This essay argues that film deserves a place within the medical humanities curriculum and demonstrates effective strategies for employing it within medical ethics and humanities classrooms. Part One of the article emphasizes how and why medical ethics teachers can utilize documentary and fictional films, such as “Thomas Szasz and the Myth of Mental Illness,” “The Deadly Deception,”Whose Life Is It Anyway? and “Voices From the Front” in their courses. Narrative film can be a useful way of looking at bioethical scenarios. This volume presents a collection of brief, accessible essays written by international experts from medicine, social sciences, and the humanities, all of whom have experience using film in their teaching of medical ethics. Each author looks at a single scene from a popular film in order to illuminate its ethical dimensions.

David Friedman posed a number of libertarian philosophical problems (Friedman 1989). This essay criticizes Walter Block’s Rothbardian responses (Block 2011) and compares them with J C Lester’s critical-rationalist, libertarian-theory responses (Lester [2000] 2012). This essay explains Jeffrey Friedman's two fundamental and persistent philosophical errors concerning the libertarian conception of liberty and the lack of a "justification‟ of libertarianism. It is ironic that Friedman himself is thereby revealed to be guilty of both an “a priori” anti-libertarianism and an anti-libertarian “straddle.” Critical-rationalist, proactive-imposition-minimising libertarianism remains completely unchallenged by him.

The most relevant and plausible conceptions of economic rationality, interpersonal liberty, human welfare, and private-property anarchy do not conflict in theory or practice. Using philosophy and social science, Escape from Leviathan defends this bold, non-normative, thesis from contrary positions in the scholarly literature. Writers considered include David Friedman, John Gray, R. M. Hare, Robert Nozick, Karl Popper, John Rawls, Murray Rothbard, Alan Ryan, Amartya Sen, and Bernard Williams. *** The rationality assumptions of neoclassical and Austrian School economics are reconciled (...) and related to liberty and welfare. A new pre-propertarian theory of interpersonal liberty as the absence of (initiated or proactively) imposed cost is argued to be libertarian. Human welfare is defended as the satisfaction of unimposed wants. Practical anarchy is simply unconstrained private property. Related topics include free will, weakness of will, the nature of moralizing, intellectual property, and restitution and retribution. Critical-rationalist epistemology (theories can only be criticized and tested, not justified or supported) is applied throughout. This essay is part of an attempt to reconcile two extreme views in economics: the (neglected) subjective, apriorist approach and the (standard) objective, scientific (i.e., falsifiable) approach. The Austrian subjective view of value, building on Carl Menger’s theory of value, was developed into a theory of economics as being entirely an a priori theory of action. This probably finds its most extreme statement in Ludwig von Mises’ Human Action (1949). In contrast, the standard economic view has developed into making falsifiable (...) predictions about economic phenomena whereby the truth of the assumptions, especially about economic agents, is relatively unimportant: predictive fecundity is all. This finds an extreme statement in Milton Friedman’s introductory essay in his Essays in Positive Economics (1953). Kant's Metaphysical Foundations of Natural Science is one of the most difficult but also most important of Kant's works. Published in 1786 between the first and second editions of the Critique of Pure Reason, the Metaphysical Foundations occupies a central place in the development of Kant's philosophy, but has so far attracted relatively little attention compared with other works of Kant's critical period. Michael Friedman's book develops a new and complete reading of this work and reconstructs Kant's main argument (...) clearly and in great detail, explaining its relationship to both Newton's Principia and eighteenth-century scientific thinkers such as Euler and Lambert. By situating Kant's text relative to his pre-critical writings on metaphysics and natural philosophy and, in particular, to the changes Kant made in the second edition of the Critique, Friedman articulates a radically new perspective on the meaning and development of the critical philosophy as a whole. What is the exact nature of the consumption function? Can this term be defined so that it will be consistent with empirical evidence and a valid instrument in the hands of future economic researchers and policy makers? In this volume a distinguished American economist presents a new theory of the consumption function, tests it against extensive statistical J material and suggests some of its significant implications.Central to the new theory is its sharp distinction between two concepts of income, measured income, (...) or that which is recorded for a particular period, and permanent income, a longer-period concept in terms of which consumers decide how much to spend and how much to save. Milton Friedman suggests that the total amount spent on consumption is on the average the same fraction of permanent income, regardless of the size of permanent income. The magnitude of the fraction depends on variables such as interest rate, degree of uncertainty relating to occupation, ratio of wealth to income, family size, and so on.The hypothesis is shown to be consistent with budget studies and time series data, and some of its far-reaching implications are explored in the final chapter. “The Nature of Belief Systems” sets forth a Hobson's choice between rule by the politically ignorant masses and rule by the ideologically constrained—which is to say, the doctrinaire—elites. On the one hand, lacking comprehensive cognitive structures, such as ideological “belief systems,” with which to understand politics, most people learn distressingly little about it. On the other hand, a spiral of conviction seems to make it difficult for the highly informed few to see any aspects of politics but those that confirm (...) the cognitive structures that organize their political perceptions. This is a troubling situation for any consequentialist democratic political theory, according to which what is crucial is the electorate's (and subsidiary decision makers') ability to make informed policy judgments, not their possession of willful but uninformed political “attitudes.” Any political theorist who does not take democracy to be an end in itself (regardless of its consequences) should be concerned about Converse's findings. To be successful, policy must anticipate a broad range of constituents. Yet, all too often, technology policy is written with primarily mainstream populations in mind. In this article, drawing on Value Sensitive Design and discount evaluation methods, we introduce a new method—Diverse Voices—for strengthening pre-publication technology policy documents from the perspective of underrepresented groups. Cost effective and high impact, the Diverse Voices method intervenes by soliciting input from “experiential” expert panels. We first describe the method. Then we report on two (...) case studies demonstrating its use: one with a white paper on augmented reality technology with expert panels on people with disabilities, people who were formerly or currently incarcerated, and women; and the other with a strategy document on automated driving vehicle technologies with expert panels on youth, non-car drivers, and extremely low-income people. In both case studies, panels identified significant shortcomings in the pre-publication documents which, if addressed, would mitigate some of the disparate impact of the proposed policy recommendations on these particular stakeholder groups. Our discussion includes reflection on the method, evidence for its success, its limitations, and future directions. (shrink)

Immanuel Kant's Metaphysical Foundations of Natural Science (1786) provides metaphysical foundations for the application of mathematics to empirically given nature. The application that Kant primarily has in mind is that achieved in Isaac Newton's Principia (1687). Thus, Kant's first chapter, the Phoronomy, concerns the mathematization of speed or velocity, and his fourth chapter, the Phenomenology, concerns the empirical application of the Newtonian notions of true or absolute space, time, and motion. This paper concentrates on Kant's second and third chapters—the Dynamics (...) and the Mechanics, respectively—and argues that they are best read as providing a transcendental explanation of the conditions for the possibility of applying the (mathematical) concept of quantity of matter to experience. Kant again has in mind the empirical measures of this quantity that Newton fashions in the Principia, and he aims to make clear, in particular, how Newton achieves a universal measure for all bodies whatsoever by projecting the static quantity of terrestrial weight into the heavens by means of the theory of universal gravitation. Kant is not attempting to prove a priori what Newton has established empirically but, rather, to clarify the character of Newton's mathematization by building Newton's empirical measures into the very concept of matter that is articulated in the Metaphysical Foundations. The concept of a “scientific philosophy” first developed in the mid nineteenth century, as a reaction against what was viewed as the excessively speculative and metaphysical character of post-Kantian German idealism. One of the primary intellectual models of this movement was a celebrated address by Hermann von Helmholtz, “Über das Sehen des Menschen,” delivered at the dedication of a monument to Kant at Königsberg in 1855. Helmholtz begins by asking, on behalf of the audience, why a natural scientist like himself (...) is speaking in honor of a philosopher. This question only arises, he says, because of the current deplorable climate of enmity and mutual distrust between the two fields – a climate which is due, in Helmholtz’s opinion, to the entirely speculative system of Naturphilosophie that Schelling and Hegel have erected wholly independent of, and even in open hostility towards, the actual positive results of the natural sciences. What Helmholtz is now recommending, however, is a return to the close cooperation between the two fields exemplified in the work of Kant, who himself made significant contributions to natural science, and, in general, “stood in relation to the natural sciences together with the natural scientists on precisely the same fundamental principles.”1 And it was this recommendation that was enthusiastically embraced within the emerging “back to Kant!” movement, where it led to the idea that all metaphysics should be replaced by the new discipline of “epistemology” or “theory of knowledge”, so that philosophy itself would now become “scientific.”. We explore Woodin's Universality Theorem and consider to what extent large cardinal properties are transferred into HOD (and other inner models). We also separate the concepts of supercompactness, supercompactness in HOD and being HOD-supercompact. For example, we produce a model where a proper class of supercompact cardinals are not HOD-supercompact but are supercompact in HOD. Additionally we introduce a way to measure the degree of HOD-supercompactness of a supercompact cardinal, and we develop methods to control these degrees simultaneously for a (...) proper class of supercompact cardinals. Finally, we also produce a model in which the unique supercompact cardinal is also the only strongly compact cardinal, no cardinal is supercompact up to an inaccessible cardinal, level by level inequivalence holds and the unique supercompact cardinal is not HOD-supercompact. Liberalism sanctifies the values chosen by the sovereign individual. This tends to rule out criticisms of an individual's “preference” for one value over another by, ironically, establishing a deterministic view of the self that protects the self's desires from scrutiny. Similarly, rational choice approaches to social theory begin with previously determined individual preferences and focus on the means by which they are pursued, concentrating on the results rather than the sources of people's values.A striking new attempt to go behind the (...) liberal and rational‐choice starting point in order to understand political preferences is found in Aaron Wildavsky's Cultural Theory. Yet Cultural Theory does not facilitate the criticism of preferences, because its understanding of them is fundamentally liberal. Even while rejecting methodological individualism, Cultural Theory's monocausally social theory of preference formation retains in a new guise the liberal preservation of preferences from criticism by reestablishing a deterministic view of the formation of values, leading it to share with liberalism an a historical view of their origins. A core value of Judaism is leading an ethical life. The Talmud, an authoritative source on Jewish law and tradition, has a number of discussions that deal with honesty in business and decision-making. One motive that can cause individuals to be unscrupulous is the presence of a conflict of interest. This paper will define, discuss, and review five Talmudic concepts relevant to conflict of interest. They are (1) Nogea B’Davar (being an interested party), (2) V’hiyitem N’keyim (behaving to ensure that (...) one is above suspicion) (3) Lifnei Iver (placing a stumbling block before the blind), (4) Shokhad (accepting a bribe), and (5) Geneivat Da’at (deception and undeserved goodwill). Case examples will be used to apply these Talmudic principles to contemporary business practice. This will include discussion of these Talmudic concepts as it applies to specific contemporary business examples relevant to the boardroom, accounting firms, investment banking, politics, and government. It may be impossible to eliminate all conflicts of interest. However, knowledge and awareness of these Talmudic principles can help individuals in business settings better address the ethical issues that they confront. (shrink)

The postwar welfare state provides social insurance against economic, health, and related risks in an uncertain world. Because everyone can envision themselves to be among the unfortunate, social insurance fuses self-interest and solidarism in a normative principle Friedman (2020) calls probabilistic justice. But there is a competing principle of status defense, where the aim is to erect boundaries between socioeconomic strata and discourage cross-class mobility. We argue that this principle dominates when inequality is high and uncertainty low. The current (...) moment is one of high inequality and high uncertainty, which results in intense status anxiety, yet does not rule out solidaristic solutions. Our contributions are to diagnose the causes of our current malaise, and to theorize the normative bases for the political choice facing contemporary western democracies. (shrink)

The traditional living donor was very healthy. However, as the supply-demand gap continues to expand, transplant programs have become more accepting of less healthy donors. This paper focuses on the other extreme, asking whether and when individuals who have life-limiting conditions should be considered for living organ donation. We discuss ethical issues raised by 1) donation by individuals with progressive severe debilitating disease for whom there is no ameliorative therapy; and 2) donation by individuals who are imminently dying or would (...) die by the donation process itself. The consensus recommendations by Salter and colleagues (2023) regarding pediatric decision-making intentionally omitted adolescents due to the additional complexity their evolving autonomy presented. Using two case studies, one focused on truth-telling and disclosure and one focused on treatment refusal, this article examines medical decision-making with and for adolescents in the context of the six consensus recommendations. It concludes that the consensus recommendations could reasonably apply to older children.

In this article, we introduce the Special Issue, Value Sensitive Design: Charting the Next Decade, which arose from a week-long workshop hosted by Lorentz Center, Leiden, The Netherlands, November 14–18, 2016. Forty-one researchers and designers, ranging in seniority from doctoral students to full professors, from Australia, Europe, and North America, and representing a wide range of academic fields participated in the workshop. The first article in the special issue puts forward eight grand challenges for value sensitive design to help guide (...) and shape the field. It is followed by 16 articles consisting of value sensitive design nuggets—short pieces of writing on a new idea, method, challenge, application, or other concept that engages some aspect of value sensitive design. The nuggets are grouped into three clusters: theory, method, and applications. Decision making for children who suffer abusive head trauma invokes multiple ethical considerations. The degree to which parents are permitted to participate in decision making after the injury has occurred is controversial. In particular, in this issue of The Journal of Clinical Ethics, Grigorian and colleagues raise concerns about the potential for conflict of interest in end-of-life decision making if the parents are facing criminal charges that could be escalated if the child dies. There are additional concerns about the parents’ (...) capacity to make decisions that are best for the child, given that the injury occurred. We argue that there are important reasons not to exclude parents from the decision-making process and that, with appropriate safeguards in place, parents are integral to determining what is best for the child.
