“The Avoidance of Love” is Cavell’s magic looking glass onto Shakespeare, where the idea of missing something, not getting what is obvious, is, on Cavell’s reading, very close to a philosophical obsession. Shakespeare here means—besides Lear—Othello, Coriolanus, Hamlet, The Winter’s Tale, and Antony and Cleopatra, and what Cavell finds in these plays is an attempt to think through what elsewhere, in the formation of the modern philosophical tradition, was getting formulated as the problem of skepticism, or not being able to (...) know that we know . It is not easy to say what this means. As if executing a skeptical decorum, Cavell’s writing does not try for transparency, nor does it always coincide with itself, and anyhow Shakespeare is not so much an object as a region of Cavell’s thinking, so everyday readers are apt to find themselves a bit at sea with him. Without claiming to match Cavell’s views point for point, I would like to give something like a para-Cavellian commentary that tries to say what his thinking, with respect to Shakespeare, seems to be getting at, and also where it leaves us.Gerald L. Bartley’s pancritical rationalism is seen by some as being a refinement of Popper’s critical rationalism. I contest this view and argue that pancritical rationalism is obtained from critical rationalism by removing some of its most important and useful features. The remainder consists of a restatement of some of Popper’s key ideas and an interpretation of others that I attempt to show is not entirely faithful to what Popper says.

ABSTRACTOrganization and management researchers praise the value of care in the workplace. However, they overlook the conflict between caring for work and for coworkers, which resonates with the dilemma of care allocation highlighted by ethicists of care. Through an in-depth qualitative study of two organizations, we examine how this dilemma is confronted in everyday organizational life. We draw on the concept of boundary work to explain how employees negotiate the boundary of their caring responsibilities in ways that grants or denies (...) care to coworkers. We argue that the possibility of an ethics of care for coworkers requires boundary work that suspends the separation of personal and professional selves and constitutes the worker as a whole person. We contribute to research on care in organizations by showing how care for coworkers may be enabled or undermined by maintaining or suppressing the care allocation dilemma. (shrink)

The present article commences analyzing the origins and influences of the religious discourse on the configuration of the modern constitutional discourse and the contributions of the jus-positivism in the consolidation of this sacred-civil language. The second issue is the definition of the U.S. Constitution as a mixed and not as a democratic constitution, with regard to the influences of Plato, Aristotle, Cicero and Polybius to the Drafters of the first modern constitutional text; stability and equilibrium took preference over democracy in (...) a wide sense. Postema is critically concerned with whether Dworkin commits himself to individualistic and privatistic sense of interpretation and how Dworkin articulates the logical independency of pre-interpretive paradigm instances or social facts which form the object of interpretation and the end which is interpretively posited in the act of interpretation. Criticisms, for the most part, appear to be compatible with Dworkin's overall theory and may simply be additional explication of the character (...) of interpretation. Physicians are frequently consulted by people with physical symptoms that, after having ruled out an "organic" pathology, we suspect they are related to the most frequent psychological conditions in the usual consultation: the various forms of reaction to severe stress (Acute Stress Reaction and Adjustment Disorder, from ICD 11), "functional" pathologies, burn out syndrome, and anxiety disorders, especially Generalized Anxiety Disorder, with or without associated depression. They are usually given a brief explanation about these problems and how they affect their (...) health, given a brochure, or suggested a website with information. And then they are encouraged to visit a mental health practitioner. But there are some challenges to this seemingly simple scenario:Not all patients are ready or willing to hear that their health problem might be related to their life or emotions. Many are strongly influenced by mind-body dualism. Others have an intuition that such a relationship exists but bringing that to consciousness is not an easy process, because it can awaken emotions that are difficult to handle. This is quite frequent in people suffering chronic anxiety (DSM-5 Generalized Anxiety Disorder) who prefer to consult medical providers rather than psychologists (Wittchen H. The first segment starts with a definition of two dimensions of the concept of rule of law; related to the notion of sovereignty and as a concept to control arbitrariness on the part of the ruler. The segment proceeds to give a historical account of the notion and the different stages of its epistemological configuration, from the ancient Greek notion of Eunomia and its incompatibility with the popular rule to the current notion, where the rule of law has become fused (...) with democracy and human rights. The first segment also focuses on the relation between the concept of the rule of law and other principles, such as proportionality, neutrality, and effectiveness. The second segment of the paper analyses the phenomenon of juridification of the rule of law in international treaties and domestic constitutions. It pays particular attention to the role that constitutional accommodation plays in the process of rationalization of the rule of law as a prerequisite to its idealization and mystification. It analyses the reason why this principle is an essential feature of the constitutionalism despite the inner plurality of legal systems. The next aspect, analysed in the third segment of this paper, is the messianic use of the concept of the rule of law. The paper performs a critical definition of messianic, covering a theological perspective and the different theories and concepts that go hand in hand with the idea of the Messiah, such as the “coming”, prophetical and apocalyptical messianism, the phenomena of eschatology, expiation and redemption pictured in Judaism. The segment also covers the secular transplantation of the messianic thought. Current nanotechnology regulation is focussed on risks. On the other hand, technical guidelines and other soft law tools are increasingly replacing hard law. This risk reduction approach does not seem to be fully aligned with open principles like sustainable nanotechnology. Indeed, risk optimization tends to be rather a continuous process than a way to settle ultimate lists of risks. There is therefore a need for a more dynamic view: Life cycle assessment contributes to add momentum and context to the models. (...) However, a complementary perspective is here suggested, based on information technologies: nanotechnology platforms. Platforms for nanotechnology governance are supposed to complement and enhance the nano-regulation, adding risk assessment and management. These platforms are mainly offering information, coordination, and context or situational awareness. More recently, some informal platforms appear to play a, certainly limited but still clear, co-regulatory role. Can these informal platforms play a relevant role in nanotechnology governance? In the context of the EU Better Regulation strategy, why not envision some of these informal platforms as future co-regulation tools? The main goal of this paper is to start a discussion on the requirements these informal co-regulatory platforms should fulfill before their hypothetical inclusion in a future better regulation toolbox. Act-utilitarianism comes in two standard varieties: ‘subjective’ act-utilitarianism, which tells agents to attempt to maximize utility directly, and ‘objective’ act-utilitarianism, which permits agents to use non-utilitarian decision-making procedures. This article argues that objective actutilitarianism is exposed to a dilemma. On one horn of it is the contention that objective act-utilitarianism makes inconsistent claims about the rightness of acts. On the other horn of it is the contention that objective act-utilitarianism collapses back into what is, essentially, subjective act-utilitarianism. Three objective act-utilitarian (...) responses to this dilemma are explored and rejected. The recommended conclusion is that a consistent utilitarian must either embrace subjective act-utilitarianism, or abandon act-utilitarianism altogether. Its main contribution lies in a genealogical perspective, grounded in the development of mental concept attribution, from a realist standpoint. To this extent, its most original contribution is the idea of a second-person perspective, that of intersubjective interaction, as the way through which one gets involved in the mental realm. The key to this inversion is the central role Carruthers assigns to language in the architecture of the mind, in spite of his defense of a version of the massive modularity hypothesis: as a ground for qualitative consciousness and for flexible thought. Rawlsian liberalism is best understood and defended on the basis of a concrete but widely shared ideal of the person as a rational agent capable of normative self?determination in the proper political and economic conditions. In Rawls? recent works, this neo?Kantian ideal of free moral personality is no longer understood as a requirement of rational or moral agency as such, but is a concrete historical ideal or meta?value presupposed by the living tradition of liberal?democratic judgment and practice, which reason can (...) recover through a critical reflection upon this tradition. Read in this way, Rawls? theory of social justice articulates a quite powerful, rational, concrete, historical, and social dimension of modern political identity, which the critics of liberalism cannot plausibly deny. But there are other rival, powerful bourgeois?individualist and patriarchal ideals of personhood, equally rooted in modern political judgments and practices, which Rawlsian liberalism ignores, and which taken together generate the social tensions, instabilities, and conflicts of social justice characteristic of modern liberal?democratic society. Rawlsian theory and liberal political thought requires but essentially lacks a conception of moral reason adequate to comprehend and mediate these normative incoherences built into modern Western political identity. A larger more adequate paradigm of moral reason and political theory is required to overcome these deficiencies. (shrink)

This paper states that modern education and utopian discourse share one common trait, that of being structurally founded on the promise of human betterment. The changing relations between concepts of education and utopianism will be developed through conceptual analysis of the dynamics of the promise in their interweaving process. This shall be discussed through three main topics. The first is the appropriation of space in early modern education (sixteenth century onward), with particular emphasis on the influence of print technology on (...) framing a new conception of educational spaces and practices. Second, the promise of the idea of progress in the Enlightenment period, which will become the further technological promise of a society-to-come, no longer spatially but temporally presented. Finally, the promise of autonomy through and against the modern subject, in which such autonomy is presented like the end of the journey through education, supposed that there is an end to such a journey. The key frame uniting the three topics is that utopian discourse journeying towards a normative conception of human society, as well as modern educational schemes journeying towards a normative conception of adulthood, are limited insofar as their respective promises, which are more impatient than the slow project of creation, more than often outruns it. The paper thus inquires whether or not there is a way to uphold the creative and imaginative possibilities of utopia in education, by acknowledging the pervasive effects of the promise on the social imaginary. The text relates these two concepts to movements in religious and political thought, beginning with Locke's views on faith and reason before going through various areas and finishing with the beginnings of Romanticism. The age of the Enlightenment is seen as constituted, on the one hand, by an attempt to relate all significant intellectual movements to reason and, on the other, (...) an attempt to devise proper restraints on the authority of reason. The “systematicity argument” has been used to argue for a classical cognitive architecture (Fodor in The Language of Thought. Harvester Press, London, 1975, Why there still has to be a language of thought? In Psychosemantics, appendix. MIT Press, Cambridge, pp 135–154, 1987; Fodor and Pylyshyn in Cognition 28:3–71, 1988; Aizawa in The systematicity arguments. Kluwer Academic Press, Dordrecht, 2003). From the premises that cognition is systematic and that the best/only explanation of systematicity is compositional structure, it concludes that cognition is (...) to be explained in terms of symbols (in a language of thought) and formal rules. The debate, with connectionism, has mostly centered on the second premise-whether an explanation of systematicity requires compositional structure, which neural networks do not to exhibit (for example, Hadley and Hayward, in Minds and Machines, 7:1–37). In this paper, I will take issue with the first premise. Several arguments will be deployed that show that cognition is not systematic in general; that, in fact, systematicity seems to be related to language. I will argue that it is just verbal minds that are systematic, and they are so because of the structuring role of language in cognition. A dual-process theory of cognition will be defended as the best explanation of the facts. (shrink)
