Les etudes leibniziennes consacrees au droit positif, telles que le De Conditionibus de 1665, sont encore mal connues pour des raisons d'accessibilite et de complexite. En effet, ecrites en latin, impregnees de references prelevees dans le Corpus justinien (Digeste, Codex et Institules) ou dans le Droit Canonique (Decretales et Extravagantes) et souvent hermetiques dans leur abstraction apparente, elles ont ete delaissees au profit des reflexions jusnaturalistes dont la lecture ne semblait pas requerir les competences d'un juriste et encore moins celle (...) d'un romaniste. Mais on a ainsi occulte des travaux qui representent un apport essentiel pour toute philosophie pretendant depasser l'utilisation superficielle des principes du Droit Naturel dans la question du fondement des legislations positives. Et l'on s'est prive, sans le savoir, des moyens techniques de reconnaitre les diverses manifestations d'une raison commune dans le detail du systeme des obligations conditionnelles. Bien plus, on a totalement meconnu la vigueur et l'actualite d'une enquete portant sur les conditions de validite des dispositions juridiques affectes d'une modalite et soulevant en definitive ces questions esentielles que sont la constituion d'une theorie generale des conditions juridiques, la rationalisation du Droit et les limites de son traitement deductif. We want to defend three claims: Firstly, we will argue that children’s vulnerability is best understood as a dynamic quality, meaning that as children progress through childhood, their vulnerability also undergoes particular changes. To capture this, we want to discriminate among physical, mental, social, and symbolic vulnerability, which vary according to certain features, such as age, maturity, gender, and race. (...) These different traits are furthermore important in order to understand what we owe children from an ethical perspective. In a nutshell, children have moral claims not to be harmed and to be protected against threats to their well-being and well-becoming, and these claims have to be explicated via the dynamic vulnerability of children. Finally, we will argue that one of the main issues is to balance the protection of children and their autonomy claims, which both enhance and diminish their vulnerability. | : Cet article examine la vulnérabilité particulière des enfants d’un point de vue éthique. Nous défendrons trois thèses. Gottfried looks at Schmitt as a critic of modern liberalism and as a defender of the national state who carefully examined Western historical and political traditions. Challenging the view that Schmitt was a mere polemicist who set out to subvert "German Democracy", Gottfried's work argues instead, that Schmitt criticized liberal democracy from a highly liberal reflective position that combined analytical depth with staggering erudition. This new source also provides a useful bibliography on secondary literature dealing with Carl Schmitt's work.

This paper is concerned with child poverty from an ethical perspective and applies the normative concept of vulnerability for this purpose. The first part of the paper will briefly outline children’s particular vulnerability and distinguish important aspects of this. Then the concept will be applied to child poverty and it will be shown that child poverty is a corrosive situational vulnerability, with many severe consequences. In this part of the paper normative reasoning and empirical literature will be brought together. Then, (...) the next section will establish why this increased vulnerability of poor children and the harm to their well-being and well-becoming, which they suffer for this reason, are of ethical concern. It will be discussed that child poverty is a structural problem based on social, political and economic factors. The concluding section will then briefly outline why it is imperative to protect children from the vulnerabilities associated with poverty. (shrink)

Johann Gottfried Herder (1744–1803) gehört unangefochten zu den Klassikern der europäischen Geistesgeschichte. Seinen Lebensunterhalt verdiente er im Predigeramt, seine erste Anstellung nach dem Studium im ostpreußischen Königsberg fand er in Riga. Hier in Livland beginnt ein homiletisches Schaffen, das ihn über seine Lebensstationen hinweg bis nach Weimar beschäftigen wird. Die vorliegende Edition erschließt erstmals vollständig Herders Predigtnachlaß, zunächst für die erste Epoche seines Wirkens. Sie umfaßt die Zeit bis Mai 1769, ediert sämtliche erhaltenen Predigten aus der Rigaer Periode, weist verlorene (...) Texte nach und berücksichtigt auch die Entwürfe aus Schul- und Studienzeit, die bis etwa 1758 zurückgehen. One oft the most fascinating abilities of humans is the ability to become conscious of the own physical and mental states. In this systematic investigation of self-consciousness, a representational theory is developed that is able to distinguish between different levels of self-consciousness. The most basic levels are already present in such simple animals as ants. From these basic forms, which are also relevant for adult human self-consciousness, high-level self-consciousness including self-knowledge can arise. Thereby, the theory is not only able to (...) integrate developmental considerations but also to sharply distinguish different aspects of the complex phenomenon self-consciousness. Pathological breakdowns of these different aspects, as they can be found in schizophrenia, are explained by specific impairments on different levels of self-representation. In this way, the work shows that a naturalistic theory of self-consciousness is possible, if the analysis starts with very simple and basic mechanisms instead of starting on the »top of the iceberg«. The comparator-model, originally developed to explain motor action, has recently been invoked to explain several aspects of the self. However, in the first place it may not be used to explain a basic self-world distinction because it presupposes one. Our alternative account is based on specific systematic covariation between action and perception. Secondly, the comparator model cannot explain the feeling of ownership of thoughts. We argue—contra Frith and Campbell—that thoughts are not motor processes and therefore cannot be described by the (...) comparator-model. Rather, thoughts can be the triggering cause (intention) for actions. An alternative framework for the explanation of thought insertion in schizophrenics is presented. (shrink)

Gottfried Achenwall, _Prolegomena to Natural Law_, ed. Pauline Kleingeld, trans. Corinna Vermeulen. Groningen: University of Groningen Press, 2020. Open Access, available via the 'direct download' link below. This is the first English translation of _Prolegomena iuris naturalis_ by Gottfried Achenwall (1719–1772). In this book, Achenwall presents the philosophical foundation for his comprehensive theory of natural law. The book is of interest not only because it provides the basis for a careful, systematic, and well-respected eighteenth-century theory of natural law in the (...) Leibniz-Wolffian tradition, but also because it sheds important light on the work of Immanuel Kant. Achenwall’s work influenced Kant’s legal and political philosophy as well as his ethics, and it is indispensable for understanding Kant’s _Feyerabend Lectures on Natural Law_ and his _Metaphysics of Morals_. In this paper I am interested in the question of whether and why states should prioritize child refugees over adult refugees in cases where they are not able to grant refuge to all those who are entitled to it. In particular I discuss three grounds on which such a prioritization could be based: (a) vulnerability, (b) efficiency and (c) life phase and life span. As can be shown, these grounds also apply, to some extent, to particular groups of adults such (...) as women, the elderly, or people with special needs. Based on this I conclude that states should invest significant resources into filtering out those who are the most needy and vulnerable although there are several limitations to doing that. Only if such a selection process were impossible, or so costly and time-consuming that it would result in significantly fewer refugees being admitted, would states have good moral reasons to prioritize children without further screening. In the New Essays on Human Understanding, Leibniz argues chapter by chapter with John Locke's Essay Concerning Human Understanding, challenging his views about knowledge, personal identity, God, morality, mind and matter, nature versus nurture, logic and language, and a host of other topics. The work is a series of sharp, deep discussions by one great philosopher of the work of another. Leibniz's references to his contemporaries and his discussions of the ideas and institutions of the age make this a fascinating (...) and valuable document in the history of ideas. The work was originally written in French, and the version by Peter Remnant and Jonathan Bennett, based on the only reliable French edition (published in 1962), first appeared in 1981 and has become the standard English translation. It has been thoroughly revised for this series and provided with a new and longer introduction, a chronology on Leibniz's life and career and a guide to further reading. (shrink)

The most defensible justifications of war in the European intellectual tradition hold that war is instrumentally necessary for the maintenance of peace and order. An investigation of Ancient Chinese philosophical attitudes towards war calls this assumption into question. The closest parallel to an instrumental concept of war is found in the Legalist school, but historical experience in China has rejected this. The Confucian school, especially Mencius and Xunxi, insists that war is not instrumental in creating social order, but derives from (...) the prior establishing of cultural and political authority, and thus must be punitive in nature. Even the use of “punitive expeditions” is not instrumental, but rather demonstrative or performative in nature, for if coercive methods are necessary, the authority to use them is arguably absent. War for the Chinese, then, is not justified by the necessity for creating public order, but is in itself a sign of the failure to achieve such an order. This contrasts sharply with the views of the dominant Western thinkers on war, such as Michael Walzer, whose positions insist upon the instrumental necessity of armed force, even to the point of absurdity. The ancient Chinese position suggests that this necessity may be ungrounded. (shrink)

This volume contains more than 60 original translations of papers written by the German philosopher Gottfried Wilhelm Leibniz (1646-1716). As well as contributing to Leibniz scholarship, it is intended to function as an introductory text for students.

Protogaea, an ambitious account of terrestrial history, was central to the development of the earth sciences in the eighteenth century and provides key philosophical insights into the unity of Gottfried Wilhelm Leibniz’s thought and writings. In the book, Leibniz offers observations about the formation of the earth, the actions of fire and water, the genesis of rocks and minerals, the origins of salts and springs, the formation of fossils, and their identification as the remains of living organisms. Protogaea also includes (...) a series of engraved plates depicting the remains of animals—in particular the famous reconstruction of a “fossil unicorn”—together with a cross section of the cave in which some fossil objects were discovered. Though the works of Leibniz have been widely translated, Protogaea has languished in its original Latin for centuries. Now Claudine Cohen and Andre Wakefield offer the first English translation of this central text in natural philosophy and natural history. Written between 1691 and 1693, and first published after Leibniz’s death in 1749, Protogaea reemerges in this bilingual edition with an introduction that carefully situates the work within its historical context.
