Deliberative democratic theory emphasises the importance of informed and reflective discussion and persuasion in political decision-making. The theory has important implications for constitutionalism - and vice versa - as constitutional laws increasingly shape and constrain political decisions. The full range of these implications has not been explored in the political and constitutional literatures to date. This article examines how ethical values are integrated into legal education in Hong Kong, a prominent financial hub in Asia. It focuses on two aspects of integration: the integrative use of prescriptive and experiential teaching methods and the integration of legal ethics education into the curricula of law schools. Effective implementation of legal ethics education in Hong Kong faces challenges due to inadequate commitment to the integrative approach in law schools. While integrating legal ethics education into the curriculum (...) alone is insufficient, there is also a lack of effective integration of prescriptive and experiential teaching methods. To address these needs and challenges, the article proposes a dedicated core course on legal ethics supported by seminars and workshops led by experienced practitioners. This approach aims to foster ethical conduct among law students, enhancing Hong Kong’s reputation as an Asian financial centre by cultivating a culture of ethical responsibility, which is vital for the development and sustainability of Hong Kong’s legal landscape. This paper is aimed at investigating the differences in ethical perception between Mainland China and Hong Kong through qualitative analysis. The level of idealism and relativism of the informants are measured quantitatively. The qualitative analysis of the viewpoints of participants from Hong Kong and other Chinese cities offers a profound understanding of ethical perception. Contradicting previous studies, our research offers a fresh perspective, indicating that those with high idealism are not always the ones who condemn misconduct or advocate (...) for whistle-blowing. Interestingly, we noted that individuals with high relativism frequently consider and emphasize alternative perspectives, rather than merely condemning or advocating misconduct and whistle-blowing. Conversely, those with low relativism frequently exhibit more anger, regardless of their stance. This discovery suggests that high relativism could be beneficial for facilitating communication between conflicting parties. (shrink)

The predictors of attitudes regarding academic plagiarism were investigated in Hong Kong secondary school students. The participants were 257 Grade 10 and 11 students who were taking liberal studies. Quantitative analysis showed that the students were unfamiliar with what actions constituted plagiarism. The best predictor of attitudes was the perceived descriptive norm regarding plagiarism. We explain this finding by applying the cultural-self perspective and present our recommendations for teachers.

This article investigates the embodied identities of Hong Kong gay men in two different `sites of desire', namely London and Hong Kong. In London, Hong Kong gay men have constantly encountered the intertwining relationships between race and sexuality in the constellation of the Western construction of body/desire/masculinity. By contrast, Hong Kong gay men in Hong Kong tend to place more emphasis on issues of family and culture. The main site of struggle for Hong Kong (...) gay men in Hong Kong is the family-oriented and community-based environment. They adopt not a confrontational politics in a constitutional sense but rather derive tactics of microscopic resistance against societal and familial domination. By comparing 34 Hong Kong gay men living in London and Hong Kong, I argue the divergent constructions of being gay in these two contexts. Through the `voices' of these gay men, I criticize the `Western' construction of identity/the body and offer new insights into the discussion of gay identities. (shrink)

Consider this scenario: A terrorist just bombed the subway in London, which resulted in the casualties of numerous innocent people. His act can be considered well-planned for he fully knew what consequences his act would bring. If determinism is true, is it possible that the terrorist in question bombed the subway out of free will? An incompatibilist would respond to this question with a resounding “no”. A compatibilist, on the other hand, would answer yes, as long as the terrorist possessed (...) certain psychological characteristics, causal histories, etc. This underlies the basis of disputes between the compatibilists and incompatibilists, who appear to hold opposite views on whether it is possible for someone to act out of free will if determinism is true. However, as I shall discuss in Chapter One, this disagreement is partly a verbal one that stems from the diverse meanings of the term “free will”. This thesis aims to transcend the verbal disagreement and explore where the deeper, more substantial disagreements may lie between compatibilists and incompatibilists. One possible sphere where substantial disagreements between compatibilists and incompatibilists may lie is the content of the ordinary concept of free will, or that of the strongest sense of control condition necessary for securing the ordinary concept of moral responsibility. On this view, the metaphysical question and the conceptual question about free will are inseparable; in order to find out the metaphysical satisfaction conditions of free will, one must first identify the conceptual satisfaction conditions of free will. Further, the latter is reflected in everyday free will/ moral responsibility ascriptions about hypothetical or real scenarios. In Chapter Two, I analyze how the recent experimental philosophy movement bears on this issue. By examining the findings of some current experimental philosophy studies, I argue that neither compatibilism nor incompatibilism can sufficiently capture the ordinary concept of free will or moral responsibility. In the light of my discussions in Chapter Two, I explain in Chapter Three why each of the various traditional accounts of free will cannot independently provide an adequate “package deal” of solutions for the problem of free will. Near the end of the chapter, I propose a pluralistic, agnostic account of free will as an alternative solution. Despite its great instrumental value, experimental philosophy is not widely recognized as a philosophically significant methodology. Hence, Chapter Four is devoted to discussing the actual and potential values of experimental philosophy in the light of its contribution to the free will debate. I conclude that the encounter between the free will debate and the experimental philosophy movement is a fruitful one; the former proves the value of the latter by receiving helpful insights from it. Recent legal developments challenge how valid the concept of mental capacity is in determining whether individuals with impairments can make decisions about their care and treatment. Kong defends a concept of mental capacity but argues that such assessments must consider how relationships and dialogue can enable or disable the decision-making abilities of these individuals. This is thoroughly investigated using an interdisciplinary approach that combines philosophy and legal analysis of the law in England and Wales, the European Court of Human (...) Rights, and the United Nations Convention on the Rights of Persons with Disabilities. By exploring key concepts underlying mental capacity, the investigation concludes that both primary relationships and capacity assessments themselves must display key competencies to ensure that autonomy skills are promoted and encouraged. This ultimately provides scope for justifiable interventions into disabling relationships and articulates the dialogical practices that help better situate, interpret, and understand the choices and actions of individuals with impairments. With only two to five slots of visual working memory (VWM), humans are able to quickly solve complex visual problems to near optimal solutions. To explain the paradox between tightly constrained VWM and impressively complex human visual problem‐solving ability, we propose several principles for dynamic VWM allocation. In particular, we propose that complex visual information is represented in a temporal manner using only a few slots of VWM that include global and local visual chunks. We built a model of human (...) traveling salesman problem solving based on these principles of VWM allocation and tested the model with eye‐movement data. Exactly as the model predicted, human eye movements during traveling salesman problem solving have precise quantitative regularities with regard to both the general statistical pattern of attentional fixations and how they vary across individuals with different VWM capacities. Even though VWM capacity is very limited, eye movements dynamically allocate VWM resources to both local and global information, enabling attention to fine details without loss of the big picture. This article proposes a comparative and typological study of predicative demonstratives in French, Mandarin Chinese and Vietnamese. Six class of predicative demonstratives have been described one after another: presentive demonstratives, identification demonstratives, localizing demonstratives, copular demonstratives, manner demonstratives and implicit demonstratives. This research makes it possible to underline the syntactic and semantic characteristics of predicative demonstratives in the three languages, in the sense that they often function as non-verbal predicates without subjects and playing a role of reference or discourse-pragmatics. Aiming at the problem of low accuracy of edge detection of the film and television lens, a new SIFT feature-based camera detection algorithm was proposed. Firstly, multiple frames of images are read in time sequence and converted into grayscale images. The frame image is further divided into blocks, and the average gradient of each block is calculated to construct the film dynamic texture. The correlation of the dynamic texture of adjacent frames and the matching degree of SIFT features of two (...) frames were compared, and the predetection results were obtained according to the matching results. Next, compared with the next frame of the dynamic texture and SIFT feature whose step size is lower than the human eye refresh frequency, the final result is obtained. Through experiments on multiple groups of different types of film and television data, high recall rate and accuracy rate can be obtained. The algorithm in this paper can detect the gradual change lens with the complex structure and obtain high detection accuracy and recall rate. A lens boundary detection algorithm based on fuzzy clustering is realized. The algorithm can detect sudden changes/gradual changes of the lens at the same time without setting a threshold. It can effectively reduce the factors that affect lens detection, such as flash, movies, TV, and advertisements, and can reduce the influence of camera movement on the boundaries of movies and TVs. However, due to the complexity of film and television, there are still some missing and false detections in this algorithm, which need further study. (shrink)

Objective:To characterize the prevalence of hyperpalatable foods (HPF) among baby foods in the U.S. and examine the prevalence of HPF exposure and consumption from both baby food and adult food sources among infants aged 9–15 months.Methods:A U.S. baby food database as well as baby foods from three 24-h dietary recalls of 147 infants were used to identify baby foods as HPF per previous publication. HPF exposure was defined as intake of any HPF during the 3-day measurement period. To determine the (...) extent of HFP consumption, % kilocalorie (kcal) intake from HPF was characterized.Results:Only 12% of baby foods were HPF; however, nearly all participants (>90%) consumed HPF, primarily through exposure to adult foods. Younger infants (<12 months) consumed 38% [standard deviation (SD) = 23.6%] of their daily food kcal from HPF and older infants (≥12 months) consumed 52% (SD = 16.4%) of daily food kilocalorie from HPF. Most younger infants (68%) and older infants (88%) had repeated exposure to the same HPF across the measurement period.Conclusions:The prevalence of HPF among baby foods in the U.S. is low. However, almost all infants were exposed to HPF, and HPF comprised a substantial percentage of daily food kilocalorie in infants' diets. Findings highlight the transition to solid food consumption during complimentary feeding period is a critical time for early HPF exposure. (shrink)

This study examines whether community social capital in US counties, as captured by strength of civic norms and density of social networks in the counties, affects corporate social responsibility of resident corporations headquartered in the counties. Analyses of longitudinal data from 3688 unique US firms between 1997 and 2009 provide strong empirical support for the propositions that community social capital facilitates positive CSR activities that benefit non-shareholder stakeholders and constrains negative CSR activities that are detrimental to non-shareholder stakeholders. Additionally, we (...) explore the effects of institutional logics arising from community isomorphism on positive and negative CSR activities, respectively. And, we explore the respective effects of corporate engagement in positive and negative CSR activities on corporate financial performance. Firms undertake more positive CSR activities when such activities are more prevalent among other local corporations headquartered in the same county. But, there is no systematic relationship between negative CSR activities and the community-level corporate engagement in negative CSR activities. Positive CSR activities enhance a firm’s future financial performance, and the positive effect is more prominent among firms headquartered in counties with high community social capital. However, negative CSR activities only reduce a firm’s future financial performance among firms headquartered in counties with high community social capital; negative CSR activities do not affect performance among firms headquartered in counties with lower levels of community social capital. Collectively, these results highlight the distinct effects of local social institutions, namely community social capital, on positive CSR activities and negative CSR activities, respectively. (shrink)
