Most people believe that it is permissible to kill a nonresponsible threat, or someone who threatens one's life without exercising agency. Defenders of this view must show that there is a morally relevant difference between nonresponsible threats and innocent bystanders. Some philosophers, including Jonathan Quong and Helen Frowe, have attempted to do this by arguing that one who kills a bystander takes advantage of another person, while one who kills a threat does not. In this paper, I show that (...) the proposals offered by Quong and Frowe have unacceptable implications. I then argue that those who claim that nonresponsible threats may be killed face a dilemma generated by the possibility of a stationary threat, or someone who endangers another person's life without moving. Unless we arbitrarily distinguish between stationary and moving nonresponsible threats, it is unclear how the permission to kill nonresponsible threats is to be explicated. I conclude that nonresponsible threats are not legitimate targets of self-defence. (shrink)

This article uses philosopher Miranda Fricker’s work on epistemic injustice to shed light on the legal concept of the fiduciary, alongside demonstrating the wider contribution Fricker’s work can make to business ethics. Fiduciary, from the Latin fīdūcia, meaning “trust,” plays a fundamental role in all financial and business organisations: it acts as a moral safeguard of the relationship between trustee and beneficiary. The article focuses on the ethics of the fiduciary, but from a unique historical perspective, referring back to the (...) original formulation of the fiduciary within a familial context to investigate presuppositions regarding agential capabilities, whilst also paying attention to the power mechanism embedded in the trustee–beneficiary relationship. Using Fricker’s theory of pre-emptive testimonial injustice, the analysis elucidates the impact of cumulative beneficiary silencing in contemporary contexts, and the article uncovers ethical issues of an epistemological kind at the core of the fiduciary—of epistemic injustice. In this article, I discuss the structural domination of whiteness as it intersects with the potential of individual critique and reflexivity. I reflect on my positioning as a white nurse researcher while researching international nurse migration. I draw on two large qualitative studies and one small focus group study to discuss my reactions as a white researcher to evidence of institutional racism in the British health services and my growing awareness of how racism is reproduced in the British nursing profession.

The aim of this literature review was to compose a narrative review supported by a systematic approach to critically identify and examine concerns about accountability and the allocation of responsibility and legal liability as applied to the clinician and the technologist as applied the use of opaque AI-powered systems in clinical decision making. This review questions if it is permissible for a clinician to use an opaque AI system in clinical decision making and if a patient was harmed as a (...) result of using a clinician using an AIS’s suggestion, how would responsibility and legal liability be allocated? Literature was systematically searched, retrieved, and reviewed from nine databases, which also included items from three clinical professional regulators, as well as relevant grey literature from governmental and non-governmental organisations. This literature was subjected to inclusion/exclusion criteria; those items found relevant to this review underwent data extraction. This review found that there are multiple concerns about opacity, accountability, responsibility and liability when considering the stakeholders of technologists and clinicians in the creation and use of AIS in clinical decision making. Accountability is challenged when the AIS used is opaque, and allocation of responsibility is somewhat unclear. Legal analysis would help stakeholders to understand their obligations and prepare should an undesirable scenario of patient harm eventuate when AIS were used. (shrink)

The advent of Artificial Intelligence (AI) and other digital technologies is touted as ushering in the fourth industrial revolution (4IR). 4IR, also known as ‘Industry 4.0,’ pertains to the burning internet connectivity, sophisticated analytics and production, and automation’s transformative impacts on the world. The surge of change in the production arena started in the second half of 2010 and has continued to increase astronomically, with a remarkable probability of shaping the future of manufacturing and humanity. The 4IR is thus heralding (...) areas such as digitalisation, artificial intelligence, cloud computing, robotics, and 3D technologies amidst many other innovative digital technologies following the first, second and third industrial revolutions. The problem this paper addresses is the role of Arts and humanities (A&H) in the era of AI. Should A&H imbibe the empirical science methodology to stay relevant? How does A&H contribute to 4IR? Leveraging on philosophical tools of arguments and reconstruction of ideas, this paper argues for the significance of Kant’s thoughts in The Contest of the Faculties and that Arts and humanities are instrumental to humanising science and technology, helping to shape interdisciplinary collaboration and fostering understanding of the ethical, social and cultural dimensions of AI. Early twentieth-century Italian poetry experiences a crisis in confidence concerning the expressibility of rhythm. Dino Campana's writings exemplify the processes the poet goes through in order to write rhythm. Rhythm is difficult to deal with because it is both sacred and tired. These two incarnations of rhythm lead Campana to different modes of expression; from more traditional definitions through to more fluid definitions. Two strands of analysis reveal themselves as central to understanding Campana's theoretical stance, namely fluidity and movement. Adam Hosein has recently proposed that a sufficient degree of intervening agency between a person’s contribution to an unjust lethal threat and the posing of that threat can exempt the contributor from liability to defensive killing. Hosein suggests that this will exempt most civilians from liability to lethal defence even if they contribute to unjust killings. I argue that intervening agency does not bear on a person’s responsibility for a threat, and does not exempt her from liability to defensive killing.

According to Jonathan Quong’s _moral status account_ of liability to defensive harm, an agent is liable to defensive harm only when she mistakenly treats others as if their moral status is diminished (for example, as if they lack a right that they in fact possess). Quong argues that, by the lights of the moral status account, a conscientious driver (Driver) who faultlessly threatens to kill Pedestrian is not liable to defensive harm. Quong argues that Driver’s action is evidence-relative permissible, despite (...) the risks it imposes, because the general practice of prudent driving is permissible. The practice is permissible because (a) its risks do not disproportionately fall on some groups rather than others, (b) the threatened harms are incidental, and (c) the risk that driving imposes is acceptable in light of the benefits everyone derives from driving. Because the correct moral theory tells us that prudent driving is permissible, Pedestrian lacks a right that Driver refrain from driving. Hence, Driver does not, by driving, treat Pedestrian as lacking a right that Pedestrian in fact possesses. Driver is not liable to defensive force. I argue, against Quong, that cost–benefit analyses of types of risky activity cannot justify individual tokens of risk imposition. Actions that risk incidentally harming others must be justified by the prospective benefits of that token action. Hence, Driver’s imposition of risk on Pedestrian cannot be justified by the benefits of the general practice of driving. I argue that the permissibility of Driver’s imposing risk on Pedestrian via prudent driving turns on whether Driver is willing to internalise at least the foreseeable costs of that risky action. One can lack a right that a person refrain from performing a risky action whilst possessing a right not to be harmed by that risky action. Even if Pedestrian cannot reasonably demand that Driver refrain from driving, she can reasonably demand that Driver refrain from forcing her to bear the costs of his driving. (shrink)

Cooperation in wrongdoing is an everyday matter for all of us, though we need to discern when such cooperation is morally excluded as constituting formal cooperation, as opposed to material (unintended) cooperation whether justified or otherwise. In this paper, I offer examples of formal cooperation such as referral of patients for certain procedures where the cooperating doctor intends an intrinsically wrongful plan of action on the part of the patient and a medical colleague. I also consider a case of formal (...) cooperation where the cooperator intends a choice on the part of another person that is not intrinsically wrong, but wrong in the circumstances because the person believes it will cause serious uncompensated harm. Artificial intelligence (AI) has recently emerged as a transformative force in teaching and learning practices, with profound implications for open and distance learning (ODL), which relies heavily on technology. Despite its global impact, the extent of African societies’ engagement with AI remains trivial. This paper critically reflects on the ethical, legal, social, pedagogical and technological implications of AI in ODL in sub-Saharan Africa, drawing insights from the Nigerian experience. This article will discuss the concepts of Cradle to Cradle and Circular Economy in relation to sustainable production involving philosophical debates on economic growth, and the risk of subversion of managerial practice to business as usual. The case study is based on the assignments submitted by Masters students as part of a course related to sustainable production and consumption at Leiden University in The Netherlands. Some of the supposedly best practice cases placed on the website of the Ellen MacArthur Foundation (...) or those awarded Cradle to Cradle certificate were evaluated by students as green-washing. This book offers a new description of the significance of Hesiod's 'myth of the races' for ancient Greek and Roman authors, showing how the most detailed responses to this story go far beyond nostalgia for a lost 'Golden' age or hope of its return. Sie sind häufig verbunden mit einer grundsätzlichen Sorge um eine kompetente und verantwortliche Pflege, die den Bedürfnissen von Patient*innen gerecht wird. Forschungen aus drei Jahrzehnten zeigen, dass strukturelle Beschränkungen, Konflikte mit Kolleg*innen, Patient*innen und Angehörigen sowie eine Managementorientierung und die Unsichtbarkeit der Pflegearbeit, Ursachen für die grundsätzlichen Sorgen sind. Sie führen zu moralischem Stress, fehlenden Beziehungen und einer Fragmentierung der Pflege. Teilweise reagieren Pflegende widerständig, indem sie beispielsweise die Regeln (...) beugen und eine passive „wait and see“ Position einnehmen. Einige Pflegende erheben ihre Stimme und suchen ein Klinisches Ethikkomitee auf. Klinische Ethikkomitees bieten eine Möglichkeit, die komplexen ethischen Fragen der Pflegepraxis zu thematisieren. Allerdings verweisen die Studien aus drei Dekaden auf einen Mangel der Thematisierung. Die Analyse der Ursachen lässt die Schlussfolgerung zu, demokratischen Lernprozessen Raum zu geben. (shrink)

We reflect, using a vignette, on conceptual tensions and the value judgements that lie behind difficult decisions about whether or not the older person with dementia should return home or move into long-term care following hospital admission. The paper seeks, first, to expose some of the difficulties arising from the assessment of residence capacity, particularly around the nature of evaluative judgements and conceptual tensions inherent in the legal approach to capacity. Secondly, we consider the assessment of best interests around place (...) of residence, which demonstrates significant conceptual tensions. In addition, ‘best interests’ raise issues around the perception of risk and the perceptions of the family and crucially involve the notions of autonomy and trust. Finally, we not only gesture at some practical considerations based on insights from values-based medicine, but also make the suggestion that we require tighter functional assessments of residence capacity coupled with broader judgements about best interests. This paper explores the experiences of infertile women who occupy a liminal space in society, and argues that the fertility clinic served as a space to tolerate women's experiences of liminality. It provided not only rituals aimed at transition to pregnancy, but also a space where women's liminal experiences, which are caused by the existential chaos of infertility, could be tolerated. The British experience seemed to differ from the American one identified in the literature, where self‐management and peer group support (...) are described as strategies used by infertile women to manage infertility. The British women in this study did not appear to draw so much on self‐management or peer group support to deal with their experiences of infertility. They appeared to be isolated in their experience. The clinic thus provided a space in which recognition was given to their intensely private experiences of difference from those in the outside fertile world and allowed them to manage these socially unacceptable, culturally taboo and invisible experiences. However, because of its very limited success rate in enabling women to become pregnant, rather than facilitating the transition of status from infertile to fertile woman, the clinic also served to reinforce the liminal experiences of those women who remained infertile. Inadvertently, the clinic offered a way of being in limbo while at the same time reinforcing the liminal experiences of women. (shrink)

This paper charts the history of the Rockefeller Foundation’s participation in the collection and long-term preservation of genetic diversity in crop plants from the 1940s through the 1970s. In the decades following the launch of its agricultural program in Mexico in 1943, the Rockefeller Foundation figured prominently in the creation of world collections of key economic crops. Through the efforts of its administrators and staff, the foundation subsequently parlayed this experience into a leadership role in international efforts to conserve so-called (...) plant genetic resources. Previous accounts of the Rockefeller Foundation’s interventions in international agricultural development have focused on the outcomes prioritized by foundation staff and administrators as they launched assistance programs and especially their characterization of the peoples and “problems” they encountered abroad. This paper highlights instead how foundation administrators and staff responded to a newly emergent international agricultural concern—the loss of crop genetic diversity. Charting the foundation’s responses to this concern, which developed only after agricultural modernization had begun and was understood to be produced by the successes of the foundation’s own agricultural assistance programs, allows for greater interrogation of how the foundation understood and projected its central position in international agricultural research activities by the 1970s. It is commonplace to observe that explanations of human behavior diverge from explanations of other sorts, though it is far from commonplace to articulate exactly what this divergence amounts to. One very obvious and rather marvelous fact about explanations in the human sciences is that the subject matter talks and sometimes literally explains itself. This dissertation is an essay about what sort of difference language participation makes to explaining what language participants do. ;Currently, action theorists are recruiting insights from philosophy (...) of natural language to shed light on the relation between actions and the reason-giving statements that explain them. The four contemporary action theorists studied here maintain that certain types of thought do cause actions. And further, they maintain that from a true reason-giving statement one can infer the particular thoughts that caused an individual action. ;In Chapter I, I show how a standard model of explanation fails to reveal how reason-giving statements convey causal thoughts. In Chapter II, I try to pinpoint how a special mode of description reserved for action can be distinguished from other ways of describing occurrences. ;Different action theorists focus on different linguistic facts from which they draw their conclusions about the nature and structure of actions themselves. In Chapter III, I examine how the difference between claims of Donald Davidson and Alvin Goldman regarding individuation of actions may be traced back to their respective ways of construing the data of talk about actions. ;In Chapter IV, I examine Jennifer Hornsby's thesis that a special form of entailment follows exclusively from sentences about actions, based on their grammatical or 'surface' form. ;In Chapter V, I study the way Donald Davidson and John Searle apply 'holistic' theories of meaning to the problem of analyzing action explanations. ;Overall the results here go a modest way, only to demonstrate that we know less today than might be supposed about reasons and actions. This article presents the findings of a study about the history of aversion therapy as a treatment technique in the English mental health system to convert lesbians and bisexual women into heterosexual women. We explored published psychiatric and psychological literature, as well as lesbian, gay, and bisexual archives and anthologies. We identified 10 examples of young women receiving aversion therapy in England in the 1960s and 1970s. We situate our discussion within the context of post-war British and transnational medical history. (...) As a contribution to a significantly under-researched area, this article adds to a broader transnational history of the psychological treatment of marginalised sexualities and genders. As a consequence, it also contributes to LGBTQIA+ history, the history of medicine, and psychiatric survivor history. This is an introduction to the Symposium on Nonparadigmatic Forms of Punishment. We explain what we mean by calling certain instances of punishment 'nonparadigmatic' and explain why nonparadigmatic punishments are of philosophical interest. We then introduce the contributions to the Special Issue and conclude by outlining directions that future research on nonparadigmatic punishment might take. We focus on three particular ways in which punishment might be nonparadigmatic: cases involving nonstandard punishing agents, those involving nonstandard subjects of punishment, and those involving (...) nonstandard means of punishment. Much work in the ethics of war is structured around the distinction between jus ad bellum and jus in bello. This distinction has two key roles. It distinguishes two evaluative objects—the war ‘as a whole’, and the conduct of combatants during the war—and identifies different moral principles as relevant to each. I argue that we should be sceptical of this framework. I suggest that a single set of principles determines the justness of actions that cause nonconsensual harm. If so, there (...) are no distinctive ad bellum or in bello principles. I also reject the view that whilst the justness of, for example, ad bellum proportionality rests on all the goods and harms produced by the war, the justness of combatants’ conduct in war is determined by a comparatively limited set of goods and harms in a way that supports the ad bellum–in bello distinction. Live coding is an embodied, sensorial and live technological–human relationship that is recursively iterated through sonic and visual outputs based on what we argue are kinship relations between and through bodies and technology. At the same time, and in a familiar moment of déjà vu for feminist scholars, live coding is most often discussed not in relation to the lived and sensory human–technology kinship, but in terms of fetishised code or software, output and agency. As feminist scholars have long argued, (...) emphasising and fetishising code or software, and celebrating output and agency are normatively masculine, white and Western conceptions of technology that feed into the growing valorisation of accelerationist logic whilst also negating embodied, not to mention other (non-white, Western, masculine) bodies, expertise or histories per se. In this article, we want to redress this by drawing on our empirical material on live coding to focus on human–technology kinship and, in so doing, think about failure, slowness and embodiment and about human–technology relations that are more akin to what Alison Kafer (drawing on the work of Donna Haraway) has termed ‘becoming with’ or ‘making kin’. This, we argue, has the potential to shift the focus from the potentialities of technologies on or through the body, towards the generative capacities of mediation (including failure), which are caught up in lived experiences. The question is not only about how the relations of bodies and technologies are played out in certain circumstances but about what might be played out if we reconceptualise these relations in these terms. The COVID-19 pandemic crisis has necessitated widespread adaptation of revised treatment regimens for both urgent and routine medical problems in patients with and without COVID-19. Some of these alternative treatments maybe second-best. Treatments that are known to be superior might not be appropriate to deliver during a pandemic when consideration must be given to distributive justice and protection of patients and their medical teams as well the importance given to individual benefit and autonomy. What is required of the doctor discussing (...) these alternative, potentially inferior treatments and seeking consent to proceed? Should doctors share information about unavailable but standard treatment alternatives when seeking consent? There are arguments in defence of non-disclosure; information about unavailable treatments may not aid a patient to weigh up options that are available to them. There might be justified concern about distress for patients who are informed that they are receiving second-best therapies. However, we argue that doctors should tailor information according to the needs of the individual patient. For most patients that will include a nuanced discussion about treatments that would be considered in other times but currently unavailable. That will sometimes be a difficult conversation, and require clinicians to be frank about limited resources and necessary rationing. However, transparency and honesty will usually be the best policy. This paper considers a certain genre of anti-racist solidarity — what I call simulations of lived experience – in order to critically examine the premises and pitfalls of such efforts. Two primary examples are examined: (1) a 2014 smartphone app called Everyday Racism, where users are invited to ‘play’ a racialised character for a week in order to ‘better understand’ the experience of racism; and (2) various iterations of ‘Hijab Day’, where non-Muslim women are invited to wear a hijab for (...) a day. I argue that both examples, while well-intentioned, offer only a ‘thin’ version of the lived experience of veiled Muslim women and people of colour, failing to reckon with the epistemological and phenomenological complexity entailed in this embodied experience. Moreover, I argue that both proceed on the misguided idea that first-hand experience, rather than empathic listening, is generative of anti-racist solidarity, and in doing so, these efforts risk reproducing the very structures and habits of white privilege they set out to challenge. This article documents the increasing participation of poor women in social movements in Latin America, focusing on movements centered around human rights and collective consumption issues, such as the cost of living or the provision of public services. It analyzes the factors that have contributed to the increased participation of poor Latin American women in social movements and why they have chosen the state rather than the workplace as the principal arena of confrontation. Although these movements are undertaken in defense (...) of women's traditional domestic role, collective action appears to be contributing to a greater consciousness of gender subordination among Latin American women and to their greater legitimacy in the public sphere.
