'a jamais pu exister—et de commentaire—attribué à un jésuite de la mission française en Chine. Le véritable aute ur du faux, (...) Louis Lavicomterie, Montagnard et régicide, l'a revendiqué pendant la Révolution. La reconstitution des circonstances et des arrière-plans historiques du texte tente de circonscrire la charge émotive et pamphlétaire de ce message chinois falsifié pour véhiculer un plaidoyer en faveur de l'abolition de la peine de mort et une satire de la justice et du clergé. Derrière Confucius, Lavicomterie a inscrit Voltaire en filigrane. We develop a model of ideals-based accountability which we have witnessed at work in several long-thriving family businesses. The owners and managers of these firms eschew individualism and materiality in the pursuit of ethical ideals such as supporting democracy and bettering the human condition. Although accountability is to these ideals, not for outcomes such as profitability or even reputation, IBA has resulted in outstanding reputations for some firms. We characterize IBA according to its missions, leadership, culture, and stakeholder relationships. We (...) also contrast it with traditional forms of accountability and differentiate IBA from related stakeholder, stewardship, and CSR perspectives. Finally, we examine its manifestations within five long-lived family enterprises, in the process generating propositions to advance the concept. (shrink)

Zipf famously stated that, if natural language lexicons are structured for efficient communication, the words that are used the most frequently should require the least effort. This observation explains the famous finding that the most frequent words in a language tend to be short. A related prediction is that, even within words of the same length, the most frequent word forms should be the ones that are easiest to produce and understand. Using orthographics as a proxy for phonetics, we test (...) this hypothesis using corpora of 96 languages from Wikipedia. We find that, across a variety of languages and language families and controlling for length, the most frequent forms in a language tend to be more orthographically well‐formed and have more orthographic neighbors than less frequent forms. We interpret this result as evidence that lexicons are structured by language usage pressures to facilitate efficient communication. (shrink)

BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

This article is about the chief character of Sartre?s unfinished trilogy of novels known as Les chemins de la liberté—Daniel, Mathieu?s fellow-student at the École normale, Daniel the "archangel," Daniel the shamefaced pederast, Daniel the gaping wound, Daniel the strange hero, Daniel the recurrent figure in many of Sartre?s works. We do not intend to offer yet another explanation of this handsome young literature professor?s convoluted character to the explanations that already exist, nor to interpret yet again his detestation of (...) mankind and his prayers to God, which the author openly mocks. What we wish to do in these few pages is firstly to shed light on the procedures of Daniel?s imagination and evolution, and secondly to analyze how the author?s goals changed as, while writing the trilogy, he evolved from Gallimard?s up and coming star into the symbol of the search for freedom, the spokesman whom some disagreed with, criticised, despised, while others glorified him and praised him to the skies. We would like to try and elucidate the evolution of this character, steering between the free future of a literary work in progress and the ungraspable heart of darkness. (shrink)

La question de la mise en œuvre de la loi a pu être pensée comme demandant l’ajustement de la loi au cas particulier. J’essaierai d’évaluer la mesure dans laquelle les nouveaux outils conceptuels proposés par la philosophie analytique, permettent de ressaisir cette question bien connue et tout à fait fondamentale de la philosophie, depuis sa discussion par Platon et Aristote. Depuis une dizaine d’années, les philosophes du droit américains – Endicott et Soames en particulier – se sont saisis de la (...) question du « vague », épistémique et ontologique. Je propose de souligner certains résultats ainsi obtenus, tout en présentant les aspects métaphysiques sollicités par ces concepts. J’interrogerai donc le point de contact de la métaphysique contemporaine et de la philosophie du droit, pour montrer comment une question classique peut être reprise à nouveaux frais autour d’un exemple tout à fait spécifique, qui est celui de la négligence (dans la relation entre parents et enfants). According to Etienne Souriau, ontology must be grasped in light of an ontogonic perspective in which future is to be rebuilt permanently as an act. We show that “constant forms” support Souriau’s aim that ontogony must be both ubiquitous and pragmatic. Firstly, the “constant forms” support Souriau’s ubiquitous ontogony which aims to escape the reification due to the “law of localization”. Secondly, as far as they are considered as “action template”, the “constant forms” support Souriau’s pragmatic ontogony according to which (...) “existence is an act”. Thirdly, Souriau characterizes as “constant forms” the morphems on which is based his synaptic vision (as opposed to the ontic vision) which values the dynamical role of transitions in order to create a future as an act, as it is required by the criteria of pragmatic ontogony. As knowledge creation quickly gains importance for globally active corporations, we attempt to combine the advantages of the Stakeholder View with those of the SECI model by Nonaka and Takeuchi. In order to support the mental processes of the stakeholders, we use so-called topic maps to transform implicit into explicit knowledge and to visualize it. The preliminary propositions are illustrated by the case study of Swiss Re.

This article intends to see to what extend Augustine’s Confessions may correspond to a kind of parrhesia, as analyzed by Michel Foucault about ancient christian writers in Le courage de la vérité. The classical parrhesia is actually subverted in the specific structure of the Confessions : the frankness of the parrhesia is supposed to have an effect on Augustine as author and on his readers, not on the omniscient God – whom Augustine precisely addresses. Furthermore, his trust in God – (...) another manifestation of parrhesia that is expressed by the Latin word fiducia – has biblical roots, but is also renewed by the idea of grace. Nevertheless, we can say that the apologetical and religious aspect of parrhesia which appears in some passages of the Confessions reminds somehow the traditional political use of parrhesia. In a thought-provoking paper, Schuklenk and Smalling argue that no right to conscientious objection should be granted to medical professionals. First, they hold that it is impossible to assess either the truth of conscience-based claims or the sincerity of the objectors. Second, even a fettered right to conscientious refusal inevitably has adverse effects on the rights of patients. We argue that the main problem with their position is that it is not derived from a broader reflection on the meaning and (...) implications of freedom of conscience and reasonable accommodation. We point out that they collapse two related but distinct questions, that is, the subjective conception of freedom of conscience and the sincerity test. We note that they do not successfully show that the standard norm according to which exemption claims should not impose undue hardship on others is unworkable. We suggest that the main reason why arguments such as no one is forced to be a medical professional are flawed is that public norms should not constrain citizens to choose between two of their basic rights unless it is necessary. In fine, Schuklenk and Smalling, who see conscience claims as arbitrary dislikes, sell freedom of conscience short and forego any attempts at balancing the competing rights involved. We maintain the authors neglect that most of legal reasoning is contextual and that the blanket restriction of healthcare professionals' freedom of conscience is disproportionate. (shrink)

The Swedish naturalist Carl Linnaeus is famous for having turned botany into a systematic discipline, through his classification systems—most notably the sexual system—and his nomenclature. Throughout his life, Linnaeus experimented with various paper technologies designed to display information synoptically. The list took pride of place among these and is also the common element of more complex representations he produced, such as genera descriptions and his “natural system.” Taking clues from the anthropology of writing, this essay seeks to demonstrate that lists (...) can be considered as genuine research technologies. They possess a potential to generate research problems of their own but also pose limitations to inquiries that can be overcome only by the use of new media. (shrink)

The grammatical paradigm used to be a model for entire areas of cognitive science. Its primary tenet was that theories are axiomatic-like systems. A secondary tenet was that their predictions should be tested quickly and in great detail with introspective judgments. While the grammatical paradigm now often seems passé, we argue that in fact it continues to be as efficient as ever. Formal models are essential because they are explicit, highly predictive, and typically modular. They make numerous critical predictions, which (...) must be tested efficiently; introspective judgments do just this. We further argue that the grammatical paradigm continues to be fruitful. Within linguistics, implicature theory is a recent example, with a combination of formal explicitness, modularity, and interaction with experimental work. Beyond traditional linguistics, the grammatical paradigm has proven fruitful in the study of gestures and emojis; literature (“Free Indirect Discourse”); picture semantics and comics; music and dance cognition; and even reasoning and concepts. We argue, however, that the grammatical paradigm must be adapted to contemporary cognitive science. Computational methods are essential to derive quantitative predictions from formal models (Bayesian pragmatics is an example). And data collection techniques offer an ever richer continuum of options, from introspective judgments to large-scale experiments, which makes it possible to optimize the cost/benefit ratio of the empirical methods that are chosen to test theories. Parental burnout is a specific syndrome resulting from enduring exposure to chronic parenting stress. But why do some parents burn out while others, facing the same stressors, do not? The main aim of this paper was to propose a theory of parental burnout capable of predicting who is at risk of burnout, explaining why a particular parent burned out and why at that specific point in time, and providing directions for intervention. The secondary goal was to operationalize this theory in (...) a tool that would be easy to use for both researchers and clinicians. The results of this two-wave longitudinal study conducted on 923 parents suggest that the Balance between Risks and Resources (BR 2 ) theory proposed here is a relevant framework to predict and explain parental burnout. More specifically, the results show that (1) the BR 2 instrument reliably measures parents' balance between risks (parental stress-enhancing factors) and resources (parental stress-alleviating factors), (2) there is a strong linear relationship between BR 2 score and parental burnout, (3) parental burnout results from a chronic imbalance of risks over resources, (4) BR 2 predicts parental burnout better than job burnout and (5) among the risk and resource factors measured in BR 2, risks and resources non-specific to parenting (e.g., low stress-management abilities, perfectionism) equally predict parental and job burnout, while risks and resources specific to parenting (e.g., childrearing practices, coparenting) uniquely predict parental burnout. Personalized medicine aims to tailor disease prevention, diagnosis, and treatment to individuals on the basis of their genes, lifestyle and environments. Patient and interest organizations may potentially play an important role in the realization of PM. This paper investigates the views and perspectives on PM of a variety of PIOs. Semi-structured telephone interviews were conducted among leading representatives of 13 PIOs located in Europe and North-America. The data collected were analysed using a conventional content analysis approach. The PIO representatives supported (...) the realization of PM but feared that many financial, structural and organizational challenges may delay its realization. They encouraged strategies to modernize drug licencing mechanisms, develop research and data sharing infrastructures, and educate patients and health care professionals in PM. Notably, they emphasized the importance of developing PM in an equitable way and taking into consideration the patients’ needs, values and personal situation. Despite varying levels of awareness regarding PM, the PIO representatives expressed willingness to engage in the PM agenda and recommended that PIOs work closely with policy-makers to design PM in a way that truly addresses the needs and concerns of patients. PIOs have the potential to become central drivers of the PM agenda. Collaborations should be further developed between PIOs, researchers, drug developers and health care authorities. (shrink)

This paper critically examines so-called “epistemic Frankfurt cases” (see e.g., Kelp 2016; Zagzebski 2001) against the backdrop of the original Frankfurt case. A distinction is drawn between two ways of deserving “epistemic credit,” which are subsequently compared to the concept of moral responsibility that is in play within the original Frankfurt case. Based on this analysis, Zagzebski's claim that agents in “epistemic Frankfurt cases” can be considered epistemically credible for the same reason as the agent in the original version is (...) said to be morally responsible is challenged; raising doubts as to whether these cases really are best described as instances of knowledge. The paper concludes with the construction and discussion of a case that is a genuine epistemic analogue to the original Frankfurt case. (shrink)

La notion de planétarité contribue-t-elle à amincir notre monde, ou à l’épaissir? Comment l’inscrire au sein d’agencements collectifs qui aident à cultiver une confiance, précondition au développement de pratiques et de savoir collectifs?

This paper is the result of a contribution between ethics and law, which will be used as thought-process tools, to address the complex issue of legal and ethical statuses of GM fish. To find answers, we propose to consider this issue from a wider angle, looking at the relations between the human, animal, and living worlds. We show that it is possible to construct other forms of intellectual logic that, without setting these worlds in opposition, do not lapse into relativism (...) where boundaries are blurred. In this sense, we submit the hypothesis that ordered pluralism should help us to move past a mere Man–Animal relationship to reveal the entire complexity of relationships within mankind and between mankind and other (non-human) worlds alongside it and to which it belongs: the animal and living worlds. With this new logic, “animal ethics” and “animal law” are re-embedded into a set of relationships. This logic emerges from a new consideration: the nature of the contemporary objects we are dealing with. We shall call objects like genetically modified fish “relational objects” in the sense that in order to be apprehended, they utilize a set of relationships of which there are just as many as the dimensions forming them, not as predicates but as primary constituents. Experimentally, in the case of GM fish, we translate this by proposing to typologize legal and ethical considerations induced by multiple relations connected to this object. According to the type of relationship in question, the GM fish will not have the same status; it is a changing object that must be suitably apprehended. (shrink)
