Religion within the Boundaries of Mere Reason is a key element of the system of philosophy which Kant introduced with his Critique of Pure Reason, and a work of major importance in the history of Western religious thought. It represents a great philosopher's attempt to spell out the form and content of a type of religion that would be grounded in moral reason and would meet the needs of ethical life. It includes sharply critical and boldly constructive discussions on topics (...) not often treated by philosophers, including such traditional theological concepts as original sin and the salvation or 'justification' of a sinner, and the idea of the proper role of a church. It has been observed that, unlike other kinds of singular judgments, mental self-ascriptions are immune to error through misidentification: they may go wrong, but not as a result of mistaking someone else’s mental states for one’s own. Although recent years have witnessed increasing interest in this phenomenon, three basic questions about it remain without a satisfactory answer: what is exactly an error through misidentification? What does immunity to such errors consist in? And what does it take to explain the fact (...) that mental self-ascriptions exhibit this sort of immunity? The aim of this paper is to bring these questions into focus, propose some tentative answers and use them to show that one prominent attempt to explain the immunity to error through misidentification of mental self-ascriptions is unsuccessful. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. Kilimanjaro is an example of what some philosophers would call a ‘vague object’: it is only roughly 5895 m tall, its weight is not precise and its boundaries are fuzzy because some particles are neither determinately part of it nor determinately not part of it. It has been suggested that this vagueness arises as a result of semantic indecision: it is because we didn’t make up our mind what the expression “Kilimanjaro” applies to that we can truthfully say such things (...) as “It is indeterminate whether this particle is part of Kilimanjaro”. After reviewing some of the limitations of this approach, I will propose an alternative account, based on a new semantic relation—multiple reference—capable of holding in a one-many pattern between a term and several objects in the domain. I will explain how multiple reference works, what differentiates it from plural reference and how it might be used to accommodate at least some aspects of our ordinary discourse about vague objects. Currently, anomalous lived temporality is not included in the main diagnostic criteria or standard symptom checklists. In this article, we present the Transdiagnostic Assessment of Temporal Experience, a structured interview that can be used by researchers and clinicians without a comprehensive phenomenological background to explore abnormal time experiences in persons with abnormal mental conditions regardless of their diagnosis. When extensive data gathered by this scale are available, it will be possible to delineate well-defined anomalous lived temporality profiles for each psychopathological (...) disorder. This instrument may also prove useful for clinicians by providing a more refined assessment of relevant psychopathological symptoms and an in-depth understanding of the patient’s abnormal behaviour as related to specific types of time experience. In the first part of the article, we provide a brief overview of the phenomenological concept of temporality, including pre-phenomenal and phenomenal time, synthesis, conation and synchronization, and of abnormal time experiences in persons affected by psychopathological conditions. In the following part, we describe the basic structure of the interview that comprises seven categories corresponding to the abnormal features of lived temporality: anomalies of synchrony, of time structure, of implicit time flow, of explicit time flow, and anomalous experiences of the past, the present and the future. The paper also includes a section on administration and scoring of the TATE scale, the complete interview and a Likert table for quantifying the frequency, intensity and interference with daily life of the phenomena explored. According to Reid, color sensations are not extended nor are they arranged in figured patterns. Reid further claimed that ‘there is no sensation appropriated to visible figure.’ Reid justified these controversial claims by appeal to Cheselden's report of the experiences of a young man affected by severe cataracts, and by appeal to cases of perception of visible figure without color. While holding fast to the principle that sensations are not extended, Dugald Stewart tried to show that ‘a variety of colour (...) sensations is a necessary means for the perception of visible figure.’ According to John Fearn, two motives appear to be central to Reid's views about color sensations and extension: his commitment to the Cartesian doctrine of the immateriality of the soul, and his attempt to evade ‘Hume's dilemma’ about the existence and immateriality of the soul. . I will argue that the concept of law is a normative notion, irreducible to any factual description. Its conceptual function is that of relating certain properties a norm may possess to the conclusion that the norm is legally binding, namely, that it deserves to be endorsed and applied in legal reasoning. Legal validity has to be distinguished from other, more demanding, normative ideas, such as moral bindingness or legal optimality.

A significant cluster of complaints of persons affected by schizophrenia, for example, their feeling ephemeral, lacking core identity, being affected by a diminished sense of existing as a self-present subject, point to the disruptions of structural aspects of the core self. These and similar disturbances aggregate significantly and selectively in the schizophrenia spectrum disorders, occur and are detectable in adolescents at risk of future schizophrenic disorder, and have a tendency to persist. All this led to the proposal that the generative (...) disorder in schizophrenia is a disorder of the self. The phenomenological notion of the self serves to investigate the fact that we live.. A dispetto della stroncatura di Aristotele, Ippone, nel V secolo a.C., si dimostra un pensatore ben inserito nelle correnti culturali più vive ed interessanti del suo secolo. Accomunato ai Milesi per aver posto l’acqua come principio di tutte le cose, è stato considerato anche un pitagorico per aver affermato l’importanza del gioco dei contrari nel nascere e nell’evolversi delle cose. In realtà, queste caratterizzazioni si dimostrano piuttosto generiche, e l’appartenenza a questa o a quella scuola non dà ragione della specificità (...) della sua posizione nell’ambiente culturale mediterraneo e magno-greco, specificità ben rinvenibile anche nella scarsezza delle testimonianze. Più che l’acqua, per Ippone, ammesso che abbia voluto stabilire un’arché di tutte le cose, è l’umido a giocare un ruolo fondamentale nell’essere e nel divenire delle cose. In questo articolo si tenta anche di tracciare un profilo della storia dell’umido, dai Milesi a Eraclito, ad Alcmeone, a Diogene di Apollonia, fino a Democrito. E si vuole inoltre sottolineare come esso rientri anche nel campo specifico delle sue riflessioni, incentrate soprattutto nel campo biologico ed embriologico, riflessioni sempre obbedienti, più che a teorie generali, all’osservazione dell’esperienza concreta. This essay is unique in putting intersubjectivity front and center. It is an attempt to provide a clinical method to re-establish the fragile dialogue of the soul with oneself and with others. Throughout, the book builds on the assumption that to be human means to be in dialogue. It uses dialogue as a unitary concept to address three essential issues for clinical practice: 'What is a human being?', 'What is mental pathology'?, and 'What is care?'. To be human - it (...) is argued - means to be in dialogue with oneself and with other persons. Thus, mental pathology is the interruption of this dialogue - of the person with the alterity that inhabits them, and with the alterity incarnated in other persons. Therefore, therapy is a dialogue with a method whose aim is to re-enact one's interrupted dialogue with alterity. Lost in Dialogue provides a method to approximate the Other, to understand its experiences, actions, and in general, understand the world in which it lives. (shrink)

This paper considers the nature of schizophrenic autism and urges its importance for understanding the phenomenological core of schizophrenia. Different clinical manifestations of schizophrenic autism are demonstrated, and it is asked whether these might reflect different aspects of one underlying phenomenologically intelligible phenomenon. Four phenomenological hypotheses are put forward: that autism is a function of semantic drifting, emotional drifting, ontological incompleteness, or a particular ethic rejecting common sense. By way of conclusion an integrative hypothesis is considered: that autism is intelligible (...) in terms of the experience of disembodiment. (shrink)

This article proposes a formal analysis of a fundamental aspect of legal reasoning: dealing with normative conflicts. Firstly, examples are illustrated concerning the dynamics of legal systems, the application of rules and exceptions, and the semantic indeterminacy of legal sources. Then two approaches to cope with conflicting information are presented: the preferred theories of Brewka, and the belief change functions of Alchourrón, Gärdenfors, and Makinson. The relations between those approaches are closely examined, and some aspects of a model of reasoning (...) with normative conflicts are outlined. Since this model takes into account an ordering of the involved regulations, criteria to order legal norms are finally specified. (shrink)

Thomas Reid presented a two-dimensional geometry of the visual field in his Inquiry into the Human Mind (1764). The axioms of this geometry are different from those of Euclidean plane geometry. The ‘geometry of visibles’ is the same as the geometry of the surface of the sphere, described without reference to points and lines outside the surface itself. In a recent article, James Van Cleve has argued that Reid can secure a non-Euclidean geometry of visibles only at the cost of (...) abandoning his direct realist theory of perception, and reintroducing sense-data. The question will be reexamined by considering two aspects of Reid’s theory of vision: the claim that we do not directly perceive distance by sight and Reid’s characterization of visible figure as a partial notion of an external object. This article models legal interpretation through argumentation and provides a logical analysis of interpretive arguments, their conflicts, and the resulting indeterminacies. Interpretive arguments are modelled as defeasible inferences, which can be challenged and defeated by counterarguments and be reinstated through further arguments. It is shown what claims are possibly (defensibly) or necessarily (justifiably) supported by the arguments constructible from a given interpretive basis, i.e., a set of interpretive canons coupled with reasons for their application. It is finally established under what (...) conditions such arguments provide single outcomes or rather support alternative interpretive conclusions, thus leading to propositions of law whose truth‐value is undetermined. Objetiva-se mostrar que a filosofia crítica comporta uma refutação integral da analogia técnica operada por Descartes. Para tanto, após apresentar a pertinência do tema da analogia em relação aos movimentos gerais da _Crítica_, utilizamo-la para interpretar o debate moderno acerca da razão dos animais. Posteriormente, acompanhamos a consolidação da noção kantiana da analogia a partir dos cursos de _Lógica _e centramo-nos, em seguida, na _Crítica da Faculdade de Julgar Teleológica_, a qual abriga uma reelaboração do conceito de arte, bem como (...) a refutação da tese cartesiana dos animais-máquina. A partir dela, pretendendo mostrar tanto as razões pelas quais Kant a rejeita, como o modo pelo qual ele a leva à contradição, sinalizamos que Descartes inconscientemente supõe o contrário do que gostaria de provar. Permeando essa discussão, esforçamo-nos por bem situar as teses do texto em relação ao próprio sistema da _Crítica_, segundo o tema da analogia. (shrink)

The World, understood as a system of meaningful relations, is for Hegel the exclusive product of the human mind. In this, Hegel stands together with Kant in direct opposition to the Christian metaphysical tradition, according to which reality reflects God's ideas. For both Kant and Hegel, faith and religion therefore acquire new meaning. Yet, that meaning is just as different for each with respect to the other as it is for both with respect to the Christian tradition.
