OBJECTIVES: To identify the factors that influence the assessment of reported cases of physician-assisted death by members of the public prosecution. DESIGN/SETTING: At the beginning of 1996, during verbal interviews, 12 short case-descriptions were presented to a representative group of 47 members of the public prosecution in the Netherlands. RESULTS: Assessment varied considerably between respondents. Some respondents made more "lenient" assessments than others. Characteristics of the respondents, such as function, personal-life philosophy and age, were not related to the assessment. Case (...) characteristics, i.e. the presence of an explicit request, life expectancy and the type of suffering, strongly influenced the assessment. Of these characteristics, the presence or absence of an explicit request was the most important determinant of the decision whether or not to hold an inquest. CONCLUSIONS: Although the presence of an explicit request, life expectancy and the type of suffering each influenced the assessment, each individual assessment was dependent on the assessor. The resulting danger of legal inequality and legal uncertainty, particularly in complicated cases, should be kept to a minimum by the introduction of some form of protocol and consultation in doubtful or boundary cases. The notification procedure already promotes a certain degree of uniformity in the prosecution policy. (shrink)

The essence of the correspondence between Arendt and Scholem can be said to lie in three things. Above all it provides an intimate account of how two great intellectuals try to come to terms with being both German and Jewish, and how to think about Germany before, during, and after the Holocaust. They also debate the issue of what it means to be Jewish in the post-Holocaust world whether in New York or in Jerusalem. Finally, the specter of Benjamin haunts (...) the work and in a sense the letters are as much about Benjamin as the other two questions since his life and tragic death epitomize them both. Arendt and Scholem's letters on these weighty questions are lightened by more routine exchanges: on travel itineraries, lunch or dinner parties where important people were present, and so forth. These daily details are woven throughout the correspondence and provide vivid biographical information about Arendt and Scholem that is unavailable in any other source. (shrink)

I defend the normativity of meaning against recent objections by arguing for a new interpretation of the ‘ought’ relevant to meaning. Both critics and defenders of the normativity thesis have understood statements about how an expression ought to be used as either prescriptive or semantic. I propose an alternative view of the ‘ought’ as conveying the primitively normative attitudes speakers must adopt towards their uses if they are to use the expression with understanding.

In adaptive sports (also known as Para sports, disability sports, or Paralympic sports), athletes are assigned to classes that indicate their functional potential, regardless of talent, training, or experience. The aim of the present study among wheelchair basketball athletes (n = 141) was to explore the role of functional classification as a potential stressor. Specifically, we looked into the anecdotal relationship between classification and athletes' concern about “performing in accordance with one's class”. Based on a serial mediation research model, we (...) examined the links between functional classification and three outcome variables (i.e., cognitive worry, somatic arousal, and game performance) through the mediator variables of perceived competitive demands and sport-specific self-efficacy. Unexpectedly, we did not find any evidence of a classification effect on either the mediator variables or competitive anxiety. However, we did find positive correlations between functional classification and athletes' contribution to their team's score, which align with research supporting the proportionality and the validity of the functional classification system. Moreover, regardless of classification, mediation analyses revealed an indirect link between perceived competitive demands and cognitive worry through sport-specific self-efficacy. These findings suggest that, regardless of classification, athletes' self-efficacy may be increased by managing their appraisals of competitive demands and that their cognitive worries may be reduced by self-efficacy interventions. Language maps signals onto meanings through the use of two distinct types of structure. First, the space of meanings is discretized into categories that are shared by all users of the language. Second, the signals employed by the language are compositional: The meaning of the whole is a function of its parts and the way in which those parts are combined. In three iterated learning experiments using a vast, continuous, open-ended meaning space, we explore the conditions under which both structured (...) categories and structured signals emerge ex nihilo. While previous experiments have been limited to either categorical structure in meanings or compositional structure in signals, these experiments demonstrate that when the meaning space lacks clear preexisting boundaries, more subtle morphological structure that lacks straightforward compositionality—as found in natural languages—may evolve as a solution to joint pressures from learning and communication. Behavioral ethics research has focused predominantly on how the attributes of individuals influence their ethicality. Relatively neglected has been how macro-level factors such as the behavior of firms influence members’ ethicality. Researchers have noted specifically that we know little about how a firm’s CSR influences members’ behaviors. We seek to better merge these literatures and gain a deeper understanding of the role macro-level influences have on manager’s ethicality. Based on agency theory and social identity theory, we hypothesize that a company’s (...) commitment to CSR shifts managers’ focus away from self-interests toward the interests of the firm, bolstering resistance to temptation. We propose this occurs through self-categorization and collective identification processes. We conduct a 2 × 2 factorial experiment in which managers make expense decisions for a company with commitment to CSR either present or absent, and temptation either present or absent. Results indicate that under temptation, managers make decisions consistent with self-interest. More importantly, we find when commitment to CSR is present, managers are more likely to make ethical decisions in the presence of temptation. Overall, this research highlights the interactive role of two key contextual factors—temptation and firm CSR commitment—in influencing managers’ ethical decisions. While limited research has highlighted the positive effects that a firm’s CSR has on its employees’ attitudes, the current results demonstrate CSR’s effects on ethical behavior and imply that through conducting and communicating its CSR efforts internally, firms can in part limit the deleterious effects of temptation on managers’ decisions. By examining a broad sweep of pedagogical and philosophical material from antiquity to the late seventeenth century, Dr Dawson explains why language caused anxiety in writers such as Montaigne, Bacon, Descartes, Hobbes, Gassendi, Nicole, Pufendorf, Boyle, Malebranche and Locke. The authors argue in favor of the “nonconciliation” (or “steadfast”) position concerning the problem of peer disagreement. Throughout the paper they place heavy emphasis on matters of phenomenology—on how things seem epistemically with respect to the net import of one’s available evidence vis-à-vis the disputed claim p, and on how such phenomenology is affected by the awareness that an interlocutor whom one initially regards as an epistemic peer disagrees with oneself about p. Central to the argument is a nested goal/sub-goal (...) hierarchy that the authors claim is inherent to the structure of epistemically responsible belief-formation: pursuing true beliefs by pursuing beliefs that are objectively likely given one’s total available evidence; pursuing this sub-goal by pursuing beliefs that are likely true (given that evidence) relative to one’s own deep epistemic sensibility; and pursuing this sub-sub-goal by forming beliefs in accordance with one’s own all-in, ultima facie, epistemic seemings. During the last fifteen years or so there has been much debate, among philosophers interested in perception, on the question of whether the representational content of perceptual experience is conceptual or nonconceptual. Recently, however, a number of philosophers have challenged the terms of this debate, arguing that one of its most basic assumptions is mistaken. Experience, they claim, does not have representational content at all. On the kind of approach they suggest, having a perceptual experience is not to be understood (...) on the model of thought or belief, as a matter of the subject's taking things in the world to be this or that way, or of having this or that feature. Nor is it to be understood on the model of receiving testimony about how things are in the world, as a matter of its being represented to us that things are this or that way. Rather, it is simply a matter of our being presented with things. Having a perceptual experience of an object is a matter of our standing in a certain kind of relation to it which makes it available to us to be represented in thought or belief, but which does not itself involve our representing it, or its being represented to us.1 Much of the motivation for rejecting the view that experience has representational content springs from a concern to do justice to what is distinctive about perceptual experience in contrast to thought and belief. In particular, perceptual experience seems to be more "primitive" than thought, in that it seems natural to appeal to the character of perceptual experience to explain the possibility of thought about objects rather than the other way around. Recent advances in stem cell research suggest that in the future it may be possible to create eggs and sperm from human stem cells through a process that we term in vitro gametogenesis (IVG). IVG would allow treatment of some currently untreatable forms of infertility. It may also allow same-sex couples to have genetically-related children. For example, cells taken from one man could potentially be used to create an egg, which could then be fertilised using naturally produced sperm from another (...) man to create a genetically-related child with half of its DNA from each of the men. In this chapter, we consider whether this technology could justifiably be denied to same-sex couples if it were made available as a fertility treatment to different-sex couples. While previous research has established that virtual reality (VR) can be successfully used in the treatment of anxiety disorders, including phobias and PTSD, no research has examined changes in brain patterns associated with the use of VR for generalized anxiety management. In the current study, we compared a brief nature-based mindfulness VR experience to a resting control condition on anxious participants. Self-reported anxiety symptoms and resting-state EEG were recorded across intervals containing quiet rest or the VR intervention. EEG activity was (...) analyzed as a function of global power shifts in Alpha and Beta activity, and with sLORETA current source density estimates of cingulate cortex regions of interest. Results demonstrated that both a quiet rest control condition and the VR meditation significantly reduced subjective reports of anxiety and increased Alpha power. However, the VR intervention uniquely resulted in shifting proportional power from higher Beta frequencies into lower Beta frequencies, and significantly reduced broadband Beta activity in the anterior cingulate cortex. These effects are consistent with a physiological reduction of anxiety. This pilot study provides preliminary evidence supporting the therapeutic potential of VR for anxiety management and stress reduction programs. (shrink)

I criticize recent nonconceptualist readings of Kant’s account of perception on the grounds that the strategy of the Deduction requires that understanding be involved in the synthesis of imagination responsible for the intentionality of perceptual experience. I offer an interpretation of the role of understanding in perceptual experience as the consciousness of normativity in the association of one’s representations. This leads to a reading of Kant which is conceptualist, but in a way which accommodates considerations favoring nonconceptualism, in particular the (...) primitive character of perceptual experience relative to thought and judgment. Each of the books that Hannah Arendt published in her lifetime was unique, and to this day each continues to provoke fresh thought and interpretations. This was never more true than for Eichmann in Jerusalem, her account of the trial of Adolf Eichmann, where she first used the phrase “the banality of evil.” Her consternation over how a man who was neither a monster nor a demon could nevertheless be an agent of the most extreme evil evoked derision, outrage, (...) and misunderstanding. The firestorm of controversy prompted Arendt to readdress fundamental questions and concerns about the nature of evil and the making of moral choices. Responsibility and Judgment gathers together unpublished writings from the last decade of Arendt’s life, as she struggled to explicate the meaning of Eichmann in Jerusalem. At the heart of this book is a profound ethical investigation, “Some Questions of Moral Philosophy”; in it Arendt confronts the inadequacy of traditional moral “truths” as standards to judge what we are capable of doing, and she examines anew our ability to distinguish good from evil and right from wrong. We see how Arendt comes to understand that alongside the radical evil she had addressed in earlier analyses of totalitarianism, there exists a more pernicious evil, independent of political ideology, whose execution is limitless when the perpetrator feels no remorse and can forget his acts as soon as they are committed. Responsibility and Judgment is an essential work for understanding Arendt’s conception of morality; it is also an indispensable investigation into some of the most troubling and important issues of our time. It argues that our entitlement to regard nature as teleological is not established by the argument of the ’Antinomy’, but rather results from our entitlement to regard the workings of our own cognitive faculties in normative terms. This implies a view of the relation between biological teleology and the representational character of mind (...) which is the reverse of that adopted by naturalistic theorists of mind like Fred Dretske and Ruth Millikan. Over the past decade, institutional theory has been extensively utilized in the field of social entrepreneurship (SE). However, an encompassing overview of the wide-ranging applications of institutional theory to SE is lacking, potentially hampering academic advances in this domain. To fill this gap, we conduct a systematic review and supplementary bibliometric analysis of 148 papers published between 2008 and 2022 to comprehensively understand the nexus of SE and institutional theory while also outlining the integration of ethics herein. Our analysis shows (...) that the existing research is divided into three clusters, reflecting three unique conversations between SE and institutional theory: institutional and societal change through SE, institutional complexity and hybrid organizations, and the institutional context of SE. We find that ethics is only integrated into these conversations to a limited degree. Based on our analysis, we zoom in on each conversation to identify the existing research gaps and point to new opportunities for future research. We also encourage SE scholars to zoom out on the abovementioned conversations to enrich this promising field by critically examining ethics and incorporating relevant insights from other research fields (i.e., social movement theory, category, and emotions). Background:The belief that we can control our thoughts is not inevitably adaptive, particularly when it fuels mental control activities that have ironic unintended consequences. The conviction that the mind can and should be controlled can prompt people to suppress unwanted thoughts, and so can set the stage for the intrusive return of those very thoughts. An important question is whether or not these beliefs about the control of thoughts can be reduced experimentally. One possibility is that behavioral experiments aimed at (...) revealing the ironic return of suppressed thoughts might create a lesson that could reduce unrealistic beliefs about the control of thoughts. Aims: The present research assessed the influence of the thought suppression demonstration on beliefs about the control of thoughts in a non-clinical sample, and among individuals with obsessive-compulsive disorder (OCD). Method: In Study 1, we assessed the effect of the thought suppression demonstration on beliefs about the control of thoughts among low and high obsessive individuals in the non-clinical population (N= 62). In Study 2, we conducted a similar study with individuals with OCD (N= 29). Results: Results suggest that high obsessive individuals in the non-clinical population are able to learn the futility of suppression through.. (shrink)

This article presents a model for regulating cognitive enhancement devices. Recently, it has become very easy for individuals to purchase devices which directly modulate brain function. For example, transcranial direct current stimulators are increasingly being produced and marketed online as devices for cognitive enhancement. Despite posing risks in a similar way to medical devices, devices that do not make any therapeutic claims do not have to meet anything more than basic product safety standards. We present the case for extending existing (...) medical device legislation to cover CEDs. Medical devices and CEDs operate by the same or similar mechanisms and pose the same or similar risks. This fact coupled with the arbitrariness of the line between treatment and enhancement count in favour of regulating these devices in the same way. In arguing for this regulatory model, the paper highlights potential challenges to its implementation, and suggests solutions. (shrink)

There is preliminary evidence, from case reports and investigational studies, to suggest that Deep Brain Stimulation could be used to treat some patients with Anorexia Nervosa. Although this research is at an early stage, the invasive nature of the intervention and the vulnerability of the potential patients are such that anticipatory ethical analysis is warranted. In this paper, we first show how different treatment mechanisms raise different philosophical and ethical questions. We distinguish three potential mechanisms alluded to in the neuroscientific (...) literature, relating to desire, control, and emotion, respectively. We explain why the precise nature of the mechanism has important implications for the patient’s autonomy and personal identity. In the second part of the paper, we consider practical dimensions of offering DBS to patients with AN in certain cases. We first discuss some limited circumstances where the mere offering of the intervention might be perceived as exerting a degree of coercive pressure that could serve to undermine the validity of the patient’s consent. Finally, we consider the implications of potential effects of DBS for the authenticity of the patient’s choice to continue using stimulation to ameliorate their condition. (shrink)

This new translation is an extremely welcome addition to the continuing Cambridge Edition of Kant’s works. English-speaking readers of the third Critique have long been hampered by the lack of an adequate translation of this important and difficult work. James Creed Meredith’s much-reprinted translation has charm and elegance, but it is often too loose to be useful for scholarly purposes. Moreover it does not include the first version of Kant’s introduction, the so-called “First Introduction,” which is now recognized as indispensable (...) for an understanding of the work. Werner Pluhar’s more recent translation, which does include the First Introduction, is highly accurate when it confines itself to rendering Kant’s German. However, it is often more of a reconstruction than a translation, containing so many interpretative interpolations that it is often difficult to separate out Kant’s original text from the translator’s contributions. Paul Guyer and Eric Matthews have provided a translation that compares to or exceeds Pluhar’s in its literal approach to the German, but that confines all interpretative material to footnotes and endnotes, so that the text itself, with all its unclarities and ambiguities, lies open to view. In addition, Guyer, as editor of the volume, has provided a great deal of valuable supplementary material. This includes an introduction with an outline of the work and details of the history of its composition and publication, and a wealth of endnotes offering clarifications of the text, background information, and, most strikingly, many references to related passages in Kant’s voluminous writings, particularly in connection with Kant’s earlier writings related to aesthetics. The edition also records differences among the first three editions of the work, and—of particular interest—erasures from and additions to Kant’s manuscript of the First Introduction. Although the introduction and endnotes reflect interpretative views that are sometimes disputable, this supplementary material makes the present edition into a valuable resource even for those able to read the text in German. In this interview, Boris Groys discusses his key cultural-theoretical ideas, positions his thought in relation to debates on the cultural economy and clarifies questions emerging from his work. The conversation focuses on his untranslated cultural-theoretical contributions, notably Über das Neue [On the New] and Topologie der Kunst [Topology of Art], but also touches on his writings available in English, for example Art Power. The interview contains three sections. The first revisits Groys’s challenge to the postmodern claim about the end of (...) cultural innovation. He problematizes this claim with reference to the current rise of digital archives and the loss of individual and collective memory. Groys goes on to elucidate the centrality of the ready-made method to cultural innovation. Cultural activity, he argues, constitutes a ritual which promises immortality in a world of perpetual change. Finally, Groys clarifies and illustrates the questions guiding his phenomenological investigation of the ‘scene of evidence’ and the ‘mode of suspicion’. The second section is dedicated to the topology of culture in 21st-century capitalism. Groys sets out from his observation of the privatization and fragmentation of archival space. Humanity is entering a ‘new virtual Middle Age’, where individuals are engaged in a series of self-installations, travelling through a string of heterogeneous valorizing spaces. The ‘chance’ of genuine art in these conditions lies in its withdrawal from exchange. As inexchangeable ‘commodity corpses’ demanding eternal preservation, artworks can provocatively indicate the possibility of a ‘life after capitalism’. His considerations also lead Groys to discuss his notion of Soviet Communism as an installation in pursuit of the wish to ‘step out of time’. The third section centres on the problems of politics and critique. Responding to a question about the political potential of art, Groys proposes consideration of the increasing intensity — presently illustrated by the conflict in the Middle East — with which politics acts in the realm of aesthetics. The interview closes with reflections on the possibility of intellectual resistance. Referring to Nietzsche and Adorno, Groys locates the potential of opposition in a resentful critique of time: a ‘rejection of everything’ and the insistence upon the possibility that what is will vanish.
