Subject-sensitive invariantism posits surprising connections between a person’s knowledge and features of her environment that are not paradigmatically epistemic features. But which features of a person’s environment have this distinctive connection to knowledge? Traditional defenses of subject-sensitive invariantism emphasize features that matter to the subject of the knowledge-attribution. Call this pragmatic encroachment. A more radical thesis usually goes ignored: knowledge is sensitive to moral facts, whether or not those moral facts matter to the subject. Call this moral encroachment. This paper (...) argues that, insofar as there are good arguments for pragmatic encroachment, there are also good arguments for moral encroachment. (shrink)

According to the view that there is moral encroachment in epistemology, whether a person has knowledge of p sometimes depends on moral considerations, including moral considerations that do not bear on the truth or likelihood of p. Defenders of moral encroachment face a central challenge: they must explain why the moral considerations they cite, unlike moral bribes for belief, are reasons of the right kind for belief (or withheld belief). This paper distinguishes between a moderate and a radical version of (...) moral encroachment. It shows that, while defenders of moderate moral encroachment are well-placed to meet the central challenge, defenders of radical moral encroachment are not. The problem for radical moral encroachment is that it cannot, without taking on unacceptable costs, forge the right sort of connection between the moral badness of a belief and that belief’s chance of being false. We often speak as if there are merely possible people—for example, when we make such claims as that most possible people are never going to be born. Yet most metaphysicians deny that anything is both possibly a person and never born. Since our unreflective talk of merely possible people serves to draw non-trivial distinctions, these metaphysicians owe us some paraphrase by which we can draw those distinctions without committing ourselves to there being merely possible people. We show that such paraphrases (...) are unavailable if we limit ourselves to the expressive resources of even highly infinitary first-order modal languages. We then argue that such paraphrases are available in higher-order modal languages only given certain strong assumptions concerning the metaphysics of properties. We then consider alternative paraphrase strategies, and argue that none of them are tenable. If talk of merely possible people cannot be paraphrased, then it must be taken at face value, in which case it is necessary what individuals there are. Therefore, if it is contingent what individuals there are, then the demands of paraphrase place tight constraints on the metaphysics of properties: either (i) it is necessary what properties there are, or (ii) necessarily equivalent properties are identical, and having properties does not entail even possibly being anything at all. It is widely agreed that hypocrisy can undermine one’s moral standing to blame. According to the Nonhypocrisy Condition on standing, R has the standing to blame some other agent S for a violation of some norm N only if R is not hypocritical with respect to blame for violations of N. Yet this condition is seldom argued for. Macalester Bell points out that the fact that hypocrisy is a moral fault does not yet explain why hypocritical blame is standingless blame. (...) She raises a challenge: one must explain what is distinct about hypocritical blame such that the hypocritical blamer lacks the standing to blame, even if the arrogant or petty blamer does not. Of those writing on hypocrisy, only we offer a direct response to Bell’s challenge. Recently, however, our account has come under criticism. We argue here that (1) our account can handle these criticisms and that (2) no other rival account adequately addresses Bell’s challenge of explaining what is uniquely objectionable about hypocritical blame. Because answering Bell’s challenge is a necessary component of any plausible account of the relationship between hypocrisy and standing, our account remains the best on offer. (shrink)

In 2019, several US states passed “heartbeat” bills. Should such bills go into effect, they would outlaw abortion once an embryonic heartbeat can be detected, thereby severely limiting an individual’s access to abortion. Many states allow health care professionals to refuse to provide an abortion for reasons of conscience. Yet heartbeat bills do not include a positive conscience clause that would allow health care professionals to provide an abortion for reasons of conscience. I argue that this asymmetry is unjustified. The (...) same criteria that justify protecting conscientious refusals to provide abortion also justify protecting positive conscientious appeals regarding abortion. Thus, if the law provides legal exemptions for health care professionals who, as a matter of conscience, refuse to provide abortions where it is legal, it should also provide exemptions for health care professionals who, as a matter of conscience, feel obligated to provide abortions where it is illegal. Two expressive limitations of an infinitary higher-order modal language interpreted on models for higher-order contingentism – the thesis that it is contingent what propositions, properties and relations there are – are established: First, the inexpressibility of certain relations, which leads to the fact that certain model-theoretic existence conditions for relations cannot equivalently be reformulated in terms of being expressible in such a language. Second, the inexpressibility of certain modalized cardinality claims, which shows that in such a language, higher-order contingentists cannot (...) express what is communicated using various instances of talk of ‘possible things’, such as ‘there are uncountably many possible stars’. The models of contingency in what propositions, properties and relations there are developed in Part 1 are related to models of contingency in what propositions there are due to Robert Stalnaker. It is shown that some but not all of the classes of models of Part 1 agree with Stalnaker’s models concerning the patterns of contingency in what propositions there are they admit. Further structural connections between the two kinds of models are explored.

Call the following claim Asymmetry: rationality often requires a more steadfast response to pure moral disagreement than it does to otherwise analogous non-moral disagreement. This paper briefly motivates Asymmetry and explores its implications for meta-ethics. Some philosophers have thought that anti-realists are better-placed than realists to explain Asymmetry because, if anti-realism is true, disagreement cannot provide evidence against the reliability of one's thinking about objective moral facts. This paper argues that this simple diagnosis fails to support otherwise plausible anti-realisms. It (...) closes by discussing an alternative explanation for Asymmetry, which appeals to the moral importance of steadfastness. (shrink)

This essay provides a novel argument for impurism, the view that certain non-truth-relevant factors can make a difference to a belief's epistemic standing. I argue that purists, unlike impurists, are forced to claim that certain ‘high-stakes’ cases rationally require agents to be akratic. Akrasia is one of the paradigmatic forms of irrationality. So purists, in virtue of calling akrasia rationally mandatory in a range of cases with no obvious precedent, take on a serious theoretical cost. By focusing on akrasia, and (...) on the nature of the normative judgments involved therein, impurists gain a powerful new way to frame a core challenge for purism. They also gain insight about the way in which impurism is true: my argument motivates the claim that there is moral encroachment in epistemology. (shrink)

In our 2018 paper, “Hypocrisy and the Standing to Blame,” we offer an argument justifying the Nonhypocrisy Condition on the standing to blame. Benjamin Rossi (2018) has recently offered several criticisms of this view. We defend our account from Rossi’s criticisms and emphasize our account’s unique advantage: explaining why hypocritical blamers lack the standing to blame.

If there is pragmatic encroachment in epistemology, whether a person knows that p can vary with normative facts about her actions—including facts that do not bear on the truth or likelihood of p. This paper raises an underappreciated question for defenders of pragmatic encroachment: which of the many norms on action are distinctively connected to knowledge? To the extent that contemporary defenders of pragmatic encroachment address this question, they do so by citing norms of ‘practical rationality.’ I show that this (...) approach can only be made to work on the assumption that all immorality involves some form of incoherence. I then suggest a pluralist strategy for pragmatic encroachers who seek to answer my question without making this heavyweight metaethical assumption: they should agree that multiple distinct norms on action play a difference-making role in epistemology. I close the paper by sketching three ways in which pragmatic encroachers might pursue this strategy. (shrink)

This paper looks into the ethics of positive perspective-taking. Positive perspective-taking is, roughly, an attitudinal orientation toward an object that treats that object as sufficiently good, or in other words, as meeting one’s normative expectations. Sometimes, positive perspective-taking is both prudent and virtuous. But sometimes, positive perspective-taking–especially about injustices done to others–seems morally suspicious. When is positive perspective-taking actually morally problematic, and in those cases, what is the nature of the moral problem? I argue that a complete answer to this (...) question should appeal to moral rights: on my view, we sometimes have moral rights against others’ putting our problems into a positive perspective. A central advantage of this proposal is its ability to account for the moral asymmetry between positive perspective-taking about injustices done to oneself and positive perspective-taking about injustices done to others. This article explores the connection between two theses: the principle of conditional excluded middle for the counterfactual conditional, and the claim that it is a contingent matter which (coarse grained) propositions there are. Both theses enjoy wide support, and have been defended at length by Robert Stalnaker. We will argue that, given plausible background assumptions, these two principles are incompatible, provided that conditional excluded middle is understood in a certain modalized way. We then show that some (although not all) arguments (...) for conditional excluded middle can in fact be extended to motivate this modalized version of the principle. (shrink)

Propositional quantifiers are added to a propositional modal language with two modal operators. The resulting language is interpreted over so-called products of Kripke frames whose accessibility relations are equivalence relations, letting propositional quantifiers range over the powerset of the set of worlds of the frame. It is first shown that full second-order logic can be recursively embedded in the resulting logic, which entails that the two logics are recursively isomorphic. The embedding is then extended to all sublogics containing the logic (...) of so-called fusions of frames with equivalence relations. This generalizes a result due to Antonelli and Thomason, who construct such an embedding for the logic of such fusions. (shrink)

Many writers have recently argued that there is something distinctively problematic about sustaining moral beliefs on the basis of others’ moral views. Call this claim pessimism about moral deference. Pessimism about moral deference, if true, seems to provide an attractive way to argue for a bold conclusion about moral disagreement: moral disagreement generally does not require belief revision. Call this claim steadfastness about moral disagreement. Perhaps the most prominent recent discussion of the connection between moral deference and moral disagreement, due (...) to Alison Hills, uses pessimism about the former to argue for steadfastness about the latter. This paper reveals that this line of thinking, and others like it, are unsuccessful. There is no way to argue from a compelling version of pessimism about moral deference to the conclusion of steadfastness about moral disagreement. The most plausible versions of pessimism about moral deference have only very limited implications for moral disagreement. (shrink)

To practise ‘fairly and justly’ a clinician must balance the needs of both the many and the few: the individual patient in front of them, and the many unseen patients in the waiting room, and in the county. They must consider the immediate clinical needs of those in the present, and how their actions will impact on future patients. The good medical practice guidance ‘Make the care of your patient your first concern’ provides no guidance on how doctors should act (...) when they care for multiple patients with conflicting needs. Moreover, conflicting needs extend far past simply those between different patients. At an organisational level, financial obligations must be balanced with clinical ones; the system must support those who work within it in a variety of roles; and, finally, in order for a healthcare service to be sustainable, the demands of current and future generations must be balanced.The central problem, we propose, is that there is no shared philosophical framework on which the provision of care or the development of health policy is based, nor is there a practical, fair and transparent process to ensure that the service is equipped to deal justly with new challenges as they emerge. Many philosophers have grappled with constructing a set of principles which would lead to a ‘good’ society which is just to different users; prominent among them is Rawls.Four important principles can be derived using a Rawlsian approach: equity of access, distributive justice, sustainability and openness. However, Rawls’ approach is sometimes considered too abstract to be applied readily to policymaking; it does not provide clear guidance for how individuals working within existing institutions can enact the principles of justice. We therefore combine the principles derived from Rawls with Scanlonian contractualism: by demanding that decisions are made in a way which cannot be ‘reasonably rejected’ by different stakeholders, we ensure that conflicting needs are considered robustly.We demonstrate how embedding this framework would ensure just policies and fair practice. We illustrate this by using examples of how it would help prevent injustice among different socioeconomic groups, prevent intergenerational injustice and prevent injustice in a crisis, for example, as we respond to new challenges such as COVID-19.Attempts to help individual doctors practise fairly and justly throughout their professional lives are best focused at an institutional or systemic level. We propose a practical framework: combining Scanlonian contractualism with a Rawlsian approach. Adopting this framework would equip the workforce and population to contribute to fair policymaking, and would ultimately result in a healthcare system whose practice and policies—at their core—were just. Robert Stalnaker has recently advocated propositional contingentism, the claim that it is contingent what propositions there are. He has proposed a philosophical theory of contingency in what propositions there are and sketched a possible worlds model theory for it. In this paper, such models are used to interpret two propositional modal languages: one containing an existential propositional quantifier, and one containing an existential propositional operator. It is shown that the resulting logic containing an existential quantifier is not recursively axiomatizable, as (...) it is recursively isomorphic to second-order logic, and a natural candidate axiomatization for the resulting logic containing an existential operator is shown to be incomplete. Many theorists writing about moral responsibility accept that voluntary control is necessary for responsibility. Call such theorists volitionists. Recently, volitionism has been called into question by theorists I call nonvolitionists. Yet neither volitionists nor nonvolitionists have carefully articulated a clear volitionist thesis, nor have they sufficiently explained the concept of voluntary control that somehow seems connected to volitionism. I argue that attempts to explain the volitionist thesis, voluntary control, and their relation are more problematic than have previously been recognized. Instead, (...) I recommend understanding volitionism in terms of intentional actions and omissions. This understanding has several benefits. It clarifies the debate and its parameters, it avoids the problematic notion of voluntary control while relying on the clearer notion of intentional action, and it highlights that the debate between volitionists and nonvolitionists essentially concerns the nature and scope of obligations. As a result, understanding volitionism in terms of intentional actions and omissions can help breathe new life into the volitionist debate. (shrink)

The impossibility theorem of Dekel, Lipman and Rustichini has been thought to demonstrate that standard state-space models cannot be used to represent unawareness. We first show that Dekel, Lipman and Rustichini do not establish this claim. We then distinguish three notions of awareness, and argue that although one of them may not be adequately modeled using standard state spaces, there is no reason to think that standard state spaces cannot provide models of the other two notions. In fact, standard space (...) models of these forms of awareness are attractively simple. They allow us to prove completeness and decidability results with ease, to carry over standard techniques from decision theory, and to add propositional quantifiers straightforwardly. (shrink)

There are a range of ethical issues that confront physicians in times of war, as well as some of the uses of physicians during wars. This book presents a theoretical apparatus which undergirds those debates, namely by casting physicians as being confronted with dual-loyalties during times of war. While this theoretical apparatus has already been developed in other contexts, it has not been specifically brought to bear on the ethical conflicts that attain in wars. Arguably, wars thrust physicians into ethical (...) conflicts insofar as these wars create a tension between a physician's obligation to heal and an obligation to serve some other good (e.g., military chain of command, national security, the greater good, etc.). Alternatively, we can debate whether this conception is appropriate. For example, one could argue that that non-medical duties cannot attach to physicians (e.g., due to nonoverlapping spheres of justice), thus abrogating the dual-loyalty challenge. Or else one could argue that these medically-trained personnel do not act qua physicians at all (but rather partisan advocates) and therefore duties that would otherwise attach to physicians do not attach here. In the first part of this book, these issues are debated. In the second part of the book, the dual-loyalities frame is used to explore various substantive debates that obtain when the military makes use of physicians. Physician involvement in torture is a heated topic, and certainly the most visible element of the debate. Also, however, we could use the dual-loyalties framework to explore issues in other arenas, such as: development of chemical and biological weapons, medical neutrality/battlefield triage, and so on. In each of these cases, the same tensions arguably exist: physicians have duties both to their patients and elsewhere (which, depending on the details of the view, could be any of the above-mentioned ends). We explore whether a Rawlsian approach might provide a guiding philosophy for the development of a healthcare system, in particular with regard to resolving tensions between different groups within it. We argue that an approach developed from some of Rawls’ principles – using his ‘veil of ignorance’ and both the ‘difference’ and ‘just savings’ principles which it generates – provides a compelling basis for policy making around certain areas of conflict. We ask what policies might be made if those making (...) them did not know if one was patient, doctor, nurse or manager – in this generation or the next. We first offer a brief summary of Rawls’ approach and how we intend to extrapolate from it. We examine how this adapted Rawlsian framework could be applied to specific examples of conflict within healthcare; we demonstrate how this framework can be used to develop a healthcare service which is both sustainable (in its training and treatment of staff, and in encouraging research and innovation) and open (to protect the powers and opportunities of those using the health service). We conclude that while Rawls’ approach has previously been rejected as a means to address specific healthcare decisions, an adapted veil of ignorance can be a useful tool for the consideration of how a just health service should be constructed and sustained. Turning the theoretical into the practical (and combining Rawls’ thought experiment with Scanlonian contractarianism), managers, doctors, patients, carers and nurses could come together and debate conflicting issues behind a hypothetical veil. Theories of embodied cognition assume that concepts are grounded in non-linguistic, sensorimotor experience. In support of this assumption, previous studies have shown that upwards response movements are faster than downwards movements after participants have been presented with words whose referents are typically located in the upper vertical space. This is taken as evidence that processing these words reactivates sensorimotor experiential traces. This congruency effect was also found for novel words, after participants learned these words as labels for novel objects that (...) they encountered either in their upper or lower visual field. While this indicates that direct experience with a word's referent is sufficient to evoke said congruency effects, the present study investigates whether this direct experience is also a necessary condition. To this end, we conducted five experiments in which participants learned novel words from purely linguistic input: Novel words were presented in pairs with real up- or down-words ; they were presented in natural sentences where they replaced these real words ; they were presented as new labels for these real words ; and they were presented as labels for novel combined concepts based on these real words. In all five experiments, we did not find any congruency effects elicited by the novel words; however, participants were always able to make correct explicit judgements about the vertical dimension associated to the novel words. These results suggest that direct experience is necessary for reactivating experiential traces, but this reactivation is not a necessary condition for understanding the corresponding aspects of word meaning. Zugleich berührt das Werk ein Kernproblem von Fichtes praktischer Philosophie: Wie läßt sich die freie Selbsttätigkeit der Einzelnen mit der alle auf ein Ideal verpflichtenden Hoheit des Vernunftsstaates vereinigen?

Some writers, such as John Fischer and Michael McKenna, have recently claimed that an agent can be morally responsible for a wrong action and yet not be blameworthy for that action. A careful examination of the claim, however, suggests two readings. On one reading, there are further conditions on blameworthiness beyond freely and wittingly doing wrong. On another innocuous reading, there are no such further conditions. Despite Fischer and McKenna’s attempts to offer further conditions on blameworthiness in addition to responsibility (...) for wrongdoing, I argue that only the innocuous reading is plausible. Once we distinguish between blame being deserved and blame being all-things-considered appropriate, we need not appeal to further conditions on blameworthiness. This discussion has important upshots regarding how compatibilists respond to certain manipulation arguments and how proponents of derived responsibility respond to criticism that agents are responsible even for outcomes that are not reasonably foreseeable. This paper investigates the ethics of regarding others as epistemically hopeless. To regard a person as epistemically hopeless with respect to p is, roughly, to regard her as unable to see the truth of p through rational means. Regarding a person as epistemically hopeless is a stance that has surprising and nuanced moral implications. It can be a sign of respect, and it can also be a way of giving up on someone. Whether it is morally problematic to take up (...) this stance, I argue, depends on the choices that one faces (or is likely to face). I close the paper by arguing against the view that there are standing moral reasons against regarding others as epistemically hopeless. (shrink)

In the wake of Albrecht Dieterich, in this paper I try to show how the overall arrangement of the hymns in the Orphic hymn book follows the progression of a nocturnal ritual. I insist on the frequency with which the hymns talk about the fear of meeting a divinity or a phasma that would be in an unkind and violent state and could drive the initiates into madness. Thus, the hymns construct the mystery experience as an event that is, at (...) least in part, dangerous and frightening. This concern with madness as a possible negative result of the initiatory experience is just one aspect of the role Bacchic initiation played in healing madness sent by evil demons, and it conveys a seriousness to these rites that makes them into something very different from the hobby of some placid burghers. Far from being only the songs that accompanied the tryphé of a Bacchic social event, the hymns point to the emotional complexity and seriousness of Bacchic mystery cults.Dans le sillage d’Albrecht Dieterich, cette étude entend montrer comment l’arrangement global des pièces reprises dans le recueil des hymnes orphiques épouse la progression d’un rituel nocturne. On insiste sur la récurrence, dans les hymnes, du motif de la crainte de rencontrer une divinité ou un phasma qui pourrait être malveillant, violent, et frapperait les initiés de folie. Since their introduction as ‘no code’ in the 1980s and their later formalisation to ‘do not resuscitate’ orders, such directions to withhold potentially life-extending treatments have been accompanied by multiple ethical issues. The arguments for when and why to instigate such orders are explored, including a consideration of the concept of futility, allocation of healthcare resources, and reaching a balance between quality of life and quality of death. The merits and perils of discussing such decisions with patients and/or their relatives (...) are reviewed and the unintended implications of ‘do not attempt resuscitation’ orders are examined. Finally, the paper explores some alternative methods to approaching the resuscitation decision, and calls for empirical evaluation of such methods that may reduce the ethical dilemmas physicians currently face. We investigate the first-order theory of closed subspaces of complex Hilbert spaces in the signature \\), where ‘\’ is the orthogonality relation. Our main result is that already its quasi-identities are undecidable: there is no algorithm to decide whether an implication between equations and orthogonality relations implies another equation. This is a corollary of a recent result of Slofstra in combinatorial group theory. It follows upon reinterpreting that result in terms of the hypergraph approach to quantum contextuality, for which it (...) constitutes a proof of the inverse sandwich conjecture. Ticking time-bomb cases famously—or infamously—invite us to imagine a scenario wherein the torture of one guilty terrorist will lead to the acquisition of information that can be used to save the lives of many innocents. Despite the contemporary focus on such cases, they have a long tradition, dating to the early 1800s. And, throughout their history, they have appeared in various guises, from the literary to the public to the philosophical. The principal moral question suggested by these cases is whether (...) one harm can be effected such that a worse one is not; while there is certainly dissent, most moral philosophers would answer this question in the affirmative. That said, there is substantial doubt as to whether torture would be the lesser harm or, more generally, whether ticking time-bomb cases gain any purchase in the real world or are otherwise relegated to philosophical fiction. But even if they gain such purchase, then what? In other words, even if torture can be morally justified in exceptional cases, should we authorize it? I n the literature—and conceptually—there are three basic approaches to authorizing torture. The first is not to authorize it at all, which is to say that torture—even if justified—requires some sort of punishable civil disobedience . Another approach is to authorize torture ex ante, such as through torture warrants. On this approach, torture remains prohibited except for when a judge grants permission for its application. Torture warrants have been defended by Alan Dershowitz, and we will evaluate that debate . Finally, torture can be legitimized ex post, which is to say that torture remains illegal but can nevertheless be justified or excused; our discussion will focus on the justifications of self-defense and necessity. Pro-environmental behaviors symbolic of the three R’s—reduce, reuse, recycle—are focused on individual consumption and use patterns. These traditional environmentalist behaviors—what I shall call “shallow environmentalism”—are vulnerable to the problem of inconsequentialism, in that a single individual engaging in them does little to combat or mitigate climate change. Indeed, some argue that continued occupation with shallow environmental behaviors such as recycling and reducing travel gets in the way of fighting climate change by inappropriately focusing blame on individuals, wasting energy on ineffective (...) means, and creating a low benchmark by which people can measure whether they have done their environmental duty. Using environmental virtue ethics, I will argue for the importance of engaging in shallow environmentalism. I will use findings in behavioral psychology to show how these behaviors play an important role in fostering motivation and how behavioral alignment with popular understandings of environmentalism is related to perceptions of legitimacy of climate activists’ positions. The thesis examines a specific way of understanding the subjectivist position in value theory according to which subjectivism is the view that value is grounded on attitudes. It is argued that this should be seen as a second-order claim about the nature of value although with pluralistic implications on the substantial, first-order level. Subjectivist analyses of final and intrinsic value and of relational value are offered. Further, the implications of subjectivism are considered with respect to, among other things, situations in (...) which we would have different attitudes than those that we actually have, the relation between value and motivation, and value relativism and egoism.
