Although indisputably one of the most important thinkers in the Western intellectual tradition, Rousseau's actual place within that tradition, and the legacy of his thought, remains hotly disputed. Thinking with Rousseau reconsiders his contribution to this tradition through a series of essays exploring the relationship between Rousseau and other 'great thinkers'. Ranging from 'Rousseau and Machiavelli' to 'Rousseau and Schmitt', this volume focuses on the kind of intricate work that intellectuals do when they read each other and grapple with one (...) another's ideas. This approach is very helpful in explaining how old ideas are transformed and/or transmitted and new ones are generated. Rousseau himself was a master at appropriating the ideas of others, while simultaneously subverting them, and as the essays in this volume vividly demonstrate, the resulting ambivalences and paradoxes in his thought were creatively mined by others. Healthcare policy and academic literature have promoted improving the transitional care of young people leaving child and adolescent mental health services. Despite the availability of guidance on good practice, there seems to be no readily accessible, coherent ethical analysis of transition. The ethical principles of non-maleficence, beneficence, justice and respect for autonomy can be used to justify the need for further enquiry into the ethical pros and cons of this drive to improve transitional care. The objective of this systematic review (...) was therefore to systematically search for existing ethical literature on child- to adult-orientated health service transitions and to critically appraise and collate the literature, whether empirical or normative. A wide range of bioethics, biomedical and legal databases, grey literature and bioethics journals were searched. Ancestral and forward searches of identified papers were undertaken. Key words related to transition, adolescence and young adulthood, ethics, law and health. The timeframe was January 2000 to at least March 2016. Titles, abstracts and, where necessary, full articles were screened and duplicates removed. All included articles were critically appraised and a narrative synthesis produced. Eighty two thousand four hundred eighty one titles were screened, from which 96 abstracts were checked. Forty seven full documents were scrutinised, leading to inclusion of two papers. Ancestral and forward searches yielded four further articles. In total, one commentary, three qualitative empirical studies and two clinical ethics papers were found. All focused on young people with complex care needs and disabilities. The three empirical papers had methodological flaws. The two ethical papers were written from a clinical ethics context rather than using a bioethical format. No literature identified specifically addressed the ethical challenges of balancing the delivery of transitional care to those who need it and the risk of pathologizing transient and self-limited distress and dysfunction, which may be normal during adolescence. There is very little research on ethical aspects of transitional care. Most existing studies come from services for young people with complex care needs and disabilities. There is much scope for improvement in the amount and quality of empirical research and ethical analysis in this area. (shrink)

Increasing globalisation and advances in artificial reproductive techniques have opened up a whole new range of possibilities for infertile couples across the globe. Inter-country gestational surrogacy with monetary remuneration is one of the products of medical tourism meeting in vitro fertilisation embryo transfer. Filled with potential, it has also been a hot topic of discussion in legal and bioethics spheres. Fears of exploitation and breach of autonomy have sprung from the current situation, where there is no international regulation of surrogacy (...) agreements—only a web of conflicting national laws that generates loopholes and removes safeguards for both the surrogate and commissioning couple. This article argues the need for evidence-based international laws and regulations as the only way to resolve both the ethical and legal issues around commercial surrogacy. In addition, a Hague Convention on inter-country surrogacy agreements is proposed to resolve the muddled state of affairs and enable commercial surrogacy to demonstrate its full potential. (shrink)

This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. The study deals with the conception of personal immortality in Miguel de Unamuno’s works. The starting point of his reflections is a particular person of “flesh and blood“ and his authentic existence. Unamuno’s “hunger of immortality“ is inspired by man’s confrontation with the phenomenon of death. For Unamuno existential phenomena of suffering and anxiety seem to be the keyword to the authentic existence and God then becomes a guarantor of individual immortality. The study concentrates on Unamuno’s conception of God in (...) the spirit of panentheism and Spanish Krausism. It observes Unamuno’s philosophical sources of information when discussing the question of immortality from Pythagoras to Platon while opposing the views of impersonal immortality (e.g. B. Spinoza). His theological argumentation is based mainly on S. Kierkegaard, St. Paul and Spanish mystics. His philosophical ideas are extracted especially from his works The Tragic Sense of Life, The Agony of Christianity and The Intimate Diary. His novella Saint Emmanuel The Good, Martyr serves as a fictional illustration of his ideas. The study concludes with the evaluation of Unamuno as an author writing “philosophizing literature“ and as a predecessor of existentialist literature, who was orientated towards Christian personalism. RESUME Jean-Paul Sartre débute comme dramaturge durant la Seconde Guerre mondiale alors qu'il est prisonnier de guerre en Allemagne, dans un camp de 25.000 détenus. Durant sa captivité, le philosophe écrit une pièce de théâtre réunissant des victimes et leurs bourreaux, des juifs, des prisonniers et des allemands. Bariona est la toute première pièce de Sartre et elle restera une référence pour le théâtre de situations que l'auteur ne cessera de réaliser pendant toute sa vie. Traditionnellement la pensée sartrienne (...) est analysée, dans un premier temps, sous le prisme de la philosophie abstraite et individualiste dont L'être et le néant est l'expression fondamentale, puis, dans un second temps, après la Seconde Guerre mondiale, à travers le marxisme dont la Critique de la raison dialectique serait le principal ouvrage. L'objectif essentiel de cet article est de mettre à l'épreuve cette idée en analysant les concepts de l'homme seul et de la collectivité dans la première pièce dramaturgique de Sartre. On verra que l'interprétation que divise la pensée de Sartre en deux n'est pas si juste. RESUMO Jean-Paul Sartre estreia como dramaturgo durante a Segunda Guerra Mundial, quando é feito prisioneiro de guerra na Alemanha em um campo de concentração com outras 25 mil pessoas. Durante seu cárcere, o filósofo escreve uma peça de teatro reunindo vítimas e seus algozes, judeus e alemães. Bariona é a primeira peça de Sartre e permanecerá a referência do teatro de situações que o autor continuará a perseguir por toda a vida. Tradicionalmente, o pensamento sartriano é considerado, em um primeiro momento, sob o prisma da filosofia abstrata e individualista, que teria na obra O ser e o nada a expressão fundamental; em seguida, em um segundo momento, depois da Segunda Guerra Mundial, o é por meio do marxismo, do qual a Crítica da razão dialética seria a obra principal. O objetivo fundamental do presente artigo é o de colocar à prova essa ideia, analisando os conceitos de homem solitário e de coletividade na primeira peça de teatro de Sartre. This method considers as part of the manifestation of his thought also the fictional works of literature and theater and not only the theoretical works. Several recent accounts claim that imagination is a matter of simulating perceptual acts. Although this point of view receives support from both phenomenological and empirical research, I claim that Jean-Paul Sartre's worry formulated in L'imagination (1936) still holds. For a number of reasons, Sartre heavily criticizes theories in which the sensory material of imaginative acts consists in reviving sensory impressions. Based on empirical and philosophical insights, this article explains how simulation theories of imagination can overcome Sartre's critique by paying (...) attention to the motor dimension of imagination. Intending to clarify the status of the sensory in imagination, a motor theory of imagination is presented in which the sensory component of imagination is interpreted in terms of anticipated sensory consequences of preparation for motor action. Work in philosophy of religion exhibits at least four symptoms of poor health: it is too partisan, too polemical, too narrow in its focus, and too often evaluated using criteria that are theological or religious instead of philosophical. Our diagnosis is that, because of the emotional and psychosocial aspects of religion, many philosophers of religion suffer from cognitive biases and group influence. We support this diagnosis in two ways. First, we examine work in psychology on cognitive biases and their affective (...) triggers. This work supports the view that, while cognitive biases are no doubt a problem in all inquiry and in all areas ofphilosophy, they are particularly damaging to inquiry in philosophy of religion. Second, we examine work in social and evolutionary psychology on religious sociality and its attendant emotions. This work establishes that the coalitional features of religion are correlated with group bias, and we contend that this bias is also harmful to inquiry in philosophy of religion. We close by offering both a prognosis and recommendations for treatment. (shrink)

My argument here is principally that the ubiquity of epistemics is evident in the ways in which knowledge claims and attributions of knowledge to self and other are embedded in turns and sequences, inform the design of turns at talk, are amended in the corrections that speakers sometimes make, to change from one epistemic stance to another, and are contested, in the occasional ‘struggles’ between participants, as to which of them has epistemic primacy. I show that these cannot be understood (...) in cognitive terms; furthermore, I show that epistemics – again the attribution of knowledge to self and other – is ‘real’ for participants. That is, in these four practices and aspects of interaction it is evident that participants orient to their states of knowledge relative to one another, on a moment-by-moment, turn-by-turn basis. According to the Requirement of Total Evidence, when assessing the credibility of hypotheses, we should endeavor to take into account all of the relevant evidence at our disposal instead of just some proper part of that evidence. In "The Fine-Tuning Argument and the Requirement of Total Evidence," Peter Fisher Epstein offers two alleged counterexamples to this requirement. I show that, on at least one very natural interpretation of the requirement, his alleged counterexamples are not genuine. I close by explaining why (...) this conclusion is important. (shrink)

It is widely claimed in recent years that science and theology can and do interact harmoniously. This chapter, however, explores some areas of potential conflict. Specifically, it asks whether the relationship between science and metaphysical naturalism is sufficiently close to cause trouble in the marriage of science to theistic religion, trouble that supports a decision to divorce even if it does not logically require it. Several popular positions about “methodological naturalism” are examined. While metaphysical naturalists claim there are no supernatural (...) entities, methodological naturalists claim only that, when scientists attempt to explain natural phenomena, they should do so without appealing to any supernatural entities. One popular position about methodological naturalism is that it cannot be reconciled with the traditional theistic view of divine action in the world. A second position is that God’s power and wisdom or God’s faithfulness or even God’s generosity makes divine intervention in the world unlikely at best and thus supports methodological naturalism. A third position is that methodological naturalism can be justified by an appeal to the nature or goals of science. Powerful objections can be raised to all three of these positions. Of course, if neither the nature of God nor the nature or goals of science support methodological naturalism, then it is tempting to conclude, as many conservative Christian thinkers do, that the commitment of contemporary science to methodological naturalism is grounded in a prior commitment, perhaps even an irrational one, to metaphysical naturalism. The chapter ends by rejecting this conclusion in favor of the view that the past success of both non-scientists and scientists in discovering natural causes for natural phenomena justifies a modest methodological naturalism and at the same time provides significant support for metaphysical naturalism. Michael Bergmann argues directly from our ignorance about actual and merely possible goods and evils and the broadly logical relations that hold betweenthem to the conclusion that “noseeum” arguments from evil against theism like William L. Rowe’s are unsuccessful. I critically discuss Bergmann’s argument in the first part of this paper. Bergmann also suggests that our ignorance about value and modality undermines the Humean argument from evil against theism that I defended in a 1989 paper. In this paper, we aim to get clear about why renewal is needed in philosophy of religion and how to achieve it. We begin with a fundamental distinction between someone’s perspective in the field and the perspective of the field, arguing that any philosopher of religion is responsible to both. Then we identify eight problems that should prevent the status quo in philosophy from appearing acceptable to anyone who takes the perspective of the field, as well as seven practical suggestions (...) which, if implemented, would help to solve these problems. The problems include such things as tribalism, ignorance about religion, and viewing issues exclusively in terms of what is religiously familiar; the mitigations such things as allowing non-Christians to join the Society of Christian Philosophers, broadening the education of philosophers of religion, and paying more attention to the deep history of religion. This article focuses on questions about evil which are both theological and doxastic, and more specifically alethic – i.e., questions about whether what we know about evil can be used to establish the falsity or probable falsity of the belief or proposition that God exists. Such a focus is natural for agnostics. More generally, it is natural for anyone who is engaged in genuine inquiry about whether or not God exists. A specific concept of God is employed – it is (...) assumed that to assert that God exists, or that ‘theism’ is true, is to assert that there exists a supernatural person who created the natural world and who is perfect in power, perfect in knowledge, and perfect in moral goodness. This is obviously a narrow sense of the words ‘God’ and ‘theism’, but it is common in the philosophical literature. The article also uses a common strategy to investigate alethic problems of evil: it constructs and evaluates a variety of ‘arguments from evil’ for the conclusion that God does not exist or that His existence is improbable. Many of our wisest policy-makers, activists, scientists, and philosophers agree that the only problem with empathy is that we don’t have enough of it. Nothing could be farther from the truth, argues Yale researcher Paul Bloom. In AGAINST EMPATHY, Bloom reveals empathy to be one of the leading motivators of inequality and immorality in society. The value of biodiversity is usually confused with the value of biological resources, both actual and potential. A sharp distinction between biological resources and biodiversity offers a clearer insight into the value of biodiversity itself and therefore the need to preserve it. Biodiversity can be defined abstractly as the differences among biological entities. Using this definition, biodiversity can be seen more appropriately as: (a) a necessary precondition for the long term maintenance of biological resources, and therefore, (b) an essential environmental (...) condition. Three values of biodiversity are identified and arranged in a hierarchy: (1) the self-augmenting phenomenon of biodiversity maintains (2) the conditions necessary for the adaptive evolution of species and higher taxa, which in turn is necessary for providing humans with (3) a range of biological resources in the long term. Two broad policy implications emerge: increments of biodiversity should not be traded off against biological resources as if they were the same, and the conservation of biodiversity should be a constraint on the public interest, not a goal in service of the public interest. As sources of knowledge, perception and testimony are both vulnerable to sceptical arguments. To both arguments a Moorean response is possible: both can be refuted by reference to particular things known by perception and testimony. However, lies and dreams are different possibilities and they are different in a way that undercuts the plausibility of a Moorean response to a scepticism of testimony. The condition placed on testimonial knowledge cannot be trivially satisfied in the way the Moorean would suggest. The ‚Naturforschende Gesellschaft’︁, founded in 1793, proved instrumental for the development of science at the University of Jena around 1800. Its library can be considered as one of its most important facilities provided for research and for the education of students. Since this library has been preserved almost without losses, we can ask whether this library served the purpose of a research library in the newly established field of ‚science’︁. In consequence, the role of scientific societies and the genesis of (...) specialised libraries in the area of science can be investigated in an exemplary case, with implications for the concept of scientific research around 1800. The notion of a μέσον, formally defined as the «middle term« in a syllogism, plays a pivotal role in Aristotle's theory of scientific demonstrations in his Analytica Posteriora. It is via the μέσον that the distinctive traits of a demonstration – the employment of causal notions and of statements concerning the essence of things – enter into demonstrative syllogisms. This, however, raises problems with respect to the provability of statements concerning the essence of things that Aristotle seems to accept in (...) certain passages of the Analytica Posteriora, as opposed to well-known passages in the Metaphysics. It is shown in which sense essences are in fact demonstrated by their being employed – via the μέσον – in a demonstration, without, however, being mentioned in the conclusion of such a demonstration. The importance Aristotle ascribes to the μέσον in Analytica Posteriora suggests a more flexible, less formalistic understanding of Aristotle's view of science, while still being based on an analysis of the formal structure of the syllogism.
