This paper offers an economic analysis of one aspect of the possible liability for incorrect information traded on information markets: expert liability for incorrect asset valuation. The article does not address the questions of whether and under what circumstances an expert should bear contractual liability for an incorrect valuation. Rather, it assumes such contractual liability towards the person who has solicited the opinion and focuses instead on analyzing the circumstances under which the expert’s liability should be extended to third parties (...) as well. Three levels of trust as a social psychological construct are delineated: trust in a specific person (relational trust), trust in people in general (generalised trust) and trust in abstract systems. Whereas much research is available on relational trust and generalized trust, much less is known about trust in systems. From theory and research several assumptions are derived which are related to the development of trust in the Internet. For example, the reliability of information technology is assumed to be directly related (...) to the development of trust in the Internet. In addition, it is assumed that in situations in which it is hard to verify the justification for trust, people construct subjective beliefs which represent a transformation of relational trust into system trust. Applications of these assumptions for strengthening the trustworthiness of the Internet are discussed. (shrink)

The placozoan Trichoplax adhaerens is a tiny hairy plate and more simply organized than any other living metazoan. After its original description by F.E. Schulze in 1883, it attracted attention as a potential model for the ancestral state of metazoan organization, the “Urmetazoon”. Trichoplax lacks any kind of symmetry, organs, nerve cells, muscle cells, basal lamina, and extracellular matrix. Furthermore, the placozoan genome is the smallest (not secondarily reduced) genome of all metazoan genomes. It harbors a remarkably rich diversity of (...) genes and has been considered the best living surrogate for a metazoan ancestor genome. The phylum Placozoa presently harbors three formally described species, while several dozen “cryptic” species are yet awaiting their description. The phylogenetic position of placozoans has recently become a contested arena for modern phylogenetic analyses and view‐driven claims. Trichoplax offers unique prospects for understanding the minimal requirements of metazoan animal organization and their corresponding malfunctions. (shrink)

Here in part 2 we discuss the exceptional genetics of the phylum Placozoa and point out some challenging model system applications for the best known species, Trichoplax adhaerens.

This essay introduces the political thought of Hans G. Ulrich as it is presented in his seminal work Wie Geschöpfe leben. What sets Ulrich's thought apart from most other authors in the field is that his interest is not in an account of community or citizenship, but in the status politicus — the political form of existence that is bestowed on human beings as God's creatures who are called to be `ruled by the spirit' instead of succumbing to any (...) form of rule by which human beings exert dominion over human beings. Drawing from Biblical sources and a fresh reading of Luther's doctrine of the two regimes in the spirit of the Confessing Church, Ulrich arrives at a highly emancipative account of political existence that does not derive its rationale from the necessity for co-existence or common action, but from the liberation from `ungodly ties' that prevent people from free discourse and cooperation. The first English translation of Hans Reichenbach's lucid doctoral thesis sheds new light on how Kant’s Critique of Pure Reason was understood in some quarters at the time. The source of several themes in his still influential The Direction of Time, the thesis shows Reichenbach's early focus on the interdependence of physics, probability, and epistemology.

This volume provides the first English translation of Hans Kelsen's and Carl Schmitt's influential Weimar-era debate on constitutional guardianship and the legitimacy of constitutional review. It includes Kelsen's seminal piece, 'The Nature and Development of Constitutional Adjudication', as well as key extracts from the 'Guardian of the Constitution' which present Schmitt's argument against constitutional review. Also included are Kelsen's review of Schmitt's 'Guardian of the Constitution', as well as some further material by Kelsen and Schmitt on presidential dictatorship under (...) Article 48 of the Weimar Constitution. These texts show Kelsen and Schmitt responding to one another, in the context of a debate focused on a concrete constitutional crisis, thus allowing the reader to assess the plausibility of Kelsen's and Schmitt's legal and constitutional theories. The problem of joint measurement of incompatible observables is investigated. Measurements are represented by positive operator-valued measures. A quantitative notion of inaccuracy is defined. It is shown that within this framework joint inaccurate measurements are possible for arbitrary maximal projection-valued measures on finite-dimensional spaces. The accuracy of such measurements is limited, as is shown by an inaccuracy inequality we derive. This new type of uncertainty relation can be unambiguously interpreted as referring to measurement precision rather than preparative quality. Rethinking politics in a new vocabulary, Hans Sluga challenges the firmly held assumption that there exists a single common good which politics is meant to realize. He argues that politics is not a natural but a historical phenomenon, and not a single thing but a multiplicity of political forms and values only loosely related. He contrasts two traditions in political philosophy: a 'normative theorizing' that extends from Plato to John Rawls and a newer 'diagnostic practice' that emerged with Marx (...) and Nietzsche and has found its three most prominent twentieth-century practitioners in Carl Schmitt, Hannah Arendt, and Michel Foucault. He then examines the sources of diagnostic political thinking, analyzes its achievements, and offers a critical assessment of its limitations.
