A major purpose of this book is to make the post-Hamblin work on fallacies available to a wider audience in a single, convenient volume.

Hamblin held that the conception of 'fallacy' as an argument that seems valid but is not really so was the dominant conception of fallacy in the history of fallacy studies. The present paper explores the extent of support that there is for this view. After presenting a brief analysis of 'the standard definition of fallacy,' a number of the definitions of 'fallacy' in texts from the middle of this century – from the standard treatment – are considered. This is followed (...) by a review of the definitions of 'fallacy' in the earlier history of logic books, including those of Aristotle, Whately, Mill and De Morgan. The essay concludes that there is scarcely any support for Hamblin's view that this particular definition of 'fallacy' was widely held. (shrink)

Medieval philosophers had a predilection for using the correlative pair father and son as an illustrative example in their discussions of relations. The use of this example has sometimes led to charges of confusion on the grounds that fatherhood and sonship are not proper converses. The present article shows how a group of twelfth-century philosophers from the milieu around the logician Alberic of Paris handled the problems arising from the use of this illustrative example which they had inherited from their (...) ancient and late-ancient predecessors. An anthology of the most important historical sources, classical and modern, on the subjects of presumptions and burdens of proof In the last fifty years, the study of argumentation has become one of the most exciting intellectual crossroads in the modern academy. Two of the most central concepts of argumentation theory are presumptions and burdens of proof. Their functions have been explicitly recognized in legal theory since the middle ages, but their pervasive presence in all forms of argumentation and in (...) inquiries beyond the law--including politics, science, religion, philosophy, and interpersonal communication--have been the object of study since the nineteenth century. However, the documents and essays central to any discussion of presumptions and burdens of proof as devices of argumentation are scattered across a variety of remote sources in rhetoric, law, and philosophy. Presumptions and Burdens of Proof: An Anthology of Argumentation and the Law brings together for the first time key texts relating to the history of the theory of presumptions along with contemporary studies that identify and give insight into the issues facing students and scholars today. The collection's first half contains historical sources and begins with excerpts from Aristotle's Topics and goes on to include the locus classicus chapter from Bishop Whately's crucial Elements of Rhetoric as well as later reactions to Whately's views. The second half of the collection contains contemporary essays by contributors from the fields of law, philosophy, rhetoric, and argumentation and communication theory. These essays explore contemporary understandings of presumptions and burdens of proof and their role in numerous contexts today. This anthology is the definitive resource on the subject of these crucial rhetorical modes and will be a vital resource to all scholars of communication and rhetoric, as well as legal scholars and practicing jurists. This essay attempts to give definitions and identity conditions for the two predominant senses of ‘Argument’ currently in use, the one involving reasons for a conclusion and the other denoting an expressed disagreement with ensuing verbal behaviour by two parties. I see Johnson's new concept of ‘Argument’, as developed in his book Manifest Rationality, as a hybrid of the two common senses of ‘Argument’, and, accordingly, I try to define and give the identity conditions of Johnson-arguments. Finally, I disagree with (...) Johnson on the nature of the definition he thinks he has proposed, and I conclude with observations suggesting that his logical perspective has dialectical and rhetorical components. (shrink)

This paper is a report of a pilot study of how candidates argue when they are running for political office. The election studied was the provincial election in Ontario, Canada, in the fall of 2011. Having collected about 250 arguments given during the election from newspaper media, we sought answers to the following questions, among others: which argumentation schemes have the greatest currency in political elections? Is a list of the best known argumentation schemes sufficient to classify the arguments given (...) in elections? What schemes should be added to the familiar list to make it more adequate for studying elections? Is it useful to classify arguments as being used for positive, policy-critical, person-critical and defensive purposes? Can political parties be usefully characterized by noting their preferred kinds of arguments and their most frequent uses of arguments? What lessons can be learned from this study to better design future studies of the same kind? (shrink)

This presentation seeks to understand informal logic as a set of methods for the logical evaluation of natural language arguments. Some of the methods identified are the fallacies method, deductivism, warrantism and argument schemes. A framework for comparing the adequacy of the methods is outlined consisting of the following categories: learner- and user-efficiency, subjective and objective reliability, and scope. Within this framework, it is also possible to compare informal and formal logic.

In this introductory article we explore the relationship between statehood and governance, examining in more detail how non-state actors like MNCs, international NGOs, and indigenous authorities, often under conditions of extreme economic scarcity, ethnic diversity, social inequality and violence, take part in the making of rules and the provision of collective goods. Conceptually, we focus on the literature on Areas of Limited Statehood and discuss its usefulness in exploring how business-society relations are governed in the global South, and beyond. Building (...) on insights from this literature, among others, the four articles included in this special issue provide rich illustrations and critical reflections on the multiple, complex and often ambiguous roles of state and non-state actors operating in contemporary Syria, Nigeria, India and Palestine, with implications for conventional understandings of CSR, stakeholders, and related conceptualizations. Richard Whately’s views of arguments involving authority are very different in his Elements of Rhetoric and his Elements of Logic. This essay begins by documenting these differences and wondering why they are. It then proceeds to take a broader and more historical view of Whately’s discussions of authority and finds him occupying an important developmental ground between his predecessor Locke and contemporary views of the argument from authority. Auxiliary condition of the methods of informal logic is Argument scheme / argumentative scheme and one of the most studied of the schemes is the one for Argument from Authority, also called Appeal to Expertise.

This special issue grew out of a small conference The Known & the Unknown: Exploring Twelfth-Century Philosophy, which was funded by the Carlsberg Foundation, hosted by the Saxo Institute, and held at the University of Copenhagen in April 2018. Its central topic was the many, mostly unexplored, commentaries on Aristotle, Boethius, and Porphyry that constitute the key textual evidence for a fascinating phenomenon that, although it played a pivotal role in the philosophical revival of Western Europe, remains frustratingly underexplored to (...) this day: the logical schools of the twelfth century. The present introduction has two parts. In the first part, John Marenbon lays out the background to this special issue of Vivarium as a whole, explaining both what the philosophical project pursued by twelfth-century logicians was and how, and how far, the historical project of understanding it has progressed over the last two hundred years. Problem: Medical student mistreatment, as well as patient and staff mistreatment by all levels of medical trainees and faculty, is still prevalent in U.S. clinical training. Largely missing in interventions to reduce mistreatment is acknowledgement of the abuse of power produced by the hierarchical structure in which medicine is practiced. Approach: Beginning in 2001, Yale School of Medicine has held annual “Power Day” workshops for third year medical students and advanced practice nursing students, to define and analyse power dynamics within (...) the medical hierarchy and hidden curriculum using literature, guest speakers, and small groups. During rotations, medical students write narratives about the use of power witnessed in the wards. In response to student and small group leader feedback, workshop organizers have developed additional activities related to examining and changing the use of power in clinical teams. Outcome: Emerging narrative themes included the potential impact of small acts and students feeling “mute” and “complicit” in morally distressing situations. Small groups provided safe spaces for advice, support, and professional identity formation. By 2005, students recognized residents that used power positively with Power Day awards and alumni served as keynote speakers on the use of power in medicine. By 2010, departments including OB/GYN, surgery, psychiatry, and paediatrics, had added weekly team Power Hour discussions. Next Steps: The authors highlight barriers, benefits, and lessons learned. Barriers include the notion of clinical irrelevance and resistance to the word “power” due to perceived accusation of abuse. Benefits include promoting open dialogue about power, fostering inter-professional collaboration, rewarding positive role modelling by residents and faculty, and creating a network of trainee empowerment and leadership. Furthermore, faculty have started to ask that issues of power be addressed in a more transparent way at their level of the hierarchy as well. (shrink)

This symposium of the Journal of Bioethical Inquiry illustrates structural competency: how clinical practitioners can intervene on social and institutional determinants of health. It will require training clinicians to see and act on structural barriers to health, to adapt imaginative structural approaches from fields outside of medicine, and to collaborate with disciplines and institutions outside of medicine. Case studies of effective work on all of these levels are presented in this volume. The contributors exemplify structural competency from many angles, from (...) the implications of epigenetics for environmental intervention in personalized medicine to the ways clinicians can act on fundamental causes of disease, address abuses of power in clinical training, racially desegregate cities to reduce health disparities, address the systemic causes of torture by police, and implement harm-reduction programs for addiction in the face of punitive drug laws. Together, these contributors demonstrate the unique roles that clinicians can play in breaking systemic barriers to health and the benefit to the U.S. healthcare system of adopting innovations from outside of the United States and outside of clinical medicine. Computer programs costing thousands of research dollars are now copied in an instant. People who would recoil at the thought of stealing cars, computers, or VCRs regularly steal software or copy their favorite music from a friend's CD. Since the Web has no national boundaries, these issues are international concerns. The contributors-philosophers, (...) legal theorists, and business scholars, among others-address questions such as: Can abstract ideas be owned? How does the violation of intellectual property rights compare to the violation of physical property rights? Can computer software and other digital information be protected? And how should legal systems accommodate the ownership of intellectual property in an information age? Building on conceptual insights from the history and sociology of numbers, media and surveillance studies, and theories of governance and risk, this article analyzes the forms of transparency produced by the use of numbers in social life. It examines what it is about numbers that often makes their ‘truth claims’ so powerful, investigates the role that numerical operations play in the production of retrospective, real-time and anticipatory forms of transparency in contemporary politics and economic transactions, and discusses some of the (...) implications resulting from the increasingly abstract and machine-driven use of numbers. It argues that the forms of transparency generated by machine-driven numerical operations open up for individual and collective practices in ways that are intimately linked to precautionary and pre-emptive aspirations and interventions characteristic of contemporary governance. As such, these numerical operations raise important political and ethical questions that deserve further conceptual and empirical scrutiny. (shrink)

This bibliography of literature on the fallacies is intended to be a resource for argumentation theorists. It incorporates and sup- plements the material in the bibliography in Hansen and Pinto’s Fallacies: Classical and Contemporary Readings, and now includes over 550 entries. The bibliography is here present- ed in electronic form which gives the researcher the advantage of being able to do a search by any word or phrase of interest.

In order to enhance the “structural competency” of medicine—the capability of clinicians to address social and institutional determinants of their patients’ health—physicians need a theoretical lens to see how social conditions influence health and how they might address them. We consider one such theoretical lens, fundamental cause theory, and propose how it might contribute to a more structurally competent medical profession. We first describe fundamental cause theory and how it makes the social causes of disease and health visible. I begin by looking at passages in Mill's System of Logic that circumscribe the range of logic as he understood the subject. His logic is clearly too narrow to be the arbiter of the extended arguments presented in his Utilitarianism, On Liberty, and The Subjection of Women. Looking at Mill's argumentative practice in those works we see that he is noticeably concerned to deal with objections, more so even than in giving arguments for his position. His practice is shown to (...) be consistent with his professed views about how opinions outside science and mathematics are to be justified. These views are stated primarily in On Liberty where Mill gives a standard of justification and proclaims the importance of dealing with objections as part of that standard. Given Mill's characterization of an art, or practice - also found in the Logic - it turns out that a case can be made that Mill's views on argumentation fit the criteria for an art, pretty much on a par with ethics as an art. In the sense that I give to 'argumentation theory' it seems entirely appropriate to say that implicitly Mill held a theory of argumentation, a theory distinct from other proposed theories of argumentation, and a theory worth further study and development. In a recent paper, “One Logician’s Perspective on Argumentation”, van Benthem expressed his reservations on Toulmin’s diagnosis and abandonment of formal logic, and argued that Toulmin was wrong for leading the study of argumentation apart from formal approach. In this paper we will try to reveal two se-rious misunderstandings of Toulmin’s ideas in his discussions, and thereby make an apology for Toulmin.

In Argumentation Theory: A Pragma-Dialectical Perspective (2018), Professor van Eemeren suggests that it might be worthwhile for pragma-dialectics and informal logic to join forces, given that there is a “considerable amount of common ground” between the two. In this paper, we explore that common ground by considering both the ways logic is understood and incorporated in the pragma-dialectical model and the ways informal logic has developed since its inception in the 1970s. In the process of our investigation, we present a (...) view of the landscape of argumentation in which the subject matter of informal logic is situated relative to theories of argumentation. If Sophroniscus is the father of Socrates, then Socrates is the son of Sophroniscus. If Socrates is similar to Plato, then Plato is similar to Socrates. But how many relations does Sophroniscus and Socrates being so related involve? How many does Plato and Socrates being thus related? Is there a difference between the two cases? These are questions that have featured prominently in discussions of relations in recent years, but they are by no means new. Focusing on a text by (...) the later Archbishop of Canterbury, Robert Kilwardby, this paper explores some of the replies and main arguments advanced by a number of philosophers working in the Latin west in the mid-to-late thirteenth century. Recently, two apparently quite different duality-based approaches to automata minimisation have appeared. One is based on ideas that originated from the controllability-observability duality from systems theory, and the other is based on ideas derived from Stone-type dualities specifically linking coalgebras with algebraic structures derived from modal logics. In the present paper, we develop a more abstract view and unify the two approaches. We show that dualities, or more generally dual adjunctions, between categories can be lifted to dual adjunctions between categories (...) of coalgebras and algebras, and from there to automata with initial as well as final states. As in the Stone-duality approach, algebras are essentially logics for reasoning about the automata. By exploiting the ability to pass between these categories, we show that one can minimize the corresponding automata. We give an abstract minimisation algorithm that has several instances, including the celebrated Brzozowski minimisation algorithm. We further develop three examples that have been treated in previous works: deterministic Kripke frames based on a Stone-type duality, weighted automata based on the self-duality of semimodules, and topological automata based on Gelfand duality. As a new example, we develop alternating automata based on the discrete duality between sets and complete atomic Boolean algebras. (shrink)

Der forskes stadig i Aristoteles verden over, men moderne fortolkere drager kun sjældent nytte af den rige ældre tradition. Denne bog beskriver og sammenligner fortolkningsmetoder og publikationsstrategier hos skolastikerne og nutidens aristotelikere. Der argumenteres for, at dele af den gamle metodik (...) med fordel kunne genoptages, og det vises, at der i konkrete tilfælde kan findes værdifulde fortolkningsforslag, som ikke ses i den nyere litteratur. This article concerns existents as a contentious issue in contemporary Abelardian scholarship. More precisely, it concerns the ontological standing of forms in Abelard’s metaphysics. Take, for example, the apple on my desk. What ontological standing does its redness have? Is it an actual entity over and above the apple or is it in some sense “reducible” to it? Abelard, famously, was a nominalist, so the question is not about some purported universal redness. Rather, it is about the particular redness of (...) the particular apple on my desk. The issue is contentious in that the best current accounts of Abelard’s metaphysics disagree strongly about how to answer this question. Here, rather than focusing on Abelard’s own writings – which so far have yielded no definitive answer – I will consider some anonymously transmitted and mainly unedited logical texts from the twelfth century and show how his contemporaries understood Abelard’s view and how the followers of his philosophical nemesis, Alberic of Paris, reacted to it. This appearance condition of fallacies refers to the phenomenon of weak arguments, or moves in argumentation, appearing to be okay when really they aren’t. Not all theorists agree that the appearance condition should be part of the conception of fallacies but this essay explores some of the consequences of including it. In particular, the differences between committing a fallacy, causing a fallacy and observing a fallacy are identified. The remainder of the paper is given over to discussing possible causes of (...) mistakenly perceiving weak argumentation moves as okay. Among these are argument caused misperception, perspective caused misperception, discursive environment caused misperception and perceiver caused misperception. The discussion aims to be sufficiently general so that it can accommodate different models and standards of argumentation that make a place for fallacies. (shrink)

This short essay is an introduction to the essays included in this special issue of Argumentation devoted to fallacies.

"The twelve chapters of this volume all began their existence as contributions to workshops held between 2009 and 2011 by a Danish-Swedish research network called The Aristotelian Tradition: The reception of Aristotle's works on logic and metaphysics in the Middle Ages, headquartered in Gothenburg and funded by the Bank of Sweden Tercentenary Foundation. Most of them were written by members of the network, some by invited speakers. While the volume amply illustrates the set of scholarly approaches characteristic of the "Copenhagen (...) School of Medieval Philosophy" (notably a strong philological foundation and an interest in ancient as well as medieval and Greek as well as Latin texts), its thematic diversity reflects the network's breadth of interests. What unites the chapters in this respect is simply a concern with different historical manifestations of Aristotelian thought on logical and metaphysical matters. The volume includes studies of texts by, among others, Apuleius, Boethius, Anonymus Aurelianensis III, Michael of Ephesus, Averroes, Anonymus Cantabrigiensis, Nicholas of Paris, Robert Kilwardby, Anonymus O, Thomas Aquinas, William of Ockham, and Francisco Suárez, relating to themes and passages in Aristotle's Categories, On Interpretation, Prior Analytics 1, Posterior Analytics 1, Sophistical Refutations and Metaphysics A and Z. The last two chapters consist of a new edition, with English translation and commentary, of the first part of a fiercely anti-Aristotelian work, which has been described as the starting-point for Renaissance Platonism and Aristotelianism alike: George Gemistos Plethon's On Aristotle's Departures from Plato."--. Is Plato’s philosophy still relevant for current issues in politics and political science? In order to answer this question, the contributions to this volume endeavour to re-read the Platonic dialogues and to interpret them in terms of textual hermeneutics on the one hand. On the other hand, they refer to Plato from a systematic point of view and apply his philosophy, in particular the method of Socratic dialogue, to discussions on contemporary political issues.
