During the first few decades of the twentieth century, legal theory on both sides of the Atlantic was characterized by a tremendous amount of skepticism toward the private law concepts of property and contract. In the United States and France, Oliver Wendell Holmes and François Gény led the charge with withering critiques of the abuse of deduction, exposing their forebears' supposedly gapless system of private law rules for what it was, a house of cards built on the ideological foundations (...) of laissez faire capitalism. The goal was to make the United States Constitution and the French civil code more responsive to the realities of industrialization. Unlike the other participants in this transatlantic critique, François Gény simultaneously insisted on the immutability of justice and social utility. His “ineluctable minimum of natural law” would guide judges and jurists toward the proper social ends, replacing deduction with teleology. The problem was that nearly all of Gény's contemporaries were perplexed by his conception of natural law, which lacked the substance of the natural rights tradition of the eighteenth and nineteenth centuries and the historicist impulse of the early twentieth. No one was more perplexed than Oliver Wendell Holmes, whose more thorough going skepticism led him to see judicial restraint as the only solution to the abuse of deduction. The ultimate framework for this debate was World War I, in which both Holmes and Gény thought they had found vindication for their views. Events on the battlefield reaffirmed Gény's commitment to justice just as they reignited Holmes' existential embrace of the unknown. In a sense, the limits of their skepticism would be forged in the trenches of the Great War. (shrink)

Our thought and talk are situated. They do not take place in a vacuum but always in a context, and they always concern an external situation relative to which they are to be evaluated. Since that is so, François Recanati argues, our linguistic and mental representations alike must be assigned two layers of content: the explicit content, or lekton, is relative and perspectival, while the complete content, which is absolute, involves contextual factors in addition to what is explicitly represented. (...) Far from reducing to the context-independent meaning of the sentence-type or, in the psychological realm, to the 'narrow' content of mental representations, the lekton is a level intermediate between context-invariant meaning and full propositional content. Recognition of that intermediate level is the key to a proper understanding of context-dependence in language and thought. Going beyond the usual discussions of indexicality and unarticulated constituents in the philosophy of language, Recanati turns to the philosophy of mind for decisive arguments in favour of his approach. He shows, first, that the lekton is the notion of content we need if we are to properly understand the relations between perception, memory, and the imagination, and second, that the psychological 'mode' is what determines the situation the lekton is relative to. In this framework he provides a detailed account of de se thought and the first person point of view. In the last part of the book, Recanati discusses the special freedom we have, in discourse and thought, to shift the situation of evaluation. He traces that freedom to a special mode - the anaphoric mode - which enables us to go beyond the egocentric stage of pre-human thought. (shrink)

If we accept the idea that the value of a “logic” depends on its ability to fit the usual meaning of the “logical constants” which it formalises and the inferences we draw on their basis, we may ask if the meaning of “possible” is well captured by normal modal logic. We are faced with the following puzzle: if is meaningful and non contradictory is it not a logical truth that ? First, it is shown why there is no logical law (...) of the form , being a neutral wff, and then some philosophical conclusions are drawn: “possible” relative to truth must be distinguished from possible “relative” to meaning, and the former only is formalised in modal logic. I argue that immunity to error through misidentification primarily characterizes thoughts that are 'implicitly' de se, as opposed to thoughts that involve an explicit self-identification. Thoughts that are implicitly de se involve no reference to the self at the level of content: what makes them de se is simply the fact that the content of the thought is evaluated with respect to the thinking subject. Or, to put it in familiar terms : the content of the thought is a property (...) which the thinking subject self-ascribes (as in the Loar/Lewis/Chisholm analysis). After answering an objection (to the effect that immunity can affect explicit de se thoughts), I extend the analysis to demonstrative thoughts, which also exhibit the property of immunity to error through misidentification. Nanotechnology is an important platform technology which will add new features like improved biocompatibility, smaller size, and more sophisticated electronics to neuro-implants improving their therapeutic potential. Especially in view of possible advantages for patients, research and development of nanotechnologically improved neuro implants is a moral obligation. However, the development of brain implants by itself touches many ethical, social and legal issues, which also apply in a specific way to devices enabled or improved by nanotechnology. For researchers developing nanotechnology such issues (...) are rather distant from their daily work in the lab, but as soon as they use their materials or devices in medical applications such as therapy of brain diseases they have to be aware of and deal with them. This paper is intended to raise sensitivity for the ethical, legal and social aspects (ELSA) involved in applying nanotechnology in brain implants or other devices by highlighting the short term problems of testing and clinical trials within the existing regulatory frameworks (A), the short and medium-term questions of risks in the application of the devices (B) and the long-term perspectives related to problems of enhancement (C). To identify and address such issues properly nanotechnologists should involve ethical, legal and social experts and regulatory bodies in their research as early as possible. This will help to remove pressure from regulatory bodies, to settle public concern and to prevent non-acceptable developments for the benefit of the patients. (shrink)

This book is a close reading of Jacques Lacan’s seminal essay, “The Agency of the Letter in the Unconscious or Reason Since Freud, ” selected for the particular light it casts on Lacan’s complex relation to linguistics, psychoanalysis, and philosophy. It clarifies the way Lacan renews or transforms the psychoanalytic field, through his diversion of Saussure’s theory of the sign, his radicalization of Freud’s fundamental concepts, and his subversion of dominant philosophical values. The authors argue, however, that Lacan’s discourse is (...) marked by a deep ambiguity: while he invents a new “language,” he nonetheless maintains the traditional metaphysical motifs of systemacity, foundation, and truth. It is often claimed that, because of semantic underdetermination, one can determine the content of an utterance only by appealing to pragmatic considerations concerning what the speaker means, what his intentions are. This supports ‘inferentialism' : the view that, in contrast to perceptual content, communicational content is accessed indirectly, via an inference. As against this view, I argue that primary pragmatic processes (the pragmatic processes that are involved in the determination of truth-conditional content) need not involve an inference from premisses (...) concerning what the speaker can possibly intend by his utterance. Indeed, they need not involve any inference at all : communication, I argue, is as direct as perception. (shrink)

Thinking involves many elements of sound that philosophical tradition has repressed. Breathing, rhythms and collateral noises participate in the making of idealities, even the most abstract. In order to hear them, the voice needs to be considered as one sound among others and as multiple, even when it comes from the same speaker, following different protocols of enunciation. Listening to the recordings of seminars and studying the role played by modern sound technologies make it possible to hear subterranean meanings and (...) tensions at the heart of mental elaboration. Thinkers and writers could be defined by the way they handle the acoustic environments favourable to the way they speak and write, whether by selection, mixing or silence. An ‘acousmatic’ reading aims to listen to this sonic investment in texts and to hear the complex vibrations of their thought. (shrink)

Professional roles are often thought to bring role-specific permissions and obligation, which may allow or require role-occupants to do things they would not be permitted or required to do outside their roles, and which as individuals they would rather not do. This feature of professional roles appears to bring them into conflict both with 'ordinary' or non-role morality, and with personal integrity which is often thought to demand some form of personal endorsement of one's conduct. How are we to reconcile (...) the demands of roles with ordinary morality and with personal integrity? This collection draws together a set of papers which explore these questions as they bear upon a number of different professional roles, including those of the lawyer, the judge and the politician, and from a variety of perspectives, including contemporary analytic moral theory, jurisprudence, psychoanalytic theory, virtue ethics, and contextualism, and, more broadly, from philosophy and legal academia and practice. If "racial memory" is a viable concept, then the enduring paradigm of human productivity is agriculture, whose seventy-century dominion Western industry and urbanization have eclipsed only (...) within the last two hundred years. The fifteen essays collected here explore America's distinctive form of agrarianism: where individualism, democracy, and a seemingly endless frontier transcended European quarrels over "commons" versus "containment." These values also helped forge our indigenous philosophy—pragmatism—and it is the confluence of these two distinctive American forms that intrigues each of these authors.The essays fall roughly into three groups: 1) historical queries whose connection to pragmatism is marginal, 2) expositions of the agrarian roots of pragmatism, and 3) estimates of the influence of classical pragmatism on the recent rise of neoagrarianism. The first category offers sparkling essays by Charles Taliaferro, James Campbell, Paul B. Thompson, Robert S. Corrington, and Douglas R. Anderson. Together these scholars sketch a history from colonial times to the mid-twentieth century—from Jefferson's "noble agrarian" to the agony of reconstruction, which hastened the split between Northern transcendentalists and Southern romantics. There are some surprises: Franklin outshines even Jefferson with his balanced vision of self-improvement and community weal, and Jefferson's correspondent Crèvecoueur emerges as a visionary who foresaw farming as a wholesome and integrated way of life a century before Emerson and Thoreau. Thomas C. Hilde finds an engagingly pragmatic notion of community in Josiah Royce, and Richard E. Hart discovers Dewey's sense of concrete experience in the novels of John Steinbeck. The contributions of neglected figures such as Francois Quesnay, Liberty Hyde Bailey, John Brewster, and A Whitney Griswold are also recovered.Turning to the second group, though obviously an irresistible title the notion that classical pragmatism is robustly "rooted" in agrarianism is slightly disingenuous. Peirce and James have no direct ties to agrarianism. And though Dewey's themes of innovation, social intelligence, community, and a conception of experience broadly inclusive of organisms and environments reflect obvious affinities, they do not show that pragmatism grew directly from or is a variant of agrarianism. Happily, the pieces on Dewey contributed by Larry A. Montmarquet finds a Deweyan respect for an encompassing "situation," a unity of fact and value in stark opposition to the "corporate" mentality of specialization and success measured in economic gain alone. For Jeffrey Burkhardt, land grant universities must renew their original commitment to the family farm by distancing themselves from the forces of positivism and scientism—the technocrats and bio-chemical engineers who have imperiled both the land and the communities who depend upon it. Neither Montmarquette nor Burkhardt are looking for handouts, or for a return to the "idyllic" life of the one-horse plow. They emphasize moral training and a combination of practices designed to support the sustainability of the smaller farm in a competitive marketplace.One author compares the mention of agrarianism in philosophical discourse to committing a rude act in public. Clearly, however, mere "respectability" is not enough. If the contributors to this volume are correct, agrarianism is a lantern that may illuminate our ongoing search for wholeness and integrity. An exploration of the central role of indirect modes of expression in ancient China.In what way do we benefit from speaking of things indirectly? How does such a distancing allow us better to discover--and describe--people and objects? How does distancing produce an effect? What can we gain from approaching the world obliquely? In other words, how does detour grant access? Thus begins Francois Jullien's investigation into the strategy, subtlety, and production of meaning in ancient and modern Chinese aesthetic and political (...) texts and events. Moving between the rhetorical traditions of ancient Greece and China, Jullien does not attempt a simple comparison of the two civilizations. Instead, he uses the perspective provided by each to gain access into a culture considered by many Westerners to be strange--"It's all Chinese to me"--and whose strangeness has been eclipsed through the assumption of its familiarity. He also uses the comparison to shed light on the role of Greek thinking in Western civilization. Jullien rereads the major texts of Chinese thought--The Book of Songs, Confucius's Analects, and the work of Mencius and Lao-Tse. He addresses the question of oblique, indirect, and allusive meaning in order to explore how the techniques of detour provide access to subtler meanings than are attainable through direct approaches. Indirect speech, Jullien concludes, yields a complex mode of indication, open to multiple perspectives and variations, infinitely adaptable to particular situations and contexts. Concentrating on that which is not said, or which is spoken only through other means, Jullien traces the benefits and costs of this rhetorical strategy in which absolute truth is absent. (shrink)
