In a providential account of the changing relation between political economy and economics, the late nineteenth-century development of economics is identified with the rational choice model; and the revival of political economy in the late twentieth century comes with the export of this model to politics and the other social sciences. An alternative prudential account locates the revival of political economy with a significant qualification to the rational choice model. This qualification restores an eighteenth- and nineteenth-century view of rule-following to (...) human agency. This essay sets out these accounts and draws the conclusion that the choice of one over the other matters, not least for the practice of contemporary politics. (shrink)

This paper uses evidence from laboratory experiments to identify a variety of tribalisms. This is important because some tribalisms encourage zerosum thinking and others do not; and some are not developed by Buchanan. This, in turn, supplies new insights into Buchanan’s project of identifying the kinds of environment that encourage his sense of moral progress. In particular, current levels of inequality become a significant barrier to moral progress not only because they create an economic form of tribalist zero-sum thinking but (...) they also undermine the scope for positive-sum. This paper reviews some of the key responses to Hahn's famous retiring remarks and argues that none has satisfactorily addressed Hahn's suggestion that a discipline does not need to consciously discuss its foundations as it can rely on an evolutionary process to select them. The paper presents a general counter to Hahn on this point which, when applied to contemporary economics, supplies a strong case for the study of methodology now. One might expect that, in pure coordination games, coordination would become less frequent as the number of options increases. Contrary to this expectation, we report an experiment which found more frequent coordination when the option set was unrestricted than when it was restricted. To try to explain this result, we develop a method for eliciting the general rules that subjects use to identify salient options in restricted and unrestricted sets. We find that each such rule, if used by all subjects, (...) would generate greater coordination in restricted sets. However, subjects tend to apply different rules to restricted and unrestricted sets. (shrink)

Mill’s classic argument for liberty requires that people’s exercise of freedom should be governed by the harm principle (MHP): that is, an action should not harm another. In this paper, we develop the concept of a Millian harm equilibrium (MHE) in _n_-person games where players maximize utility subject to the constraint of an MHP. Our main result is in the spirit of the fundamental theorems of welfare economics. We show that for every initial ‘reference point’ in a game the associated (...) MHE is Pareto efficient and, conversely, every Pareto efficient point can be supported as an MHE for some initial reference point. This is an important result for an old question in political philosophy over whether the exercise of liberty is consistent with order in society and for how we think about policy in a non-ideal world. Mark Siderits has been one of the sharpest, clearest philosophers working on Buddhism in the last several decades. His work has also been strikingly wide-ranging. In this chapter, we will focus on two themes in his work that we find particularly interesting. First, Siderits makes a strong case that Abhidharma Buddhists promote mereological nihilism – the view that only simple entities are ultimately real, and aggregates (like a chariot or a heap) are at best useful fictions. Mereological nihilism grounds (...) an argument against the existence of selves, which of course, is central to the tradition. But Siderits draws out a further, bracing conclusion from mereological nihilism – that consciousness isn’t ultimately real. We think this conclusion so antithetical to other commitments of Buddhism that it provides reason to doubt whether Buddhists should sustain the commitment to mereological nihilism. There is another important argument for the no-self view, however, Vasubandhu’s causal-efficacy argument; on this argument, real things must enter in cause-and-effect relations, and when we turn to cause-and-effect, there is no place where the self plays a necessary role. This argument informs our exploration of the second theme from Siderits – his defense of the “personalist” view that person (unlike self) is a useful fiction. We challenge this claim, first by noting that Vasubandhu himself uses the causal-efficacy argument against both selves and persons, and second by arguing that selves and persons are also on a par when it comes to whether they are useful fictions. Recent work by Joshua Knobe indicates that people’s intuition about whether an action was intentional depends on whether the outcome is good or bad. This paper argues that part of the explanation for this effect is that there are stable individual differences in how ‘intentional’ is interpreted. That is, in Knobe’s cases, different people interpret the term in different ways. This interpretive diversity of ‘intentional’ opens up a new avenue to help explain Knobe’s results. Furthermore, the paper argues that the (...) use of intuitions in philosophy is complicated by fact that there are robust individual differences in intuitions about matters of philosophical concern. This paper develops an empirical argument that the rejection of moral objectivity leaves important features of moral judgment intact. In each of five reported experiments, a number of participants endorsed a nonobjectivist claim about a canonical moral violation. In four of these experiments, participants were also given a standard measure of moral judgment, the moral/conventional task. In all four studies, participants who respond as nonobjectivists about canonical moral violations still treat such violations in typical ways on the moral/conventional task. In (...) particular, participants who give moral nonobjectivist responses still draw a clear distinction between canonical moral and conventional violations. Thus there is some reason to think that many of the central characteristics of moral judgment are preserved in the absence of a commitment to moral objectivity. (shrink)

In Political Theology the "Modern Way": The Case of Jacques Almain (d. 1515), Shaun Retallick provides the first monograph on this late medieval philosopher-theologian and conciliarist, and his thought. He demonstrates that Almain's political theology, of which ecclesiology is a sub-discipline, is strongly impacted by the Via moderna. At the heart of his political theology is the individual and his or her will. Yet, the individual is rarely viewed in isolation from others; there is a strong emphasis on community (...) and on the religious and secular bodies through which it is realized. But these bodies, including the Church, are understood in collectivist rather than corporatist terms, which tends to a quite radical form of conciliarism. (shrink)

Despite the declarations of international documents on minority language rights, provision is patchy for supporting minority languages in the UK, where since the 1980s governments have deliberately or unwittingly greatly raised the profile and comparative standing of English. The partial exception to this trend has been the treatment of indigenous/regional minority languages, stimulated by policies of devolution intended to revive or create a sense of national identity, and to redress perceived historic linguistic injustices. In a multicultural state or region these (...) apparently reasonable goals appear to conflict with current views of citizenship that argue for inclusiveness and equal treatment for all under the law. In particular, the question arises why indigenous minority languages should receive official support and funding that is denied to speakers of minority ethnic languages. In this article, I examine various justifications offered for this, including higher population levels, the geographical concentration of indigenous speakers, the long historical ties between regional language and culture, and the notion of promotional rights. I attempt to show each argument lacks force and ignores the fact of natural language change. I argue for an approach to indigenous languages that weights support and funding according to a range of factors including the number of minority speakers, their perceived need and the benefits that would flow from funding. Support from the local community and private sources could also be encouraged. (shrink)

We argue that Dienes & Perner's (D&P's) proposal needs to specify independent criteria when a subject explicitly represents factuality. This task is complicated by the fact that people typically “tacitly” believe that each of their beliefs is a fact. This problem does not arise for comparative evidence on monkeys, for they presumably lack the capacity to represent factuality explicitly. D&P suggest that explicit visual processing and declarative memory depend on explicit representations of factuality, whereas the analogous implicit processes do not (...) require such representations. Many of the implicit/explicit findings are also found in monkeys, however, and D&P's account needs to explain this striking parallel. (shrink)

For liberal political philosophers the notion of ?reasonableness? has provided a moral and legal standard for judging the acceptability and, by extension, legitimacy of government behaviour. In order for a government directive to constitute a legitimate obligation on citizens, it must be compatible with the dictates of reason and treat all citizens in a reasonable manner. Arguably, such an approach achieves its most powerful presentation (to date, at least) in the theories of ?political? liberals, who typically assert that reasonableness must (...) be the ?final court of appeal? in relation to decisions concerning matters of public import ? i.e., those that place demands upon all citizens of the polity. According to political liberals, only by adopting and maintaining a governance framework that assigns primacy to reasonableness is it possible to obtain and preserve the desired protection against the abuse of political power. The purpose of this essay is to offer a brief review of the ?reasonableness? paradigm promoted by political liberals (in particular), and in the course of doing so, identify and assess a number of difficulties that would seem to undermine its ability to achieve its stated goal. Hidden away in the remote corners of one of the largest parts of Husserl's Kˆrper, if we can use that word to translate Corpus, there is ein Leib , an animate body of text that reverberates not only with some of Husserl's other little known texts, but also with some of the most recent discoveries in neuroscience. These texts suggest a theory of intersubjectivity, or what psychologists term social cognition. Let me start with a proviso: whether Husserl ever fully settled (...) on this theory is completely open to interpretation. Accordingly, I will leave it to Husserlian scholars to determine whether this is a position that Husserl actually or ultimately embraces, either in the years 1906 through 1913 when he writes some of these texts, or later when he writes other related texts. The texts in question are from Husserl's early years and they are rather tentative and reactive in nature, since he was just beginning to think of these problems, and he was responding to proposals put forward by Lipps and Meinung. That's also why I claim that these texts suggest a theory of social cognition rather than anything like a pure phenomenology of intersubjectivity. Husserl was trying to work out ways to counter the theories of Lipps and Meinung, and his reflections, I think, should count as phenomenologically informed theory. (shrink)

The theory of hyletic data has been criticized and dismissed a number of times since Edmund Husserl proposed it early in this century. This rejection of Husserl's theory has been part of a larger, wholesale critique of the traditional notion of sensation in which theories of sensation have been displaced by theories of perception.

The medicalization of mental health remains a point of contention for bioethicists, especially as it concerns the epistemic capabilities of those diagnosed with an illness or disorder. Gosselin (2019) argues that biomedicalization commits epistemic injustices against these persons and consequently entraps them in a “cycle of vulnerability”; in response, she proposes principles of justice to defend them from such affronts. This paper builds off of her work and responds particularly to the demand for a “sociocentric view of the self as (...) essentially relational.” I present a theory of interdependent agency and affiliation that I contend conceptually bolsters her normative principles. I explain how an expanded use of relational epistemologies, united with a non-ideal theory of mental health, can enrich our hermeneutical resources with respect to those with mental illnesses/disorders. My account introduces normative considerations premised on interdependency, most notably from care theory. Concepts such as vulnerability, relational autonomy, attentiveness, and responsiveness ground a relationally-situated approach that (1) improves the epistemic positionalities of patients, (2) informs more suitable dynamics of care/treatment, and (3) unites groups of mutually interested actors against harm and injustice. I thus use a framework of care to promote affiliations of similarly disadvantaged persons under shared causes and initiatives. I refer to these assemblages as “caring affinity networks.”. (shrink)

The basis of property rights is a central problem in political philosophy. The core philosophical dispute concerns whether property rights are natural facts, independent of human conventions. In this article, we examine adult judgments on this issue. We find evidence that familiar property norms regarding external objects (e.g., fish and strawberries) are treated as conventional on standard measures of authority dependence and context relativism. Previous work on the moral/conventional distinction indicates that people treat property rights as moral rather than conventional (...) (e.g., Dahl & Waltzer, 2020; Nucci & Turiel, 1993; Tisak & Turiel, 1984). However, these studies explicitly assume that one person owns property that another steals. Study 1 explores judgments of authority dependence regarding ownership in cases that explicitly appeal to stealing and prior ownership as compared to cases that omit such explicit appeals. We find that participants tend to treat ownership as authority dependent when explicit appeals to stealing are absent, but not when the explicit appeals are present. Study 2 examines intuitions about authority dependence of ownership violations as compared to canonical conventional and harm-based moral violations. We find that ownership violations are treated as more authority dependent than harm-based moral violations. This all suggests that some central property norms are treated as conventional. However, we also find that the conventionality of property norms is restricted in several ways. In study 3, we find that people do not treat norms of self-ownership as conventional. Other people cannot take your hair or skin cells even if the teacher says it's okay. Study 4 uses a measure of context relativism to examine the conventionality of ownership norms, comparing different possible norms of ownership. We find that participants regard takings that are violations in their own culture as permissible in other cultures; however, only some foreign norms are deemed acceptable. In study 5 we find another limitation – participants think it's impermissible to take resources from someone based on a new property norm that is retrospectively imposed. Finally, in study 6 we explore whether some takings might be judged to be morally (non-conventionally) wrong as a function of scarcity. We find that when asked about another culture that allows taking, participants tend to say that taking a food item from the person who caught it is permissible when the food is plentiful, but not when the food is scarce. This paper, in opposition to the standard theories of social cognition found in psychology and cognitive science, defends the idea that direct perception plays an important role in social cognition. The two dominant theories, theory theory and simulation theory , both posit something more than a perceptual element as necessary for our ability to understand others, i.e., to “mindread” or “mentalize.” In contrast, certain phenomenological approaches depend heavily on the concept of perception and the idea that we have a direct (...) perceptual grasp of the other person’s intentions, feelings, etc. This paper explains precisely what the notion of direct perception means, offers evidence from developmental studies, and proposes a non-simulationist interpretation of the neuroscience of mirror systems. A Polish group G is tame if for any continuous action of G, the corresponding orbit equivalence relation is Borel. When [Formula: see text] for countable abelian [Formula: see text], Solecki [Equivalence relations induced by actions of Polish groups, Trans. Amer. Math. Soc. 347 (1995) 4765–4777] gave a characterization for when G is tame. In [L. Ding and S. Gao, Non-archimedean abelian Polish groups and their actions, Adv. Math. 307 (2017) 312–343], Ding and Gao showed that for such G, the (...) orbit equivalence relation must in fact be potentially [Formula: see text], while conjecturing that the optimal bound could be [Formula: see text]. We show that the optimal bound is [Formula: see text] by constructing an action of such a group G which is not potentially [Formula: see text], and show how to modify the analysis of [L. Ding and S. Gao, Non-archimedean abelian Polish groups and their actions, Adv. Math. 307 (2017) 312–343] to get this slightly better upper bound. It follows, using the results of Hjorth et al. [Borel equivalence relations induced by actions of the symmetric group, Ann. Pure Appl. Logic 92 (1998) 63–112], that this is the optimal bound for the potential complexity of actions of tame abelian product groups. In this paper we consider the importance of trust, in the context of economic institutions, and specifically with respect to questions about market mechanisms and the role of social interactions. We review recent advances in institutional economics closely tied to developments in philosophy of mind and cognitive science, involving extended and enactive cognition. We argue that the analysis of different conceptions of institutional mind extension, in Denzau and North’s shared mental models, Clark’s extended mind, and a more enactive approach that (...) emphasizes the importance of social interaction and personal relationships, can benefit from Kathrine Hawley’s distinction between reliability and trust. Institutional arrangements based solely on the reliability of impersonal mechanisms can lead to a variety of social pathologies and, at the extreme, a form of cognitive atrophy, all of which can undermine the sustainability of institutions. Even if trust comes with risks and some degree of unpredictability, it turns out to be a necessary glue-like ingredient in the constitution of social institutions. (shrink)

Is it lawful for a doctor to give a patient life-shortening pain relief? Can treatment be lawfully provided to a child under 16 on the basis of her consent alone? Is it lawful to remove food and water provided by tube to a patient in a vegetative state? Is a woman's refusal of a caesarean section recommended for the benefit of the fetus legally decisive? These questions were central to the four focal cases revisited in this book. This book revisits (...) nine landmark cases. For each, a new leading judgment is attributed to an imagined judge, Athena, who operates within the constraints of the legal system of England and Wales. Her judgments accord with an innovative legal theory, referred to as 'modified law as integrity', and are linked as a line of precedent. The result is a re-spinning of extant judicial threads into a web of legal principles with a greater claim to coherence and defensibility than those in the original cases. A recent Massachusetts bill seeks to incentivize living organ donation among the state’s incarcerated population by offering volunteers reduced sentences. While the incentive has been removed from the bill, the bill remains controversial. This essay argues that insofar as carceral conditions unduly motivate incarcerated people to participate, living organ donation in prison remains a morally hazardous initiative. The essay suggests that the pervasiveness of medical neglect in Massachusetts prisons not only makes organ donation unsafe but it also implicitly renders the (...) lives of those outside of prison more valuable than those inside. This falls short of Catholic teaching on human dignity. Drawing from the history of medical experimentation in US prisons, the essay posits how the state might unduly influence incarcerated people to become living donors by preying on their moral sentiments. In such instances, the self-gift of organ donation can be understood as a kind of exploited or coerced kenosis. (shrink)

The meaningful consideration of cultural practices, values and beliefs is a necessary component in the effective translation of advancements in neuroscience to clinical practice and public discourse. Society’s immense investment in biomedical science and technology, in conjunction with an increasingly diverse socio-cultural landscape, necessitates the study of how potential discoveries in neurodegenerative diseases such as Alzheimer disease are perceived and utilized across cultures. Building on the work of neuroscientists, ethicists and philosophers, we argue that the growing field of neuroethics provides (...) a pragmatic and constructive pathway to guide advancements in neuroscience in a manner that is culturally nuanced and relevant. Here we review a case study of one issue in culturally oriented neuroscience research where it is evident that traditional research ethics must be broadened and the values and needs of diverse populations considered for meaningful and relevant research practices. A global approach to neuroethics has the potential to furnish critical engagement with cultural considerations of advancements in neuroscience. (shrink)

Williams (1970) argues that our intuitions about personal identity vary depending on how a given thought experiment is framed. Some frames lead us to think that persistence of self requires persistence of one's psychological characteristics; other frames lead us to think that the self persists even after the loss of one's distinctive psychological characteristics. The current paper takes an empirical approach to these issues. We find that framing does affect whether or not people judge that persistence of psychological characteristics is (...) required for persistence of self. Open-ended, abstract questions about what is required for survival tend to elicit responses that appeal to the importance of psychological characteristics. This emphasis on psychological characteristics is largely preserved even when participants are exposed to a concrete case that yields conflicting intuitions over whether memory must be preserved in order for a person to persist. Insofar as our philosophical theory of personal identity should be based on our intuitions, the results provide some support for the view that psychological characteristics really are critical for persistence of self. Sentimental Rules is an ambitious and highly interdisciplinary work, which proposes and defends a new theory about the nature and evolution of moral judgment. In it, philosopher Shaun Nichols develops the theory that emotions play a critical role in both the psychological and the cultural underpinnings of basic moral judgment. Nichols argues that our norms prohibiting the harming of others are fundamentally associated with our emotional responses to those harms, and that such 'sentimental rules' enjoy an advantage in cultural (...) evolution, which partly explains the success of certain moral norms. This has sweeping and exciting implications for philosophical ethics. Nichols builds on an explosion of recent intriguing experimental work in psychology on our capacity for moral judgment and shows how this empirical work has broad import for enduring philosophical problems. The result is an account that illuminates fundamental questions about the character of moral emotions and the role of sentiment and reason in how we make our moral judgments. This work should appeal widely across philosophy and the other disciplines that comprise cognitive science. (shrink)
