Religion within the Boundaries of Mere Reason is a key element of the system of philosophy which Kant introduced with his Critique of Pure Reason, and a work of major importance in the history of Western religious thought. It represents a great philosopher's attempt to spell out the form and content of a type of religion that would be grounded in moral reason and would meet the needs of ethical life. It includes sharply critical and boldly constructive discussions on topics (...) not often treated by philosophers, including such traditional theological concepts as original sin and the salvation or 'justification' of a sinner, and the idea of the proper role of a church. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. We introduce a sequent calculus B for a new logic, named basic logic. The aim of basic logic is to find a structure in the space of logics. Classical, intuitionistic, quantum and non-modal linear logics, are all obtained as extensions in a uniform way and in a single framework. We isolate three properties, which characterize B positively: reflection, symmetry and visibility. A logical constant obeys to the principle of reflection if it is characterized semantically by an equation binding it with (...) a metalinguistic link between assertions, and if its syntactic inference rules are obtained by solving that equation. All connectives of basic logic satisfy reflection. To the control of weakening and contraction of linear logic, basic logic adds a strict control of contexts, by requiring that all active formulae in all rules are isolated, that is visible. From visibility, cut-elimination follows. The full, geometric symmetry of basic logic induces known symmetries of its extensions, and adds a symmetry among them, producing the structure of a cube. Rational beliefs and actions are typically evaluated against certain benchmarks, e.g., those of classical logic or probability theory. Rationality therefore is traditionally taken to involve some sort of reasoning, which in turn implies contentful cognition. Radically Enactive views of Cognition, on the other hand, claim that not all cognition is contentful. In order to show that rationality does not need to lie outside of REC’s scope of radicalizing cognition, I develop a Radically Enactive notion of Rationality, according to which rationality (...) is embodied, situated and contentless. For RER, an organism acts rationally insofar as it sustains a proficient interaction with its environment, which in turn requires the coordination of cognitive abilities in accordance with environmental constraints. Rationality is thus distinguished from reasoning, for reasoning is understood as a capacity to coordinate representational cognitive abilities. (shrink)

Definition of the problem Biomedical research based on big data offers immense benefits. Large multisite research that integrates large amounts of personal health data, especially genomic and genetic data, might contribute to a more personalized medicine. This type of research requires the transfer and storage of highly sensitive data, which raises the question of how to protect data subjects against data harm, such as privacy breach, disempowerment, disenfranchisement, and exploitation. As a result, there is a trade-off between reaping the benefits (...) of big-data-based biomedical research and protecting data subjects’ right to informational privacy. Arguments Blockchain technologies are often discussed as a technical fix for the abovementioned trade-off due to their specific features, namely data provenance, decentralization, immutability, and access and governance system. However, implementing blockchain technologies in biomedical research also raises questions regarding consent, legal frameworks, and workflow integration. Hence, accompanying measures, which I call enablers, are necessary to unleash the potential of blockchain technologies. These enablers are innovative models of consent, data ownership models, and regulatory models. Conclusion Blockchain technologies as a technical fix alone is insufficient to resolve the aforementioned trade-off. Combining this technical fix with the enablers outlined above might be the best way to perform biomedical research based on big data and at the same time protect the informational privacy of data subjects. . I will argue that the concept of law is a normative notion, irreducible to any factual description. Its conceptual function is that of relating certain properties a norm may possess to the conclusion that the norm is legally binding, namely, that it deserves to be endorsed and applied in legal reasoning. Legal validity has to be distinguished from other, more demanding, normative ideas, such as moral bindingness or legal optimality.

Pretopologies were introduced in [S], and there shown to give a complete semantics for a propositional sequent calculus BL, here called basic linear logic, as well as for its extensions by structural rules,ex falso quodlibetor double negation. Immediately after Logic Colloquium '88, a conversation with Per Martin-Löf helped me to see how the pretopology semantics should be extended to predicate logic; the result now is a simple and fully constructive completeness proof for first order BL and virtually all its extensions, (...) including the usual, or structured, intuitionistic and classical logic. Such a proof clearly illustrates the fact that stronger set-theoretic principles and classical metalogic are necessary only when completeness is sought with respect to a special class of models, such as the usual two-valued models.To make the paper self-contained, I briefly review in §1 the definition of pretopologies; §2 deals with syntax and §3 with semantics. The completeness proof in §4, though similar in structure, is sensibly simpler than that in [S], and this is why it is given in detail. In §5 it is shown how little is needed to obtain completeness for extensions of BL in the same language. Finally, in §6 connections with proofs with respect to more traditional semantics are briefly investigated, and some open problems are put forward. (shrink)

Telemedicine is a complex field including various applications and target groups. Especially telehealthcare is seen by many as a means to revolutionize medicine. It gives patients the opportunity to take charge of their own health by using self-tracking devices and allows health professionals to treat patients from a distance. To some, this means an empowerment of patient autonomy as well as an improvement in the quality of care. Others state the dangers of depersonalization of medicine and the pathologization of daily (...) life. This paper examines the ethical implications of telehealthcare, focusing on patient autonomy and quality of care by analyzing metareviews, randomized controlled trials and narrative ethical analyses on the topic. As a result, we conclude that the technically enhanced encounter between patients and health professionals may mean an empowerment of patient autonomy when it goes along with a personal relationship based on trust, assistance and support. When it comes to the quality of care, telehealthcare may lead to an improvement as long it is adopted to the patient’s individual needs. (shrink)

In this paper, we consider the nature of two aspects of human emotional experience—moods and affects—in their relation to the concept of the person. We argue for the importance of the concept of the person in an approach to human emotional experience. This paper differentiates between the concepts of minimal self, extended self, and person. Furthermore, it offers a phenomenological proposal to understand the feeling dimension of moods and affects as critical for the differentiation of human emotional experience, and hence (...) an understanding of that experience. By way of conclusion, we opt for a narrative approach to the question of the normative dimension of emotional experience to clarify the intricate relationship between mood and personhood. (shrink)

In this study, we use temporally aligned word embeddings and a large diachronic corpus of English to quantify language change in a data-driven, scalable way, which is grounded in language use. We show a unique and reliable relation between measures of language change and age of acquisition (AoA) while controlling for frequency, contextual diversity, concreteness, length, dominant part of speech, orthographic neighborhood density, and diachronic frequency variation. We analyze measures of language change tackling both the change in lexical representations and (...) the change in the relation between lexical representations and the words with the most similar usage patterns, showing that they capture different aspects of language change. Our results show a unique relation between language change and AoA, which is stronger when considering neighborhood-level measures of language change: Words with more coherent diachronic usage patterns tend to be acquired earlier. The results support theories positing a link between ontogenetic and ethnogenetic processes in language. (shrink)

This paper considers the nature of schizophrenic autism and urges its importance for understanding the phenomenological core of schizophrenia. Different clinical manifestations of schizophrenic autism are demonstrated, and it is asked whether these might reflect different aspects of one underlying phenomenologically intelligible phenomenon. Four phenomenological hypotheses are put forward: that autism is a function of semantic drifting, emotional drifting, ontological incompleteness, or a particular ethic rejecting common sense. By way of conclusion an integrative hypothesis is considered: that autism is intelligible (...) in terms of the experience of disembodiment. (shrink)

Thomas Reid presented a two-dimensional geometry of the visual field in his Inquiry into the Human Mind (1764). The axioms of this geometry are different from those of Euclidean plane geometry. The ‘geometry of visibles’ is the same as the geometry of the surface of the sphere, described without reference to points and lines outside the surface itself. In a recent article, James Van Cleve has argued that Reid can secure a non-Euclidean geometry of visibles only at the cost of (...) abandoning his direct realist theory of perception, and reintroducing sense-data. The question will be reexamined by considering two aspects of Reid’s theory of vision: the claim that we do not directly perceive distance by sight and Reid’s characterization of visible figure as a partial notion of an external object. In this paper, the ontological, terminological, epistemological, and ethical aspects of omission are considered in a coherent and balanced framework, based on the idea that there are omissions which are actions and omissions which are non-actions. In particular, we suggest that the approach to causation which best deals with omission is Mackie's INUS conditional proposal. We argue that omissions are determined partly by the ontological conditional structure of reality, and partly by the interests, beliefs, and values of observers. The final (...) upshot is that moral judgments involved in cases of omissions cannot be grounded on, but are the ground for judgments about what INUS conditions count as omissions. (shrink)

This article models legal interpretation through argumentation and provides a logical analysis of interpretive arguments, their conflicts, and the resulting indeterminacies. Interpretive arguments are modelled as defeasible inferences, which can be challenged and defeated by counterarguments and be reinstated through further arguments. It is shown what claims are possibly (defensibly) or necessarily (justifiably) supported by the arguments constructible from a given interpretive basis, i.e., a set of interpretive canons coupled with reasons for their application. It is finally established under what (...) conditions such arguments provide single outcomes or rather support alternative interpretive conclusions, thus leading to propositions of law whose truth‐value is undetermined. AgeTech involves the use of emerging technologies to support the health, well-being and independent living of older adults. In this paper we focus on how AgeTech based on artificial intelligence (AI) may better support older adults to remain in their own living environment for longer, provide social connectedness, support wellbeing and mental health, and enable social participation. In order to assess and better understand the positive as well as negative outcomes of AI-based AgeTech, a critical analysis of ethical design, digital (...) equity, and policy pathways is required. A crucial question is how AI-based AgeTech may drive practical, equitable, and inclusive multilevel solutions to support healthy, active ageing. In our paper, we aim to show that a focus on equity is key for AI-based AgeTech if it is to realize its full potential. We propose that equity should not just be an extra benefit or minimum requirement, but the explicit aim of designing AI-based health tech. This means that social determinants that affect the use of or access to these technologies have to be addressed. We will explore how complexity management as a crucial element of AI-based AgeTech may potentially create and exacerbate social inequities by marginalising or ignoring social determinants. We identify bias, standardization, and access as main ethical issues in this context and subsequently, make recommendations as to how inequities that stem form AI-based AgeTech can be addressed. Objetiva-se mostrar que a filosofia crítica comporta uma refutação integral da analogia técnica operada por Descartes. Para tanto, após apresentar a pertinência do tema da analogia em relação aos movimentos gerais da _Crítica_, utilizamo-la para interpretar o debate moderno acerca da razão dos animais. Posteriormente, acompanhamos a consolidação da noção kantiana da analogia a partir dos cursos de _Lógica _e centramo-nos, em seguida, na _Crítica da Faculdade de Julgar Teleológica_, a qual abriga uma reelaboração do conceito de arte, bem como (...) a refutação da tese cartesiana dos animais-máquina. A partir dela, pretendendo mostrar tanto as razões pelas quais Kant a rejeita, como o modo pelo qual ele a leva à contradição, sinalizamos que Descartes inconscientemente supõe o contrário do que gostaria de provar. Permeando essa discussão, esforçamo-nos por bem situar as teses do texto em relação ao próprio sistema da _Crítica_, segundo o tema da analogia. (shrink)

Definition of the problemThe options of reproductive medicine are expanding. In some cases, it is unclear whether there is a medical indication for applying procedures of assisted reproduction or whether this application is wish-fulfilling. The distinction between medical indication and wish fulfilment depends on the concept of indication. Thus, the concept of indication has a special status in reproductive medicine. The distinction between medical indication and wish-fulfilling treatment is mostly based on implicit or explicit normative judgements, rather than on mere (...) clinical facts. The use of “indicated” suggests a purely empirical-clinical judgment, whereas the normative judgements behind the concept are concealed. The aim of this paper is to analyze the normative implications of indication in reproductive medicine. Therefore, the concept of indication and its special status within reproductive medicine is scrutinized.ArgumentsThe analysis shows that the normative implications of indication are tied to a sociocultural script of parenthood, which manifests in the regulations of reimbursement. This script encompasses societal views, norms, and role models, and can be described as “good parenting”. The script of good parenting acts as a regulatory instance that determines the access to procedures of assisted reproduction. It is based on traditional heteronormative concepts of marriage and family, and reserves reproduction exclusively for heterosexual, married couples.ConclusionThe sociocultural script of good parenting in reproductive medicine implies a contradiction: Assisted reproduction technologies provide the opportunity of reproduction for individuals outside the heteronormative frame, yet they are legitimized and limited by this exact frame. Definition of the problem Medical ethics is increasingly faced with issues that result from power asymmetries and epistemic injustice. However, medical ethics lacks the epistemic lenses for analyzing these social context factors of clinical practice. A theoretical and conceptual reconfiguration is necessary in order to be able to address these issues. Arguments This paper discusses the foundations of critical medical ethics, which takes perspectives and epistemic categories from critical theories. This includes the Critical Theory of the Frankfurt School as well (...) as those approaches from social sciences and cultural studies that reflect on power asymmetries. By drawing on these theories, the epistemic spectrum of medical ethics could be broadened in order to better include real power relations into normative analyses. The paper starts by outlining the contribution of social sciences to empirical medical ethics. This shows that an empirical approach as such cannot bridge the epistemic gap. In a further step, epistemic lenses and concepts from critical theories are discussed, such as Critical Theory of the Frankfurt School, feminist approaches, postcolonial approaches, queer theory, gender studies, and science and technology studies (STS). The conclusion sums up the foundations of critical medical ethics and discusses its limitations. Conclusion Critical medical ethics possesses the epistemic categories and broader social perspective needed to address issues in medicine that result from power asymmetries and epistemic injustice in society. The graduation theses of the Scottish universities in the first half of the seventeenth century are at the crossroads of philosophical and historical events of fundamental importance: Renaissance and Humanist philosophy, Scholastic and modern philosophy, Reformation and Counterreformation, the rise of modern science. The struggle among these tendencies shaped the culture of the seventeenth century. Graduation theses are a product of the Scholasticism of the modern age, which survived the Reformation in Scotland and decisively influenced Scottish philosophy in the seventeenth (...) century, including the reception of early modern philosophy. We can therefore speak of a ‘Scottish Scholasticism’, characterised by an original reception and interpretation of the long traditions of Scholastic philosophy and Aristotelianism. The aim of the thesis is the analysis of the general physics of the graduation theses: the two central theories are prime matter and movement. Natural philosophy is a particularly interesting case, and the main features of the graduation theses are the reception of Scholasticism alongside innovation within Scholasticism. Graduation theses adhere to the Scholastic tradition, especially Scotism, while being innovative in their opposition to Catholic forms of Scholasticism. Scottish Scholasticism can be then further qualified as an example of ‘Reformed Scholasticism’. (shrink)

Nicola Matteucci was an Italian political philosopher and historian of political thought. Having studied under Benedetto Croce and Federico Chabod, he combined historical approach with a theoretical investigation of liberalism. His first works were mostly historical in character, but his interest in constitutionalism, especially English and American, led him already in the 1960s to attack legal positivism, whose most famous exponents were Hans Kelsen and, in Italy, Norberto Bobbio: Matteucci argued that this doctrine, by seeing the constitution merely as a (...) tool to organize state powers and institutions, does not discriminate between liberal and totalitarian political arrangements. Matteucci instead argued that the constitution represents the choice of a political form and contains the fundamental norms for the protection of individual rights and liberties. In his later and more theoretical writings Matteucci developed a view of liberalism as “response to a challenge”: liberal authors developed a series of conceptual and legal tools to counter the challenges of their age -the absolutist state, the totalitarian state and so on. An original Tocqueville scholar, Matteucci was very critical of populism and considered the “tyranny of the majority”, the conformism typical of mass society, one of the subtlest and biggest threats to democracy.
