The information explosion and digital modes of learning often combine to inform the quest for the best ways of transforming information in digital form for pedagogical purposes. This quest has become more urgent and pervasive with the ‘turn’ to online learning in the context of COVID-19. This can result in linear, asynchronous, transmission-based modes of teaching and learning which commodify, package and deliver knowledge for individual ‘customers’. The primary concerns in such models are often technical and economic – technology as (...) a cost-effective ‘solution’ to educational challenges. In this paper I argue for the importance of dialogic learning space in teaching and learning by means of Information and Communication Technologies, whether in the form of fully online learning, blended learning or face-to-face encounters using ICT affordances. Although the 20th Century theorists Mikhail Bakhtin (1895–1975) and Hans-Georg Gadamer (1900–2002) produced their seminal works before the advent of ICTs, they were both concerned with the quality and authenticity of human engagement with texts and with other persons and contexts. Besides a shared interest in dialogue as an ontological feature of human life and being, they both used spatiotemporal concepts for understanding and interpreting texts. The article draws on Gadamer’s notions of dialogue and horizon, and Bakhtin’s notions of dialogue and chronotope, to conceptualize dialogic possibilities for online education. Its purpose is to provide a framework, grounded in Bakhtin’s and Gadamer’s ideas, for a dialogic approach to online teaching and learning in higher education. (shrink)

Hayek's social theory presupposes that rules are unintended consequences of individual actions. This essay explicates one kind of Hayekian explanation of that claim. After noting the kinds of rules that Hayek believes are subject to such a theory, the essay distinguishes three functional explanations advocated by Hayek. He combines one of these functional explanations with an invisible hand explanation. A schema suitable for constructing invisible hand-functional evolutionary theories is employed to outline this combination.

After providing a brief overview of the economic theory of judicial decisions this paper presents an argument for why not only the economic theory of judicial decisions, but also the rational approach in general, most often fails in explaining decision-making. Work done within the research program of New Institutionalism is presented as a possible alternative. Within this research program judicial activity is conceptualized as the activity of "interpreting the rules of the game", i.e. the institutions that frame the economic (...) and political interaction in a society. Such a conceptualization of judicial interpretation and judicial decision-making would have to depart from rational choice modes of reasoning, and should instead focus on how human beings actually reason, learn and choose drawing from research in cognitive science. Gibbs’s phase rule treats mixtures by relating the number of independent variables governing their state to the numbers of phases and independent substances. For the case of a single substance, it provides a criterion of purity. But where more substances are involved, the notion of independent substance is less readily understood. Textbook writers sometimes use algebraic terminology in ways that are suggestive but cannot be taken as literally accurate. I suggest that a mereological interpretation applies to these cases, as (...) it captures more concisely the insights underlying the use of algebraic ter- minology and illuminates the general notion of substance. The subject of this study was chosen with the aim of reaching the integrity and authenticity of the narrations that reveal the interpretive meaning in the vocabulary of the Qur’an. Therefore, it is known that jurists and researchers face many problems in correcting the narrations related to the legal rulings. It is necessary to stop at correct or reliable narrations because they contribute to revealing the legal ruling. They are of higher importance if they are related to the jurisprudence of (...) the Qur’an, which necessitated choosing this research that stems from the problem due to the importance of reaching the later narrations used by the interpreters of the verses of the rulings. The study also focused on creating a new method in interpreting the verses of the rulings with the corresponding narrations, whether by chains of transmission or texts, in order to reach the reliability of the quadripartite victory. This chapter is an essay in a volume that examines constitutional law in the United States through the lens of H.L.A. Hart's "rule of recognition" model of a legal system. My chapter focuses on a feature of constitutional practice that has been rarely examined: how jurists and scholars argue about interpretive methods. Although a vast body of scholarship provides arguments for or against various interpretive methods -- such as textualism, originalism, "living constitutionalism," structure-and-relationship reasoning, representation reinforcement, minimalism, and so forth (...) -- very little scholarship shifts to the meta-level and asks: What are the considerations that jurists and scholars bring to bear in arguing that one or another interpretive method is legally favored? And can we "make sense" of this body of argument? Is there a model of legal discourse that both accurately describes how U.S. jurists and scholars actually argue about interpretive methods, and that vindicates this discourse (in the sense of seeing these actors as making valid arguments)? I find that Hart's rule-of-recognition model fails to describe or vindicate how U.S. jurists and scholars argue about interpretive methods. The problem, in a nutshell, is that Hart sees legal argument as asserting or presupposing the social fact of contemporary official acceptance of a rule of recognition. By contrast, jurists and scholars typically point to social facts other than contemporary official acceptance in arguing for the legal status of an interpretive method -- for example, the fact that the method is supported by Framers' intent, or by U.S. culture and tradition, or by precedent. Further, jurists and scholars very often argue that some interpretive method is legally favored even though the method is controversial. On Hart's model, such a claim is problematic -- because, on his model, the content of the rule of recognition is not controversial, but rather a matter of consensus among officials. The upshot may just be that Hart's model is a failure. However, another possibility is to adopt an "error theory" of U.S. constitutional discourse. It may perhaps be the case that U.S. jurists and scholars often make claims for the favorable legal status of some interpretive method that are inconsistent with the best understanding of the nature of law. Interpretations of the tax law, issued by tax authorities, are a fairly new institution in Poland. They were introduced into the legal system by the Tax Ordinance Act of 29 October 1997. From that time these regulations were deeply changed three times. Now it seems that Polish legislator has finally succeeded in elaborating an appropriate model for binding interpretation of tax law that protects the interests of taxpayers. However, discussed regulations seem to need some other amendments. The objective of (...) this article is to present the evolution of the provisions pertaining to the issuing of the so-called official interpretations of tax law and to point at certain shortcomings of the present regulations. This paper provides an ethical intepretation of the Nash choice rule. In a setting in which (cardinal) utilities are interpersonally comparable, this procedure is characterised by an impartiality requirement and by the assumption that choices are not responsive to the agents' relative ability to convert resources into utility.

There are frequent claims that the regulation of international law is uncertain, vague, ambiguous, or indeterminate, which does not support the desired stability, transparency, or predictability of international legal relations. This monograph examines the framework of interpretation in international law based on the premise of the effectiveness and determinacy of international legal regulation, which is a necessary pre-requisite for international law to be viewed as law. This study examines this problem for the first time since these questions were introduced (...) and identified as the basic premises of the international legal analysis, in the works of JL Brierly and Sir Hersch Lauterpacht. Addressing different aspects of the effectiveness of legal regulation, this monograph examines the structural limits on, and threshold of, legal regulation, and the relationship between established legal regulation and non-law. Once the limits of legal regulation are ascertained, the analysis proceeds to examine the legal framework of interpretation that serves to maintain and preserve the object and aims of existing legal regulation. The final stage of analysis is the interpretation of those treaty provisions that embody the indeterminate conditions of non-law. Given that the generalist element of international legal doctrine has been virtually silent on the problem and implications of the effectiveness and determinacy of international legal regulation, this study examines the material accumulated in doctrine and practice for the past several decades, including the relevant jurisprudence of all major international tribunals. The concept of a rule that primarily interests Wittgenstein is one that is central to our understanding of 'what is possible before all new discoveries and inventions'. Wittgenstein's investigations of the concept of a rule run 'criss‐cross in every direction'. As Wittgenstein points out, 'any interpretation still hangs in the air along with what it interprets, and cannot give it any support'. Like our inner mental picture of a cube, what we think of as an interpretation of a (...) rule doesn't by itself predetermine the steps that accord with the rule it supposedly interprets. In his great work, Philosophical Investigations, Wittgenstein aims both to uncover the sources of these difficulties and to show his readers how to overcome them. This paper advances an interpretation of what Hume called ‘the general rules’: natural principles of belief-formation that nevertheless can be augmented via reflection. According to Hume, reflection is, in part, what separates the wise from the vulgar. In this paper, I argue that for Hume being wise must therefore be, to some degree, voluntary. Hume faced a significant problem in attempting to reconcile his epistemic normativity, i.e. his claims about what we ought to believe, with his largely involuntarist (...) theory of the mind. Reflection on the General Rules, and an interpretation of that reflection as voluntary, helps explain not only Hume's theory of belief, but also how he hoped to reconcile epistemic normativity with naturalism about the mental. The Born’s rule to interpret the square of wave function as the probability to get a specific value in measurement has been accepted as a postulate in foundations of quantum mechanics. Although there have been so many attempts at deriving this rule theoretically using different approaches such as frequency operator approach, many-world theory, Bayesian probability and envariance, literature shows that arguments in each of these methods are circular. In view of absence of a convincing theoretical proof, recently some researchers have (...) carried out experiments to validate the rule up-to maximum possible accuracy using multi-order interference (Sinha et al, Science, 329, 418 [2010]). But, a convincing analytical proof of Born’s rule will make us understand the basic process responsible for exact square dependency of probability on wave function. In this paper, by generalizing the method of calculating probability in common experience into quantum mechanics, we prove the Born’s rule for statistical interpretation of wave function. (shrink)

Purpose of this article is to assess the validity of the Razian conception of the rule of law by subjecting it to the acid test of Michel Troper's 'realist theory of interpretation'. The author argues that, in light of the Wittgensteinian view of rule-following, a serious indeterminacy can be seen as inherent in both this conception of the rule of law and Troper's theory of interpretation.

『회남자』 통치철학에 대한 일반적 평가는 긍정적이다. 백성들을 위하는 통치라는 점에서 민본주의를 주장하는 유가와 부합하는 통치로 평가되기도 한다. 그러나 『회남자』의 통치를 대표하는 무위감화통치는 수동적으로 반응하기만 하는 피치자를 상정하는 듯하고, 이런 추정에 근거해서 『회남자』통치를 가부장주의라고 비판하는 해석이 제안된 바 있다. 본고에서는 『회남자』 통치가 가부장적이라는 해석의 문제점을 지적하고, 오히려 피치자의 자발성을 중시하는 통치라고 주장한다. 『회남자』의 법치는 본성에 근거한 통치라고 할 수 있다. 호오好惡는 『회남자』 본성의 중요한 특성 중 하나다. 법가에서는 자연스러운 호오가 단순히 상벌의 근거였으나, 『회남자』의 저자들은 그것을 예제의 근거로 간주했다. 게다가 지나친 예제를 (...) 거부했고, 예제의 근거를 본성에 새겨 넣으려는 시도에도 반대했다. 따라서 『회남자』의 통치는 가부장적인 일방적 통치이기는커녕, 유가통치보다도 더욱 자발성을 허용하는 통치라고 평가할 수 있다. The study of South Asian ethics presents a variety of problems for the comparative ethicist. This response focuses on one such problem relating to Hinduism: the pervasive use of nonsystematic lists as a source of ethical injunctions and guidelines. The author demonstrates how an indigenous hermeneutic may unpack a list that contains the gift of fearlessness among other gifts. The source of this interpretation is Pūrva Mīmāṃsā, an ancient Indian school of philosophy that specialized in language and the application (...) of sacrificial logic to law and ethics. The same principles that allowed ritual specialists to sort out a huge array of rules into proper injunctions also allow us to make sense of ethical principles embodied in puzzling lists of concrete items. Clearly and engagingly written, this volume is vital reading for students of philosophy and sociology, and anyone interested in Wittgenstein's later thought. David Bloor provides a challenging and informative evaluation of Wittgenstein's account of rules and rule-following. Arguing for a collectivist reading, Bloor offers the first consistent sociological interpretation of Wittgenstein's work for many years.

Properly understood, the instrumental rule says to take means that actually suffice for my end, not, as is nearly universally assumed, to intend means that I believe are necessary for my end. This alternative explains everything the standard interpretation can—and more, including grounding certain correctness conditions for exercises of our will unexplained by the standard interpretation.

This is a short, and therefore necessarily very incomplete discussion of one of the great questions of modern philosophy. I return to a station at which an interpretative train of thought of mine came to a halt in a paper written almost 20 years ago, about Wittgenstein and Chomsky,[1] hoping to advance a little bit further down the track. The rule-following passages in the Investigations and Remarks on the Foundations of Mathematics in fact raise a number of distinct issues about (...) rules, meaning, objectivity, and reasons, whose conflation is encouraged by the standard caption, "the Rule-following Considerations".[2] So, let me begin by explaining my focus here. The purpose of this article is to analyze the powers of tax appeal authorities and their interpretation of the Tax Ordinance Act governing tax hearings. The tax hearing is part of the tax appeal proceeding and takes place within an additional procedure to supplement the evidence and materials on the case. This means that article 229 of Tax Ordinance Act is the limit of the hearing conducted by the tax body. Tax trial/hearing should be treated as a form of (...) activity in gathering evidence, which operates next to the cabinet proceedings. In the literature, the current forms were considered to be equivalent. The decision to perform additional procedures to supplement the evidence and materials should always be on that tax appeal authority. The phrase “can perform” should be interpreted by the authority as an obligation to conduct, at least as an order to make a positive or negative assessment of the need for additional evidence. In the Author’s opinion, there are no objections to carry out certain types of evidence. The appeal tax authority is recognizing the case de novo and is evaluating the facts in a way it is required to assess the completeness of the collected evidence, and the same to determine whether all of the facts have been proven. The limits of the powers of the tax appeal authority to conduct current investigation determines the content of articles 229 and 233 § 2 of Tax Ordinance Act. The competence of the appeal body, which is not subject to challenge, is to complement the evidence to draw additional conclusions, but not to change the basic findings. It may hear witnesses, appoint experts and confront their opinions, carry out documentary evidence, as necessary to carry out a visual inspection, provided that these activities are within the limits of additional evidence and conduct supplementary materials in the case. All of this evidence can be carried out during the tax hearing ordered by the tax appeal authority. (shrink)

My object is to question a recurrent claim made to the point that Thomas Reid (1710–1796) was hostile to ether theories and that this hostility had its source in his distinctive interpretation of the first of Newton's regulæ philosophandi. Against this view I will argue that Reid did not have any quarrel at all with unobservable or theoretical entities as such, and that his objections against actual theories concerning ether were scientific rather than philosophical, even when based on Newton's (...) first rule. I argue further that Reid's insistence on Newton's rule concerns, not direct observation, but rather the notion of explanation itself. (shrink)

The aim of this paper is to propose a novel reading of the critical legitimacy of the regulative use of reason in the Transcendental Dialectic of Kant's Critique of Pure Reason. After introducing some key terminology of the Dialectic, I analyse the shortcomings of two influential accounts of the regulative use of reason and identify their common problem in their commitment to the descriptivity of the ideas of reason. I then offer my rule‐based account of the regulative use of reason (...) by clarifying how Kant transforms reason's metaphysical inclinations into prescriptive rules of bottom‐up empirical research. Finally, I explain why such interpretation of reason is metaphysically innocent and thereby a promising approach to understand its role in Kant's scientific project. (shrink)

The developing academic field of machine ethics seeks to make artificial agents safer as they become more pervasive throughout society. In contrast to computer ethics, machine ethics is concerned with the behavior of machines toward human users and other machines. This study aims to use an action-based ethical theory founded on the combinational aspects of deontological and teleological theories of ethics in the construction of an artificial moral agent (AMA).,The decision results derived by the AMA are acquired via fuzzy logic (...) interpretation of the relative values of the steady-state simulations of the corresponding rule-based fuzzy cognitive map (RBFCM).,Through the use of RBFCMs, the following paper illustrates the possibility of incorporating ethical components into machines, where latent semantic analysis (LSA) and RBFCMs can be used to model dynamic and complex situations, and to provide abilities in acquiring causal knowledge.,This approach is especially appropriate for data-poor and uncertain situations common in ethics. Nonetheless, to ensure that a machine with an ethical component can function autonomously in the world, research in artificial intelligence will need to further investigate the representation and determination of ethical principles, the incorporation of these ethical principles into a system’s decision procedure, ethical decision-making with incomplete and uncertain knowledge, the explanation for decisions made using ethical principles and the evaluation of systems that act based upon ethical principles.,To date, the conducted research has contributed to a theoretical foundation for machine ethics through exploration of the rationale and the feasibility of adding an ethical dimension to machines. Further, the constructed AMA illustrates the possibility of utilizing an action-based ethical theory that provides guidance in ethical decision-making according to the precepts of its respective duties. The use of LSA illustrates their powerful capabilities in understanding text and their potential application as information retrieval systems in AMAs. The use of cognitive maps provides an approach and a decision procedure for resolving conflicts between different duties.,This paper suggests that cognitive maps could be used in AMAs as tools for meta-analysis, where comparisons regarding multiple ethical principles and duties can be examined and considered. With cognitive mapping, complex and abstract variables that cannot easily be measured but are important to decision-making can be modeled. This approach is especially appropriate for data-poor and uncertain situations common in ethics. (shrink)

Rule-following has become a focus of philosophical interest since Kripke’s interpretation of Wittgenstein’s Philosophical Investigations. The case which Kripke makes is an argument against reducing the description of the beliefs of a person to a description in naturalistic terms. However, it has also implications for the metaphysics of mind. I claim that, contrary to what one might except, Kripke’s case contains an argument in favour of materialism in ontology.

The project of this chapter is to explore some relations between the rule-following considerations and radical interpretation. I spell out the sense in which the rule-following considerations are about meaning determination, and investigate whether the principle of meaning determination used in the early Davidson's account of meaning determination - the principle of charity - provides an answer to what I shall call "Wittgenstein's paradox". More precisely, I am interested in one aspect of the paradox: the "problem of objectivity". My (...) question then is whether meaning, as determined by charity, is such that the correctness of the applications of meaningful expressions is an objective matter. After running us through the basics of the radical interpretation account of meaning determination I argue that the principle of charity does seem to fall prey to the problem of objectivity. After unsuccessfully trying to rescue objectivity by means of Lewisian natural properties, this is the verdict I in the end endorse. (shrink)

In this paper, I develop an ecological-enactive perspective on the role rules play in linguistic behaviour. I formulate and motivate the hypothesis that metalinguistic reflexivity – our ability to talk about talking – is constitutive of linguistic normativity. On first sight, this hypothesis might seem to fall prey to a regress objection. By discussing the work of Searle, I show that this regress objection originates in the idea that learning language involves learning to follow rules from the very (...) start. I propose an ecological-enactive response to the regress objection. The key move is to deny that language learning consists initially in learning rules. A child first engages in regular communicative behaviour, by learning first-order linguistic skills, and then retroactively interprets her own behaviour in normative metalinguistic terms, i.e., as being guided by rules by relying on reflexive or second-order linguistic skills. On this view, metalinguistic reflexivity enables regulation of already regular communicative behaviour, and thereby constitutes linguistic normativity. Finally, I argue that linguistic rules are resources: they are available to participants in order to (re)negotiate properties of situated language behaviour and thereby reorganize linguistic practices. The account developed in this paper thus allows us to understand the constitutive role of metalinguistic reflexivity for linguistic normativity without falling prey to the regress objection. Recent scholarship on John Stuart Mill’s moral theory has settled on the view that he is committed to a form of rule utilitarianism. I argue that this consensus is mistaken. Mill’s explicit account of practical rules is incompatible with rule utilitarianism but consistent with sophisticated act utilitarianism. I also examine the direct, textual evidence cited by rule utilitarian interpreters, arguing that it is consistent with the act utilitarian account of practical rules. Finally, I argue that two systematic considerations (...) cited by rule utilitarian interpreters—Mill’s analysis of “wrong” in terms of the appropriateness of punishment, and his account of supererogation—also do not require a rule utilitarian reading. Mainstream game theory explains cooperation as the outcome of the interaction of agents who permanently pursue their individual goals. Amartya Sen argues instead that cooperation can only be understood by positing a type of rule-following behaviour that can be out of phase with the pursuit of individual goals, due to the existence of a collective identity. However, Sen does not clarify the ontological preconditions for the type of social behaviour he describes. I will argue that Sen's account of collective identity (...) can be best interpreted in the light of John Searle's notion of collective intentionality, while Sen's explanation of rule-following behavior and agency is best understood using the critical realist transformational model of social activity. Automated Vehicles (AVs) are designed and programmed to follow traffic rules. However, there is no separate and comprehensive regulatory framework dedicated to AVs. The current Queensland traffic rules were designed for humans. These rules often contain open texture expressions, exceptions, and potential conflicts (conflict arises when exceptions cannot be handled in rules), which makes it hard for AVs to follow. This paper presents an automatic compliance checking framework to assess AVs behaviour against current traffic rules (...) by addressing these issues. Specifically, it proposes a framework to determine which traffic rules and open texture expressions need some additional interpretation. Essentially this enables AVs to have a suitable and executable formalization of the traffic rules. Defeasible Deontic Logic (DDL) is used to formalize traffic rules and reasoning with AV information (behaviour and environment). The representation of rules in DDL helps effectively in handling and resolving exceptions, potential conflicts, and open textures in rules. 40 experiments were conducted on eight realistic traffic scenarios to evaluate the framework. The evaluation was undertaken both quantitatively and qualitatively. The evaluation result shows that the proposed framework is a promising system for checking Automated Vehicle interpretation and compliance with current traffic rules. (shrink)

The golden rule says: ‘Treat others as you want to be treated’. This article organizes contemporary interpretations of the rule into three groups: the ‘material’ golden rule, the ‘relativistic’ golden rule, and the ‘formal’ golden rule. The article also argues that (a) the relativistic golden rule is the weakest, (b) the formal golden rule is virtually irrefutable, (c) the material golden rule is less evident than the formal one, but not necessarily false and (d) the formal golden rule and the (...) material golden rule are not incompatible—they can complement each other. BackgroundThe German guidelines for liver transplantation stipulate that every patient with alcohol-related liver disease needs to prove evidence of a 6-month abstinence period before they can be admitted to the waiting list for liver transplantation. This internationally widespread abstinence rule has been criticised as it prevents patients at least temporarily from receiving an effective and potentially life-saving therapy. This poses the question of how this abstinence rule is depicted and justified by transplantation professionals.ArgumentsIn case of the 6‑month abstinence rule, guidelines (...) are used as a tool for rationing health care. Four frames of interpretation can be reconstructed from the ethical and medical literature. Each linguistically mediated frame offers a different representation of the 6‑month abstinence rule. According to these different framings, the 6‑month waiting period is depicted (1) as a diagnostic tool to determine the regenerative capacity of the liver, (2) as a prognostic tool to determine the prospects of success of a transplantation, and (3) to determine the drinking behaviour after transplantation. In a further context, the abstinence rule (4) is interpreted as an expression of an obligation to avoid behaviour harmful to health.ConclusionThese four frames provide linguistically mediated patterns of interpretation that are used by different actors to limit the indication for liver transplantation. They give rise to different ethical questions that allow a systematic ethical assessment of the 6‑month abstinence rule. (shrink)

Thomas E. Hill, Jr., interprets and extends Kant's moral theory in a series of essays that highlight its relevance to contemporary ethics. He introduces the major themes of Kantian ethics and explores its practical application to questions about revolution, prison reform, and forcible interventions in other countries for humanitarian purposes.

The existence of probability in the sense of the frequency interpretation, i.e., probability as “long term relative frequency,” is shown to follow from the dynamics and the interpretational rules of Everett quantum mechanics in the Heisenberg picture. This proof is free of the difficulties encountered in applying to the Everett interpretation previous results regarding relative frequency and probability in quantum mechanics. The ontology of the Everett interpretation in the Heisenberg picture is also discussed.

This paper discusses the interrelationship between wisdom, science and craft from the perspective of the Wittgenstein concept of tacit knowledge. It challenges the notion of the ‘rules-model’ as put forward by Logical Positivists, and shows the limitation of this model for describing the tacit dimension of knowledge. The paper demonstrates the crucial role of practice in ‘rule-following’ in the real world. It is held that ‘to follow a rule’ is to practice a custom, a usage or an institutional practice. (...) Hence, rules can only exist as a link in social life.The dream of the ‘precise’ language can only be realised in a closed scientific world. It is inadequate for reflecting the user's relationship to language and its content and practice in varied ‘use situations’. It is only through examples that we learn to deal with, describe, interpret and learn from the new situations.The rule-based models which are used to acquire and describe human knowledge in syntactic and propositional forms are, in effect, an impoverishment of the description of reality. It is argued that expert knowledge and linguistic knowledge are linked together and emerge as two sides of the same subject as the pragmatic perspective of reality. The tacit dimension of expert knowledge is, in many cases, more significant than the linguistic knowledge, especially in the case of the vocational and aesthetic world.The challenge to AI researchers, therefore, is to recognise that knowledge based systems which ignore the tacit dimension of expert knowledge not only distance the user from reality but also impoverish the learning process itself.
