Algunas de las pre-guntas que nos plantea el pensamiento de G. Deleuze son: ¿qué podríamos hacer o experimentar con ella?, ¿cómo podremos devenir en ella?.

Legal scholarship exploring the nature of evidence and the process of juridical proof has had a complex relationship with formal modeling. As evident in so many fields of knowledge, algorithmic approaches to evidence have the theoretical potential to increase the accuracy of fact finding, a tremendously important goal of the legal system. The hope that knowledge could be formalized within the evidentiary realm generated a spate of articles attempting to put probability theory to this purpose. This literature was both insightful (...) and frustrating. Much light was shed on the legal system, but it also quickly became evident that the tools of probability theory were in many ways ill-constructed for the task. Fundamental incompatibilities between the structure of legal decision making and the extant formal tools were identified, and it became evident that many of the purported explanations of legal phenomena were internally inconsistent. As a consequence, interest in this type of formal modeling declined, and attention was directed toward different kinds of explanations of the phenomena. Perhaps under the influence of a recent trend toward various types of formal modeling in legal scholarship, a recent burst of articles, rather than attempting to explain the macro structure of trials, which was the previous object of interest, attempts to quantify the probative value of various items of evidence in ways consistent with the formal features of various probability theories, and then to study decision making from that perspective. For example, the value of evidence is often purported to be its likelihood ratio, that is, the probability of discovering or receiving the evidence given a hypothesis (e.g., the defendant did it) divided by the probability of discovering or receiving the evidence given the negation of the hypothesis (the defendant didn't do it). Alternatively, the value of evidence is purported (more contextually) to be the information gain it provides, defined as the increase in probability it provides for a hypothesis above the probability of the hypothesis based on the other available evidence. Both conceptions then assume that all of the various probability assessments conform or ought to conform to the dictates of Bayes' theorem (that maintains consistency among such assessments); empirical studies are then done testing the extent to which this is so and proposing how the law can increase the probability that it is so. The general criticisms of using Bayes' theorem as a formal model of juridical proof are well known and were integral to the last wave of interest in formal modeling of the evidentiary process. This paper thus for the most part puts aside that more general issue, and focuses specifically on mathematical modeling of the value of particular items of evidence. The paper demonstrates that formal modeling has only limited value in explaining the value of legal evidence, much more limited than those constructing and discussing the models assume, and thus that the conclusions they draw about the value of evidence are unwarranted. This is done through a discussion of four recent examples that attempt to quantify evidence relating to, respectively, carpet fibers, infidelity, DNA random-match evidence, and character evidence used to impeach a witness. This article thus makes two contributions. First, and most importantly, it is another demonstration of the complex relationship between algorithmic tools and legal decision making. Second, at a minimum it points out serious pitfalls for analytical or empirical studies of juridical proof. (shrink)

Pickering & Garrod's (P&G's) mechanistic theory of dialogue attempts to detail the psychological processes involved in communication that are lacking in Clark's theory. By relying on automatic priming and alignment processes, however, the theory falters when it comes to explaining much of dialogic interaction. We argue for the inclusion of less automatic, though not completely conscious and deliberate, processes to explain such phenomena.

BackgroundAccurate reporting on sex and gender in health research is integral to ensuring that health interventions are safe and effective. In Canada and internationally, governments, research organizations, journal editors, and health agencies have called for more inclusive research, provision of sex-disaggregated data, and the integration of sex and gender analysis throughout the research process. Sex and gender analysis is generally defined as an approach for considering how and why different subpopulations (e.g., of diverse genders, ages, and social locations) may experience (...) health conditions and interventions in different or similar ways.The objective of this study was to assess the extent and nature of reporting about sex and/or gender, including whether sex and gender analysis (SGA) was carried out in a sample of Canadian randomized controlled trials (RCTs) with human participants.MethodsWe searched MEDLINE from 01 January 2013 to 23 July 2014 using a validated filter for identification of RCTs, combined with terms related to Canada. Two reviewers screened the search results to identify the first 100 RCTs that were either identified in the trial publication as funded by a Canadian organization or which had a first or last author based in Canada. Data were independently extracted by two people from 10% of the RCTs during an initial training period; once agreement was reached on this sample, the remainder of the data extraction was completed by one person and verified by a second.ResultsThe search yielded 1433 records. We screened 256 records to identify 100 RCTs which met our eligibility criteria. The median sample size of the RCTs was 107 participants (range 12–6085). While 98% of studies described the demographic composition of their participants by sex, only 6% conducted a subgroup analysis across sex and 4% reported sex-disaggregated data. No article defined “sex” and/or “gender.” No publication carried out a comprehensive sex and gender analysis.ConclusionsFindings highlight poor uptake of sex and gender considerations in the Canadian RCT context and underscore the need for better articulated guidance on sex and gender analysis to improve reporting of evidence, inform policy development, and guide future research. For over half a century I have been interested in the role of intuitive spatial reasoning in mathematics. My Oxford DPhil Thesis (1962) was an attempt to defend Kant's philosophy of mathematics, especially his claim that mathematical proofs extend our knowledge (so the knowledge is "synthetic", not "analytic") and that the discoveries are not empirical, or contingent, but are in an important sense "a priori" (which does not imply "innate") and also necessarily true. -/- I had made my views clear (...) in courses on philosophy of science and mathematics when teaching at Sussex University (from 1964) which was why one of our former students, Mary Pardoe (then Mary Ensor) who had become a mathematics teacher informed me, while visiting the university, that she had found a new diagrammatic proof of the triangle sum theorem. I reported her proof in some papers and presentations on methods of representation and reasoning, e.g. here, but neither she nor I has encountered anyone else who knew about the proof. (shrink)

This article aims to explicate the concept of emotional sharing against the background of interactive and situated approaches to affectivity, and to contextualize emotional sharing within the broader context of emotion research. It brings together research on situated affectivity with the debate on collective emotion. Emotional sharing is defined via four requirements and distinguished from other phenomena in the broad field of collective emotion, especially from mechanisms of emotional convergence and other forms of affective we-experience. The paper makes use of (...) the recently proposed concepts of affective scaffolding and affective arrangement to explore how emotional sharing is always enacted in sociorelational dynamics and embedded in socio-material contexts which enable, shape, and modulate the unfolding of emotional sharing and regulate who is likely to participate. This article presents evidence supporting the claim that ethical reasoning is a skill that can be taught and assessed. We propose a working definition of ethical reasoning as 1) the ability to identify, analyze, and weigh moral aspects of a particular situation, and 2) to make decisions that are informed and warranted by the moral investigation. The evidence consists of a description of an ethical reasoning education program—Ethical Reasoning in Action —designed to increase ethical reasoning skills in a variety of (...) situations and areas of life. ERiA is housed at a public, major comprehensive U.S. university—James Madison University—and assessment of the program focuses on interventions delivered prior to and during orientation for incoming first-year students. Findings indicate that the interventions measurably enhance the ability of undergraduate students to reason ethically. ERiA’s competency-targeted program and positive student learning outcomes offers a promising model for higher education ethics programs seeking to connect classroom learning in ethics to decision-making in everyday life. The complex chaotic dynamics and multistability of financial system are some important problems in micro- and macroeconomic fields. In this paper, we study the influence of two-delay feedback on the nonlinear dynamics behavior of financial system, considering the linear stability of equilibrium point under the condition of single delay and two delays. The system undergoes Hopf bifurcation near the equilibrium point. The stability and bifurcation directions of Hopf bifurcation are studied by using the normal form method and central manifold theory. Furthermore, one feature of the proposed financial chaotic system is that its multistability depends extremely on the memristor initial condition and the system parameters. It is shown that the nonlinear dynamics of financial chaotic system can be significantly changed by changing the values of time delays. (shrink)

Hablar de tiempo de subjetividad, como se propone aqui, es situarse en un territorio entrecruzado por muchos senderos. Desde el lugar escogido, lo que se divisa es una filigrana de rutas, una trama de caminos por recorrer, que pronto abandona su inicial apariencia de abanico de opciones entre las que escoger, para mostrar su autentica condicion de red teorica o atmosfera intelectual en cuyo (...) interior se encuentra atrapado el hombre contemporaneo. A lo largo del texto, esta percepcion mutara en convencimiento, modesto pero firme. El convencimiento de que, mas alla de criticas y dificultades, la categoria de subjetividad representa, como reza el titulo de la tercera parte, una dificultad necesaria, un ambito teorico fecundo a la hora de intentar arrojar algun tipo de luz sobre lo que nos ocurre. Aldo Antonelli offers a novel view on abstraction principles in order to solve a traditional tension between different requirements: that the claims of science be taken at face value, even when involving putative reference to mathematical entities; and that referents of mathematical terms are identified and their possible relations to other objects specified. In his view, abstraction principles provide representatives for equivalence classes of second-order entities that are available provided the first- and second-order domains are in the equilibrium dictated by (...) the abstraction principles, and whose choice is otherwise unconstrained.entities are the referents of abstraction terms: such referents are to an extent indeterminate, but we can still quantify over them, predicate identity or non-identity, etc. Our knowledge of them is limited, but still substantial: we know whatever has to be true no matter how the representatives are chosen, i.e., what is true in all models of the corresponding abstraction principles. This view is backed up by an “austere” conception of universals, according to which these are first-order objects, i.e., ways of collecting first-order objects. Antonelli thus claims that second-order logic does not import any novel ontological commitment beyond ontology of first-order, naturalistically acceptable, objects. Moreover, in the case of arithmetic, even if Hume’s Principle is construed as described above, Frege’s Theorem goes through unaffected, since there is nothing in its proof that depends on an account of the “true nature” of numbers. A viable construal of logicism is then given by the combination of semantic nominalism and a naturalistic conception of abstraction. [Editors note]. (shrink)

Foucault’s remarks concerning psychoanalysis are ambivalent and even prima facie contra-dictory, at times lauding Freud and Lacan as anti-humanists, at others being severely criti-cal of their imbrication within psychiatric power. This has allowed a profusion of interpretations of his position, between so-called ‘Freudo-Foucauldians’ at one extreme and Foucauldians who condemn psychoanalysis as such at the other. In this article, I begin by surveying Foucault’s biographical and theoretical relationship to psychoanalysis and the sec-ondary scholarship on this relationship to date. I pay (...) particular attention to the discussion of the relationship in feminist scholarship and queer theory, and that by psychoanalytic thinkers, as well as attending to the particular focus in the secondary literature on Fou-cault’s late work and his relationship to the figure of Jacques Lacan. I conclude that Fou-cault’s attitude to psychoanalysis varies with context, and that some of his criticisms of psychoanalysis in part reflect an ignorance of the variety of psychoanalytic thought, partic-ularly in its Lacanian form. I thus argue that Foucault sometimes tended to overestimate the extent of the incompatibility of his approach with psychoanalytic ones and that there is ultimately no serious incompatibility there. Rather, psychoanalysis represents a substantively different mode of inquiry to Foucault’s work, which is neither straightforwardly ex-clusive nor inclusive of psychoanalytic insights. (shrink)

These notes of G. E. Moore's lectures for the three terms of 1934-1935 were compiled by Alice Ambrose, then Student of Newnham College, and Margaret Macdonald, then Fellow of Girton College. The lectures cover a wealth of interrelated topics, and provide instances of the analyses which made Moore «the father of the analytic school.» Since his analyses of such concepts as material objects, sense data, and truth rest on the ordinary use of expressions for these concepts, «ordinary language» philosophers found (...) in him their champion.
