Universal Human Rights brings new clarity to the important and highly contested concept of universal human rights. This collection of essays explores the foundations of universal human rights in four sections devoted to their nature, application, enforcement, and limits, concluding that shared rights help to constitute a universal human community, which supports local customs and separate state sovereignty. This introduction to the Common Knowledge symposium titled “Comparative Relativism” outlines a variety of intellectual contexts where placing the unlikely companion terms comparison and relativism in conjunction offers analytical purchase. If comparison, in the most general sense, involves the investigation of discrete contexts in order to elucidate their similarities and differences, then relativism, as a tendency, stance, or working method, usually involves the assumption that contexts exhibit, or may exhibit, radically different, incomparable, or incommensurable traits. Comparative studies are required to (...) treat their objects as alike, at least in some crucial respects; relativism indicates the limits of this practice. Jensen argues that this seeming paradox is productive, as he moves across contexts, from Lévi-Strauss's analysis of comparison as an anthropological method to Peter Galison's history of physics, and on to the anthropological, philosophical, and historical examples offered in symposium contributions by Barbara Herrnstein Smith, Eduardo Viveiros de Castro, Marilyn Strathern, and Isabelle Stengers. Comparative relativism is understood by some to imply that relativism comes in various kinds and that these have multiple uses, functions, and effects, varying widely in different personal, historical, and institutional contexts that can be compared and contrasted. Comparative relativism is taken by others to encourage a “comparison of comparisons,” in order to relativize what different peoples—say, Western academics and Amerindian shamans—compare things “for.” Jensen concludes that what is compared and relativized in this symposium are the methods of comparison and relativization themselves. He ventures that the contributors all hope that treating these terms in juxtaposition may allow for new configurations of inquiry. (shrink)

Bishop was both fully at home in, and fully estranged from, Nova Scotia and Brazil. In Nova Scotia, after Bishop’s father had died, her mother went insane; Bishop lived there with her grandparents from the age of three to the age of six. She then left to be raised by an aunt in Massachusetts, but spent summers in Nova Scotia till she was thirteen. Subsequent adult visits north produced poems like “Cape Breton,” “At the Fishhouses,” and “The Moose”; and Bishop (...) responded eagerly to other poets, like John Brinnin and Mark Strand, who knew that landscape. Nova Scotia represented a harsh pastoral to which, though she was rooted in it, she could not return. Brazil, on the other hand, was a place of adult choice, where she bought and restored a beautiful eighteenth-century house in Ouro Prêto. It was yet another pastoral, harsh in a different, tropical way—a pastoral exotic enough to interest her noticing eye but one barred to her by language and culture . Foreign abroad, foreign at home, Bishop appointed herself a poet of foreignness, which is, far more than “travel,” her subject. Three of her books have geographical names—“North and South,” “Questions of Travel,” and “Geography III”—and she feels a geographer’s compulsions precisely because she is a foreigner, not a native. Her early metaphor for a poem is a map, and she scrutinized that metaphor, we may imagine, because even as a child she had had to become acquainted through maps with the different territories she lived in and traveled back and forth between. In the poem “Crusoe in England,” Bishop’s Robinson Crusoe, shipwrecked on his island, has nightmares of having to explore more and more new islands and of being required to be their geographer: I’d have nightmares of other islands stretching away from min, infinities of islands, islands spawning islands, ………………………………………… knowing that I had to live on each and every one, eventually, for ages, registering their flora, their fauna, their geography.This recurrent anxiety marks the end of one of Bishop’s earlier dreams—that one could go home, or find a place that felt like home. In “A Cold Spring,” a book recording chiefly some unhappy years preceding her move to Brazil, there had yet survived the dream of going home, in a poem using the Prodigal Son as surrogate. He deludes himself, by drinking, that he can be happy away, but finally his evening horrors in exile determine him to return: Carrying a bucket along a slimy board, he felt the bats’ uncertain staggering flight, his shuddering insights, beyond his control, touching him. But it took him a long time finally to make his mind up to go home. [“The Prodigal Son”] Helen Vendler is Kenan Professor of English at Harvard University. Recent research by scholars such as Dennis Des Chene and Roger Ariew, among others, has deepened our knowledge of the Scholastic context of Descartes's philosophy, especially his metaphysics and natural philosophy. Helen Hattab's book is a valuable addition to this literature. Her main concern is the development from explanations by Aristotelian substantial forms in late Scholastic thought to the allegedly more perspicuous explanations that characterized the new mechanistic science. "Open Democracy envisions what true government by mass leadership could look like."—Nathan Heller, New Yorker How a new model of democracy that opens up power to ordinary citizens could strengthen inclusiveness, responsiveness, and accountability in modern societies To the ancient Greeks, democracy meant gathering in public and debating laws set by a randomly selected assembly of several hundred citizens. To the Icelandic Vikings, democracy meant meeting every summer in a field to discuss issues until consensus was reached. Our contemporary representative (...) democracies are very different. Modern parliaments are gated and guarded, and it seems as if only certain people—with the right suit, accent, wealth, and connections—are welcome. Diagnosing what is wrong with representative government and aiming to recover some of the lost openness of ancient democracies, Open Democracy presents a new paradigm of democracy in which power is genuinely accessible to ordinary citizens. Hélène Landemore favors the ideal of “representing and being represented in turn” over direct-democracy approaches. Supporting a fresh nonelectoral understanding of democratic representation, Landemore recommends centering political institutions around the “open mini-public”—a large, jury-like body of randomly selected citizens gathered to define laws and policies for the polity, in connection with the larger public. She also defends five institutional principles as the foundations of an open democracy: participatory rights, deliberation, the majoritarian principle, democratic representation, and transparency. Open Democracy demonstrates that placing ordinary citizens, rather than elites, at the heart of democratic power is not only the true meaning of a government of, by, and for the people, but also feasible and, today more than ever, urgently needed. THE TITLE OF THIS PAPER calls for clarification. Not only are there several senses in which something may be said to "be," there are also many nuances to the terms "categorial" and "intuition." Taking Aristotle as a guide, let us focus upon the primary sense of "being," that is, substance considered both as first substance and second substance. We may then take "categorial" as referring to what Aristotle calls the "figures of predication," the ways in which predicates characterize subjects, indicating (...) "what" the subject is, its quality, quantity, relation, its "where," its "when," and so forth. The term "intuition" expresses something too primitive to be defined, but Edmund Husserl's metaphorical contrast between the "emptiness" of thought and speech and the "fullness" of intuition successfully highlights its essential characteristic. A couple of examples should suffice to grasp the import of Husserl's distinction. Consider the difference, for instance, between first entertaining vague plans of visiting a foreign city and then experiencing the fulfillment of actually strolling through its streets, or the difference between first reading a manual of instructions for performing some task and then actually executing the task skillfully. Taking Husserl as a guide, let us therefore characterize intuition broadly as the presentation of something in its fullness, as opposed to thinking or talking about it in an empty way. Finally, combining Husserlian and Aristotelian terminologies, we may describe categorial intuition as the presentation of figures of predication. Rather than presenting some particular thing, say a red chair, categorial intuition presents the chair's being red, the red quality's belonging to the chair. In short, categorial intuition makes present the modes of presentation of things. (shrink)

Short food supply chains have become the focus of considerable research in the last two decades. However, studies so far remain highly localized, and claims about the economic and social advantages of such channels for farmers are not backed by large-scale empirical evidence. Using a web survey of 613 direct-market farmers across Canada, this article explores the potential economic and social benefits that farmers derive from participating in short food supply chains. We used multivariate analysis to test whether a farmer’s (...) degree of involvement in direct food channels is positively correlated with levels of work enjoyment, social satisfaction, and economic satisfaction. The results indicate that, overall, direct-market farmers report high levels of occupational satisfaction, although work-related challenges persist, such as stress, excessive workloads, and competition. Farmer participation in short food chains was also a positive predictor of work enjoyment and economic satisfaction, but not of social satisfaction, as measured by the share of total farm sales attributable to direct selling. Net annual farm revenue, the share of direct food sales involving a middleman, age, and gender also correlated with one or more dimensions of occupational satisfaction. (shrink)

Gallup Polls have reported on the perceived ethics of various professions in the US since 1976. Clergymen and pharmacists were consistently identified as two of the most ethical professionals in the 1980''s and 1990''s. Business executives have not fared well in these polls and have not been rated among the top ten most ethical professions in any of the years the poll was taken. Ethical codes have not done much to belay the perception that the US business executive is not (...) very ethical. Whether the Sarbanes-Oxley Act will impact the ethical behavior of business executives remains to be seen. (shrink)

The United States juvenile justice system has primary oversight of youth who come into contact with legal authorities. This system is purposefully distinct from the adult system given the presumption of youths’ reduced culpability for delinquent behavior and increased potential for rehabilitation. Some juvenile court policies and practices are supportive of youth while others may drive youth further into the juvenile justice system. Today, we are at a point in which we can—and should—use information technology to accrue data to unpack (...) the impact of these policies and practices on and across youth. Moreover, technology-driven policies and practices such as electronic monitoring may be detrimental to the well-being of youth, whereas others such as video conferencing could be more widely used to benefit youth. While juvenile courts hold youth accountable for their behavior, courts also need to be accountable to youth by employing data-informed policies and practices that advance the health and well-being of youth. This paper is devoted to Ibn Sinn's text deals with two distinct, though closely related, subjects. First he considers the classification of problems, founded on the logical criteria which are the number and degree of indetermination of the solutions and the number of hypotheses and their possible independence. This classification does not replace the Hellenistic one, which remains relevant insofar as it purports to solve geometrical problems, but complements it and has a different frame of reference, applying principally to algebra, (...) that new born science. Ibn Sinn to bestow more importance on the role played by analysis in the course of the proof, the only role left to synthesis being to check that all implications involved in the course of analysis are in fact equivalences. This method will prove to be productive in algebra too, so much so that some algebraists will explicitly identify algebra with analysis. (shrink)

Bertrand Russell's 1903 masterpiece "The Principles of Mathematics" places great emphasis on the need to separate propositions from psychological items such as thoughts. In 1919 Russell explicitly retracts this view, however, and defines propositions as "psychological occurrences". These psychological occurrences are held by Russell to be mental images. In this paper, I seek to explain this radical change of heart. I argue that Russell's re-psychologising of the proposition in 1919 can only be understood against the background of his struggle with (...) the problem of the unity of the proposition in earlier work. Once this is recognized, and the solution to the problem offered by the 1919 theory is appreciated, new light is also shed on Russell's naturalism. I go on to compare Russell's psychological "picture theory" with the vehemently anti-psychological picture theory of Wittgenstein's "Tractatus Logico-Philosophicus" and suggest that, once the background of the dispute is brought into clearer focus, Russell's position can be seen to have many advantages over its more celebrated rival. Disclosure is a common response to conflicts of interest; it is intended to expose the conflict to scrutiny and enable it to be appropriately managed. For disclosure to be effective the receiver of the disclosure needs to be able to use the information to assess how the conflict may impact on their interests and then implement a suitable response. The act of disclosure also creates an expectation of self-regulation, as the person with the conflicting interests will be mindful of their (...) own potential biases and aware that their decisions may be monitored. This article discusses some of the problems of relying on disclosure as a solution to address conflicts of interest in research, including the added complexities around institutional conflicts of interest. The case of Dan Markingson illustrates these issues and highlights the vulnerable position relying on disclosure as a solution leaves research participants in. (shrink)

This paper argues in favor of the epistemic properties of inclusiveness in the context of democratic deliberative assemblies and derives the implications of this argument in terms of the epistemically superior mode of selection of representatives. The paper makes the general case that, all other things being equal and under some reasonable assumptions, more is smarter. When applied to deliberative assemblies of representatives, where there is an upper limit to the number of people that can be included in the group, (...) the argument translates into a defense of a specific selection mode of participants: random selection. This paper takes stock of a recent but growing movement within the field of deliberative democracy, which normatively argues for the epistemic dimension of democratic authority and positively defends the truth-tracking properties of democratic procedures. Authors within that movement call themselves epistemic democrats, hence the recognition by many of an ‘epistemic turn’ in democratic theory. The paper argues that this turn is a desirable direction in which the field ought to evolve, taking it beyond the ‘fact of disagreement’ that had (...) previously blocked the conceptual road to acknowledging more than intrinsic properties to democratic decision procedures. The paper shows how two authors in particular – Joshua Cohen and David Estlund – have successfully lifted the Rawlsian requirement of epistemic abstinence and defends epistemic democrats and the implications of the epistemic turn in democratic theory against various misconceptions. We evaluate here the performance of four models of cross-situational word learning: two global models, which extract and retain multiple referential alternatives from each word occurrence; and two local models, which extract just a single referent from each occurrence. One of these local models, dubbed Pursuit, uses an associative learning mechanism to estimate word-referent probability but pursues and tests the best referent-meaning at any given time. Pursuit is found to perform as well as global models under many conditions extracted from (...) naturalistic corpora of parent-child interactions, even though the model maintains far less information than global models. Moreover, Pursuit is found to best capture human experimental findings from several relevant cross-situational word-learning experiments, including those of Yu and Smith (), the paradigm example of a finding believed to support fully global cross-situational models. Implications and limitations of these results are discussed, most notably that the model characterizes only the earliest stages of word learning, when reliance on the co-occurring referent world is at its greatest. Bertrand Russell's work on the foundations of mathematics apparently played a decisive role in persuading Wittgenstein to abandon his aeronautical engineering studies in favor of philosophy. Wittgenstein's influence on Russell turned out to be profound as well: two years after they first met, Wittgenstein had delivered an objection to Russell's theory of judgment that was so devastating that it led to the abandonment of a major philosophical project of Russell's, leaving him reportedly “paralysed”. Two fundamental elements are pivotal to the (...) logicism of Russell's Principles of Mathematics: his conception of a proposition, and his commitment to the doctrine of the unrestricted variable. In addition to the ontological problems facing his theory of propositions, Russell also became convinced that his ontology of propositions contained fundamental logical problems, as he encountered recurring contradictions in his attempts to formalize a propositional logic that would comport with his philosophical theory. In his article The Nature, Importance, and Difficulty of Machine Ethics, James H. Moor distinguishes two lines of argument for those who wish to draw a “bright line” between full ethical agents, such as human beings, and “weaker” ethical agents, such as machines whose actions have significant moral ramifications. The first line of argument is that only full ethical agents are agents at all. The second is that no machine could have the presumed features necessary for ethical agency. This paper (...) shows why Moor is mistaken in his refutation of the first line of argument; it also makes a positive case that “weaker” ethical agents are not agents at all. This positive case, however, allows Moor’s rejection of the second line of argument to stand: allowing that there could be moral machines, but that these machines would have to be full moral agents and not merely something that models moral behavior or can be used in morally charged ways. Humility holds a modest but important place among the judicial virtues. But in spite of its growing popularity, it does not yet have a place on the ‘central judicial virtues’ lists. This paper provides an argument that judicial humility, especially institutional judicial humility, should be considered a necessary judicial virtue at least in common-law jurisdictions. This is because it is a necessary ingredient in precedent-based decisions that are fully justified from the point of view of the law and of political (...) morality. Further, while it is sufficient that individual judges make decisions that a humble judge would have made, the judicial community must in fact be humble in order to produce fully justified common-law decisions – humility is therefore necessary as a community-virtue. Consensus plays an ambiguous role in deliberative democracy. While it formed the horizon of early deliberative theories, many now denounce it as an empirically unachievable outcome, a logically impossible stopping rule, and a normatively undesirable ideal. Deliberative disagreement, by contrast, is celebrated not just as an empirically unavoidable outcome but also as a democratically sound and normatively desirable goal of deliberation. Majority rule has generally displaced unanimity as the ideal way of bringing deliberation to a close. This article offers an (...) epistemic perspective on this question of consensus versus disagreement. For ensuring the production of better decisions, we argue, the normative appeal of consensus varies depending on the deliberative task – whether it entails problem solving or prediction. We argue that in pure problem-solving contexts, consensus retains a strong normative appeal and forms the ideal deliberative outcome of deliberation. In contrast, on predictive tasks, consensus should generally not be used as a stopping rule noris it likely to be epistemically desirable as an outcome. Instead deliberators may be better served by ending the deliberation with a form of deliberative disagreement we call ‘positive dissensus’, which paves the way for more accurate aggregate predictions. NIMBY (Not In My Backyard) refers to an oppositional attitude from local residents against some risk generating facility that they have been chosen to host either by government or industry. The attitude is claimed to be characteristic of someone who is positive to a facility but who wants someone else to be its host. Since siting cannot be provided if everyone has this attitude, society ends up in a worse situation. The attitude is claimed to be egoistic and irrational. Here (...) it is argued that the NIMBY critique rests on questionable assumptions about the rightness of weighing total benefit against total cost. This weighing-principle will sometimes have to yield so that the rights of individuals can be acknowledged. (shrink)
