Recently two distinct forms of rule-utilitarianism have been introduced that differ on how to measure the consequences of rules. Brad Hooker advocates fixed-rate rule-utilitarianism, while Michael Ridge advocates variable-rate rule-utilitarianism. I argue that both of these are inferior to a new proposal, optimum-rate rule-utilitarianism. According to optimum-rate rule-utilitarianism, an ideal code is the code whose optimum acceptance level is no lower than that of any alternative code. I then argue that all three forms of rule-utilitarianism fall prey to two fatal (...) problems that leave us without any viable form of rule-utilitarianism. (shrink)

Two Greek myths attest to the power of music to blur distinctions between humans and nonhumans: Orpheus made music that inspired human-like attention in animals, trees, and stones, while the Sirens reduced passing sailors to the level of animals incapable of resisting their song. Recast in terms employed by Lacan, these myths portray music as calling forth a response in creatures thought merely able to react and, contrariwise, stripping away the capacity for response in humans, leaving nothing but reaction in (...) its place. Critiquing Lacan’s dogmatic distinction between human and animal behavior, Derrida questioned the “purity and indivisibility” of reaction and response and recommended that critics explore the involvement of both in “the whole differentiated field of experience and of a world of life-forms.” In this essay, I take up Derrida’s challenge with regard to music as it has been understood in the European aesthetic tradition. While music has long been considered capable of provoking highly refined cognitive and emotional responses, it also acts upon the body in a wide variety of ways, many of them involuntary – a fact that has struck music’s advocates as alternately promising and disturbing. Revisiting eighteenth- and nineteenth-century commentaries by the philosophers and critics Johann Georg Sulzer, Johann Gottfried Herder, and Eduard Hanslick, I first illuminate persistent anxieties over the admixture of reaction and response in musical listening. I then turn to recent ethological studies in order to argue against any decisive separation of the human from the nonhuman in the arena of musical aesthetics. (shrink)

Within the cognitive sciences, most researchers assume that it is the job of linguists to investigate how language is represented, and that they do so largely by building theories based on explicit judgments about patterns of acceptability – whereas it is the task of psychologists to determine how language is processed, and that in doing so, they do not typically question the linguists' representational assumptions. We challenge this division of labor by arguing that structural priming provides an implicit method of (...) investigating linguistic representations that should end the current reliance on acceptability judgments. Moreover, structural priming has now reached sufficient methodological maturity to provide substantial evidence about such representations. We argue that evidence from speakers' tendency to repeat their own and others' structural choices supports a linguistic architecture involving a single shallow level of syntax connected to a semantic level containing information about quantification, thematic relations, and information structure, as well as to a phonological level. Many of the linguistic distinctions often used to support complex (or multilevel) syntactic structure are instead captured by semantics; however, the syntactic level includes some specification of “missing” elements that are not realized at the phonological level. We also show that structural priming provides evidence about the consistency of representations across languages and about language development. In sum, we propose that structural priming provides a new basis for understanding the nature of language. (shrink)

When women won the vote in the United States in 1920 they were still routinely barred from serving as jurors, but some began vigorous campaigns for a place in the jury box. This book tells the story of how women mobilized in fifteen states to change jury laws so that women could gain this additional right of citizenship. Some campaigns quickly succeeded; others took substantially longer. The book reveals that when women strategically adapted their tactics to the broader political environment, (...) they were able to speed up the pace of jury reform, while less strategic movements took longer. A comparison of the more strategic women's jury movements with those that were less strategic shows that the former built coalitions with other women's groups, took advantage of political opportunities, had past experience in seeking legal reforms and confronted tensions and even conflict within their ranks in ways that bolstered their action. Amanda Hollis-Brusky shows how the Federalist Society serves as the hub of a complex circulatory system and how the ideas it generates have become the lifeblood of the conservative movement.

The revised Common Rule includes a new option for the conduct of secondary research with identifiable data and biospecimens: regulatory broad consent. Motivated by concerns regarding autonomy and trust in the research enterprise, regulators had initially proposed broad consent in a manner that would have rendered it the exclusive approach to secondary research with all biospecimens, regardless of identifiability. Based on public comments from both researchers and patients concerned that this approach would hinder important medical advances, however, regulators decided to (...) largely preserve the status quo approach to secondary research with biospecimens and data. The Final Rule therefore allows such research to proceed without specific informed consent in a number of circumstances, but it also offers regulatory broad consent as a new, optional pathway for secondary research with identifiable data and biospecimens. In this article, we describe the parameters of regulatory broad consent under the new rule, explain why researchers and research institutions are unlikely to utilize it, outline recommendations for regulatory broad consent issued by the Secretary's Advisory Committee on Human Research Protections, and sketch an empirical research agenda for the sorts of questions about regulatory broad consent that remain to be answered as the research community embarks on Final Rule implementation. By exploring such questions, the reader is led to reflect upon the nature of scientific method in social science. Some philosophers hold that trust grows fragile when people become too rational. They advocate a retreat from reason and a return to local, traditional values. Others hold that truly rational people are both trusting and trustworthy. Everything hinges on what we mean by 'reason' and 'rational'. If these are understood in an egocentric, instrumental fashion, then they are indeed incompatible with trust. Did Adam and Eve act rationally in eating the fruit of the forbidden tree? That can seem to depend solely on whether they had found the best means to their ends, in the spirit of the 'economic' theories of rationality. In this 1995 book, Martin Hollis respects the elegance and power of these theories but judges their paradoxes endemic. I argue for two main points in historiography of physics regarding the significance of Du Châtelet's Foundations of Physics in the development of mechanics. The first is that, despite Du Châtelet calling it a textbook in the Preface, it should not be understood as 'merely' a textbook. Instead, it fits in a tradition of women involved in natural philosophy in that era using liminal publication opportunities, and to reduce some of the resistance to their publication. Even these liminal opportunities were (...) rare and mostly available to women of very high social standing and wealth, who also happened to have supportive families or spouses, and were usually associated with some other well-known male thinker. The second point is that, even if we treat Foundations as a textbook, the way in which it synthesizes and refines work by Newton, Leibniz, Descartes, and others, meets the criteria given by Kuhn for the establishment of a first paradigm, which is not complete without such a definitive statement that enables the mop-up work characteristic of normal science. I conclude that by Kuhn's own criteria, he ought to have identified Du Châtelet as a key part of establishing the first paradigm in physics. She blazed a trail for others to follow. (shrink)

We talk about how different theories of causation affect the no-difference challenge; how the challenge shows up in real-world cases including voting, global labour injustice, global poverty, and climate change; and we work through a number of the solutions to the challenge that have been offered, arguing that many fail to actually meet it. The theme of the dissertation is that we should not be too cautious about engaging in metaphysics of modality; what may appear to be a refusal to engage in metaphysical speculation may instead involve a commitment to epistemic consequences that we should not accept. In Part I, I argue that David Lewis's modal realism implies that scepticism towards induction is rationally unavoidable. I conclude that his theory must be rejected. ;While not endorsing Lewis's account of the nature of possible worlds, (...) I argue that the recombination principle is what is causing the problems, and that this principle will cause problems when combined with any theory of modality according to which there are objective matters of fact as to what is possible or necessary. ;I conclude that we must reject the recombination principle, and that any principle we accept in its place must be one which will not lead to inductive scepticism. This suggests that we cannot countenance any objective possibilities that contravene actual natural laws. ;In Part II, I argue that one sort of explanation is closely connected with objective possibility: A fundamental explanation for some state of affairs involves saying something about its nature that has implications for what is objectively possible. I defend a weak form of the principle of sufficient reason, according to which every state of affairs has a fundamental explanation ;I go on to recast and defend a version of the Cosmological Argument for the existence of God. This argument, on my view, is plausible only when taken as an inductive argument, and indeed, as an inference to the best explanation. I argue that the theistic hypothesis deserves to be taken seriously on its merits as an explanation; more generally, I claim that it is not sufficient grounds for rejecting any hypothesis simply to say that it involves commitments as to what is possible or necessary. A willingness to accept some such commitments is an unavoidable consequence of what we normally take to be rational ways of forming beliefs. (shrink)

Recent writers on negligence and culpable ignorance have argued that there are two kinds of culpable ignorance: tracing cases, in which the agent’s ignorance traces back to some culpable act or omission of hers in the past that led to the current act, which therefore arguably inherits the culpability of that earlier failure; and non-tracing cases, in which there is no such earlier failure, so the agent’s current state of ignorance must be culpable in its own right. An unusual but (...) intriguing justification for blaming agents in non-tracing cases is provided by Attributionism, which holds that we are as blameworthy for our non-voluntary emotional reactions, spontaneous attitudes, and the ensuing patterns of awareness as we are for our voluntary actions. The Attributionist explanation for why some non-tracing cases involve culpability is an appealing one, even though it has limited scope. After providing a deeper account of why we should take the Attributionist position seriously, I use recent psychological research to argue for a new account of the conditions under which agents are culpable for straightforward instances of blameworthy acts. That account is extended to blameworthiness for non-voluntary responses. I conclude that even when the agent’s failure to notice arises from a nonvoluntary objectionable attitude, very few such cases are ones in which Attributionism implies that the agent is blameworthy for her act. In this paper, I discuss the nature and consequences of confabulation about political opinions and behaviours. When people confabulate, they give reasons for their choices or behaviour which are ill-grounded and do not capture what really brought the behaviour about, but they do this with no intention to deceive and endorse their own accounts. I suggest that this can happen when people are asked why they voted a certain way, or support certain campaigns, and so on. Confabulating in these political (...) contexts seems bad because we do not get a fully truthful account of why some political choice was made, and so the reasoning behind the choice is under-scrutinised. However, I argue that if people have a virtue of self-regulation, confabulation in political contexts can actually be part of the process of coming to better understand our political choices and embody more consistently the political values which we ascribe to. Even though the evidence‐based medicine movement (EBM) labels mechanisms a low quality form of evidence, consideration of the mechanisms on which medicine relies, and the distinct roles that mechanisms might play in clinical practice, offers a number of insights into EBM itself. In this paper, I examine the connections between EBM and mechanisms from several angles. I diagnose what went wrong in two examples where mechanistic reasoning failed to generate accurate predictions for how a dysfunctional mechanism would respond to intervention. (...) I then use these examples to explain why we should expect this kind of mechanistic reasoning to fail in systematic ways, by situating these failures in terms of evolved complexity of the causal system(s) in question. I argue that there is still a different role in which mechanisms continue to figure as evidence in EBM: namely, in guiding the application of population‐level recommendations to individual patients. Thus, even though the evidence‐based movement rejects one role in which mechanistic reasoning serves as evidence, there are other evidentiary roles for mechanistic reasoning. This renders plausible the claims of some critics of evidencebased medicine who point to the ineliminable role of clinical experience. Clearly specifying the ways in which mechanisms and mechanistic reasoning can be involved in clinical practice frames the discussion about EBM and clinical experience in more fruitful terms.
