Paris. The Place de Grève is teeming with the city's idle seeking relief from their boredom. Street-singers, story-tellers and showmen are encircled by groups of people in varying moods—some sullen, others eager, some distracted, others attentive. Sweets vendors, mercers and lampoonists attract customers by their words and gestures. A little apart from the crowd, men with grave faces seem to be waiting for something: they are the unemployed, keeping an eye out for a possible hirer. On some days a drumroll (...) precedes several men-at-arms escorting a condemned man and his executioner to the place of execution; the festive atmosphere turns suddenly somber, the crowd becomes silent. If scattered jeers and taunts are heard, more often than not it is just to relieve the tension.The Place de Grève gave its name to the French word for strike, greve. And perhaps something still remains of the liveliness of that gathering-place in today's strikes. The Spanish word for strike, huelga, is near to juerga, Spanish for amusement or diversion. The English “strike,” the German streik, the Italian sciopero, all connote fighting, an exchange of blows. The words themselves thus suggest that a strike may be both militant and festive. (shrink)

Belgian electoral law clearly and explicitly describes a procedure by which proportional representation is refined through grouping of lists from different districts of the same province. However, the actual practice of provincial electoral boards diverges from legal prescriptions to the extent that about 10 % of the seats at the House of Representatives are mis-occupied, though there is absolutely nothing that could impede a strict application of the law.

The distinction has occasioned a long controversy between Carnap and W.V. Quine. The latter distinguishes two sorts of analytic statements: the logical truths, characterized by their remaining true under all reinterpretations of the descriptive terms; and the statements, which reduce to logical truths with the help of definitions or by substitution of synonyms for synonyms. In “Two Dogmas of Empiricism”, he directs his criticism mainly against the latter arguing that the explications so far provided move in a circle, since, in (...) the end, the concept of synonymy is explained in terms of analyticity. He reaches the conclusion that the only form of synonymy not exhibiting this deficiency is that introduced by explicit conventions. But according to him, this procedure is of no avail, because the philosophically interesting content of the general term “analytic in L” cannot be grasped with its help. Carnap’s suggestion of defining a new basic concept “analytic in L0” does not solve the problem since we could just as well designate this with a neutral word, say “K”, thus avoiding the illusion of an explanation. The attempt to define synonymy with the help of semantic rules fails in a similar way: it accomplishes nothing more than to place certain statements under the rubric “Semantic rules” — a notion which is no clearer than the explicandum. Carnap replies that his definition of “analytically true” is given with regard to artificial or formalized languages for which we can determine syntactic and semantic rules in such a way that the concept of truth, in Tarski’s sense, can be applied to them. Analytic statements other than logical truths will thus be distinguished by means of so-called meaning postulates which serve to make the truth-value of such statements independent of empirical matters. I share Carnap’s astonishment that Quine finds the term “semantic rule” unintelligible while formulating no complaint against similar notions such as that of a syntactically well-formed formula, or that of an axiom etc. It appears that he cannot be satisfied with rules, because he expects a theory which would give us an empirical, i.e., a behavioristic, criterion of analyticity for natural languages. His chief dissatisfaction seems to come from the fact that no clear explicandum has been put forward — in contrast, e.g., with the notion of truth, where we have a sufficiently clear pre-theoretical concept. Thus, according to him, there is nothing that could be clarified by an explication. (shrink)

One of the requirements in the Dutch regulation for euthanasia and assisted suicide is that the doctor must be satisfied ‘that the patient's suffering is unbearable, and that there is no prospect of improvement.’ In the notorious Chabot case, a psychiatrist assisted a 50 year old woman in suicide, although she did not suffer from any somatic disease, nor strictly speaking from any psychiatric condition. In Seduced by Death, Herbert Hendin concluded that apparently the Dutch regulation now allows physicians to (...) assist anyone in suicide simply because he or she is unhappy.In this paper, I reject Hendin's conclusion and in particular his description of Mrs Boomsma as someone who was ‘simply unhappy.’ After a detailed narration of her lifestory, I turn to the American philosopher Harry Frankfurt's account of volitional incapacity and love for a more accurate characterization of her suffering. Having been through what she had, she could only go on living as another person than the one she had been when she was a happy mother. That would have violated her integrity, and that she could not bring herself to do. (shrink)

Penser l'homme et la folie : dans ce recueil d'études où s'est condensée, au fil des dernières années, sa réflexion, Henri Maldiney se propose de penser ensemble l'énigme de l'humanité et l'énigme de la " catastrophe " qui survient à certains d'entre nous. Double décentrement de la pensée, qui la met à la fois hors de l'anthropologie, fût-elle philosophique, et de son envers dans les théories psycho-pathologiques. Double décentrement où s'éprouvent donc au mieux la tradition philosophique - et en (...) particulier celle qui est issue de Heidegger - et la tradition de la Daseinsanalyse et de la Schicksalsanalyse, telle qu'elle est représentée par Binswanger, Straus, Minkiwski, Von Weizsäcker et Szondi. Dans une démarche authentiquement phénoménologique, où il s'agit de retourner à la " chose même " de l'humain et de la folie, de penser en va-et-vient de l'énigme à penser à ce qui en a été dit, Henri Maldiney dégage, par sa conception toute nouvelle de la transpossibilité et de la transpassibilité, une " compréhension " globale du phénomène humain qui le rend moins intraitable que par le passé. Le " séisme " de la folie, montre-t-il, vient d'un énigmatique court-circuit de la transpossibilité et de la transpassibilité, qui est seul propre à les mettre véritablement en relief comme la dimension profonde et cachée de notre expérience : celle de l' "événement " ou de l'émergence du nouveau, de la surprise de l'inattendu. La transpassiblité est une " possibilité " qui nous excède, en ce qu'elle fonde toute possibilité pour nous d'exister, parce qu'elle est en deçà de tout projet, transpossiblité de l'accueil - et de l'accueil transpassible -, y compris de l'accueil par nous-mêmes, de nous-mêmes. The objective of this study is to analyze the measurability and interfirm comparability of sustainability performance through the qualitative content analysis of 12 sustainability reports of mining firms using the Global Reporting Initiative guidelines. The systematic comparison of information disclosed in 92 GRI indicators sheds light on the reasons underlying the impossibility of rigorously measuring and comparing the sustainability performance of firms from the same sector, which are supposed to be strictly following the same reporting guideline. These reasons include qualitative (...) aspects of sustainability, lack of compliance with GRI protocols, indicator contingency, ambiguous or incomplete information, data heterogeneity, and report opacity. The study makes it possible to return to the very notion of sustainability, its meaning, and flexible application by organizations. The results are discussed from three different theoretical perspectives, each of which proposes possible and complementary explanations of the main findings. (shrink)
