In recent years, the advancements made in the field of neuroscience have been echoed in criminal law, reigniting the discussion on culpability from the viewpoint of if it actually exists, considering the echoes of determinism on the re-found non-existence of free will. This discussion has triggered, once again, the issue of the boundaries and inter-relations between law and science, namely on whether normative or legal concepts and categories should acknowledge scientific breakthroughs. Bringing forth the theme of the limits of the (...) law, this discussion is able to provide insight, with reference to a specific problem, as to whether there are plausible legal answers in the context of the ascription of liability if the subject of law ceases to be a responsible—and thus free—person. Taking into consideration evolution both of science and criminal law dogmatic, we aim to argue that in the particular case of culpability, the desired autonomy of law has its limitations, and that without such limitations the ascription of liability would not have a correct answer. For this argument we will firstly approach the meaning of culpability as a milestone of subjective responsibility in criminal law, so that we can then analyse some arguments made regarding the impact of neuroscience on the maintenance of a concept of culpability with the meaning given above, so that lastly we can proceed to the rebuttal of the overarching impact of science on the law and advocate the autonomy of culpability within the necessary limits imposed by the needs of a plausible legal answer. This introductory chapter integrates two different steps: a global consideration of the problems which the “signifier” limits is able to include and a detailed mapping of the reflective path which the following thirteen chapters effectively pursue.

The rising demographic of older adults worldwide has led to an increase in dementia cases. In order to ensure the proper allocation of care and resources to this clinical group, it is necessary to correctly distinguish between simulated versus bona-fide cognitive deficits typical of dementia. Performance Validity Tests are specifically designed to assess a lack of effort and the possible simulation of cognitive impairment. Previous research demonstrates that PVTs may be sensitive to dementia, thus inaccurately classifying real memory impairment as (...) simulation. Here, we analyzed the sensitivity of PVTs in discriminating between dementia and simulation using receiver operating characteristic curve analyses. Further, we examined the potential need for adjusting cut-off scores for three stand-alone and one embedded PVT for Portuguese older adults with dementia. The results showed that all measures, except for the Coin in Hand— Extended version, were sensitive to one or more sociodemographic and/or cognitive variables, and it was necessary to adjust cut-off points for all measures. Additionally, the Rey-15 Item Memory Test did not demonstrate sufficient discriminating capacity for dementia. These results present important implications for clinical practice and the daily life of patients, as the use of incorrect cut-off points could impede patients from getting the resources they need. Some are foundation narratives (Sâo Mamede, Ourique); others are historical facts that were sung so often over the years by Portuguese and foreign poets that they came to signify basic schemes of the human imagination (Inês de Castro's pure love, whose realization was frustrated by a fight between two men, father and son); other so-called Portuguese myths, on the contrary, are (...) built around concepts that give metaphysical shape to supposed characteristics that define the national soul (saudosismo, the doctrine of nostalgia, which attempts to define the Portuguese national soul as the search for a mythical initial unity that would create a wholeness in which contraries would be abolished; the Fifth Empire as its realization on Earth); other Portuguese myths express the supposed divine predestination of the people and of the Portuguese Man, based upon divine intervention in the founding of the nation in Ourique (the Fifth Empire that would be the Age of Spirit announced by Joachim de Fiore); still others are based on historically negative facts (King Sebastian and the defeat at Alcazarquibir) but transformed through archetypal elements to show the capacity for renewal out of the defeat, a renewal that goes beyond real historical renewal to include spiritual renewal of the Portuguese Man and his fatherland, which should produce the Fifth Empire conceived either in earthly or spiritual terms. To these myths I will add a legend preceding the formation of the nation, King Roderick's Legend, because it attempts to justify the loss of Visigothic Spain to the Arabs. (shrink)

This study examines the impact of a social desirability response bias as a personality characteristic (self-deception and impression management) and as an item characteristic (perceived desirability of the behavior) on self-reported ethical conduct. Findings from a sample of college students revealed that self-reported ethical conduct is associated with both personality and item characteristics, with perceived desirability of behavior having the greatest influence on self-reported conduct. Implications for research in business ethics are drawn, and suggestions are offered for reducing the effects (...) of a socially desirable response bias. (shrink)

Advances in artificial intelligence (AI) raise important questions about whether people view moral evaluations by AI systems similarly to human-generated moral evaluations. We conducted a modified Moral Turing Test (m-MTT), inspired by Allen et al. (Exp Theor Artif Intell 352:24–28, 2004) proposal, by asking people to distinguish real human moral evaluations from those made by a popular advanced AI language model: GPT-4. A representative sample of 299 U.S. adults first rated the quality of moral evaluations when blinded to their source. (...) Remarkably, they rated the AI’s moral reasoning as superior in quality to humans’ along almost all dimensions, including virtuousness, intelligence, and trustworthiness, consistent with passing what Allen and colleagues call the comparative MTT. Next, when tasked with identifying the source of each evaluation (human or computer), people performed significantly above chance levels. Although the AI did not pass this test, this was not because of its inferior moral reasoning but, potentially, its perceived superiority, among other possible explanations. The emergence of language models capable of producing moral responses perceived as superior in quality to humans’ raises concerns that people may uncritically accept potentially harmful moral guidance from AI. This possibility highlights the need for safeguards around generative language models in matters of morality. (shrink)

La arquitectura digital ha alterado de manera decisiva la sociedad y, en consecuencia, demanda respuestas legales. De la Internet desarrollada en la década de 1970 con fines militares, casi nada permanece igual. La plataforma ha otorgado un poder sin igual a las empresas de tecnología, cambiando la forma en que nos comunicamos, abordamos la política, negociamos y también cómo nos relacionamos. En la economía digital actual, la atención de los usuarios es el principal producto, y estos usuarios también son productores (...) de contenido. En este modelo, se facilita la propagación de información falsa, lo que pone en riesgo la democracia y la ciencia. Para abordar estos fenómenos, es fundamental desarrollar y aplicar mecanismos adecuados de regulación de las plataformas para proteger a la sociedad y la libertad. A standing presumption in the literature is that devil’s advocacy is an inherently beneficial argumentative move; and that those who take on this role in conversation are paradigms of argumentative virtue. Outside academic circles, however, devil’s advocacy has acquired something of a notorious reputation: real-world conversations are rife with self-proclaimed devil’s advocates who are anything but virtuous. Motivated by this observation, in this paper we offer the first in-depth exploration of non-ideal devil’s advocacy. We draw on recent analyses of two (...) better known discursive practices—mansplaining and trolling—to illuminate some of the signature traits of vicious devil’s advocacy. Building on this comparative examination, we show that all three practices trade on a manipulation of illocutionary force; and we evaluate their respective options for securing plausible deniability. This paper argues that Zika virus infection has its ethical implications beyond the reproductive health of women. It claims that Zika virus infection like public health emergency exposes the underlying health determinants and health status of women. Therefore, ethical mitigation of Zika like public health emergencies should consider these underlying health determinants and health status of women. For, undermining and overlooking these underlying determinants and health status of women, during the public health emergencies, enhance the health inequities. The recent Zika (...) virus infection in Brazil has triggered different ethics consultation and has prompted to outline ethical recommendations. However, the recommendations have either focused on the reproductive health of women or on the core strategies of public health emergency. Considering this as a gap in perspective to prepare for Zika like public health emergencies, this paper argues that it is the underlying holistic health of women, precisely, health capability, which should be given due ethical consideration. Finally, the paper concludes highlighting the fact that focusing on the holistic health of the women during Zika like public health emergencies and beyond can bring in long-term benefits for global health equity. The accuracy of proxies when they interpret advance directives or apply substituted decision-making criteria has been called into question. It therefore became important to know if the Andalusian Advance Directive Form (AADF) can help to increase the accuracy of proxies' predictions. The aim of this research was to compare the effect of the AADF on the accuracy of proxies' predictions about patients' preferences with that gained from informative and deliberative sessions about end-of-life decision making. A total of 171 pairs of (...) patients and their proxies were randomized to three groups. The control group's answers to the Life Sustaining Preferences Questionnaire (LSPQ) were compared with their proxies' answers to the same questionnaire. In one intervention group, the patients had already completed the AADF and given it to their proxies, who used it to guide their own answers to the LSPQ. In the second intervention (discussion) group, both patients and proxies attended two educative sessions guided by trained nurses and later filled in the LSPQ. Comparisons of accuracy and other variables showed a strong association with the discussion group. The findings show that promoting communication between patients and their proxies improves the accuracy of proxies' predictions much more than isolated use of the AADF form. (shrink)

A Dirac-like equation for a massive field obeying the classical Proca equations of motion (PMO) is proposed in close analogy with Majorana’s construct for Maxwell electrodynamics. Its underlying algebraic structure is examined and a plausible physical interpretation is discussed. The behavior of the PMO equations in the presence of an external electromagnetic field is also investigated in the low energy limit, via unitary transformations similar to the Foldy-Wouthuysen canonical transformation for a Dirac fermion.

Estudo introdutório de apresentação, seguido de tradução, da palestra “Fenomenologia e antropologia”, ministradas por Edmund Husserl nas sedes da Kantgesellschaft de Frankfurt, Berlim e Halle em 1931, na qual avalia criticamente, a partir dos pressupostos transcendentais da fenomenologia, a tendência da filosofia alemã dos anos 20 do século passado para uma antropologia filosófica.

A partir de sua obra fundamental, tecemos considerações em torno à sua perspectiva fenomenológico-existencial. O intuito é destacar seu engajamento filosófico existencial, a pertinência de suas críticas ao totalitarismo e sua preocupação com o avanço de uma tecnocracia que ameaça a existência humana. Argumenta-se que a postura filosófica do filósofo de Praga torna-se paradigmática para a conjuntura atual e para a práxis filosófica autêntica.

How should one describe the irreducible relationships in photopoetry observed in intermedial literary photobooks? According to most authors, in literary photobooks, the verbal sign system is linked to the photographic image as a bidirectional interaction, creating a coupled system that can be seen as a new sign system. Mutually modulatory influences link verbal text and photography. But the nature of such influences needs to be explained in detail and with accuracy. What kind of relation are we dealing with? Many authors (...) have tried to explain this phenomenon through several epistemic metaphors. The problem is that these metaphors are rarely subjected to any general theory of meaning. Surprisingly, this is not even mentioned as a problem. In this article, we propose a general semiotic model to describe the irreducible photography-poetry relation, derived from C. S. Peirce’s pragmatic theory of signs, and we also present some preliminary results of the analysis of Quarenta Clics em Curitiba, a photobook by Paulo Leminski and Jack Pires. Our purpose here is to introduce and explore this model to describe the photography-poetry relationship in coupled systems. This relationship is decomposed, in the functional roles occupied by poems and photographs, into a sign-object-interpretant relation. The triadic irreducibility that characterizes semiosis (à la Peirce) is the main property applied to photograph-poetry coupling in Quarenta Clics em Curitiba. (shrink)

En este artículo se compara, la posición que tiene el historiador de la filosofía colombiana Carlos Arturo López Jiménez sobre la idea que tenía Cayetano Betancur acerca de la posibilidad de que existiera una Filosofía en Colombia, con lo que el autor mismo decía sobre este aspecto. De este modo, primero, se mostrará la perspectiva de López Jiménez y el uso que hace de las ideas de Cayetano Betancur. Enseguida se describe el recorrido intelectual de Cayetano Betancur con respecto al (...) problema de si existiría o no una Filosofía en Colombia. Así se expondrá cómo, en un momento determinado, Betancur hace un viraje en su pensamiento y pasa de negar una Filosofía en Colombia a asumir su existencia y su posibilidad, asi como también reconoce la necesidad de identificar y leer las fuentes filosóficas locales. O artigo tem por objetivo investigar a particular relação que se estabelece entre a temática do início da filosofia – que é de extrema importância para toda a “escola fenomenológica de Freiburg” – e a concepção da essência da filosofia tal como desenvolvida especificamente no pensamento de Martin Heidegger e Eugen Fink. A partir da reinterpretação e radicalização operadas em relação à abordagem estabelecida pela fenomenologia husserliana, mostraremos como a figura de Husserl se impõe tanto como pano de fundo quanto (...) como alvo polêmico das reflexões de Heidegger e Fink. Assim, se o primeiro desenvolve uma concepção da filosofia como práxis radical de um “outro” pensamento, que procede por tentativas e experimentações, o segundo transforma a fenomenologia husserliana no sentido de uma filosofia da liberdade. BackgroundThe issue of stigma is very important in the battle against HIV/aids in Africa since it may affect patient attendance at healthcare centres for obtaining antiretroviral medications and regular medical check-ups. Stigmatization creates an unnecessary culture of secrecy and silence based on ignorance and fear of victimization. This study was designed to determine if there is external stigmatization of people living with HIV and AIDS by health care workers at a tertiary hospital in KwaZulu-Natal province, South Africa. The study investigated (...) the impact of knowledge of HIV/aids by HCWs on treatment of patients, as well as the comfort level and attitude of HCWs when rendering care to PLWHA.MethodsA descriptive cross sectional study was designed to collect data using an anonymous self-administered structured questionnaire from 334 HCWs. The study was conducted in clinical departments of a large multidisciplinary 922-bed tertiary care teaching hospital in Durban, KZN.ResultsOverall HCWs had an above average knowledge about HIV/aids although some gaps in knowledge were identified. Tests of statistical significance showed that there was association between level of education and knowledge of HIV/aids ; occupation and knowledge of HIV/aids ; and gender and knowledge of HIV/aids. Test for comfort level was only significant for gender, with males showing more comfort and empathy when dealing with PLWHA. The study also revealed that patients were sometimes tested for HIV without informed consent before surgery, due to fear of being infected, and there was some gossiping about patients' HIV status by HCWs, thereby compromising patient confidentiality. The majority of HCWs showed a willingness to report incidents of stigmatization and discrimination to higher authorities, for better monitoring and control.ConclusionsAlthough knowledge, attitude and comfort level of HCWs taking care of PLWHA was above average, enforcement of existing antidiscrimination laws and continuing education in medical ethics and healthcare law, would greatly improve the performance of HCWs taking care of PLWHAs. More psychological support and counselling should be provided to HCWs, to further reduce the impact of stigmatization and discrimination against PLWHA. (shrink)

We apply the Galilean covariant formulation of quantum dynamics to derive the phase-space representation of the Pauli–Schrödinger equation for the density matrix of spin-1/2 particles in the presence of an electromagnetic field. The Liouville operator for the particle with spin follows from using the Wigner–Moyal transformation and a suitable Clifford algebra constructed on the phase space of a (4 + 1)-dimensional space–time with Galilean geometry. Connections with the algebraic formalism of thermofield dynamics are also investigated.

It seems self-evident that people prefer painful experiences to be in the past and pleasurable experiences to lie in the future. Indeed, it has been claimed that, for hedonic goods, this preference is absolute (Sullivan, 2018). Yet very little is known about the extent to which people demonstrate explicit preferences regarding the temporal location of hedonic experiences, about the developmental trajectory of such preferences, and about whether such preferences are impervious to differences in the quantity of envisaged past and future (...) pain or pleasure. We find consistent evidence that, all else being equal, adults and children aged 7 and over prefer pleasure to lie in the future and pain in the past and believe that other people will too. They also predict that other people will be happier when pleasure is in the future rather than the past but sadder when pain is the future rather than the past. Younger children have the same temporal preferences as adults for their own painful experiences, but prefer their pleasure to lie in the past, and do not predict that others’ levels of happiness or sadness vary dependent on whether experiences lie in the past or the future. However, from the age of 7, temporal preferences were typically abandoned at the earliest opportunity when the quantity of past pain or pleasure was greater than the quantity located in the future. Past-future preferences for hedonic goods emerge early developmentally but are surprisingly flexible. (shrink)

This study explores the experiences of nurses that provide ‘complex’, generalist healthcare in hospital settings. Complex care is described as care for patients experiencing acute issues additional to multimorbidity, ageing or psychosocial complexity. Nurses are the largest professional group of frontline healthcare workers and patients experiencing chronic conditions are overrepresented in acute care settings. Research exploring nurses’ experiences of hospital‐based complex care is limited, however. This study aims to add to what is known currently. Four ‘complex care’ nurses undertook in‐depth (...) semistructured interviews and their narratives were analysed using the conceptual framework of complex adaptive phenomenology. Two overarching themes constituting the ‘essence’ of complex care nursing were identified: Contextual factors and attribute/value‐based elements. Creating meaningful patient outcomes and feeling part of a team were experienced as fulfilling, whereas time constraints, institutional settings and systemic barriers to comprehensive caregiving diminished the experience of providing complex care. Overall, work meaning presented as a dynamic phenomenon, shaped by personal and professional values, local settings and systemic factors. It is recommended that more expansive research be undertaken to explore the experience of complex care for nurses. Such knowledge can contribute to initiatives that draw a skilled, effective and engaged hospital‐based complex care nursing workforce. (shrink)

Humans’ attitudes towards an event often vary depending on whether the event has already happened or has yet to take place. The dread felt at the thought of a forthcoming examination turns into relief once it is over. People also value past events less than future ones – offering less pay for work already carried out than for the same work to be carried out in the future, as recent research in psychology shows. This volume brings together philosophers and psychologists (...) with a shared interest in such psychological past/future asymmetries. It asks questions such as: What different kinds of psychological past/future asymmetries are there, and how are they related? Under what conditions do humans exhibit them? To what extent do they reflect features of time itself, or particular beliefs people have about time? O ensaio busca apresentar a possibilidade de uma história subterrânea da modernidade na qual os textos das preceptivas artísticas apresentam mudanças que viriam a ser características do pensamento moderno.

Este artigo busca analisar o modo pelo qual a concepção de angolanidade interage com o mais recente processo de angolanização da economia angolana. É realizada uma breve abordagem histórica acerca das políticas culturais e também uma contextualização relativamente à economia política de Angola, abarcando dos anos da luta pela independência angolana até os dias atuais. O trabalho dedica especial ênfase aos anos do pós-guerra civil, quando o tema das políticas culturais, bem como o processo de angolanização, ganham maior ênfase na (...) agenda governamental e, por sua vez, encontram potencialidades e vulnerabilidades ao se relacionar com a histórica construção da angolanidade enquanto identidade nacional. O trabalho explora o modo pelo qual as concepções de angolanidade e angolanização ultrapassam os espectros das políticas públicas que visam, respectivamente, ao setor cultural e ao setor econômico, de modo que transcendem tais fronteiras e integram um complexo governativo que expõe as urgências e a dinamicidade da construção da nação angolana em um contexto pluriétnico. Esse ensaio busca apresentar as dualidades presentes nos primeiros movimentos da edição de Fausto como elementos constituintes da formação do todo da obra. É a própria caracterização dual que garante à obra o estatuto de tragédia. Buscando estabelecer relações com as polaridades abordadas por Goethe essa leitura dual se faz de acordo com alguns postulados teóricos do próprio autor e é uma ferramenta que auxilia a compreensão dessa obra.

RESUMO O ensaio busca apresentar como as caracterizações da alegoria, em Winckelmann, ultrapassam a mera tentativa de se compreender um modo de figurar, nos moldes de uma iconologia, configurando uma espécie de metodologia geral para a compreensão da História da arte dos antigos e para a própria apreensão do ideal das artes. Tal possibilidade é dada num ambiente de debates artísticos que antecede a distinção canônico-romântica entre símbolo e alegoria. ABSTRACT This essay aims to show how the central characteristics that (...) Winckelmann gave to the allegory surpass the very range of the modes of figuration and became an original method to understand arts in History and in its ideal. This way of thinking took place in an age that the distinction between allegory and symbol was not canonic and it is very distant from the core of this opposition that became clear in romantic thought. Methodological tools for doing philosophy that take into account the historical context of the phenomenon under consideration are arguably better suited for examining questions of race and gender than acontextual or ahistorical methodological tools. Accordingly, Rebecca Tuvel’s “defense” of so-called transracialism arguably veers off track to the extent that it relies on acontextual and ahistorical tools. While Tuvel argues, largely relying on such tools, that so-called transracialism is both metaphysically possible and ethically permissible, from a perspective that factors in context (...) and history, so-called transracialism is arguably neither. Nonetheless, Tuvel’s ethical call to the effect that an individual right to racial self-definition should be acknowledged has its appeal. However, the lesson to be learned from the Tuvel affair arguably has less to do with the metaphysical or ethical status of so-called transracialism than with changes that arguably need to be made in the way mainstream/analytic professional philosophy goes about its business, particularly with regard to non-ideal topics like race and gender.
