La nomination des phénomènes sociaux par les spécialistes cherche à les débarrasser des contenus moraux ou idéologiques que véhiculent les termes courants et vise leur objectivation. L’exercice est difficile, car, bien souvent, les nouveaux termes proposés peuvent générer des interprétations qui trahissent les intentions de leurs auteurs. Les glissements sont encore plus importants lorsque ces termes sont repris et légitimés par les institutions. L’auteur prend pour exemple deux termes, celui de familles monoparentales et celui d’hébergement alterné. Scientific breakthroughs rarely yield the potential to engage a foundational ethical question. Recent studies on direct reprogramming of human skin cells reported by the Yamanaka lab in Japan and the Thomson lab in Wisconsin suggest that scientists may have crossed both a scientific and an ethical threshold. The fascinating science of direct nuclear reprogramming highlights empirical data that may clarify the ontological status of cellular activity in the early stages of what could become a human fetus and justify ethical options (...) for research in this controversial field. Selon la façon dont on l’envisage et l’origine du regard qui se pose sur elle, l’autorité ne paraît pas représenter la même chose. Pour certains elle est l’expression d’un principe abstrait, atemporel, relatif au jeu des places qu’organisent les rapports sociaux, en l’occurrence les places spécifiques qu’occupent les parents par rapport à l’enfant. Pourtant, pour d’autres approches, notamment les approches psychanalytiques, l’autorité n’est pas un principe neutre, elle a un sexe, de préférence masculin. Que peut-on dire d’une telle affirmation à (...) notre époque de reconfiguration des relations non seulement entre les sexes mais aussi entre les générations, et plus globalement de l’ensemble des relations privées, si ce n’est des rapports entre le public et le privé? Je m’essaie ici à une analyse sociologique, alimentée de références psychologiques et historiques, de la signification de cette question et des réponses qu’il est possible de lui apporter. (shrink)

Forensic psychiatry is a particular subspecialty within psychiatry, dedicated in applying psychiatric knowledge and psychiatric training for particular legal purposes. Given that within the scope of forensic psychiatry, a third party usually intervenes in the patient-doctor relationship, an amendment of the traditional ethical principles seems justified. Thus, 47 articles, two book chapters and the guidelines produced by the World Psychiatric Association, the American Association of Psychiatry and the Law, as well as by the Royal Australian and New Zealand College of (...) psychiatrists, were analyzed. The review revealed that the ethics of correctional forensic psychiatry and those of legal forensic psychiatry do not markedly differ from each other, but they are incongruent in terms of implementation. In an effort to better understand which ethical principles apply to forensic psychiatry, a chronological review of the literature published from 1950 to 2015 was carried out. The ethics of correctional forensic psychiatry are primarily deontological. The principle of justice translates into the principle of health care equivalence, the principle of beneficence into providing the best possible care to patients, and the principle of respect of autonomy into ensuring confidentiality and informed consent. The ethics of legal forensic psychiatry are rather consequentialist. In this latter setting, the principle of justice is mainly characterized by professionalism, the principle of beneficence by objectivity and impartiality, and the principle of respect of autonomy by informed consent. However, these two distinct fields of forensic psychiatry share in common the principle of non maleficence, defined as the non collaboration of the psychiatrist in any activity leading to inhuman and degrading treatment or to the death penalty. The enlargement of the European Union to include eventually Turkey and the former communist countries is a major challenge for our understanding of the meaning of Europe as a geopolitical, social and cultural space. It is also a question of the identity of Europe as one shaped by social or systemic integration. With the diminishing significance of national borders within the EU, the outer territorial frontier is also losing its significance and Europe will become more and more postwestern. It thus (...) appears that the eastern frontier is more flexible than was previously thought. The EU is now at the decisive point of moving beyond postnationality to a transnational encounter with multiple civilizational forms. Enlargement is not just about getting bigger but is crucially a matter of cultural transformation and therefore it differs from all previous dynamics of Europeanization. Rather than tell the story of Europeanization exclusively as one of national histories and of closure, a civilizational analytic offers the possibility of multiple modernities and thus of a more appropriate theorization of the current situation. The main purpose of this second article devoted to T. Piketty’s Capital in the Twenty-First Century (the first was published in the previous issue of Actuel Marx) is to introduce our alternative reading of history. The tendencies manifest during the last decades of the 20th century and the early 21st century are not, it is argued, the replication of the tendencies which prevailed prior to World War I. The starting-point for our analysis is the beginning of the 20th century, a (...) moment characterized by the dynamics of a “managerial capitalism” built around the “tripolar” class pattern of capitalists, managers, and popular classes. The main quantitative manifestation of these trends was the steady rise in the share accounted for by wages (compared to capital income) in the income of upper classes (notably the top 1 percent). In place of Piketty’s impact of shocks, we focus on the chain of successive configurations of class domination and alliances, in a succession of “social orders” marking the historical advance of managerial capitalism : the first financial hegemony, in the years leading up to the Great Depression ; the postwar social-democratic compromise ; and its successor, neoliberalism, involving a new alliance to the right, between the managerial and popular classes. O. The idea of scientific progress in contemporary philosophy of science. Explicating the concept of cognitive progress means at the same time articulating an ideal of science. A desirable ideal: explain a lot and offer certainty. 1. Working out the ideal with the "foundationalist-positivist" approach. If the question, "When is it rational to accept a theory?" is answered, "When it has sufficient inductive support," this leads to insoluble problems. Reactions to the collapse of this approach - especially relativism and theory (...) instrumentalism. 2. The Popperian alternative: rational theory preference despite fallibility of methods for determining truth or greater accuracy of representations. What good reasons can there be for the conjecture that one theory is superior to a competing theory in its achievement as a description? Achievements to date as fallible but objective indicators of strength in describing. The sorts of risks for a theory differ in explanation and in prediction. Corresponding to the risks are the chances for cognitive progress. Instead of a cumulative index, itemized indication of success and failure in explanation and prediction with regard for importance of the questions at issue. Plato's attitude toward the poets and poetry has always been a flashpoint of debate, controversy and notoriety, but most scholars have failed to see their central role in the ideal cities of the Republic and the Laws, that is, Callipolis and Magnesia. In this paper, I argue that in neither dialogue does Plato "exile" the poets, but, instead, believes they must, like all citizens, exercise the expertise proper to their profession, allowing them the right to become full-fledged participants in the (...) productive class. Moreover, attention to certain details reveals that Plato harnesses both positive and negative factors in poetry to bring his ideal cities closer to a practical realization. The status of the poet and his craft in this context has rarely to my knowledge been addressed. (shrink)

The Ecclesiological Investigations International Research Network organized a major international conference at Georgetown University, Washington National Cathedral and Marymount University, in 2015, to commemorate the 50th anniversary of the conclusion of the Second Vatican Council. The council, one of the most important events in the history of the Roman Catholic Church, initiated a process of renewal, transition, and openness that affected not only Catholics, but all Christians, adherents of other religions, and the secular world. The Washington conference received worldwide media (...) attention, with highlights including keynote addresses by several cardinals, archbishops, and bishops as well as eminent scholars from a wide and diverse range of backgrounds in terms of geography and expertise alike. This second of three volumes emerging from this event assesses how Vatican II opened up the Catholic Church to encounter, dialogue, and engagement with other world religions. It begins with a contribution from the late President of the Pontifical Council for Interreligious Dialogue, Cardinal Jean-Louis Tauran, followed by a section devoted to exploring the impact, relevance, and promise of the Council's Declaration on Non-Christian Religions, Nostra Aetate. The volume turns next to explore how Vatican II in general has influenced and helped develop method in both interfaith dialogue and in the intellectual and comparative study of world religions in the post-conciliar decades. The final thematic section of this volume is devoted to a range of perspectives on the fruits and future of Vatican II’s opening to other faiths. At times decisions are made in the field of genetics that are presented as if the ethical debates have been adequately treated and so all moral considerations have been addressed, when the truth is very different. Nor is it always easy or desirable to separate the ethical, legal and social questions posed by new developments. The impact of developments in genetic science upon communities is one field of enquiry that envelops each of these areas.This paper explores the impact of genetics (...) upon communities through focusing, in particular, upon certain developments in reproductive science. After introducing core issues and technologies, it discusses particular ethical concerns in relation to the ‘shadow’ of eugenics over such developments, before exploring the role of legislative debates and procedures in transforming social attitudes, values and hence norms. It then turns to consider debates concerning the ‘quality of life ethic’ now prevalent in healthcare, and moves on to discuss the issue of genetic discrimination – focusing, in particular, upon discrimination against disabled persons as a representative instance of the actual ethical and social/communitarian implications of the foregoing. It ends by highlighting the need to discern the ways in which the ethics of genetics is presently shaped and practised in order to discern better the particular social and communitarian implications of certain technological advances. Dans son article de 1913, «L’intérêt de la psychanalyse», Freud déclarait que la philosophie pouvait profiter des lumières de la psychanalyse parce que celle-ci peut dévoiler la motivation subjective et individuelle de doctrines philosophiques prétendument issues d’un travail logique et impartial, et ainsi désigner à la critique les points faibles du système d’un philosophe. Mon texte présente quelques exemples de l’utilisation de la psychanalyse pour identifier l’impact de l’inconscient sur la pensée de certains philosophes tels que Parménide, Berkeley, Kant, Sartre. (...) À la lumière de ces exemples, j’examine brièvement quelques questions à propos du conseil de Freud : Est-il praticable ? Quand peut-on l’appliquer ? Comment en rendre l’application moralement acceptable ? Selon quels critères juger de la valeur de vérité d’interprétations psychanalytiques de ce genre ? Quels sont les bénéfices, et en valent-ils la peine ?In his article of 1913, " The Claims of Psycho-Analysis to Scientific Interest", Freud stated that philosophy could profit from psychoanalysis because it can indicate the subjective and individual motives of philosophical theories which are ostensibly based on impartial logical work, and in this way it can draw critical attention to the weak spots in a philosopher’s system. This paper presents a few examples of the use of psychoanalysis to identify the impact of the unconscious on the theories of certain philosophers, e.g., Parmenides, Berkeley, Kant, Sartre. In the light of these examples, I examine briefly a number of questions concerning Freud’s recommendation : Can it be put into practice ? In what circumstances ? How can it be applied in a way that is morally defensible ? By what criteria can one evaluate the truth value of such psychoanalytic interpretations ? What are the advantages, and are they worth the effort required ? (shrink)
