This paper addresses a hitherto unexamined issue in the work of Michel Henry, namely, his critical interpretation of Martin Heidegger’s analysis of “appearing” and “speaking.” Throughout his distinguished career, Henry went to great philosophical lengths to distance himself from traditional phenomenology and from the work of Heidegger. However, for the most part, Henry’s critical reading of Heidegger has received little attention from phenomenologists and even that has been cursory. Hence, the central aim of this paper is twofold: (...) (1) to show that Henry’s critique of the “appearing” and “speaking” of the world remains unanswered; and (2) to show that a proper reading of Heidegger throws light on the shortcomings of Henry’s own project. Hence, because the second objective follows necessarily from having achieved the first, this paper submits that what is first needed is a re-assessment of Henry’s critique in light of a more accurate understanding of the depth-dimension of “appearing” and “speaking,” which is, I argue, evinced in the analysis of the voice of conscience in Being and Time. The paper subsequentlyoffers what I see as a more appropriate interpretation of the call of conscience in terms of a radicalised “transcendence in immanence” which is not reducible to the mere exteriority of inner-worldly beings. The paper concludes by arguing that the voice of conscience underscores the shortfalls of Henry’s critique of the “appearing” and “speaking” of the world in Heidegger. (shrink)

In his new book the eminent Kant scholar Henry Allison provides an innovative and comprehensive interpretation of Kant's concept of freedom. The author analyzes the concept and discusses the role it plays in Kant's moral philosophy and psychology. He also considers in full detail the critical literature on the subject from Kant's own time to the present day. In the first part Professor Allison argues that at the centre of the Critique of Pure Reason there is the foundation for (...) a coherent general theory of rational agency. The second part employs this account of rational agency as a key to understanding Kant's concept of moral agency and associated moral psychology. The third part focuses on Kant's attempt to ground both moral law and freedom in the Groundwork and the Critique of Practical Reason. abstract Because we are more comfortable with judgements of conceptual conceivability than with judgements of practical possibility, we content ourselves with imaginary cases, which are useless for making many decisions that practical people most need to make, notably all-things-considered decisions about when to follow an admitted general principle and when to make an exception. The diverse cases of climate change, preventive attack, and torture all illustrate how the avoidance of the difficult task of integrating empirical judgements with conceptual judgements through (...) the flight into the sanitized abstraction of imaginary cases undermines attempts at practical ethics. All three cases involve allegedly exceptional, or emergency, situations, although climate change seems to require more than the usual compliance with general principle while preventive attack and torture supposedly require less than the usual compliance. By my lights the proposed exceptions are, respectively, fully, sometimes, and never justified. But the fundamental point is that one unfortunately cannot decide any of the cases without assessing what is in fact likely as well as what is conceptually possible. (shrink)

Due to the prevalence, severity, and costs associated with autism spectrum disorders, it has become a public health issue. In response, state governments have adopted ASD-specific private insurance mandates requiring coverage of ASD screening, diagnosis, and treatment. Despite rapid uptake of these laws, differences exist in the type and levels of coverage, especially for allied health services including occupational therapy. We piloted a structured legal research methodology to code ASD insurance mandates that impact allied health service provisions. State private insurance (...) mandates were obtained from WestlawNext. A coding methodology was piloted on 14 states and included variables for age and service limits, treatments covered, and medical necessity. Coding methods were feasible and highly reliable among raters. Ten of 12 states had a coverage mandate, many with specific provisions for allied health providers. A full analysis of all 50 states is warranted to identify provisions affecting allied health providers serving individuals with ASD. (shrink)

Resolution of the problem of mass nouns depends on an expansion of our semantic/ontological taxonomy. Semantically, mass nouns are neither singular nor plural; they apply to neither just one object, nor to many objects, at a time. But their deepest kinship links them to the plural. A plural phrase — 'the cats in Kingston' — does not denote a single plural thing, but merely many distinct things. Just so, 'the water in the lake' does not denote a single aggregate — (...) it is not ONE, but rather MUCH. The world is not the totality of singular objects, plural objects, and mass objects; for there are no plural or mass objects. It is the totality of single objects and (just) stuff. (shrink)

This article investigates to what extent protocols for dynamicdisputes, i.e., disputes in which the information base can vary at differentstages, can be justified in terms of logics for defeasible argumentation. Firsta general framework is formulated for dialectical proof theories for suchlogics. Then this framework is adapted to serve as a framework for protocols fordynamic disputes, after which soundness and fairness properties are formulated for such protocols relative to dialectical proof theories. It then turns out that certaintypes of protocols that are (...) perfectly fine with a static information base, arenot sound or fair in a dynamic setting. This paper takes up Berman and Hafner's (1993) challenge to model legal case-based reasoning not just in terms of factual similarities and differences but also in terms of the values that are at stake. The formal framework of Prakken and Sartor (1998) is applied to examples of case-based reasoning involving values, and a method for formalising such examples is proposed. The method makes it possible to express that a case should be decided in a certain way because that advances certain (...) values. The method also supports the comparison of conflicting precedents in terms of values, and it supports debates on the relevance of distinctions in terms of values. (shrink)

The study examines the relative merits of a noncompatibility and a restructuring explanation of the recurrent empirical finding that a prominent attribute looms larger in choices than in judgments. Pairs of equally attractive options were presented to 72 undergraduates who were assigned to six conditions in which they performed (1) only preference judgments or choices, (2) preference judgments or choices preceded by judgments of attractiveness of attribute levels, or (3) preference judgments or choices accompanied by think-aloud reports. The results replicated (...) the prominence efTect for choices, but a prominence effect was also found for preference judgments. In accordance with the restructuring explanation, the think-aloud protocols indicated that options were more often restructured in choices than in preference judgments. However, restructuring could not explain the prominence effect observed for preference judgments. A modified compatibility hypothesis is offered as an alternative explanation. (shrink)

David Chalmers’ ‘conceivability’ argument against physicalism is perhaps the most widely discussed and controversial argument in contemporary philosophy of mind. Recently, several thinkers have suggested a novel response to this argument, which employs the ‘powerful qualities’ ontology of properties. In this paper, I argue that this response fails because it presupposes an implausible account of the physical/phenomenal distinction. In the course of establishing this, I discuss the so-called ‘ultimate’ argument for the claim that dispositional properties form the subject matter of (...) physics. I argue that the ultimate argument can be interpreted in a strong or a weak way, and that the strong interpretation is implausible. I argue that this undermines the powerful qualities based response to the conceivability argument. I also argue for a general conclusion: that we should not define ‘the physical’ exclusively in terms of a distinction drawn from ontology. (shrink)

Henry Home (1696-1782) has been called "perhaps the most complete 'Enlightenment man' among the eighteenth-century Scottish thinkers." Kinsman and friend of David Hume, mentor and patron of Adam Smith, John Millar, and Thomas Reid, he was a key figure in that circle of luminaries. He read law, was called to the bar in 1723, was raised to the Bench of the Court of Session in 1752, with the title Lord Kames (the name of his family estate), and joined the (...) High Court of the Justiciary in 1763. Publishing broadly in law, history, philosophy, and criticism, Kames made significant contributions to the Enlightenment's science of human nature. The Essays is commonly considered Kames's most important philosophical work. In the first part, he sets forth the principles and foundations of morality and justice, attacking Hume's moral skepticism and addressing the controversial issue of the freedom of human will. In the second part, Kames focuses on questions of metaphysics and epistemology to offer a natural theology in which the authority of the external senses is an important basis for belief in the Deity. The text of this volume is based on the third edition of 1779, while the appendix presents substantial variant readings in the first and second editions. (shrink)

This book re-evaluates New Left and Marxist texts from the 1980s, in order to explore problems facing the study of 'class' which have emerged within Australian and international theories. The author contrasts the popular ideas of Connell, Bourdieu and the 'Death of Class' thesis, with those of lesser known texts, concluding that no single definition can account for the various historical meanings of class. Instead, loosely following Castoriadis, the concept of class can best be understood as creatively imagined and institutionalised. (...) Paternoster proposes that class is best studied through historical phenomenology, which can be used to link political economy, cultural sociology and anthropological ethnographies. This approach allows the contributions of Marxist and New Left authors to be reintegrated with contemporary theories. Doing so highlights the significance of labour populism, while cautioning against the ahistorical applications of texts such as Boudieu's Distinction. Reimagining Class in Australia will be of interest to students and scholars across a range of disciplines, including sociology, history, political economy and anthropology. (shrink)

Participative reforms to risk regulation are often argued to enhance the evidence base, improve the representation of the public interest, and build support for policy processes and outcomes. While rationales and mechanisms for participation have received most scholarly attention, less attention has been paid to the actual impact of participation on policy processes and outcomes. This article, therefore, considers the impacts of participation by examining the UK Food Standards Agency's Consumer Committee, which was created in 2002 to institutionalize consumer representation (...) within policy making, but which was disbanded as a failure in 2005. Using three case studies, the article identifies two broad institutional dimensions of regulation that shaped and constrained the committee's impact on the evidence base, policy outcomes and building support for policy, and contributed to its eventual failure. Those dimensions relate to the design and organization of regulatory regimes, and to the understandings and influence of regulatory actors. (shrink)

The idea of a single scientific method, shared across specialties and teachable to ten-year-olds, is just over a hundred years old. For centuries prior, science had meant a kind of knowledge, made from facts gathered through direct observation or deduced from first principles. But during the nineteenth century, science came to mean something else: a way of thinking. The Scientific Method tells the story of how this approach took hold in laboratories, the field, and eventually classrooms, where science was once (...) taught as a natural process. Henry M. Cowles reveals the intertwined histories of evolution and experiment, from Charles Darwin's theory of natural selection to John Dewey's vision for science education. Darwin portrayed nature as akin to a man of science, experimenting through evolution, while his followers turned his theory onto the mind itself. Psychologists reimagined the scientific method as a problem-solving adaptation, a basic feature of cognition that had helped humans prosper. This was how Dewey and other educators taught science at the turn of the twentieth century-but their organic account was not to last. Soon, the scientific method was reimagined as a means of controlling nature, not a product of it. By shedding its roots in evolutionary theory, the scientific method came to seem far less natural, but far more powerful. This book reveals the origin of a fundamental modern concept.
